HomeMy WebLinkAboutPLANNING MINUTES 2017-03-14 MINUTES OF THE 1,102nd PUBLIC HEARINGS AND REGULAR MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, March 14, 2017, the City Planning Commission of the City of Livonia held its 1,102nd Public Hearings and Regular Meeting in the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan. Mr. Ian Wilshaw, Chairman, called the meeting to order at 7:00 p.m. Members present: Sam Caramagno Glen Long Betsy McCue Carol Smiley Kevin Priddy Ian Wilshaw Members absent: Peter Ventura Mr. Mark Taormina, Planning Director, and Ms. Margie Watson, Program Supervisor, were also present. Chairman Wilshaw informed the audience that if a petition on tonight's agenda involves a rezoning request, this Commission makes a recommendation to the City Council who, in turn, will hold its own public hearing and make the final determination as to whether a petition is approved or denied. The Planning Commission holds the only public hearing on a request for preliminary plat and/or vacating petition. The Commission's recommendation is forwarded to the City Council for the final determination as to whether a plat is accepted or rejected. If a petition requesting a waiver of use or site plan approval is denied tonight, the petitioner has ten days in which to appeal the decision, in writing, to the City Council. Resolutions adopted by the City Planning Commission become effective seven (7) days after the date of adoption. The Planning Commission and the professional staff have reviewed each of these petitions upon their filing. The staff has furnished the Commission with both approving and denying resolutions, which the Commission may, or may not, use depending on the outcome of the proceedings tonight. ITEM #1 PETITION 2017-02-02-01 XU MASSAGE Mr. Caramagno, Secretary, announced the first item on the agenda, Petition 2017- 02-02-01 submitted by Hong Yin Xu requesting waiver use approval pursuant to Section 10.03(m) of the City of Livonia Zoning Ordinance #543, as amended, to operate a massage establishment (Xu Massage) within the multi-tenant commercial center (Middlebelt-Norfolk Plaza) at 20337 Middlebelt Road, located on the northwest corner of Middlebelt Road and Norfolk Avenue in the Northeast '/4 of Section 2. March 14, 2017 28061 Mr. Taormina: This is a request to operate a massage establishment, Xu Massage, within the Mid-Eight shopping plaza which is located at the northwest corner of Middlebelt Road and Norfolk Avenue. This property is zoned C-1, Local Business. Massage establishments are allowed in the C-1 district with waiver use approval as set forth in Section 10.03(m) of the Zoning Ordinance. The retail center consists of two adjoining buildings that are on adjacent parcels. These parcels share access, parking and are under common ownership. Combined, both of the buildings measure roughly 10,600 square feet and are subdivided into six or seven tenant spaces. The current tenants include The House of Wags, Get It Girl (which is a dance and fitness studio), a hair salon, as well as TLC dog training and canine education. The proposed massage establishment would be located in the northern most unit within the shopping complex and it has an address of 20337 Middlebelt Road. The lease space is roughly 1,030 square feet measuring 21 feet in width by about 49 feet in depth. The unit as proposed would be divided into several massage rooms. There would be no modifications to the exterior of the building. Allowed is one wall sign measuring 21 square feet in size. In terms of parking, this shopping center has a pre-existing deficiency. The ordinance would typically require 57 spaces, and there are 42 off-street parking spaces available. But again, that is something that is pre-existing and cannot be modified. Section 10.03(m)(2) of the ordinance is a special requirement that stipulates that no massage establishment can be located within 400 feet of another property which is either occupied or approved for a massage establishment. Xu Massage, as proposed, would not conflict with this provision of the ordinance. There are no other massage establishments within 400 feet of this location. Another special requirement is that no massage establishment be located within 400 feet of a school, place of worship, state licensed day care facility, public library, playground or public park. This proposed massage establishment fails to meet this special use requirement. Clarenceville Methodist Church is located directly across Middlebelt Road, approximately 