HomeMy WebLinkAboutPLANNING MINUTES 1983-03-15 7876 r MINUTES OF THE 451st REGULAR MEETING AND PUBLIC HEARINGS HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA f`On Tuesday, March 15, 1983, the City Planning Commission of the City of Livonia, held its 451st Regular Meeting and Public Hearings in the Livonia City Hall, 33000 Civic Center, Livonia, Michigan. Mr. Daniel R. Andrew, Chairman, called the Regular Meeting and Public Hearings to order at 8:05 p.m., with approximately 55 interested people in the audience. MEMBERS PRESENT: Judith Scurto Daniel R. Andrew Jerome Zimmer Herman Kluver Donna Naidow Donald Vyhnalek Lee Morrow MEMBERS ABSENT: Sue Sobolewski Joseph Falk Messrs. John J. Nagy; City Planning Director; H G Shane, Assistant City Planning Director; and Ralph H. Bakewell, Planner IV, were also present. Mr. Andrew then informed the audience that if a Petition on tonight's agenda involves a rezoning request, this Commission only makes a recommendation to the City Council, who in turn will then hold their own Public Hearing and decide the question. If a petition involves a waiver use request, and the petition is denied by the Planning Commission, the petitioner then has ten days in which to appeal for relief. Otherwise the petition is terminated. ^Mrs. Scurto, Acting Secretary, announced the first item on the agenda is Petition 83-2-1-4 by the City Planning Commission to rezone property located on the west side of Wayne Road, north of Joy Road in the Southwest 1/4 of Section 33, from RUF to P.S. Mr. Nagy: We have a letter from Gary Clark, Division of Engineering dated February 3, 1983'. That is the extent of correspondence. Mr. Andrew: This petition was initiated by City Council. Is there anyone wishing to be heard regarding this petition? Claude Howard: am representing the property owners. My clients have no objection to the rezoning. Mr. Andrew: Are you an attorney? a Mr. Howard: I am a commercial real estate broker. The owner is here. Mr. Morrow: The property ' to the south is described as RUF. Mr. Andrew: It technically still is. There is a rezoning request pending before the City Council. Mr. Morrow: For P.S. or C-1? Ar. Andrew: For P.S. ti 1�r. Zimmer: Were the same notifications set out for tonight's meeting as were a few weeks ago? The response- was large at the last meeting. Mr. Nagy: Essentially the same notifications were sent out. There was no one else present wishing to be heard regarding this petition. • 7877 Mr. Andrew, Chairman, declared the public hearing on this item closed. Irt:On a motion duly made by Mr. Morrow, seconded by Mr. Zimmer, and unanimously adopted, it was #3-42 - 83 RESOLVED that, pursuant to a Public Hearing having been held on March 15, 1983 on Petition 83-2-1-4 by the City Planning Commission to rezone property located on the west side of Wayne Road, north of Joy Road in the Southwest 1/4 of Section 33, from RUF to P.S. , the City Planning Commission does hereby recommend to the City Council that Petition 83-2-1-4 be approved for the following reasons: (1) The proposed change of zoning is consistent with the Future Land Use Plan of the City of Livonia as adopted by the Planning Commission. (2) The proposed change of zoning is consistent with the Planning Commission goals and policies for land use as the proposed change of zoning would act as a buffer separating the established residential neighborhood from the adverse affects of the heavily travelled thoroughfares. (3) The proposed change of zoning will provide for a uniform zoning classification in this area and not leave a remanent parcel of residential zoning in the mid-block area. (4) The proposed change of zoning and uses permitted are compatible to and in harmony with the surrounding and established uses of the area. FURTHER RESOLVED that, notice of the above Public Hearing was given in accordance with the provisions of Section 23.05 of Zoning Ordinance #543. 