HomeMy WebLinkAboutApril 17, 2025 - 30th Meeting signedMINUTES OF THE 30th MEETING OF THE CITY OF LIVONIA BROWNFIELD REDEVELOPMENT AUTHORITY The 30th Meeting of the Brownfield Redevelopment Authority of Livonia was called to order at 4:00 p.m. on Wednesday, April 17, 2025, by Chairman Scheel at City of Livonia City Hall MEMBERS PRESENT: Lynda Scheel, Chairman Ken Harb, Vice Chairman Dillon Breen, Secretary Nicholas Lomako Andrew Lendrum Jumana Judeh Dan West MEMBERS ABSENT: Melissa Karolak OTHERS PRESENT: Jacob Uhazie, Assistant Planning Director Kris Canty, Planner IV ROLL WAS CALLED. A quorum was present. APPROVAL OF MINUTES On a motion by Lendrum, seconded by Harb, and adopted, it was: #01-2025 RESOLVED, that the Minutes of the 29th Meeting of the City of Livonia Brownfield Redevelopment Authority and held November 12, 2024, as amended, are hereby approved. A roll call vote on the foregoing resolution resulted in the following: AYES: Scheel, Harb, Lendrum, Breen, Lomako, NAYS: None ABSENT: Karolak ABSTAIN: Judeh, West Chairman Scheel declared the motion is carried and the foregoing resolution adopted. REVIEW OF LBRA TAX CAPTURE FOR LIVONIA MARKETPLACE AND CONSIDERATION OF TAX INCREMENT FINANCE (TIF) REIMBURSEMENT PAYMENT #22 (W-2024) FOR AUTHORIZED ELIGIBLE EXPENSES Mr. Uhazie: Thank you. This is payment number 22 of 24. The taxable value for the winter 2024 tax collection period is $12,603,633.00. The Ms. Scheel: On a motion Livonia Brownfield Redevelopment Authority April 17, 2025 Page 2 incremental value for capture is approximately $6 million. The total taxes for capture are $108,751.05. In this case, 20% of the amount goes to the LSRRF and administrative costs to the tune of $21,750.21, and 80% goes to the developer to the amount of $87,000.84. Seeing no questions, a motion is in order. by Lomako, seconded by West, and unanimously adopted, it was: #02-2025 RESOLVED, that the City of Livonia Brownfield Redevelopment Authority does hereby approve the distribution of Captured Taxes from the Livonia Marketplace Project as follows: 1) Payment #22 (W-2024) to Livonia Phoenix, LLC, for $87,000.84, for the reimbursement of eligible expenses; and 2) $21,750.21 for deposit into the Livonia Brownfield Redevelopment Authority's Local Site Remediation Revolving Fund (LSRRF) and to pay for administrative expenses. Ms. Scheel: Any discussion? Chairman Scheel declared the motion is carried and the foregoing resolution adopted. REVIEW OF LBRA TAX CAPTURE FOR LIVONIA COMMONS AND CONSIDERATION OF TAX INCREMENT FINANCE (TIF) REIMBURSEMENT PAYMENT #20 (W-2024) FOR AUTHORIZED ELIGIBLE EXPENSES. Mr. Uhazie: Thank you. This is payment number 20 out of 20 and the last payment sent to the developer. The LSRRF will start collecting 100% of the disbursements going forward for the next five years. The taxable value for winter 2024 is $3,723,589. The incremental value for capture is $1,982,789. The total taxes for capture" is $50,189.35. Ms. Scheel: Are there any questions for Jacob regarding the numbers? Seeing none, would someone like to make a motion? On a motion by Lomako, seconded by Harb, and unanimously adopted, it was: Livonia Brownfield Redevelopment Authority April 17, 2025 Page 3 #03-2025 RESOLVED, that the City of Livonia Brownfield Redevelopment Authority does hereby approve the distribution of Captured Taxes from the Livonia Commons Project as follows: 1.) Payment #20 (W-2024) to TMA-LIVCOM, LLC, for $50,189.35 to reimburse eligible expenses. Ms. Scheel: Is there any discussion? Chairman Scheel declared the motion is carried and the foregoing resolution adopted. REVIEW OF LBRA TAX CAPTURE FOR LIVONIA MARKET II AND CONSIDERATION OF TAX INCREMENT FINANCE (TIF) REIMBURSEMENT PAYMENT #12 (W-2024) FOR AUTHORIZED ELIGIBLE EXPENSES. Mr. Uhazie: Ms. Scheel: Mr. Harb: Mr. West: Thank you. This is payment number 12 of 22. The taxable value for winter of 2024 is $4,514,000. The incremental value for capture is $3,208,578. The total