HomeMy WebLinkAboutPLANNING MINUTES 1947-01-30Regular Meeting Jan. 30th,1947 Minutes of the Meeting of the Livonia Township Zoning Board held at Livonia Township Hai, Jan. 30th, 1947. This meeting is a public hearing to consider petitions for changes in Zoning. The meeting was called to order at 8:10 P.M. by Chairman Johnston. Members present: Carson Johnston, Chairman, G. Louis Isbell, Secretary, George N. Bentley and Attorney John Ambrose. Secretary Isbell read a petition dated Nov. 18th, 1946, signed by 33 property owners to change the Zoning from an A-G-1-C to and M-2 district, of the following described property: The area bounded by Terrence Avenue on the North, Middlebelt Rd. on the West, Broadmoor Avenue on the South and Harrison Road on the East. Secretary Isbe11 also read a petition dated Nov. 2d, 1946, signed by 14 property owners to change the Zoning from R-1-C to C-1 on the property on the North side of Five Mile Road, between Foch and Deering, including three lots on the East of Foch. The legal notice of public hearing on Jan. 30th, 1947, was read by Attorney Ambrose. Attorney Ambrose also read the R-1-C and C-1 regulations. Chairman Johnston now asked the owners of property on Five Mile Road to state their views on the Change. Mrs. Bandy, 1700 Delaware, Detroit, and Mr• Sossi, 27492 Five Mile Road, stated they were in favor of the change, as was Mr. Harry Cline of 27601 Five Mile Rd. Mr. Powell, 27464 Five Mile Rd. asked if he could have on the front of his property with his home in the rear, and advised that he could. A mote was now taken and the majority were in favor of beginning 150 feet East d' Foch and extending to Deering on a business he was the change the West. Chairman Johnston now asked for a discussion of the petition for changing the area aforementioned from A-G-1-C to M-2. He explained that in drawing up the Zoning Laws, no district was allowed for a Riding Stable except M-2. The area in question now contains the Morton Riding Stable, but, since this stable was already there before the Zoning Law went into effect, it is non -conforming. The Non -Conforming use was ready by Attorney Ambrose. The history of the Motton Riding Stable was given by Attorney Ambrose, through the reading of the minutes of the Board of Appeals concerning this case. Page Two,- Zoning Board, Jan. 30th. 1947. Attorney Ambrose read the M.�2 regulations. The people present were now asked by Chairman Johnston to state their views. Mr. Rohrer, 28120 Terrence, asked if the signing of the petition in favor of M-2 district, actually necessitated a vote for M-2. Chairman Johnston replied that it did not. Mr. Hughes, of Detroit, who owns lots on Terrence, stated he would not want to build there if the change was made, -Mr. Stearns, 28430 Terrence, and Mr. English, 15540 Middlebelt, stated their objections to the stable. Mr. Conklin, 28242 Terrence moved there on Dec. 14th. Stated he would not have bought there if he had known about the horseso Mr. English asked how one went about complaining of the cruelty to the animals, and was advised by Attorney Ambrose that complaint should be made to the Justice of the Peace. Mr. Rohrer suggested that all the property owners should get together and get the Stable out of there. Chairman Johnstcm now called for a vote. There were no votes for the change to M-2. With 110 people present, the vote was unanimous against the change. Mr. Bentley moved for a recess of five minutes, during which time the Board would discuss the petitions. Seconded by Mr• Isbell. Motion carried. 0n motion by Mr. Bentley, seconded by Mr. Isbell, the petition for changing the district described in the Mortonos Stable petition,- in view of the overwhelming opposition of all present at this public hearing in excess of 100 - everyone present opposed, no one for - this petition be denied, and this Board so recommends to the Town- ship Board. Motion carried. On motion by br. Bentley, seconded by Mr. Isbell, it was moved and carried that, in connection with the petition to change from R-1-0 to C-1 district the property on the north side of Five Mile Road between Foch and Deering, that this Board recommends to the Township Board that a change to C-1 be made on the frontage beginning 150 feet east of Foch and extending to Deering on the West. There being no further business to come before this Board, on motion by Mr. Isbell, seconded by Mr. Bentley, the meeting was adjourned by Chairman Jo;•aston at 9:20 P.M. G. Louis Isbel: Chairman