1[0er Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. s. Scurto announced the next item on the agenda is Petition 83-2-1-5 by Carrollton Arms to rezone property located on the north side of Seven Mile Road, east of Farmington Road in the Southwest 1/4 of Section 3, from R-2A to R-7. Mr. Nagy: We have a letter from Gary Clark, Division of Engineering dated February 21, 1983. Mr. Bob Paciocco: 36776 Vargo, Livonia I am a partner of Carrollton Arms. We are proposing on approximately 19 to 20 acres, 96 two bedroom condos and 56 one bedroom condos. We plan to retain residential zoning on the east side of Shadyside to provide for a buffer of single family homes to• separate the established single family residential neighborhood to.the west of this development. The one bedroom condos will be 900 square feet and the two bedroom condos 1,050 square feet. The property is best suited for condo type living. It is a narrow strip and to the north is school property and a City park. There are commercial stores to the south. It is a very good piece of property for this type of housing which is badly needed in this area. There is a big shortage of condos in Livonia, Northville, Plymouth. Mr. Morrow: Most of the access will be on Seven Mile. 4r. Paciocco: The access will be on Seven Mile just east of the shopping center. Shadyside will not be effected. 4r. Zimmer: The yellow lots are excluded and will remain R2A. Iv Mr. Andrew: That is correct. Anyone in the audience wishing to be heard on this matter? 7878 I. Henry Kost .n: 192 '.L Shadyside, Livonia, Mi. I wondered about access to Shadyside. Mr. Andrew: No access to Shadyside. Mr. Costin: How high will the structures be? Mr. Paciocco: Two story units. Mr. John Candlish: 32415 Seven Mile, Livonia, Mi. Where will the sewer be? There is none down Seven Mile? Mr. Priest: We will tap the sewer on Shadyside. It will adequately serve that property. The storm sewers will be taken care of by the Tarabusi Creek. There was no one else present wishing to be heard regarding this petition. Mr. Andrew, Chairman', declared the public hearing on this item closed. On a motion duly made by Mr. Vyhnalek, seconded by Mr. Kluver, and unanimously adopted, it was #3-43-83 RESOLVED that, pursuant to a Public Hearing having been held on March 15, 1983 on Petition 83-2-1-5 by Carrollton Arms, a Michigan Co-Partnership requesting to rezone property located on the north side of Seven Mile Road, east of Farmington Road in the Southwest 1/4 of Section 3, from R.-2A to R-7, the City Planning Commission does hereby recommend to the City Council that Petition 83-2-1-5 be approved for the following reasons: 11; (1) The proposed change of zoning and uses permitted would be compatible to and in harmony with the surrounding and established uses of the area. (2) The proposed change of zoning and the increased density that would be 'permitted by the proposed change of zoning can be accommodated in this area as there is located to the north and east open space lands consisting of either-: flood plain area or park and school lands that will provide permanent open space adjacent. to this development. (3) The proposed change of zoning will not adversely affect the surrounding area as the arra is adequately separated and buffered from the surrounding and established residential uses as there is permanent open space to the northeast, there is either commercial, parking or large acreage parcels to the south and the project itself will, provide for a single family transitional area on the west. (4) The proposed change of zoning will not adversely affect the surrounding area from a traffic standpoint as the area proposed for the rezoning has direct access to Seven Mile Road. (5) The proposed change of zoning to the R-7 multi-family zoning classification will maximize on the unique property configuration, topography and open space potential of the area. 7879 FURTHER RESOI"ED that, notice of public hearing was given in accordance with the provisions of Section 23.05 of Zoning Ordinance #543. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Morrow, seconded by Mr. Zimmer, and unanimously adopted, it was #3-44-83 RESOLVED that, the Planning Commission does hereby determine to waive the provisions of Section 10 of Article VI of the Planning Commission Rules of Procedure regarding the seven day period concerning effectiveness of Plan- ning Commission resolutions in connection with Petition 83-2-1-5 by Carrollton Arms, a Michigan Co-Partnership requesting to rezone property located on the north side of Seven Mile Road, east of Farmington Road in the Southwest 1/4 of Section 3. