HomeMy WebLinkAboutPLANNING MINUTES 1976-09-28 6173 MINUTES OF THE 321st REGULAR MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, September 28, 1976 the City Planning Commission of the City of Livonia held •ts 321st Regular Meeting in the Engineering Building, 13325 Farmington Road, Livonia, 1600 Michigan. Mr. Daniel R. Andrew, Chairman, called the meeting to order at 8:00 p.m. Members present: Daniel R. Andrew Joseph J. Falk Esther Friedrichs Herman H. Kluver Jerome Zimmer Suzanne T. Wisler Judith Scurto Members absent: *William DuBose *William Scruggs Messrs. John J. Nagy, Planning Director; H G Shane, Assistant Planning Director; Ralph H. Bakewell , Planner IV; and Robert M. Feinberg, Assistant City Attorney, were also present. On a motion duly made by Mr. Zimmer, seconded by Mr. Kluver and unanimously adopted, it was #9-177-76 RESOLVED that, pursuant to a letter dated August 10, 1976 from Edward J. McNeely, the City Planning Commission does hereby determine to waive the open space requirements of Section 9.09 of the Subdivision Rules and Regulations as they relate to Blue Grass Estates Subdivision pro- IriI4'10" posed to be located on the west side of Newburgh Road, north of Lady- wood in the East 1/2 of Section 18, for the following reasons: (1) There is already sufficient lands to provide this area with adequate open space for park, recreation and open space purposes. (2) The size of the area that would accrue as a result of the development of the subdivision is not of sufficient size to have practical meaning to the subdivision and the maintenance of such a small open space area would burden the Parks and Recreation Department. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Kluver, seconded by Mr. Falk and unanimously adopted, it was #9-178-76 RESOLVED that, pursuant to a Public Hearing having been held on August 24, 1976, the City Planning Commission does hereby recom- mend to the City Council that the Preliminary Plat for Blue Grass Estates Subdivision proposed to be located on the west side of Newburgh Road, north of Ladywood in the East 1/2 of Section 18 be approved subject to the following conditions: (1) that a landscape greenbelt plan will be presented to the (6110 Planning Commission for its approval of the greenbelt area proposed along Newburgh Road before submittal of the final plat; and 4 (2) that the subdivision will be provided with entrance markers the design and plan of which shall be subject to Planning i 6174 (* ii Commission approval , all of which shall occur before submittal of the final plat. for the following reasons : (1) The proposed plat complies with the R-3 Zoning District regula- tions and the Subdivision Rules and Regulations, the open space requirement having been waived by the City Planning Commission. (2) The proposed preliminary plat has received favorable comments for approval from reporting City Departments. (3) The proposed preliminary plat is well designed and laid out so as to provide for an attractive, convenient and livable single-family residential development. AND THAT, the City Planning Commission does hereby recommend the waiving of the open space provisions of the Plat Ordinance, Section 9-116(p) of the Livonia Code of Ordinances, inasmuch as there is already sufficient lands to provide this area with adequate open space for park, recreation and open space purposes. FURTHER RESOLVED that, notice of the above hearing was sent to the abutting property owners, proprietor, City Departments as listed in the Proof of Service and copies of the plat together with notice have been sent to the Building Department, Superintendent of Schools, 4 Fire Department, Police Department and Parks and Recreation Department. Hr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. 4 On a motion duly made by Mr. Kluver, seconded by Mrs. Wisler and unanimously adopted, 1[00 i t was #9-179-76 RESOLVED that, purusant to a Public Hearing having been held on August 24, 1976 on Petition 76-7-1-28 as submitted by R. William and Paula Ellen Joyner to rezone property located on the west side of Gill Road, north of Curtis in the Northwest 1/4 of Section 9, from RUFB to R-3, the City Planning Commission does hereby recom- mend to the City Council that Petition 76-7-1-28 be approved for the following reasons: (1) The proposed change of zoning is a minor extension of an already existing R-3 Zoning District located to the north. (2) The proposed change of zoning will provide for single-family lot development consistentwith the recentresidential development occurring within the neighboring area. FURTHER RESOLVED that , notice of the above Public Hearing was published in the official newspaper, the Livonia Observer-Eccentric, under date of August 5, 1976 and a notice of suchhearing was sent - to the Detroit Edison Company, Chesapeake & Ohio Railway Company, Michigan Bell Telephone Company, Consumers Power Company and City Departments as listed in the Proof of Service. +lr. On a motion