120 feet away. This requirement can only be waived by the City Council by means of a separate resolution in which two-thirds of the Council members concur. With that, Mr. Chairman, I can read out the departmental correspondence. Mr. Wilshaw: Please. Mr. Taormina: There are six items of correspondence. The first item is from the Engineering Division, dated February 22, 2017, which reads as follows: "In accordance with your request, the Engineering Division has reviewed the above referenced petition. We have no March 14, 2017 28062 objections to the waiver use at this time. The existing parcel is assigned the address of 20337 Middlebelt Road. The following legal description should be used in conjunction with this petition: Lot #4, except the east 20 feet thereof, Storm and Fowler's Country Crest Subdivision, part of the NE % of Section 2, T. 1 S., R. 9E., Livonia Township (now City of Livonia) as recorded in Liber 42, Page 74, Wayne County Records. The existing building is currently serviced by public water main, sanitary sewer and storm sewer. Should renovations to the building require alterations to the existing services, drawings will need to be submitted to this department to determine if permits will be required. Also, should the owner need to complete work within the Middlebelt Road right-of-way, permits from the Wayne County Department of Public Services will be required." The letter is signed by David W. Lear, P.E., Assistant City Engineer. The second letter is from the Livonia Fire & Rescue Division, dated February 22, 2017, which reads as follows: "This office has reviewed the site plan submitted in connection with a request to operate a massage establishment within the multi-tenant commercial center (Middlebelt — Norwalk Plaza) on property located at the above referenced address. We have no objections to this proposal." The letter is signed by Keith Bo, Fire Marshal. The third letter is from the Division of Police, dated February 16, 2017, which reads as follows: "I have reviewed the plans in connection with the petition. I have no objections to the proposal." The letter is signed by Brian Leigh, Sergeant, Traffic Bureau. The fourth letter is from the Inspection Department, dated March 1, 2017, which reads as follows: "Pursuant to your request, the above-referenced petition has been reviewed. This proposed massage establishment would be located within 400 feet of a place of worship. This Department has no further objections to this petition." The letter is signed by Jerome Hanna, Director of Inspection. The fifth letter is from the Treasurer's Department, dated February 24, 2017, which reads as follows: "In accordance with your request, the Treasurer's Office has reviewed the address connected with the above noted petition. At this time, there are no outstanding amounts receivable for taxes. Therefore, I have no objections to the proposal." The letter is signed by Lynda Scheel, Treasurer. The sixth letter is from the Finance Department, dated February 16, 2017, which reads as follows: "I have reviewed the addresses connected with the above noted petition. Two of the addresses have outstanding water bills: 20325 Middlebelt - $26.22; 20331 Middlebelt — $426.50." The letter is signed by Coline Coleman, Chief Accountant. That is the extent of the correspondence. March 14, 2017 28063 Mr. Wilshaw: Are there any questions of the Planning Director? Seeing none, would the petitioner please come to the podium? Shedia Huang, Translator for Petitioner: No, everything seems good. Mr. Wilshaw: Are there any questions for the petitioner? Ms. Smiley: When you submitted this petition, were you aware that right across the street there's a church? Ms. Huang: I know that there's a church across the street but the thing I'm thinking, because the store is in the small mall, maybe I think that would be okay. Ms. Smiley: It's an ordinance that we have. I can't think of one time when an exception was made for that reason. That is going to be one of the big problems. Okay. Thank you. Mr. Priddy: What is your prior experience running a massage business? How much experience you do have running a massage business? Ms. Huang: Yes, I do have experience for running a massage store. He actually opened one before in Garden City but then since family issue because he couldn't spend much time running a store instead of spending it with the kids. So we stopped the business and now he's thinking that since his kids are all in college, they're on their own, they're