taxable value for capture is $52,339.93. In this case, 25% goes to the LSRRF and administration, which is $13,084.98 and $39,254.95 goes to the developer. Thank you, Jacob. Does anybody have any questions for Jacob regarding the numbers? Seeing, no questions, we need a motion. Can you tell the new people what Livonia Market II is and where? I believe, it is across from Livonia Mall...LA Fitness, just wanted to let you guys know that. Oh, the LA Fitness. Ms. Judeh: That is Seven and Middle Belt where the new Meijers is coming? Ms. Scheel: The Meijers is Seven and Farmington. Mr. Harb: Number four, Livonia Marketplace was Livonia mall, right? Mr. West: Marketplace was, yeah, Livonia Mall. Sears, which continues to languish here. Livonia Brownfield Redevelopment Authority April 17, 2025 Page 4 Ms. Judeh: So while we're at it, where's Livonia Commons? Mr. Harb: That's where the Joanne Fabrics is across from Costco. Ms. Judeh: Costco, oh, yes. The southwest corner. Ms. Scheel: Yes. Ms. Judeh: Thank you. And where's Livonia Marketplace? Mr. Harb: Livonia Mall Mr. West: Kohls, Walmart Ms. Scheel: But not Sears. Mr. Uhazie: And then the Haggerty Center coming up, that is by the Costco...the commercial developments in front of Costco. Ms. Judeh: Where's it at? Mr. Uhazie: Haggerty, and north of Seven, Costco. Mr. Harb: The little strip center. Mr. Breen: If you have internet connection, there is a map on the website that takes you to the sites of Brownfields in the city. Ms. Judeh: Thank you. That's very helpful. Ms. Scheel: Okay, so we're on number six. Any further questions for Jacob? No further questions. Motion would be in order. On a motion by Harb, seconded by Lendrum, and unanimously adopted, it was: #04-2025 RESOLVED, that the City of Livonia Brownfield Redevelopment Authority does hereby approve the distribution of Captured Taxes from the Livonia Marketplace II Project as follows: 1.) Payment #12 (W-2024) to Livonia Market II, LLC, for $39,254.95 for the reimbursement of eligible expenses and Livonia Brownfield Redevelopment Authority April 17, 2025 Page 5 2.) $13,084.98 for deposit into the Livonia Brownfield Redevelopment Authority's Local Site Remediation Revolving Fund (LSRRF) and to pay for administrative expenses. Ms. Scheel: Any further discussion? Chairman Scheel declared the motion is carried and the foregoing resolution adopted. REVIEW OF LBRA TAX CAPTURE FOR HAGGERTY CENTER AND CONSIDERATION OF TAX INCREMENT FINANCE (TIF) REIMBURSEMENT PAYMENT #12 (W-2024) FOR AUTHORIZED ELIGIBLE EXPENSES. Mr. Uhazie: Thank you. So, this is payment number 12 of 28. Taxable value for winter of 2024 is $12,865,549. The incremental value for capture is $12,021,049. The total taxes for capture is $196,093.36. 20% of the capture goes to the LSRRF and administration fees for a total of $39,218.67. 80% of the capture goes to the developer for $156,874.69 Ms. Scheel: Thank you. Does anybody have any questions for Jacob regarding the numbers? Mr. West: Just remind me where this is located. Mr. Uhazie: This is the Haggerty Center on... Ms. Scheel: Where First Watch is, I think, up there. Mr. West: So, in front of the apartments, right? Ms. Scheel: Yes, yep. Any further questions? If not, a motion would be in order. On a motion by West, seconded by Lomako, and unanimously adopted, it was: #05-2025 RESOLVED, that the City of Livonia Brownfield Redevelopment Authority does hereby approve the distribution of Captured Taxes from the Livonia Haggerty Center Project as follows: 1) Payment#12 (W-2024) to Haggerty Square, LLC in the amount of $156,874.69 for the reimbursement of eligible expenses; and Livonia Brownfield Redevelopment Authority April 17, 2025 Page 6 2) $39,218.67 for deposit into the Livonia Brownfield Redevelopment Authority's Local Site Remediation Revolving Fund (LSRRF) and to pay for administrative expenses. Chairman Scheel declared the motion is carried and the foregoing resolution adopted. REVIEW OF LBRA TAX CAPTURE FOR LIVONIA WEST COMMERCE CENTER 2 AND CONSIDERATION OF TAX INCREMENT FINANCE (TIF) REIMBURSEMENT PAYMENT #4 (W-2024) FOR AUTHORIZED ELIGIBLE EXPENSES. Mr. Uhazie: Thank you. Just for reference, this site is the RACER trust site for the Amazon and National distribution centers off of Eckles. Ms. Judeh: Off of what street? Mr. Uhazie: Eckles and Amrhein. Ms. Judeh: Okay. Mr. Uhazie: This is payment number four of 56. The taxable value for winter 2024 is $10,017,294. The incremental value for capture is $9,723,049. The total capture is $246,114.68. 