HomeMy WebLinkAboutPLANNING MINUTES 1979-02-13 6930 MINUTES OF THE 325th SPECIAL MEETING HELD BY THE CITY PLANNING COMMISSION ti OF THE CITY OF LIVONIA On Tuesday, February 13, 1979 the City Planning Commission of the City of Livonia held its 325th Special Meeting in the Engineering Building, 13325 Farmington Road, Livonia, Michigan. Mr. Daniel R. Andrew, Chairman, called the meeting to order at 8:25 p.m. Members present: Daniel R. Andrew Joseph J. Falk Esther Friedrichs Jerome Zimmer Judith Scurto C. Russell Smith Robert Morrow Members absent: Herman Kluver Suzanne Wisler* Messrs. John J. Nagy, Planning Director; H. G. Shane, Assistant Planning Director; Ralph H. Bakewell, Planner IV; Richard Collins, Planner III, and William Poppenger, Planner I, were also present. On a motion duly made by Mr. Zimmer, seconded by Mr. Smith and unanimously adopted, it was #2-28-79 RESOLVED that, pursuant to a Public Hearing having been held on February 6, 1979 on Petition 78-12-2-32 as submitted by J. D'Adama requesting waiver use approval to construct a veterinary clinic on 1; the north side of Joy Road between Oporto and Melvin in the Southeast 1/4 of Section 35, the City Planning Commission does hereby recommend to the City Council that Petition 78-12-2-32 be approved subject to the following conditions: (1) that Site Plan, Sheet 1, dated 12/15/78, which is hereby approved, shall be adhered to; (2) that Building Elevation, Sheet 5, dated 12/15/78, which is hereby approved shall be adhered to; (3) that a detailed landscape plan shall be submitted within 30 days for Planning Commission review and approval; and (4) that any signs proposed to be erected on the site, either free- standing or affixed to the building, shall first be submitted for Planning Commission review and approval before sign permits are issued; for the following reasons: (1) Subject proposal complies with all of the general and special conditions of the Zoning Ordinance with regard to waiver uses as contained in Section 10.03 and 19.06, respectively. (2) The nature of the proposal with regard to hours of operation, IL intensity of use and physical appearance will be harmonious with and compatible to the surrounding neighborhood. 6931 (3) Such an office use will provide a buffer between a major thoroughfare and abutting residences in keeping with the Planning Commission's adopted goals and policies. AND THAT, the City Planning Commission does hereby waive the provisions of Section 10 of Article VI of the Planning Commis- sion Rules of Procedure regarding the seven-day period concern- ing effectiveness of Planning Commission resolutions. FURTHER RESOLVED, notice of the above public hearing was sent to property owners within 500 feet, petitioner and City departments as listed in the Proof of Service. A roll call vote on the foregoing resolution resulted in the following: AYES: Friedrichs, Smith, Morrow, Falk, Zimmer, Andrew NAYS: Scurto ABSENT: Kluver, Wisler Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. *Mrs. Wisler entered the meeting at 8:45 p.m. On a motion duly made by Mrs. Scurto and seconded by Mrs. Wisler, it was RESOLVED that, pursuant to a Public Hearing having been held on February 6, 1979 on Petition 79-1-2-1 as submitted by James Blain Associates requesting waiver use approval to construct a building IVfor general office uses on the northeast corner of Levan and School- craft Service Drive in the Southeast 1/4 of Section 20, the City Planning Commission does hereby recommend to the City Council that Petition 79-1-2-1 be approved subject to the following conditions: (1) that Site Plan dated 2/13/79, prepared by James Blain Associates, Architects, which is hereby approved shall be adhered to; (2) that Building Elevation Plan dated 2/13/79, prepared by James Blain Associates, Architects, which is hereby approved shall be adhered to; (3) that a landscape plan showing all landscape materials proposed to be located on the site shall be submitted for Planning Commis- sion approval within 30 days of this approval; for the following reasons: (1) The proposed use complies with all of the requirements of the P.S. Zoning District regulations and the specific waiver use require- ments of Section 19.06 regarding general office uses. (2) The site has capacity to support the use. (3) The proposed use will not adversely affect the surrounding uses of the area or impede the orderly development of the surrounding ILadjacent lands. FURTHER RESOLVED that, notice of the above public hearing was sent to property owners within 500 feet, petitioner and City departments as IL listed in the Proof of Service. 6932 On a motion duly made by Mr. Zimmer and seconded by Mrs. Scurto, it was resolved that o a substitute motion be considered for adoption relative to Condition #2 of the main motion to 'read: . ; (2) that Building Elevation Plan dated 2/13/79, prepared by James Blain Associates, Architects, is hereby approved except that wood shall be used in the place of enameled aluminum paneling on the facia and roof screening. A roll call vote on the foregoing motion amending the main motion resulted in the following: AYES: Scurto, Friedrichs, Zimmer NAYS: Morrow, Smith, Falk, Wisler, Andrew ABSENT: Kluver Mr. Andrew, Chairman, declared the resolution to amend the main motion fails for lack of support. The main motion previously made by Mrs . Scurto and seconded by Mrs. Wisler was re- instated, amended and unanimously adopted to read ,as follows: #2-29-79 RESOLVED that, pursuant to a Public Hearing having been held on February 6, 1979 on Petition 79-1-2-1 as submitted by James Blain Associates requesting waiver use approval to construct a building for general office uses on the northeast corner of Levan and School- licraft Service Drive in the Southeast 1/4 of Section 20, the City Planning Commission does hereby recommend to the City Council that Petition 79-1-2-1 be approved subject to the following conditions: (1) that Site Plan dated 2/13/79, prepared by James Blain Associates, Architects, which is hereby approved shall be adhered to; (2) that Building Elevation Plan dated 2/13/79, prepared by James Blain Associates, Architects, which is hereby approved shall be adhered to; and (3) that a landscape plan showing all landscape materials proposed to be located on the site shall be submitted for Planning Commission approval within 30 days of this approval; AND THAT, the Planning Commission recognizes that the P.S. Zoning District regulations require a protective screen wall where the P.S. zoning abuts residential zoning and that due to the preferences of the adjoining property owners to have a greenbelt substituted for the wall, the Planning Commission encourages the petitioner to request a variance of the wall requirement from the Zoning Board of Appeals; for the following reasons: • (1) The proposed use complies with all of the requirements of the P.S. Zoning District regulations and the specific waiver use ILrequirements of Section 19.06 regarding general office uses. 6933 (2) The site has capacity to support the use. (3) The proposed use will not adversely affect the surrounding uses of the area or impede the orderly development of the surrounding and adjacent lands. AND THAT, the City Planning Commission does hereby waive the provisions of Section 10 of Article VI of the Planning Commission Rules and Procedures regarding the seven-day period concerning effectiveness of Planning Commission resolutions.