duly made by Mrs. Scurto and seconded by Mrs. Friedrichs , it was '#9-180-76 RESOLVED that, pursuant to a Public Hearing having been held on August 24, 1976 on Petition 76-5-2-8 as submitted by John W. Cossin, Pastor of The Lords House, requesting waiver use approval to con- struct an addition to an existing Church located on the north side of Ann Arbor Trail , east of Newburgh Road in the Northwest 1/4 of Section 32, the City Planning Commission does hereby recommend to the City Council that Petition 76-5-2-8 be approved subject to the following conditions: (1) that Site Plan #S-1 , dated 9/16/76, prepared by Harold E. Eskovitz, which is hereby approved, shall be adhered to in all respects; (2) that the building materials for the proposed Church addition shall conform to those materials as specified on the approved Site Plan; (3) that the. hours of operation of the Church and all related and accessory uses thereto shall be limited in hours of operation not to exceed 11 :00 p.m. , and that there shall not be more than two persons manning the telephones in connection with the Crisis Program; (4) that the proposed Church assembly hall shall be furnished with fixed seats, permanently secured, so as to establish the max- imum seating capacity of the Church at 594 seats ; (5) that any outdoor lighting fixtures, standards, etc. , proposed for either the site of the proposed building or the offstreet parking lot shall have the design of the fixture and standard first approved by the City Planning Commission before their construction and installation, and that all outdoor lighting shall be serviced by an underground wiring system; (6) that the offstreet parking lot shall be permanently improved with a hard-surfaced material such as asphalt, completionto occur within sixty (60) days after completion of the Livonia Drain #29 project; (7) that the lease agreement that the Church has for its offstreet parking lot area shall be prepared in recordable form and registered with the Wayne County Register of Deeds and a copy of the recorded instrument submitted to the Livonia City Planning Department within ten (10) days of the date of this resolution; (8) that a landscape plan setting forth the landscape treatment of the site shall be submitted to the Planning. Commission for approval within thirty (30) days of the date of this resolution ; and (9) that the petitioner shall , with the approval of the owner of Lot a735, Supervisor's Livonia Plat No. 12, cause a sidewalk to be installed across the frontage of said lot at the sole cost and expense of the petitioner and which installation shall be made simultaneously with the petitioner's sidewalk constructed along Newburgh Road as shown on the approved Site Plan. for the following reasons: 6176 (1) The proposed use, to a large extent, is already fully developed on the property, therefore, the petition proposes to make what is a nonconforming use, a conforming use. (2) Theproposed use with its associated development plans will provide for the regulating and redevelopment of the property so as to upgrade the existing development by way of improved architecture, offstreet parking and site landscaping to achieve a greater degree of compati- bility and harmony with the surrounding development of the area. (3) All responding City Departments have found no adverse affects assoc- iated with the proposed use. FURTHER RESOLVED that, notice of the above Public Hearing was sent to property owners within 500 feet, petitioner and City Departments as listed in the Proof of Service. A roll call vote on the foregoing resolution resulted in the following: AYES: Friedrichs , DuBose, Scurto, Scruggs, Wisler NAYS: Kluver, Zimmer, Falk, Andrew ABSENT: None '1r. Andrew stated that his reason for voting no on this petition is that it does not meet :he requirements of Section 4.03(a) of the Zoning Ordinance #543 in that the Church is located on land less than two acres in size. 1r. On a motion duly made by Mr. Kluver, seconded by Mr. Falk and unanimously adopted, it was #9-181-76 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 (b) of Ordinance #543, the Zoning, Ordinance of the City of Livonia, as amended, does hereby establish and order that a Public Hearing be held to determine whether or not to rezone property located on the north side of Broadmoor between Middlebelt Road and Harrison in the Southwest 1/4 of Section 13, from RUF to P.L; and FURTHER RESOLVED that, notice of such hearing be given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Kluver, seconded by Mr. Falk and unanimously adopted, it was 9-182-76 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 (b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, does hereby establish and order that a Public 4 Hearing be held to determine whether or not to rezone property located on the south side of Puritan between Henry Ruff and Middlebelt 6177 Road in the Southeast 1/4 of Section 14, from RUF to P.L. ; and FURTHER RESOLVED