10% goes to the LSRRF for a total of $15,860.72 and 90% of it goes to the developer for a cost $230,253.95. Ms. Scheel: Thank you, Jacob. Does anybody have any questions regarding this project for Jacob Seeing none a motion will be in order. On a motion by Harb, seconded by Lomako, and unanimously adopted, it was: #06-2025 RESOLVED, that the City of Livonia Brownfield Redevelopment Authority does hereby approve the distribution of Captured Taxes from the Livonia West Commerce Center 2 Project as follows: 1.) Payment #4 (W-2024) to Livonia West Commerce Center 2, LLC, in the amount of $230,253.95 to reimburse eligible expenses. 2.) $15,860.72 for deposit into the Livonia Brownfield Redevelopment Authority's Local Site Remediation Livonia Brownfield Redevelopment Authority April 17, 2025 Page 7 Revolving Fund (LSRRF) and to pay for administrative expenses. Chairman Scheel declared the adopted. Ms. Scheel: Mr. Lomako: Ms. Scheel: Ms. Judeh: Ms. Scheel: Ms. Judeh: Mr. Lomako: motion is carried and the foregoing resolution Does anybody have any other business they would like to bring up? Just a very quick comment. At the last meeting, this regards the Seven and Victor project. I brought up an issue that I thought was dismissed casually by the applicant and incorrectly by the applicant. I brought up, in their own brownfield plan, there was a section dealing with how material changes are addressed, and in their own brownfield plan, they write that any material change as determined at this whole discretion of this board has to come back to this board. And if you read the minutes, to refresh your memory, their response was, well, what that really means is only if the numbers change, you know, and if the numbers change, that's what we really meant. I'm not buying that. I don't think that's what that means at all. And so I bring that out for the benefit of staff that they pay particular attention to their work plan that was presented to the city, and see what material changes they believe to be true and any of significance I would hope that they would bring back to this body for review and consideration. I believe it means more than just the mathematics of the Brownfield plan. I think it means number of units, a number of buildings, how much open space remains. That sort of item set I think are material changes to the project description. Thank you for that. So, Jacob, can we note that for Mark so that Mark can let us know how that would be handled? I have a question. Sure. Go ahead. So, when you talk about changes, you're talking about changes in specs as well as quality, as well as construction material? Well, the work plan describes the project description. In a particular place in the work plan it talks about the number of units and the characteristics of the project and then, after it goes Ms. Judeh: Ms. Scheel: Mr. Lomako: Ms. Judeh: Mr. Lomako: Mr. Harb: Mr. Lomako: Ms. Scheel: Mr. Uhazie: Livonia Brownfield Redevelopment Authority April 17, 2025 Page 8 and describes it, it indicates that, and I quote here because I'm reading the plan, "All material changes as determined by the Authority in its sole discretion, to the project description are subject to the approval of the Authority and shall be consistent with the overall nature of the proposed development, its proposed public purpose, and the purposes of Act 381, right? You can read it the way you want. What's the definition of material