MINUTES OF THE 3?Gth REGULAR MEETING
HELD BY THE CITY PLANNING COMMISSION
OF THE CITY OF LIVONIA
On Tuesday, July 26, 1977, the City Planning Commission of the City of Livonia held
IL its 338th Regular Meeting in the Livonia City Hall , 33001 Five Mile Road, Livonia,
Michigan.
Mr. Daniel R. Andrew, Chairman, called the meeting to order at 8:00 p.m.
Members present: Daniel R. Andrew Joseph J . Falk Esther Friedrichs
Suzanne Wisler Judith Scurto ' Lee Morrow
Jerome Zimmer
Members absent: *William DuBose Herman Kluver
On a motion duly made by Mrs . Wisler., seconded by Mr. Zimmer and unanimously adopted,
it was
#7-150-77 RESOLVED that, the City Planning Commission does hereby determine
to remove from the table Petition 77-6-1-18 by Lionel E. LaMay
to rezone property located on the south side of Plymouth Road
between Levan Road and Edward Hines Drive in the Northwest 1/4
of Section 32, from RUF to C-2 and P.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Zimmer, seconded by Mrs . Wisler and unanimously adopted,
it was
#7-151-77 RESOLVED that, pursuant to a Public Hearing having been held on
July 12, 1977 on Petition 77-6-1-18 as submitted by Lionel E.
LaMay to rezone property located on the south side of Plymouth
Road between Levan Road and Edward Hines Drive in the Northwest
1/4 of Section 32, from RUF to C-2 and P, the City Planning Com-
mission does hereby recommend to the City Council that Petition
77-6-1-18 be approved for the following reasons:
(1) This zoning request will provide for a more orderly and
appropriate development of commercial parking facilities.
(2) This request will provide a more appropriate zoning classi-
fication consistent with the existing use of a portion of
the property in question, thus removing its nonconforming
use status.
(3) This rezoning will not adversely affect adjacent residential
property in that there is sufficient control through the site
plan approval process to provide for necessary buffering,
aesthetics and traffic control .
(4) The limited use allowed by the Zoning Ordinance with respect to
the P, Parking., classification will prevent the further expansion
lib:IV of commercial buildings, thus providing a buffer zone to adjacent
residential properties.

IL ' FURTHER RESOLVED that, notice cf the above Public Hearing was published
in the official newspaper, the Livonia Observer, under date of June 27,
1977, and a notice of such hearing was sent to the Detroit Edison Company,
Consumers Power Company and City Departments as listed in the Proof of
Service.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs . Wisler, seconded by Mrs. Friedrichs and unanimously adopted,
it was
#7-152-77 RESOLVED that, pursuant to Ordinance #29 of the City of Livonia, as
amended by Ordinance #50, the City Planning Commission does hereby
establish and order that a public hearing be held to determine whether
or not the portion of Parkdale Avenue located south of Plymouth Road
between Levan Road and Edward Hines Drive in the Northwest 1/4 of
Section 32, should be vacated.
FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Ordinance #29 of the City of Livonia, as amended by Ordinance #50.
Mr. Andrew, Chairman , declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs. Scurto, seconded by Mrs. Wisler and unanimously adopted,
it was
#7-153-77 RESOLVED that, the City Planning Commission does hereby determine
to remove from the table Petition 77-6-1-19 by Raymond Chopp to
rezone property located on the north side of Parkdale between
Raleigh and Ann Arbor Road in the Northwest 1/4 of Section 32,
from RUF to C-2.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
*Mr. DuBose entered the meeting at 8:20 p.m.
On a motion duly made by Mrs. Scurto and seconded by Mrs . Wisler, it was
#7-154-77 RESOLVED that, pursuant to a Public Hearing having been held, on
July 12, 1977 on Petition 77-6-1-19 as submitted by Raymond Chopp '
to rezoning property located on the north side of Parkdale between
Raleigh and Ann Arbor Road in the Northwest 1/4 of Section 32, from
RUF to C-2, the City Planning Commission does hereby recommend to
the City Council that Petition 77-6-1-19 as amended by letter dated
July 22, 1977 from the petitioner be approved only to the extent that
the portion of property legally described as follows be rezoned from
RUF to C-2:
The northerly 145 feet of Lots 14 & 15 of "Schaffmasters Plymouth
Riverside Estates Sub." of part of the N. 1/2 of Section 32, T. 1 S. ,
R. 9 E. , Livonia Twp. , now the City of Livonia, Wayne County, Michigan.
and that the balance of the property covered in the original legal
description remain in the RUF Zoning Classification;
for the following reasons :
(1) This change in zoning represents a minor extension of a commercial