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. Mrs. Scurto announced the next item on the agenda is Petition 83-2-2-3 by R & G, Inc., requesting waiver use approval to utilize a Class C Liquor License in connection with an existing restaurant located within the Wonderland Shopping Center on the southwest corner of Plymouth and Middlebelt Roads in the Northeast 1/4 of Section 35. Mr. Andrew: We have a letter dated March 11, 1983 asking for the petition to be withdrawn. L On a motion duly made by Mr. Kluver, seconded by Mr. Zimmer, and unanimously adopted, it was #3-45-83 RESOLVED that, pursuant to a letter dated March 11, 1983, the City Planning Commission does hereby approve the withdrawal of Petition 83-2-2-3 by F & G, Inc. regtiesting waiver use approval to utilize a Class C Liquor License in connection with an existing restaurant located within the Wonderland Shopping Center on the southwest corner of Plymouth and Micdlebelt Roads in the North- east 1/4 of Section 35, and determines that no further action by the City is necessary. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. Mrs. Scurto announced the next item on the agenda is Petition 83-2=2-4 by LPR Land Company requesting waiver use approval to construct a building for general office use on the northeast corner of Farmington Road and Lyndon Avenue in the Northwest 1/4 of Section 22. Mr. Nagy: We have a letter from Mr. and Mrs. J. Smiley, 33149 Allen, dated March 3, 1983, residents of Kimberly Oaks opposing the petition. We have a letter from the Wayne County Road Commission dated March 1, 1983 from A.E. Sunstrum. We have a letter dated March 9, 1983 from Mr. R. Rienke, 14377 Westmore, opposing the petition. We have a letter from Mr. David Hulgrave, 33209 Lyndon, opposing the petition. We have a letter from Lieutenant Widmaier, Division of Public Safety, Traffic. li; We have a letter from A. Sawyer, Department of Public Safety, Division of Fire. Mr. Gene Lambert, 555 South Woodward, Birmingham, Michigan: It is our desire to construct a Class A building providing some of the finest office space in Livonia. We would like the flexibility to put in - 7880 office tena. other than professional services. We are looking for Clash A office tenants. We will have no store front tenants. There is a great 1[ deal of need in Livonia for this type building. ,Mr. Andrew: You will not have barber shops, cafeteria type operations? Mr. Lambert: We will have no commercial services. Mrs. Scurto: What would keep this development eventually from having a restaurant such as Jacques? Mr. Andrew: A rezoning would be required. Mr. Lambert: We are trying to have a building which would attract a tenant that needed 15,000 to 20,000 sq. ft. This is non existent in Livonia at this time. By use of landscaping and setback we can achieve a look compatible with the residential area. We think that the two-story with all brick veneer facade will look very wall and blend in with the residential area. Mr. Andrew: What about abolishing Lyndon as an entrance and exit or just using Lyndon as an exit only? Mr. Lambert: Wayne County Road Commission and we believe that Lyndon is essential to best serve this site. We have revised the site plan with a large berm. Cars will not be seen on Westmore. We are keeping lighting levels at night down. The lighting as it runs around the berm area will shine toward Farmington Road. There will be no glare into the subdivision. It will be our policy on the building to turn all but a few security lights out by 10 p.m. We feel to best service the complex that we need IL to. ingress and egress on Lyndon as well as two ingress and egress points on Farmington. Mr. Andrew: Which will be Phase 1 construction? Mr. Lambert: It would be the southerly building. Mr. Andrew: At what point in time would you move ahead with Phase 2? Mr. Lambert: Hopefully we could continue with Phase 2 before we completed Phase 1. There will be about 30,000 sq. ft. of rental space in each building. In order for use to get through with the financing we must have approved plans. About 83 percent of the square footage is net rental area. There will be about 25,000 to 26,000 square feet of rental space. The berm will be about three to four feet in height with about 20 feet for run off. Mr. Andrew: The widened, most-northerly driveway and changed radii are reflected on the revised print? Mr. Lambert: Yes. Mr. Andrew: If you reverse the phases would it be a possiblity that you could create the two Farmington Road exits and eliminate Lyndon. !!r. Lambert: I don't think it is possible. It would be very detrimental to the overall development not to use Lyndon. r. Zimmer: Then the use of Lyndon as a drive is a feature regardless of development of 1 or 2? - . 