PUBLIC HEARING
Minutes of Meeting Held on Wednesday, July 19, 2017

A Public Hearing of the Council of the City of Livonia was held at the City Hall
Auditorium on Wednesday, July 19, 2017.

The Public Hearing was called to order at 7:00 p.m. with President Kathleen McIntyre
presiding. This is a Public Hearing in regard to a request for a change in zoning in the
City of Livonia on the following matter: Petition 2017-05-01-02 submitted by Brian
Duggan on behalf of Soave/Oro Construction, L.L.C., to rezone the property located on
the west side of Farmington Road between Pickford and Clarita Roads (18761
Farmington Road), in the Northeast ¼ of Section 9, from OS (Office Services) to R-1
(One Family Residential – 60’ x 120’ Lot).
The City Clerk has mailed a notice to the Petitioner and those persons in the area
affected by the proposed changes, and all other requirements of Ordinance No. 543, the
Zoning Ordinance, have been fulfilled. The public hearing is now open for comments.
There were ten people in the audience. Please state clearly your name and address
before making your comments.
McIntyre: Mr. Taormina.
Taormina: Thank you. I apologize, I do not have the display on the television for you
but I will just briefly describe this petition. It’s a rezoning request involving
property that is on the west side of Farmington Road, it’s about three
parcels south of Clarita, currently zone Office Services and at the
Petitioner’s request to change the zoning to R-1 (One Family Residential)

for the purpose of constructing a new single family residence. The net lot
area of this parcel is about 6,600 square feet, 60 ‘ x 110’ so it’s slight
deficient in depth in the area and would require secondarily if the zoning
passes approval by the Zoning Board of Appeals for those deficiencies,
however, they are showing a site plan for a house on the lot that would
fully conform to the R-1 District of setback and other regulations pertaining
to lot coverage. The Planning Commission reviewed this item and held its
Public Hearing and is recommending approval of the change of zoning to
R-1. Thank you.
Bahr: Madam Chair, I have a question for Mr. Taormina, the property to the
south is residential?
Taormina: To the south are residential homes, that is correct.
Bahr: To the north it looks like offices?
Taormina: Yes. So this parcel sets the southerly limit of the Office zoning and from
that point extending south are residential zoned properties with homes
located on them. Even though the Future Land Use Plan does propose
office for not only this parcel but also the parcel to the south, it does mark
the limit of that zoning line, that office zoning line.
Bahr: Do you know the history or the rationale of that zoning?
Taormina: That goes back pretty far, I do know that corresponds to the office zoning
that is directly across the street, they match somewhat as to where that
southerly boundary is.
Bahr: Thanks.
Brosnan: Madam Chair.
McIntyre: Yes.
Brosnan: Through the Chair to Mr. Taormina, if that building were to be razed the
way that it is, is it possible for an office to be developed on it if we find
ourself deficient with the footage for the front of a house to be there?
Taormina: By itself I think it would be very difficult for an office building to be built on
that, it would be a very small building, and factor in the requirements for
parking and what type of office use, the setbacks, stormwater
management that would be required for a nonresidential development it
would be virtually impossible I think to develop it a usable office building
on that property.

Brosnan: Thank you.
Bahr: Madam Chair.
McIntyre: Mr. Bahr.
Bahr: The lots, the three lots to the south, are those zoned residential?
Taormina: They’re zoned residential, they’re held in common. The majority of the
parcels extending south, I don’t know how many in a row, but most of
those are owned by an individual and I believe they have a structure on
one or two of those.
Bahr: It’s not the individual that lives next door to there?
Taormina: No, no, I believe it’s a doctor.
Bahr: Okay, thank you.
McIntyre: Anything else? We can go to the Petitioner, Mr. Duggan.
Duggan: Thank you. Brian Duggan, 14315 Denne, Livonia, 48154. The only new
item I have is the Planning Commission asked for an elevation of one of the houses so I
will give you that. It’s going to be identical to the ranch we did on the west end of the
street just by the veterinarian hospital.
McIntyre: Does anyone have anything for Mr. Duggan, the Petitioner? Anyone from
the audience care to comment on this item?
Meakin: Madam Chair.
McIntyre: Yes.
Meakin: I’ll offer the approving resolution.
McIntyre: Okay, thank you. So we have an approving resolution offered by
Councilmember Meakin and that will be on the agenda for Wednesday,

August 9, 2017 and Mr. Duggan, we would appreciate you or a
representative to be at that meeting.
Duggan: Thank you.
McIntyre: Thank you.
Brosnan: Madam Chair.

McIntyre: Yes.
Brosnan: Before the Petitioner leaves, what is the timeline to develop this property if
your rezoning is successful?
Duggan: Well, he can put up a house in twelve months, so once we get it approved,
if we’re going into August he might wait until spring but by next summer
we’ll have the house up.
McIntyre: Thank you.
As there were no further questions or comments, the Public Hearing was declared
closed at 7:08 p.m.
