HomeMy WebLinkAboutPUBLIC HEARING - PH 2016-08-15 - REZONING - SOAVE ORO PUBLIC HEARING Minutes of Meeting Held on Monday, August 15, 2016 ______________________________________________________________________ A Public Hearing of the Council of the City of Livonia was held at the City Hall Auditorium on Monday, August 15, 2016. MEMBERS PRESENT: Kathleen E. McIntyre, President Scott Bahr Maureen Miller Brosnan Jim Jolly Brian Meakin Cathy K. White MEMBERS ABSENT: Brandon Kritzman, Vice President OTHERS PRESENT: Mark Taormina, Director of Planning Don Knapp, City Attorney Bonnie J. Murphy, CER-2300, Certified Electronic Recorder The Public Hearing was called to order at 7:15 p.m. with President Kathleen McIntyre presiding. This is a Public Hearing relative to a request for a change of zoning within the City of Livonia on the following matter: Petition 2016-06-01-04 submitted by Soave/Oro Construction, L.L.C., to rezone the property located on the north side of Lyndon between Harrison and Barkley (28200 Lyndon) in the Northeast ¼ of Section 24, from R-U-F (Rural Urban Farm – minimum ½ acre lots) to R-2 (One Family Residential – 9,600 sq. ft., 80 ft. x 120 ft. lots). The City Clerk has mailed a notice to those persons in the area affected by the proposed changes, and all other requirements of Ordinance No. 543, the Zoning Ordinance, have been fulfilled. There were fifteen people in the audience. McIntyre: The Public Hearing is now open. Mr. Taormina, would you like to begin? Taormina: Thank you. The property that is the subject of this rezoning petition is the former CB Swim Club, which is located on the north side of Lyndon between Harrison and Barkley. This property is 2.71 acres in area and includes roughly 346 feet of frontage along Lyndon and 341 feet of depth. The front part of this site, as most everyone knows, contains an old swimming pool, clubhouse and parking lot, while the rear part of this site is undeveloped and maintained as an open field. And as we all know, too, that this swim club has been vacant for a number of years. The purpose 2 of the rezoning would be to allow for the development of single family homes that are in accordance with R-2 district regulations. R-2 requires a minimum lot size of 70 feet by 120 feet, for a total area of 8,400 square feet of lot area and the land area requested to be rezoned is sufficient in size to allow for the division of the property into approximately eight conventional sized lots. This is actually the third rezoning petition involving the CB Swim Club property. The Swim Club site was originally much larger and had extended north to Oakley Avenue and west to Harrison Avenue. In 1988 the land area, roughly 1.70 acres in size, that included all of the Oakley Avenue frontage into the site, was rezoned from R-U-F to R-2. The petition was approved and the property was subsequently subdivided into six lots. And then in 2005, the westerly 120 feet of the Swim Club property, the property’s entire frontage along Harrison Avenue, was also rezoned from R-U-F to R-2, and that was subsequently developed into six condominium lots. The surrounding property to the north is R-2 residential, to the east R-2 residential and to the west, R-2 residential as well as Grace Baptist Church which is zoned R-U-F and Compton Park is zoned PL, and then to the south is the Perrinville Early Childhood Preschool which is zoned PL as well as single family under the R-1 category. The Future Land Use Plan designates this area as Low Density Residential, that corresponds to a density between one to five dwelling units per acre and is consistent with the R-2 zoning and anticipated maximum development density of approximately three dwelling units per acre. The Planning Commission is recommending approval of the rezoning. Thank you. McIntyre: Thank you, Mr. Taormina. White: Madam Chair. McIntyre: Yes. White: Through the Chair to Mark, you mentioned that the R-2 lots are 70 x 120, and the notice says 80 x 120. Taormina: Yes, I think that that was corrected, I’m not sure which notice. I know we sent out a corrected notice on that. So you’re looking at the old notice. White: Thank you. McIntyre: Anything else? Alright. Would the petitioner like to come forward? 3 Duggan: Good evening. My name is Brian Duggan. My address is 14315 Denne, Livonia. I am here representing Michael Soave, if you have any questions. I think Mark did a fine job. The site is a hangout for teenagers, there’s been several police calls on that site already. So this will clean it up and hopefully put some new homes in that area. Bahr: Madam Chair. McIntyre: Yes. Bahr: I don’t have to ask any questions. I’ve lived in that neighborhood for many years. I’m very happy to offer an approving resolution. It’s a reputable developer. Although many of us would have loved to have seen the swim club use continued, it’s been vacant for a long time McIntyre: Thank you. And we just want to make sure that you know that the next th Regular Meeting for this item will be Wednesday evening, September 7, so know that either you or a representative of the petitioner needs to be there.