7881 Mr. Lambert: Yes. It is most convenient to keep our construction activities to the 1[: north without inconvience to our tenants with other construction activities. Mr. Zimmer: How many cars can stack up between the new proposed cut in Lyndon's boulevard? Mr. Nagy: About 6 to 7 cars. Mr. Lambert: One other change you might note we have set back the parking on Farmington. We have added another 10 feet. In that regard we lost -5 parking spaces. Mr. Zimmer: Would car headlights shine into the homes of residents on Westmore? Mr. Lambert: I don't think that is possible. Mr. Morrow: Have you built any professional buildings? Mr. Lambert: Yes. • Mr. Morrow: This size? Mr. Lambert: No. Mr. Morrow: In your opinion the P.S. zoning versus general office, which would generate more traffic? [ Mr. Lambert: It depends on the type of P.S. and type of general office. Some general office tenants would generate a lot of office space and very few tenants or vice versa. Mrs. Scurto: How long has this been zoned P.S.? Mr. Nagy: Since February 3, 1981, Ordinance amendment #854. Mr. Andrew: If the curb cut was not put in on Lyndon could you use the site without it? Mr. Lambert: I am not sure how the site can be utilized in an efficient manner without it. Wayne County Road Commission feels strongly Lyndon is needed. Mr. Andrew: Any one in the audience wishing to be heard on this petition? Mr. Gene Syverson, 33164 Martin, Livonia: Lyndon has homes all the way from Inkster to Farmington. This plan changes a very clearly marked entrance into a subdivision. There will be too much traffic. I hope you keep that in mind later on when a P.S. development wants in. Carl Ericson, Attorney for property owner Edward Maskeny, 33150 Barkley, Livonia: Mr. Maskeny is opposed to this petition on general grounds. It would be detrimental to the beauty, harmony and safety of the residential area. There is plenty of general office space available in Livonia. This develop- ment does not take the needs of the community into consideration. The IL surrounding property owners rights and needs have not been adequately provided for. 7882 Mr. Kiuver: If this was doctors versus Company XYZ, P.S. zoning would allow almost the same size, same topography, same parking, same ingress and egress. That is the present zoning here, P.S. They could duplicate this site plan. IL Mrs. Getsinger, 14656 Westmore, Livonia: My home faces the property across the street. My home has been on the market for several months. I received an offer last week. When the prospective buyer went to the City and found out about this zoning, they withdrew their offer. I cannot sell my home. Mr. Dave Hulgrave, 33209 Lyndon, Livonia: I have three small children. We have enjoyed having an open field. I am opposed to this opening on Lyndon. The size of this building is too big for the site in question. I think with the new City Hall, etc. you are trying to make this area a show case. City Hall is back far enough on Five Mile but this building is up so close to the road. Mr. Schuster, 33080 Oakley, Livonia: You have a master plan utilizing this property with something other than general office use. The rendering provided here looks overwhelming compared to the other building in this area. Mr. Thompson: 14309 Westmore, Livonia: I spentone-half hour at 5:30 p.m. and I found 300,000 sq. ft. available for rent for anyone. I don't know why we need the likes of that in our area. I thought when the expressway was built it would decrease the traffic on Lyndon. Instead in increased. We have enough traffic with the baseball fields, Hockey, Spree. Mr. Kcm Williams, 33070 Barkley, Livonia: 1[0 . ° Are they going to get a tax credit? Mr. Andrew: I don't know if they have applied for EDC financing. Mr. Williams: They should pay their fair share of taxes. Times seem to be getting better. If times go bad and they cannot finish this project, who is responsible? Mr. Andrew: The mortgage company might be unhappy. Resident, 33010 Oakley, Livonia: We have seen progress in this area with City Hall, Fire Department. We are surrounded by various commercial buildings•. I think we the citizens should change lt to something else. We have enough commercial. Mrs. Collins, Lyndon Ave. : When we moved here in 1969 my taxes were $700. Now they are $2500. I think it is ridiculous to pay these kinds of taxes to have this stuff. Mr. Cowley, 14323 Westmore, Livonia: I don't think it fits into the neighborhood scheme. I do have a little girl that does go down Lyndon. I can foresee more traffic, more accidents. The lighting will be a nuisance. The Farmington Road lights as well as the Ford Field lights are already there and a nuisance. 