independent, so now he's rethinking about opening a massage store. Mr. Priddy: How many locations did you look at because I think the concern is that it's so close to a church. Have you looked at locations? Ms. Huang: He didn't really look at a lot of the stores. This is probably the first one we're looking at since I mean the room was actually exactly what he wanted. So he decided right away when he saw it. So he didn't really look at any other stores instead of that one. And we noticed the church was so close to the store, was actually right after we decided to open the store. Mr. Priddy: Thank you. Mr. Long: The presentation spoke to the Zoning Ordinance restricting hours from between 8:00 a.m. to 10:00 p.m. and you've agreed to work March 14, 2017 28064 within those hours. Did you plan to be open seven days a week during those time periods as well or just five days a week? What was your planned schedule? Ms. Huang: We think that maybe six days. Mr. Long: Would you be closed on Sunday or would you be closed on a weekday? Ms. Huang: We think Sunday. We're probably going to close on Sunday. So six days a week and have Sunday off. Mr. Long: Thank you. Mr. Caramagno: How long was the prior massage establishment open, the prior one you ran in Garden City? Ms. Huang: Close to a year. Mr. Caramagno: How many employees did you have there? Ms. Huang: Two to three. Mr. Caramagno: What type of training or licensing or schooling do you have to have to work in a facility like this? Ms. Huang: Do you mean him or the employees? Mr. Caramagno: Whoever is touching people and performing the massage. Ms. Huang: All the employees have to have licenses. They have to be in school for like at least . . . they have been knowing the massage . . . going to school for at least a year. That's how he would hire them to work for the store. Mr. Caramagno: Is there State training or requirements or certification that you need? Ms. Huang: Yeah. He said that for his employees, at least all of them, they need a license and they have to be certified from the school they were training from. He said most of them were from California but it's not really a requirement like . . . it's not a requirement which State it has to be from but they do have a license. They did go to school for training. Mr. Caramagno: So you can get certified in California and come here and work. The license transfers one state to the next? March 14, 2017 28065 Ms. Huang: He said that, yes, because people they could learn from Michigan State. They could learn from New York, from all of the different schools, but they learn the same thing. So as long as it's international. The thing to learn is the proper way to train and how to . . . I mean, propose a massage. Right? Yeah. As long as they're trained the proper way and they know how to do the massage from the school, that would be good enough. Mr. Caramagno: When I look at your plan here, I just don't see a lot of detail. It's lines drawn on a piece of paper. Four rooms, a bathroom. I don't see a lot of detail in your plan. I would be surprised that you want to start a business in the city. It sounds like your research wasn't very well. There's a church right across the street, but your plan doesn't even look like it's anything meaningful at all. I don't know. Ms. Huang: It's really basically . . . it was hand drawn. We did it. If you want a more specifically, we could just tell you right now. Mr. Caramagno: I don't think I need you to tell me right now, but I would think that you would have presented something a little more detailed to us before coming to this meeting. That's just my opinion. Ms. Huang: Yeah. I think that we probably better. Because we went to the Planning room and the guy was telling us, this looks okay. He said it was okay, so we did not add more stuff on it. We could have done it better. Ms. McCue: How many employees are you planning on having? Ms. Huang: Like two employees. Ms. McCue: How do you recruit them? Where do you find them? Ms. Smiley: The clients? Ms. McCue: The employees. Ms. Huang: He says that maybe from friends that introduce, who have a license, who had a work experience before. I would say,just from friends introduced who have worked before. They have work experience and they had a license. They went to school for proper training and everything like that. Ms. McCue: What will you do to get your client base? Where will your customers come from? Who will you market to? March 14, 2017 28066 Ms. Huang: We target the customers or the