MINUTES OF THE 348th REGULAR MEETING
HELD BY THE CITY PLANNING COMMISSION
OF THE CITY OF LIVONIA
I [ On Tuesday, January 31 , 1978 the City Planning Commission of the City of Livonia held
its 348th Regular Meering in the Livonia City Hall , 33001 Five Mile Road, Livonia,
Michigan.
Mr. Daniel R. Andrew, Chairmancalled the meeting to order at 8:00 p.m.
Members present: Daniel R. Andrew Joseph J. Falk Esther Friedrichs
Herman Kluver Judith Scurto William DuBose
Suzanne Wisler Jerome Zimmer Robert Morrow
Members absent: None
Messrs. H G Shane, Assistant Planning Director; Ralph H. Bakewell , Planner IV; and
Robert M. Feinberg, Assistant City Attorney, were also present.
Mr. Andrew informed the audience that if a petition on tonight's agenda involves a
question of rezoning or vacating, this Commission only makes recommendations to the
City Council and the City Council after holding a public hearing makes the final deter-
I mination as to whether a petition is approved or denied, and if a petition requesting
a waiver of use approval is denied, the petitioner has ten days in which to appeal the
decision to the City Council .
- On a motion duly made by Mrs. Wisler and seconded by Mr. Zimmer, it was
#1-16-78 RESOLVED that, pursuant to a Public Hearing having been held on
December 13, 1977 on Petition 77-11-2-24 as submitted by Mario Fallone
requesting waiver use approval to establish an S.D.D. Liquor Licensed
operation in an existing commercial business located on the east side
of Middlebelt Road, south of Bretton Road in the Southwest 1/4 of
Section 1 , the City Planning Commission does hereby recommend to the
City Council that Petition 77-11-2-24 be approved subject to the
following conditions:
(1) that the screening of the roof-mounted equipment be developed in
accordance with Plan dated 1/30/78, prepared by Michael A. Boggio
Associates, Architects, and painted a color the same as or compatible
with the color of the building; which screening shall be installed
before the S.D.D. facility is located within the structure; and
(2) that all landscape materials installed on the site shall be properly
maintained and kept in a healthy condition and that any dead or dying
materials will be replaced so as to have the site landscaping in full
accordance with the landscape plan previously approved by Planning
Commission Resolution #10-22-74 in connection with Site Plan Petition
74-10-8-39;

for the following reasons:'
(1) The proposed use will not adversely affect the surrounding area as
the site has the capacity to support the added use.

10 (2) The proposed use fully complies with Section 11 .03(r) of the
Zoning Ordinance.
FURTHER RESOLVED that, notice of the above Public Hearing was sent to
property owners within 500 feet,
petitioner and City Departments as
listed in the Proof of Service.
A roll call vote on the foregoing resolution resulted in the following:
AYES: Friedrichs, DuBose, Zimmer, Scurto, Falk, Morrow, Wisler, Andrew
NAYS: None
ABSTAIN: Kluver
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. DuBose, seconded by Mrs. Friedrichs and unanimously adopted,
it was
#1-17-78 RESOLVED that, pursuant to a Public Hearing having been held on
January 17, 1978 on Petition 77-12-2-27 as submitted by Richard C.
Shuler for Allied Supermarkets requesting waiver use approval for
the storage of recreational vehicles on property located west of
Merriman Road, north of Plymouth Road in the Southeast 1/4 of Section
27, the City Planning Commission does hereby recommend to the City
Council that Petition 77-12-2-27 be approved subject to the following
conditions:
11140 (1 ) that Site Plan, revised date 1/16/78, prepared by Allied Super-
markets , Inc. , which is hereby approved, shall be adhered to; and
(2) that no signs shall be erected anywhere on the leased premises or on
the site to advertise the recreational vehicle storage facility;
for the following reasons:
(1) The proposed use will not adversely affect the surrounding uses of the area
as there already are in existence two similar uses on adjacent properties.
(2) The site has excess capacity to support the intended use.
(3) The proposed use complies with Section 16. 11 (d) of the Zoning Ordinance.
FURTHER RESOLVED that, notice of the above Public Hearing was sent to
property owners within 500 feet, petitioner and City Departments as
listed in the Proof of Service.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Zimmer and seconded by Mr. DuBose, it was
#1-17-78 RESOLVED that, pursuant to a letter dated 1/9/78 from Raymond J. Staley,
the City Planning Commission does hereby determine that temporary
10 occupancy be granted the petitioner and an extension of time until