t • district which will provic'e for more orderly development
of the adjacent commercial facilities.
(2) This change in zoning will not be detrimental to the adjacent
residential neighborhood in that it will provide for a sub-
stantial upgrading of existing commercial facilities.
(3) Subject lots will not support good quality residential develop-
ment due to their location.
FURTHER RESOLVED that, notice of the above Public Hearing was published
in the official newspaper, the Livonia Observer, under date of June 23,
1977, and a notice of such hearing was sent to the Detroit Edison Company,
Consumers Power Company and City Departments as listed in the Proof of
Service.
A roll call vote on the foregoing resolution resulted in the following:
AYES: DuBose, Scurto, Falk, Morrow, Friedrichs , Wisler, Andrew
NAYS: Zimmer
ABSENT Kluver
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs. Scurto, seconded by Mr. DuBose and unanimously adopted,
it was
IlLe #7-155-77 RESOLVED that, pursuant to Ordinance. #29 of the City of Livonia , as
amended by Ordinance #50, the City Planning Commission does hereby
establish and order that a public hearing be held to determine whether
or not a 12-foot wide drainage easement located across Lot #128 of
Green Brier Estates Subdivision No. 2 in the Northwest l/4 of Section
15, should be vacated.
FURTHER RESOLVED that, notice of such hearing shall be given as provided
in Ordinance #29 of the City of Livonia, as amended by Ordinance #50.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mrs. Wisler, seconded by Mr. DuBose and unanimously adopted,
it was
#7-156-77 RESOLVED that, the City Planning Commission does hereby approve the
Entrance Marker Design Plan for Blue Grass Estates Subdivision
subject to adherence to the Design Plan as shown on the approved
Preliminary Plat #6079, revised date 5/20/77, and further that the
Greenbelt Design Plan for Blue Grass Estates Subdivision is hereby
approved subject to adherence to Plan #6079 dated 6/15/77•
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. DuBose, seconded by Mr. Falk and unanimously adopted,
it was
#7-157-77 RESOLVED that, the City Planning Commission does hereby approve
the Final Plat for Blue Grass Estates Subdivision proposed to
be located on the west side of Newburgh Road, north of Ladywood
in the East 1/2 of Section 18, for the following reasons:

(1) The Final Plat conforms to the previously approved
Preliminary Plat.
(2) The Engineering Division recommends approval of the
Final Pit.
(3) The Final Plat conforms to the Subdivision Rules and
Regulations and Zoning Ordinance #543 of the City of
Livonia.
(4) All of the financial obligations imposed upon the
proprietor by Council Resolution #563-77 have been
complied with.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. DuBose, seconded by Mr. Falk and unanimously adopted,
it was
#7-158-77 RESOLVED that, the City Planning Commission does hereby waive the
provisions of Section 10 of the Planning Commission Rules of Pro-
cedure with regard to the effective date of resolutions being seven
days after adoption of such resolutions and determines to transmit
Resolution #7-157-77 wherein Final Plat approval is given Blue Grass
Estates Subdivision to the City Council immediately.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
On a motion duly made by Mr. Zimmer and seconded by Mrs. Wisler, it was
RESOLVED that, the City Planning Commission does hereby determine
to remove from the table Petition 77-4-2-7 by Jeanne Hildebrandt,
General Manager of the Livonia Mall , requesting waiver use approval
to construct a Denny's Restaurant on the southwest corner of the
parking lot of the Livonia Mall Shopping Center located on the
northwest corner of Seven Mile and Middlebelt Roads in the Southeast
1/4 of Section 2.
Upon withdrawal by Mrs . Wisler of her second to the above motion, Mr. Andrew, Chairman ,
declared the tabling status of Petition 77-4-2-7 continued.
On a motion duly made by Mrs . Scurto, seconded by Mr. Falk and unanimously adopted,
it was
#7-159-77 RESOLVED that, the City Planning Commission does hereby determine
to remove from the table Petition 77-6-8-12 by RoweSign Company
requesting approval of all plans required by Section 18.47 of Ordinance
#543, as amended by Ordinance #990, submitted in connection with a pro-
posal to erect three wall signs on an existing building located on the
south side of Six Mile Road between Newburgh Road and Fitzgerald in
Section 17.

#7-160-77 RESOLVED that, pursuant to Section 18.47 of Ordinance #543, the
Zoning Ordinance of the City of Livonia, as amended by Ordinance
#990, the City Planning Commission does hereby recommend to the
City Council that Petition 77-6-8-12 as submitted and amended by
PoweSign Company requesting approval of all plans required by
LSection 18..47 in connection with a proposal to erect two wall signs
on an existing building located on the south side of Six Mile Road
between Newburgh Road and Fitzgerals in Section 17, be denied for the
following reasons:
(1) The two additional wall signs would detract from the overall
aesthetic qualities of the Shopping Center.
(2) The proposal to add two wall signs represents an excessive
amount of sign coverage for the use intended.
(3) To allow two wall signs for the intended promotional display
would only encourage other tenants to seek similar sign dis-
plays for their development promotional schemes, all of which
would be distractive to the quality and character of the Center
and to allow a sign display for one tenant and deny others
would place the Planning Commission in an indefensible position.
Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopte

held by the City Planning Commission on July 26, 1977, was adjourned
at 9:05 p.m.
