HomeMy WebLinkAboutPLANNING MINUTES 1977-08-30 6494 MINUTES OF THE 310th REGULAR MEETING HELD BY THE CITY PLANNING COMMISSION 4 OF THE CITY OF LIVONIA On Tuesday, August 30, 1977 the City Planning Commission of the City of Livonia held its 340th Regular Meeting in the Livonia City Hall , 33001 Five Mile Road, Livonia, Michigan. Mr. Daniel R. Andrew, Chairman , called the meeting to order at 8:00 p.m. Members present: Daniel R. Andrew Herman H. Kluver Esther Friedrichs Suzanne Wisler Judith Scurto Jerome Zimmer William DuBose Robert L. Morrow Members absent : Joseph J. Falk (Vacation) Messrs. John J. Nagy, Planning Director; Ralph H. Bakewell , Planner IV; and Robert M. Feinberg, Assistant City Attorney, were also present. Mr. Andrew informed the audience that if a petition on tonight 's agenda involves a question of rezoning or vacating, this Commission only makes recommendations to the City Council and the City Council after holding a public hearing makes the final determination as to whether a petition is approved or denied, and if a petition requesting a waiver of use approval is denied, the petitioner has ten days in which to appeal the decision to. the City Council . Mrs . Friedrichs , Secretary, announced the first item on the agenda is Petition 77-7-2-14 by Comm-Auto Brake Center, Inc. , requesting waiver use approval to use existing building located on the northeast corner of Plymouth and Merriman Roads in the Southwest 1/4 of Seczion 26, for automobile 4 repair service. On a motion duly made by Mrs. Wisler, seconded by Mrs. Scurto and unanimously adopted, it was #8-131-77 RESOLVED that , pursuant. to a public hearing having been held on August 16, 1977 on Petition 77-7-2-14 as submitted by Comm-Auto Brake Center, Inc. , requesting waiver use approval to use existing building located on the northeast corner of Plymouth and Merriman Roads in the Southwest 1/4 of Section 26, for automobile repair service, the City Planning Commission does hereby determine to table Petition 77-7-2-14 until the Study Meeting to be conducted on September 13, 1977. FURTHER RESOLVED that, notice of the above Public Hearing was sent to property owners within 500 feet, petitioner and City Departments as listed in the Proof of Service. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. Mrs . Friedrichs, Secretary, announced the next item on the agenda is Petition 77-7-2-15 by Brightmoor Tabernacle requesting waiver use approval to construct a new Church and Church school building on property located on the north side of Six Mile Road, east of Wayne Road in the Southwest 1/4 of Section 9. Wisler, seconded by Mrs. Scurto and unanimously adopted, • 4 It was ' 6495 I' n-182-77 RESOLVED that, pursuant to a Pul' iic Hearing having been held on August 16, 1977 on Petition 77-7-2-15 as submitted by Brightmoor Tabernacle requesting waiver use approval to construct a new Church and church school building on property located on the north side of Six Mile Road, east of Wayne Road in the Southwest 1/4 of Section 9, the City Planning Commission does hereby determine to table Petition 77-7-2-15 until the Study Meeting to be conducted on November 15, 1977. FURTHER RESOLVED that, notice of the above Public Hearing was sent to property owners within 500 feet , petitioner and City Departments as listed in the Proof of Service. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. Mrs. Friedrichs, Secretary, announced the next item on the agenda is a letter dated 7/28/77 from Rodney C. Kropf, Attorney, requesting an extension of time with regard to Condition #5 in connection with the approval of Petition 71-5-2-18 by Rodney C. Kropf, Attorney for Sam and Joy Moy, requesting waiver use approval to expend the existing restaurant located on the west side of Middlebelt Road between Munger and Six Mile Road in the Northeast 1/4 of Section 14. On a motion duly made by Mr. Zimmer, seconded by Mrs. Scurto and unanimously adopted, it was RESOLVED that, pursuant to a letter dated 7/28/77 from Rodney C. Kropf, Attorney, the City Planning Commission does hereby determine to grant an extension of time until June 1 , 1978 with regard to Condition #5 t #8_183_77 concerning removal of the existing residential structure located on Lot 38A in connection with the approval of Petition 71-5-2-18 as sub- mitted by Rodney C. Kropf, Attorney for Sam and Joy Moy, requesting waiver use approval to expand the existing restaurant located on the west side of Middlebelt Road between Munger and Six Mile Road in the Northeast 1 /4 of Section 14; such extension being subject to the enclosure of the trash dumpster located at the rear of the restaurant facility, said enclosure to be constructed of materials matching those used on the principal buil :linn and the location of subject enclosed dumpster being subject to approval the Planning Department; and further, that enclosure of the dumpster =1 be accomplished by a date no later than November 1 , 1977. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. Mrs. Friedrichs , Secretary, announced the next item on the agenda is a motion by the City Planning Commission to hold a public hearing to determine whether or not to amend Part V of the Master Plan of the City of Livonia, the Master School and Park Plan, so as to delete property located on the northeast corner of Middlebelt Road and West Chicago in Section 36. On a motion duly made by. Mrs. Scurto, seconded by Mrs . Wisler and unanimously adopted, it was #8-184-77 RESOLVED that, pursuant to the provisions of Act 285 of the Public Acts 3 s of Michigan of 1931 , as amended, the City Planning Commission does hereby establish and order that a public hearing be held to determine whether or not to amend Part V of the Master Plan of the City of Livonia, the Master School and Park Plan, so as to delete property located on the north- east corner of Middlebelt Road and West Chicago in Section 36. • 6496 If: AND that, notice of time and place of said hearing shall be published in a newspaper of general circulation in the City of Livonia and a notice by registered United" States mail shall be sent to each public utility or railroad company owning or operating any public utility or railroad within the City of Livonia in accordance with the provisions of Act 285 of the Public Acts of Michigan of 1931 , as amended. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. DuBose, seconded by Mr. Morrow and unanimously adopted, it was #8-185-77 RESOLVED that, pursuant to Section 18.47 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended by Ordinance #990, the City Planning Commission does hereby recommend to the City Council that Petition 77-8-8-16 as submitted by Eugene Pulice requesting approval of all plans required by Section 18.47 in connection with a proposal to construct additions to one existing building and remodel one existing building located on the north side of Five Mile Road between Loveland and Mayfield in Section 15, be approved subject to the granting by the Zoning Board of Appeals of a variance of 15 parking units and subject to the following conditions: (1) that Site Plan, Sheet I , dated 8/1/77, prepared by M. F. Milewski , which is hereby approved, shall be adhered to; (2) that Building Elevations as shown on Sheets 2 and 3, dated 6/14/77, a and Sheet 4, dated 7/22/77, which are hereby approved, shall be adhered to; (3) that Landscape Plan #L-1 , dated 7/22/77, which is hereby approved, shall be adhered to; (4) that plans for any proposed free-standing signs or signs proposed to be attached to the building shall be submitted to the City Planning Commission for approval ; and (5) that there shall be traffic control signs placed at the two driveways connecting with the side streets of Mayfield and Loveland so as to prohibit traffic from turning north and burdening the local residential streets. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. Mr. Andrew, Chairman, announced that the next item on the agenda, a Sign Design Plan submitted in connection with a condition of approval of Petition 77-2-2-1 by Diehl & Diehl , Architects for St. Edith . Parish, requesting waiver use approval to construct a home for senior citizens on the south side of Five Mile Road between Blue Skies and Newburgh Road in the Northeast ,1/4 of Section 19, is removed from the agenda.