4r. Andrew: Do you face Farmington Road? Cowley: No. 7883 Don Dane, Hubbard Ave: . I: I realize this is now zoned P.S. However, they are trying to go to a larger scope. P.S. would be a much lesser scope. If you reduce the scope you reduce the problems. A smaller, shorter building and more green and less traffic would reduce problems. We have boulevards up Lyndon. . We are proud of them. Mr. Vyhnalek: Were there any P.S. site plans submitted in the past? Mr. Nagy: This is the first one. Mr. Allan, 14196 Cranston, Livonia: This would have conceivably more traffic than P.S. I jog in this area. There are a considerable number of children riding bikes to Ford Field, Livonia Y, etc. This will be very hazardous. Mrs. Scurto: I could not live with an ingress and egress on Lyndon and therefore, cannot support this petition. I would like to say that the people who own this property pay an exorbitant amount of taxes and are entitled to use their property. If you wish to pool your money and buy it for a field you have that option. Mr. Zimmer: I have no trouble with the waiver use. P.S. zoning has been there a long time. I would like to explore the possibility of closing off the Lyndon ingress and egress. There was no one else present wishing to be heard regarding this petition. On a motion duly made by Mr. Zimmer, seconded by Mrs. Scurto, and adopted, it was #3-46-83 RESOLVED that, pursuant to a Public Hearing having been held on March 15, 1983 on Petition 83-2-2-4 submitted by LPR Land Company requesting waiver use approval to construct a building for general office use on the northeast corner of Farmington Road and Lyndon Avenue in the Northwest 1/4 of Section 22, the City Planning Commission does hereby determine to table Petition 83-2-2-4 until the Study Meeting of March 22, 1983. A roll call vote on the foregoing resolution resulted in the following: AYES: Scurto, Andrew, Zimmer, Vyhnalek, Naidow, Morrow NAYS: Kluver ABSENT: Falk, Sobolewski Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. Mrs. Scurto announced the next item on the agenda is a Petition by John Del Signore requesting waiver use approval to utilize a Class C Liquor License within a banquest hall proposed to be located on the north side of Plymouth Road between Merriman and Hubbard Roads in the Southeast 1/4 of Section 27. John Del Signore, 14680 Fairlane, Livonia: I would like to build a banquet hall. It would be able to hold 600 people. Ar. Anlrew: Do you need the Class C license for the banquet hall? . DelSignore: Yes. Mr. Andrew: When do you plan to start? 7884 Mr. Del Signore: In ',he next couple of months. Mr. Zimmer: Are the parking requirements met? _' Mr. Bakewell: Yes. Mr. Zimmer: Currently is the restaurant deficient? Mr. Del Signore: We have adequate parking at the restaurant. Mr. Vyhnalek: You will enter the banquet hall site through the restaurant site also. It will be a horseshoe effect. Mr. Del Signore: Yes. Through the restaurant but not my wife's building. Mr. Zimmer: How wide is the greenbelt on Plymouth Road? Mr. Bakewell: 15 feet. Mr. Zimmer: What is the building setback? Mr. Bakewell: 60 feet to the front of the most forward projected area where the windows are. Edward's Glass is forward, Welding is forward. On a motion duly made by Mrs. Scurto, seconded by Mrs. Naidow, and unanimously adopted, it was #3-47-83 RESOLVEDthat, pursuant to a Public Hearing having been held on March 15, 1983 on Petition 83-2-2-5 by John Del Signore requesting waiver use approval to utilize -a Class C Liquor License within a banquet hall proposed to be located on the north side of Plymouth Road between Merriman and Hubbard Roads in the Southeast 1/4 of Section 27, the City Planning Commission does hereby determine to table Petition 83-2-2-5 until the Study Meeting of April 5, 1983. Mr. Andrew, Chairman, declare the motion is carried and the foregoing resolution adopted. Mrs. Scurto announced the next item on the agenda is Petition 83-2-2-6 by the Livonia Jaycees requesting waiver use approval to operate a carnival on property located within the Wonderland Shopping Center at the southwest corner of Plymouth and Middlebelt Roads in Section 35. . Mr. Nagy: We have a letter from Engineering dated January 18, 1983 signed by Gary Clark. John Hoyt, 3014'; Orangelawn, Livonia: I would like to see the same stipulations as last year. The City was very cooperative. Last year we did have a shooting and a carnival trailer smashed the Stroh's Store at Joy and Middlebelt. I would hope that a new company would be used by the Jaycees. 