workers. Like people who I would say from age 27 to 30 because they go to work and they feel tired. We promote the general relaxation of the . . . basically, it is for well being and also reduce pain from work because the over hours working and stuff like that. So mostly our target will be just like adults who are working and stuff like that. I don't think I explained that well. Ms. McCue: That's okay. I'm just wondering how do you get the word out? How do you tell people about your business? Ms. Huang: We think there's a newspaper. You know, how we could just commercials on the newspaper and also since we're in the mall there, there will be people in the mall all the time. Ms. McCue: Okay. Thank you. Mr. Long: Just to follow up on that, you haven't done any sort of study that would marry you to this location. It's not as if you know that this location has an under-served need for massage therapy in this area. It's just you saw the building. You liked the building. Ms. Huang: Yes, exactly. Mr. Long: You could still theoretically open your business elsewhere if this location didn't prove to work out. Ms. Huang: I believe so. Mr. Long: Okay. Thank you. Mr. Wilshaw: Mr. Taormina, just a quick question. The city ordinance about massage therapists requires that they be licensed by the State of Michigan. Is that correct? Mr. Taormina: That is correct. The establishment must be licensed and all the employees must be properly certified as well. That is a requirement. That's a State law and our ordinance refers to compliance with those State regulations. Mr. Wilshaw: Okay. Thank you. Is there anybody in the audience that wishes to speak for or against this petition? Seeing no one coming forward, is there anything else you would like to say in conclusion? Ms. Huang: No. That would be it. March 14, 2017 28067 Mr. Wilshaw: With that, I will close the public hearing and ask for a motion. On a motion by Smiley, seconded by McCue, and unanimously adopted, it was #03-14-2017 RESOLVED, that pursuant to a Public Hearing having been held by the City Planning Commission on March 14, 2017, on Petition 2017-02-02-01 submitted by Hong Yin Xu requesting waiver use approval pursuant to Section 10.03(m) of the City of Livonia Zoning Ordinance #543, as amended, to operate a massage establishment (Xu Massage) within the multi-tenant commercial center (Middlebelt-Norfolk Plaza) at 20337 Middlebelt Road, located on the northwest corner of Middlebelt Road and Norfolk Avenue in the Northeast 1/4 of Section 2, which property is zoned C-1, the Planning Commission does hereby deny Petition 2017- 02-02-01 for the following reasons: 1. That the petitioner has failed to affirmatively show that the proposed use is in compliance with all of the special and general waiver use standards and requirements as set forth in Sections 11.03 and 19.06 of the Zoning Ordinance #543; 2. The massage establishment would be within four hundred feet (400') of the Clarenceville Methodist Church, and therefore in violation of Section 10.03(m)(3) of the City of Livonia Zoning Ordinance No. 543, as amended; 3. That the petitioner has not adequately established that there is a need for the proposed use in this section of the City; 4. That the petitioner has not sufficiently demonstrated that the proposed use would be compatible to and in harmony with the surrounding uses in the area; and 5. That the proposed use is contrary to the goals and objectives of the Zoning Ordinance which, among other things, are intended to insure suitability and appropriateness of uses. FURTHER RESOLVED, that notice of the above hearing was given in accordance with the provisions of Section 19.05 of Zoning Ordinance #543, as amended. Mr. Wilshaw, Chairman, declared the motion is denied. You will have 10 days in which you can appeal this decision in writing to the City Council. March 14, 2017 28068 ITEM #2 PETITION 2017-02-02-02 WADE SHOWS Mr. Caramagno, Secretary, announced the next item on the agenda, Petition 2017- 02-02-02 submitted by Wade Shows, Inc. requesting waiver use approval pursuant to Section 11.03(1) of the City of Livonia Zoning Ordinance#543, as amended, to conduct a carnival in the parking lot of Sears, sponsored by the Rotary Club of Livonia, consisting of amusement rides, games and food concessions from May 25, 2017, through June 4, 2017, inclusive, on property at 29500 Seven Mile Road, located on the northwest corner of Seven Mile Road and Middlebelt Road in the Southeast 1/4 of Section 2. Mr. Taormina: This is a