a date no later than June 1 , 1978 be granted for compliance with the
installation of landscape materials as set forth in a condition of
approval of Petition 77-7-2-14 by Comm-Auto Brake Center, Inc. , request-
ing waiver use approval to use an existing building located on the north-
east corner of Plymouth and Merriman Roads in the Southwest 1/4 of
Section 26 for automobile repair service at which time all required
improvements shall be installed; provided however, that in the event all
required improvements have not been made by June 1 , 1978, the temporary
occupancy approval shall become null and void.
A roll call vote on the foregoing resolution resulted in the following:
AYES: Friedrichs, DuBose, Zimmer, Morrow, Wisler, Andrew
NAYS: Kluver, Scurto, Falk
ABSENT: None
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs. Scurto, seconded by Mr. Morrow and unanimously adopted,
it was
#1-19-78 RESOLVED that, pursuant to Ordinance #29 of the City of Livonia, as
amended by Ordinance #50, the City Planning Commission does hereby
establish and order that a public hearing be held to determine whether
or not a water main easement and a sanitary sewer easement located on
the south side of St. Martins Avenue, west of Purlingbrook in the
Southeast 1/4 of Section 2, should be vacated.
FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Ordinance #29 of the City of Livonia, as amended by Ordinance #50.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs. Scurto, seconded by Mr. DuBose and unanimously adopted,
it was
#1-20-78 RESOLVED that, the City Planning Commission pursuant to Section 23.01 (b)
of Ordinance #543, the Zoning Ordinance of the City of Livonia, does
hereby establish and order that a public hearing be held to determine
whether or not to rezone property located on the east side of Newburgh
Road, south of the 1-96 Freeway in the Northwest 1/4 of Section 29, from
M-1 to M-2.
FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
Livonia, as amended.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Morrow and seconded by Mrs. Wisler, it was
#1-21-78 RESOLVED that, the City Planning Commission pursuant to Section 23.01 (b)
of Ordinance #543, the Zoning Ordinance of the City of Livonia, does

IL hereby establish and order that a public hearing be held to determine
whether or not to rezone property located on the west side of Levan
Road, south of the 1-96 Freeway in the Northwest 1/4 of Section 29,
from M-1 to M-2.
FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
Livonia, as amended.
A roll call vote on the foregoing resolution resulted in the following:
AYES: Kluver, Friedrichs, DuBose, Scurto, Falk, Morrow, Wisler, Andrew
NAYS:
ABSTAIN: Zimmer
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. DuBose, seconded by Mrs . Wisler and unanimously adopted,
it was
#1-22-78 RESOLVED that, the City Planning Commission pursuant to Section 23.01 (b)
of Ordinance #543, the Zoning Ordinance of the City of Livonia, does
hereby establish and order that a public hearing be held to determine
whether or not to amend Section 11 .03, Waiver Uses within the C-2 Zoning
District, by amending the present standards and adding new standards for
Gasoline Service Stations; Restaurants; New and Used Car Lots and Show-
rooms, New or Used Mobile Home Sales; Open-air Sales, display and/or
rental of utility trailers and travel trailers; and Buildings of 30,000
square feet or more.

FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
Livonia, as amended.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs. Wisler, seconded by Mr. DuBose and unanimously adopted,
it was
#1-23-78 RESOLVED that, the City Planning Commission pursuant to Section 23.01 (b)
of Ordinance #543, the Zoning Ordinance of the City of Livonia, does
hereby establish and order that a public hearing be held to determine
whether or not to amend Section 19.06, General Waiver Requirements and
General Standards, Paragraph (c) , by adding additional standards for the
storage of refuse and screening of mechanical equipment.
FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
Livonia, as amended.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.

#1-24-78 RESOLVED that, the City Planning Commission pursuant to Section 23.01 (b)

of Ordinance #543, the Zoning Ordinance of the City of Livonia, does
hereby establish and order that a public hearing be held to determine
whether or not to amend Section 10.03, Waiver Uses within the C-1 Zoning
District, by adding paragraph (h) to establish controls for buildings
of 30,000 square feet or more.
FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of
Livonia, as amended.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made, seconded and unanimously adopted, the 348th Regular Meeting
held by the City Planning Commission on Tuesday, January 31 , 1978,
was adjourned at 8:50 p.m.