changes, right? So, I think if we have Mark look at it... My point is that, you know, obviously staff is more experienced with determining what that means than I do as a kind of a new member here, but the applicant, when they responded to that question, and to me, personally, by name, talked about it only dealing with math. I'm just not buying it. I just don't think that's correct. And if I'm wrong, so be it. I'd like to be told that, but I don't believe from their own description that that's what they meant. If it dealt with math, I think they would have been a little bit more specific to say it deals with numbers, as opposed to material. Yeah, I think that's boiler plate language that the applicant has used in the past. If it's meant to be more than mathematics, then maybe the work plan should be amended, or a clarifying footnote to the text somewhere, or have you. But it was just bothering me for a while. I think that's a fair point. Thank you for listening. We're not going to have an extra building without coming back for approval, right? Or, you know, are we all going to do one -bedroom units now, not any two -bedroom units, or is it going to be a four story, not a three story? Or, you know, is the open space going to go from six acres to two acres? You know, there's a lot of things to me that are material changes. And so, we'll have Mark be aware of your concern. Well, the one thing with that site, there's only so much that can change, just because it is a consent decree. It's already been Livonia Brownfield Redevelopment Authority April 17, 2025 Page 9 through the court system, the planning and City Council. But you know, there's not major changes that they can make, to the open space, for instance, they are allotted what they were given, and it's because it was a court decision they're not going to make major changes. Mr. Harb: What we're talking about is Victor Parkway and Seven Mile. Mr. West: The town homes there, right? Ms. Scheel: Townhomes and then the open space...it's scheduled to be open space on the other side of it as well. So, yeah, you'll talk to Mark, and I'll follow up with an email too. Thanks for bringing that up. Mr. Lomako: Appreciate it. Ms. Scheel: You're welcome. Any other business anybody would like to bring before the board. If not, we'll move on. Move on to item number 10, which is the election of officers. So, we elect officers every year at the spring meeting. The current officers are myself as Chair and Harb as Vice chair, Andy Lendrum as Treasurer, and Dylan Breen as Secretary. So, we'll start out as treasurer...we'll start out with the President. Are there any nominations for President? ELECTION OF OFFICERS On a motion by Breen, seconded by Harb, and unanimously adopted, it was: #07-2025 RESOLVED, that Lynda Scheel is hereby appointed to serve as Chairman thru the spring of 2026 or the next time at which a full slate of officers is elected. Chairman Scheel declared the motion is carried and the foregoing resolution adopted. On a motion by Lomako, seconded by Lendrum, and unanimously adopted, it was: #08-2025 RESOLVED, that Ken Harb is hereby appointed to serve as Vice Chairman thru the spring of 2026 or the next time at which a full slate of officers is elected. On a motion by Lomako, seconded by West, and unanimously adopted, it was: #09-2025 RESOLVED, that Dillon Breen is hereby appointed to serve as Secretary thru the spring of 2026 or the next time at which a full slate of officers is elected. Chairman Scheel declared the motion is carried and the foregoing resolution adopted. On a motion by West, seconded by Harb, and unanimously adopted, it was: #10-2025 RESOLVED, that Andy Lendrum is hereby appointed to serve as Treasurer thru the spring of 2026 or the next time at which a full slate of officers is elected. Chairman Scheel declared the motion is carried and the foregoing resolution adopted. Ms. Scheel: Great. We have our officers for next year. Congratulations. Thank you.