recurring request by the Rotary Club of Livonia to hold a fund-raising carnival in the parking lot of Sears. The operator of this year's carnival is Wade Shows. As you know, the City has granted approval to allow a carnival at this same location for several years now. The duration of the carnival this year, similar to previous years, is 11 days. It would run from May 25 through June 4. The dates of operation correspond to the Thursday and Friday before Memorial Day weekend, includes Memorial Day weekend and the entire week after Memorial Day including the following weekend. The hours of operation would be the same — from Monday through Friday, 4:00 p.m. to 11:00 p.m., Saturdays and Sundays from 12:00 p.m. to 11:00 p.m., and then on Monday, June 5, the carnival would be closed and disassembled. The layout of the carnival is also the same as in previous years. The area measures roughly 660 feet in an east to west direction by 320 feet north to south. The north boundary corresponds to one of the main aisle ways in the Sears parking lot that provide ingress and egress between the properties, but that aisle way would not be impacted or interfered with, and then the westerly boundary basically traces the western line of the Sears property. There are two main segments on the plan. The RV's and all of the other storage, trucks, and equipment associated with the carnival would be placed in the southwest corner of the property. This is something that was changed from a few years back in order to eliminate any noise complaints from the neighbors to the south. Then the main carnival is shown on the easterly portion of the property. With that, Mr. Chairman, I can read out the departmental correspondence. Mr. Wilshaw: Please. Mr. Taormina: There are four items of correspondence. The first item is from the Engineering Division, dated February 21, 2017, which reads as follows: "In accordance with your request, the Engineering Division has reviewed the above referenced waiver use approval March 14, 2017 28069 request. The address of 29500 Seven Mile Road is correct for the subject parcel, and should be used in connection with this petition. The legal description provided for the property does not close per surveying standards, but is sufficient to describe the parcel for this petition. We have no objections to the proposed petition, although the following items should be noted: (1) Should the carnival have the need to occupy, or should any of the associated activities impact either of the Seven Mile Road or Middlebelt Road right-of-way, a permit from Wayne County will be required as both roads are under their jurisdiction. (2) All sanitary sewage from the site, recreational vehicles or campers shall be disposed of properly. (3) Should the operators need to have water provided for their facilities, they should contact the City of Livonia Water Department to obtain the proper equipment, including a water meter with backflow preventer." Sears has two outstanding false alarm bills: 29500 Seven Mile Road (carnival location) $3,062.58; 12001 Sears Drive, #4 & 5(separate location) $2,129.50. I'll just point out that those outstanding false alarm charges must be paid prior to the City Council vote on this item. Thank you. Mr. Wilshaw: Are there any questions of the Planning Director? Mr. Long: One question. I know the residents' area was moved in recent years to the southwest corner. Are we aware of any problems with the surrounding businesses that have occurred because of that, and are the surrounding businesses noticed of this public hearing so if they had a problem with it, they would be able to show up? Mr. Taormina: They are noticed and we have not received any complaints to my knowledge, at least none have been brought to my attention either through the departmental response letters or directly to me. Typically, if we had some issues, that would have been addressed in the Inspection Department report, but they indicate they have no objections to the proposal. So I am assuming that there have not been any complaints. Mr. Long: Great. Thank you. Mr. Wilshaw: Is the petitioner here this evening? We will need your name and address for the record please. Is there anything you would like to what you've heard so far? Ms. Hardesty: I don't think so. The issue with the outstanding invoices, we have assurances that will be handled prior to the final approvals on that. But other than that, it's a great event. I'm sure the businesses aren't complaining because we bring a lot of people