HomeMy WebLinkAboutPLANNING MINUTES 1977-08-09F • MINUTES OF THE. 318th SPECIAL MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA 3 On Tuesday, August 9, 1977 the City Planning Commission of the City of Livonia held its 318th Special Meeting in the Engineering Building, 13325 Farmington Road, Livonia, Michigan. Mr. Daniel R. Andrew, Chairman , called the meeting to order at 10: 15 p.m. Members present: Daniel R. Andrew Jerome Zimmer Esther Friedrichs Suzanne T. Wisler Robert L. Morrow William Dubose Joseph .J. Falk Members absent: Herman H. Kluver Judith A. Scurto (vacation) Messrs. John J . Nagy, Planning Director; H G Shane, Assistant Planning Director; and Ralph H. Bakewell , Planner IV, were also present. On a motion duly made by Mr. Zimmer, seconded by Mr. Falk and unanimously adopted, it was #8-161-77 RESOLVED that, the City Planning Commission does hereby determine to remove from the table Petition 77-4-2-7 by Jeanne Hildebrandt, General Manager of the Livonia Mall , requesting waiver use approval to construct a Denny's Restaurant on the southwest corner of the parking lot of the Livonia Mall Shopping Center located on the north- west corner of Seven Mile and Middlebelt Roads in the Southeast 1/4 of Section 2. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mrs. Wisler and seconded by Mr. Falk, it was #8-162-77 RESOLVED that, pursuant to a public hearing having been held on June 7, 1977 on Petition 77-4-2-7 as submitted by Jeanne Hildebrandt, General Manager of. the Livonia Mall , requesting waiver use approval to construct a Denny's Restaurant on the southwest corner of the parking lot of the Livonia Mall Shopping Center located on the north- west corner of Seven Mile and Middlebelt Roads in the Southeast 1/4 of Section 2, the City Planning Commission does hereby recommend to the City Council that Petition 77-4-2-7 be denied for the following reasons: (1) The proposed use is in conflict with Article XIII of Zoning Ordinance #543, Parking District Regulations., in that the proposed use encroaches upon an area presently zoned in a parking classification. (2) The proposed use and related development is in conflict with Section 18.37, subsection (o) of Zoning Ordinance #543, in that the layout of offstreet parking facilities is not in accord with the minimum standards as provided and as set forth in the schedule as shown in the Ordinance. 1116: 4'//Lfl 110 (3) The proposed use conflicts with the comprehensive Thoroughfare Plan of the City of Livonia in that a portion of the subject site is planned to be used for the implementation of a ring road to service the northwest quadrant of the Livonia Mall Shopping area. (4) The proposed use is in conflict with Section 19.06, General Waiver Requirements, and the general standards of Zoning Ordinance #543 as they relate to the proposed use. (5) The proposed use will not promote the orderly growth and development of the surrounding area as it would tend to encourage the further conversion of ajoining lands for other satelite commercial uses which would be detrimental to the surrounding area and detract from the overall development. (6) The proposed use is not consistent with sound planning principles , particularly traffic flow, in that the intensity of the proposed commercial use with its related traffic flow and turning movements in connection therewith would conflict with the major point of ingress and egress to the Livonia Mall Shopping Center which would be hazardous to the free flow of traffic within the area. FURTHER RESOLVED that, notice of the above Public Hearing was sent to property owners within 500 feet, petitioner and City Departments as lile listed in the Proof of Service. A roll call vote on the foregoing resolution resulted in the following: f AYES: DuBose, Zimmer, Falk, Morrow, Wisler, Andrew NAYS: Friedrichs ABSENT: Kluver, Scurto Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Zimmer, seconded by Mr. Falk and unanimously adopted, it was #8-163-77 RESOLVED that, the City Planning Commission does hereby determine to remove from the table Petition 77-5-1-13 by Dr. Michael K. Nicola to rezone property located on the northeast corner of Schoolcraft Road and Ellen Drive in the Southwest 1/4 of Section 21 , from R-2 to P.S. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Zimmer and seconded by Mr. Falk, it was #8-164-77 RESOLVED that, pursuant toa public hearing having been held on July 12, 1977 on Petition 77-5-1-13 as submitted by Dr. Michael K. Nicola to rezone property located on the northeast corner of School- tecraft Road and Ellen Drive in the Southwest 1/4 of Section 21 , from R-2 to P.S. , the City Planning Commission does hereby recommend to the City Council that Petition 77-5-1-13 be denied for the following reasons: 64445- (1 ) The proposed change of zoning is in conflict with the adopted Future Land Use Plan. (2) The proposed change of zoning is unrelated to and not compatible with any of the established or surrounding uses of the area as residential uses and/or zoning adjoins the area on all three sides. (3) The area under petition represents spot zoning in that the area under petition is of limited size. (4) The proposed use is not related to and incompatible with the established residential uses of the area. (5) The proposed rezoning would not promote the orderly growth and development of the surrounding area but would tend to encourage the further conversion of adjoining lands to nonresidential uses which would be detrimental to the established residential neighbor- hoods to the north, east and west and inconsistent with the adopted goals and policies as part of the Future Land Use Plan of the City of Livonia. FURTHER RESOLVED that, notice of the above Public Hearing was published in the official newspaper, the Livonia Observer, under date of June 23, 1977 and a notice of such hearing was sent to the Detroit Edison Company, Chesapeake & Ohio Railway Company, Michigan Bell Telephone Company, Con- sumers Power Company and City Departments as listed in the Proof of Service. A roll call vote on the foregoing resolution resulted in the following: AYES: Zimmer, Falk, Morrow, Wisler, Andrew NAYS: Friedrichs, DuBose ABSENT: Kluver, Scurto Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Zimmer, seconded by Mr. Falk and unanimously adopted, it was #8-165-77 RESOLVED that, pursuant to Section 23.01 (b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, the City Planning Commission does hereby, establish and order that a public hearing be held to determine whether or not to amend Section 18.24, Accessory Buildings, of Ordinance #543 so as to provide controls on heights of detached garages and accessory buildings. FURTHER RESOLVED that, a hearing be held and notice given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. i On a motion duly made by Mrs. Wisler, seconded by Mrs. Friedrichs and unanimously adopted, it was G`LL #8-166-77 RESOLVED that, the City Planning Commission does hereby approve the �, Capital Improvement Program 1978-1983 for the City of Livonia as prepared by the City Planning Department and its submission to the Mayor and City Council . Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