7885 Mr. Duke Young, P.O.Bo>. ?039, Livonia: We have the same carnival company this year. Accidents happen everyday. We will use the parking on the north side of Plymouth. We have permission from Ford Motor. 3 There was no one else present wishing to be heard regarding this petition. On a motion duly made by Mrs. Naidow, seconded by Mr. Morrow and unanimously adopted, it was #3-48-83 RESOLVED that, pursuant to a Public Hearing having been held on March 15, 1983 on Petition 83-2-2-6 by the Livonia Jaycees requesting waiver use approval to operate a carnival on property located within the Wonderland Shopping Center at the southwest corner of Plymouth and Middlebelt Roads in Section 35, the City Planning Commission does hereby recommend to the City Council that Petition 83-2-2-6 be approved subject to the following conditions: (1) that no equipment, trailers, electric generator, animals, temporary housing accommodations or any other apparatus related thereto shall not be placed closer than 400' to the south property line of the Wonder- land or K-Mart Shopping Centers; and (2) that the carnival shall be limited to the dates as specified by the Jaycees which are May 16, 1983 to May 31, 1983. Mrs. Scurto announced the next item on the agenda is Petition 83-3-2-7 by C. D. Hardy requesting waiver use approval for outside storage of contractor's equipment on property located on the east side of Wayne Road between Industrial Road and the C & 0 Railway in the Northwest 1/4 of Section 28. Mr. C. D. Hardy, 409 Jefferson, 4th Floor, Detroit, MI 48226: We will be storing light trucks and small trenching equipment along with some rolls of cable. Mr. Vyhnalek: The area is now gravel and will have to be paved. Mme. Hardy: We realized that. We just moved in on March 1. Mrs. Scurto: What is the height of trenching equipment? ' Mr. Hardy: It is very small. Mr. Andrew: Are you putting the cable in Livonia? Mr. Hardy: No, we are presently in Garden City and Pontiac. El• Mr. Roth, 17220 W. 12 Mile Road, Ste. 201, Southfield, MI 48076: I am opposed to it. They have moved equipment on my property. The building is too small for them. At 7:30 a.m. there were at least 100 vehicles working out of that location. My tenant has had to call the police a few times. There are over 50 pieces of equipment. They need a larger site. 7886 Mr. Nagy: We looker at the site in mid-afternoon. We found at least 50 panelized I: vehicles. There were also employee vehicles there. Every inch was being utilized. There are only 10 parking spaces avaiable outside of the yard area. Mr. Hardy: We have obtained 15 spaces from Lot 14. We are using those and have re- solved some of the problems. We have a larger storage area in Pontiac. We have moved some of the equipment back to Pontiac and Romulus. Mr. Vyhnalek: Planning will attempt to police this. Mr. Nagy: It is our responsibility to enforce the zoning ordinance. Mrs. Scurto: I would like to see a lease agreement that you have made with Lot 14. Is that area paved? Mr. Hardy: Yes, we do not have a lease agreement but I will attempt to bring something in. • Mr. Roth: Could you table the matter until I have a chance to go back to the site to try and work something out with my neighbor? On a motion duly made by Mr. Zimmer, seconded by Mrs. Scurto, and unanimously adopted, it was #3-49-83 RESOLVED that, pursuant to a Public Hearing having been held on March 15, 1983 I: on Petition 83-3-2-7 byHardy C. D. re questing waiver use approval for outside storage of contractor's equipment on property located on the east side of Wayne Road between Industrial Road and the C & 0 Railway in the Northwest 1/4 of Section 29, the City Planning Commission does hereby determine to table Petition 83-3-2-7 until the Study Meeting of March 22, 1983. (2) The proposed building elevations are incompatible to and not in harmony with the established and existing architectural character of thx; building.