to that corner, to that area during our event. No issues. Mr. Wilshaw: Are there any questions for the petitioner? Ms. Smiley: How long has Wade Shows been doing the carnival at this location? Ms. Hardesnty: I believe it's our sixth year. Ms. Smiley: It's a big fund-raiser, is it not? March 14, 2017 28071 Ms. Hardesty: It is. It's a big fund-raiser for the Livonia AM Rotary Club and that money all goes back into the Livonia community actually. Ms. Smiley: Thank you, and thank you for doing that. Mr. Caramagno: How many customers do you think you put through there during the date of the events? Ms. Hardesty: I don't have any numbers in front of me. A good guess during the entire event, maybe 10,000 people. Mr. Caramagno: I had no feel for that at all. So 10,000 you think? Ms. Hardesty: I'm thinking about that. Yes. Mr. Caramagno: Thank you. Ms. Hardesty: But that's the whole time. I mean we're there for 11 days and two weekends. Mr. Caramagno: I understand. Mr. Wilshaw: I don't think there's anybody in the audience, so we want to thank you, Ms. Hardesty, for coming to us, and I will now ask if there's a motion for the floor? On a motion by McCue, seconded by Caramagno, and unanimously adopted, it was #03-15-2017 RESOLVED, that pursuant to a Public Hearing having been held by the City Planning Commission on March 14, 2017, on Petition 2017-02-02-02 submitted by Wade Shows, Inc. requesting waiver use approval pursuant to Section 11.03(1) of the City of Livonia Zoning Ordinance#543, as amended, to conduct a carnival in the parking lot of Sears, sponsored by the Rotary Club of Livonia, consisting of amusement rides, games and food concessions from May 25, 2017, through June 4, 2017, inclusive, on property at 29500 Seven Mile Road, located on the northwest corner of Seven Mile Road and Middlebelt Road in the Southeast '/4 of Section 2, which property is zoned C-2, the Planning Commission does hereby recommend to the City Council that Petition 2017- 02-02-02 be approved subject to the following conditions: 1. That the carnival shall be limited to the dates as specified by Wade Shows, Inc., which are May 25, 2017, through June 4, 2017, inclusive; March 14, 2017 28072 2. That the proposed carnival operation shall be confined to the area as illustrated on the aerial layout plan as received by the Planning Commission on February 16, 2017; 3. That all rides, food concessions, booths and all other equipment and apparatus relating to the operation of the carnival shall be located at least sixty feet (60') distant from the Seven Mile and Middlebelt Roads right-of-way lines; 4. That the temporary housing and storage of other trucks and equipment associated with the carnival shall be parked or stored within the extreme southwestern portion of the Sears parking lot, but no closer than sixty feet (60') from the Seven Mile Road right-of-way line; 5. That the hours of operation shall be limited to the following: Monday through Friday from 4:00 p.m. to 11:00 p.m.; and on the weekends, Saturday and Sunday, from 12:00 p.m. to 11:00 p.m.; and 6. That access to fire hydrants is provided for the Fire Department. Subject to the preceding conditions, this petition is approved for the following reasons: 1. That the proposed use complies with all of the special and general waiver use standards and requirements as set forth in Sections 11.03 and 19.06 of the Zoning Ordinance #543; 2. That the site has the capacity to accommodate the proposed use; 3. That the use of the subject property for carnival purposes will not interrupt the normal traffic flow and circulation in the area and will not impede access to Sears or Livonia Marketplace; and 4. That no reporting City department objects to the proposed use. FURTHER RESOLVED, that notice of the above hearing was given in accordance with the provisions of Section 19.05 of Zoning Ordinance #543, as amended. March 14, 2017 28073 Mr. Wilshaw, Chairman, declared the motion is carried and the foregoing resolution adopted. It will go on to City Council with an approving resolution. ITEM #3 APPROVAL OF MINUTES 1,101st Public Hearings and Regular Meeting Mr. Caramagno, Secretary, announced the next item on the agenda, Approval of the Minutes of the 1,1015t Public Hearings and Regular Meeting held on February 7, 2017. On a motion by Long, seconded by Priddy, and unanimously adopted, it was #03-16-2017 RESOLVED, that the Minutes of 1,101st Public Hearings and Regular Meeting held by the Planning Commission on February 7, 2017, are hereby approved.