that, notice of such hearing be given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Kluver, seconded by Mr. Falk and unanimously adopted, it was #9-183-76 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 (b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, does hereby establish and order that a Public Hearing be held to determine whether or not to rezone property located on the east side of Henry Ruff between Five Mile Road and Jamison in the Northeast 1/4 of Section 23, from RUFA to P.L. ; and FURTHER RESOLVED that, notice of such hearing be given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr, Kluver, seconded by Mr. Falk and unanimously adopted, Ai t was #9-184-76 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 (b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, does hereby establish and order that a Public Hearing be held to determine whether or not to rezone property located on the north side of Lyndon between Middlebelt Road and Harrison in the Northwest 1/4 of Section 24, from RUF to P.L. ; and FURTHER RESOLVED that, notice of such hearing be given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended. ,Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a moition duly made by Mr. Kluver, seconded by Mr. Falk and unanimously adopted, it was #9-185-76 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 (b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, does hereby establish and order that a Public Hearing be held to determine whether or not to rezone property located on the south side of Lyndon between Harrison and Inkster Road in the South 1/2 of Section 24, from R-1-A to P.L. ; and to' FURTHER RESOLVED that, notice of such hearing be given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended. fir. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. 6178 On a motion duly made by Mr. Kluver, seconded by Mr. Falk and unanimously adopted, it was #9-186-76 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 (b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, does hereby establish and order that a Public Hearing be held to determine whether or not to rezone property located north of Schoolcraft Road between Melvin and Beatrice in the Southeast 1/4 of Section 23, from R-1-A to P.L; and FURTHER RESOLVED that, notice of such hearing be given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mrs. Scurto and seconded Mr. Zimmer, it was #9-187-76 RESOLVED that,. the minutes of the 319th Regular Meetingheld by the City Planning Commission on August 24, 1976, are approved. A roll call vote on the foregoing resolution resulted in the following: AYES: Friedrichs, DuBose, Zimmer, Scurto, Scruggs , Wisler, Andrew NAYS: None ABSENT: None ABSTAIN: Kluver, Falk kr. On a motion duly made by Mrs. Scurto and seconded by Mr. DuBose, it was #9-188-76 RESOLVED that, the minutes of the 312th Special Meeting held by the City Planning Commission on August 31 , 1976, are approved. A roll call vote on the foregoing resolution resulted in the following: AYES: Kluver, Friedrichs, DuBose, Zimmer, Scurto, Falk, Scruggs, Andrew NAYS.: None ABSENT: None ABSTAIN: Wisler Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Scurggs , seconded by Mr. Kluver and unanimously adopted, it was #9-189-76 RESOLVED that, the City Planning Commission does hereby approve the Landscape Plan submitted by Patrick O'Hara in connection with a con- dition of approval_ of Petition 74-1.0-8-41P requesting approval of all plans required by Section 18.58 of Ordinance #543, the Zoning Ordinance, as amended by Ordinance #988, in connection with a proposal to construct an office building on the south side of Plymouth Road between Eckles and Newburgh Roads in Section 30, subject to the following conditions: (1) that Landscape Plan dated September 28, 1976, which is hereby approved, shall be adhered to; 6179 (2) that all landscaping as shown on the approved Landscape Plan shall be installed prior to October 31 , 1976 and shall there- after be maintained in a healthy condition; and (3) that the sign plan proposed by the petitioner is accepted in principle by the Planning Commission; the exact square footage to be determined by the Bureau of Inspection. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted. On a motion duly made by Mr. Kluver, seconded by Mrs. Friedrichs and unanimously adopted, it was #9-190-76 RESOLVED that, pursuant to Section 18.58 of Ordinance #543, the Zoning Ordinance, as amended by Ordinance #988, the City Planning Commission does hereby determine to table Petition 76-9-8-19P by Philip Gerard requesting approval of all plans required by Section 18.58 submitted in connection with a proposal to construct an addition to an existing building located on the south side of Schoolcraft between Eckles and Newburgh in Section 19, until the Planning Commission Study Meeting to be conducted on October 5, 1976. Mr. Andrew, Chairman, declared the motion is carried and the foregoing resolution adopted.
