MINUTES OF THE 278th REGULAR MEETING
HELD BY THE CITY PLANNING COMMISSION

On Tuesday, July 9 , 1974 , the City Planning Commission of the City
I:
of Livonia, held its 278th Regular Meeting and a Public Hearing
at the Livonia City Hall, 33001 Five Mile Road, Livonia, Michigan.
Mr. Daniel R. Andrew, Chairman called the Public Hearing and Regular
Meeting to order at 8 :10 p.m. , with approximately 25 interested
persons in the audience.
Members Present: Daniel R. Andrew Joseph J. Talbot

Herman Kiuver William Scruggs
Members Absent: Joseph Falk (vacation)
Charles Pinto (absent)
Suzanne Taylor (illness)
John J. Nagy, Planning Director, H G Shane, Planner IV; Ralph Bakewell,
Planner IV; and Robert Brezinski, Assistant City Attorney were also
present.
Mr. Andrew informed the audience that if a petition on the evening's
agenda involved a question of rezoning or vacating then the Planning
I: Commission would only recommend to the City Council that certain
action be taken whereupon the Council would ultimately decide whether
or not to approve or deny the petition. Further, if a petition
involved a waiver of use approval that is denied, the petitioner
had ten days in which to appeal the decision to the Council.
Mr. Kiuver, Acting Secretary announced the first item on the agenda,
Petition 74-6-1-13 by Roy I. Albert, Architect for Margaret
Megaw, requesting to rezone property located on the south
side of Seven Mile Road between Middlebelt and Melvin in
the Northeast 1/4 of Section 11, from R-5 to C-2.
Mr. Andrew: Is there any correspondence on file?
Mr. Nagy: A letter from the Engineering Department states there
is a need for the additional 60 ft. right of way and
there are no engineering problems.
Mr. Albert: We want this rezoning for the commercial sale of tile.
Mr. Andrew: Would there be any problem in amending the petition to
read R-5 to C-1?
Mr. Albert: No, there would be none.
Mr. Hand: Do you own the parcel next to Clarita?
te Mr. Albert: No.

Mrs. Friedrichs: Is the land covered by the petition owned in
total by Margaret Megaw?
Mr. Albert: Yes.
Mr. Kluver: Is there any conflict on the site of plan
because of the introduction of the parking zone?
Mr. Nagy: Yes, it would necessitate readvertising with the
parking classification being advertised.
Mr. Hand: Can he do this by letter in regard to C-1 instead
of C-2? Why not the parking be handled in the
same manner.
Mr. Brezinski : You would have to readvertise the parking.
Mr. Hand: Are you ready with a detailed site plan for this
area?
Mr. Albert: It is almost ready.
Mr. Wright: We are not interested in the commercial land

was denied commercial zoning on this adjacent
piece of property. Therefore, we are opposed
unless our property is included.
Mr. Andrew: What did you propose in this petition?

Mr. Wright: An auto dealership.
Mr. Andrew: That would require C-2.
Are you opposed to this petition?
Mr. Wright: I am opposed unless the whole piece goes. Our
property included.
There was no one else present wishing to be heard and the Chairman
closed the public hearing on this item.
On a motion duly made by Mr. Kluver, seconded by Mr. Hand and unanimously
adopted it was,
#7-137-74 RESOLVED that, pursuant to a public hearing having been held
on July 9 , 1974 on Petition 74-6-1-13 as submitted by Roy I.
Albert, Architect for Margaret Megaw, requesting to rezone
property located on the south side of Seven Mile Road between
Middlebelt and Melvin in the Northeast 1/4 of Section 11,
from R-5 to C-2, the City Planning Commission does hereby
determine to table this item to the study meeting of July 16 ,
1974.

The Chairman declared the motion carried and the foregoing resolution
adopted.
Mr. Andrew advised Mr. Albert to produce a letter signed by the owner
ofaag- propperty• stating their desire to change the zoning petition to

Mr. Kluver announced the next item on the agenda, Petition 74-6-1-14
by the City Planning Commission on its own motion to rezone
property located north of Seven Mile Road between Purling-
brook and Middlebelt Road in the Southeast 1/4 of Section
2, from R-1 to P.
Mr. Nagy: The Engineering Department advises no objection.
There was no one present wishing to be heard and the public hearing
was closed.
On motion duly made by Mr. Kluver, seconded by Mr. Hand and unanimously
adopted, it was
#7-138-74 RESOLVED that, pursuant to a Public Hearing having been
held on July 9 , 1974 , on Petition 74-6-1-14 by the City
Planning Commission on its own motion to rezone property
located north of Seven Mile Road between Purlingbrook and
• Middlebelt Road in the Southeast 1/4 of Section 2 , from
R-1 to P, the City Planning Commission does hereby
recommend to the City Council that Petition 74-6-1-14
be approved for the following reasons :
(1) The proposed change of zoning would reflect the
established use of the property due to the fact
that this area has been developed as the offstreet
parking area for the Livonia Mall Shopping Center.
(2) R-1 residential zoning is inappropriate in that the
area has been developed as the offstreet parking
area for the Livonia Mall Shopping Center.
(3) The proposed change of zoning will better reflect the
land use and would more appropriately have the zoning
lines conform to the property ownership lines.
FURTHER RESOLVED that, notice of the above public hearing
was published in the official newspaper, the Livonia
Observer-Eccentric, under date of 6/20/74 and a notice
of such hearing was sent to the Detroit Edison Company,
Chesapeake & Ohio Railway Company, Michigan Bell Telephone
Company, Consumers Power Company and City Departments as
listed in the Proof of Service.
The Chairman declared the motion carried and the foregoing resolution
adopted.
Mr. Kluver announced the next item on the agenda, Petition 74-6-6-2
by the City Planning Commission on its own motion to amend
Section 18.38 Offstreet Parking; Schedule, of Ordinance
4543, the Zoning Ordinance of the City of Livonia, so as to
revise the offstreet parking requirements for housing
for the elderly.
Mr. Talbot: The reduction to 1. parking space is feasible. In
checking with various communities I found that
Dearborn allows for only one parking space. Wyandotte

provides for less than one. I checked five
different communities and they have only one.
Plymouth has 25 spaces for 60 units.

On a motion duly made by Mr. Kluver, seconded by Mr. Scruggs and
unanimously adopted it was ,
#7-139-74 RESOLVED that, pursuant to a public hearing having been
held on July 9 , 1974 , on Petition 74-6-6-2 by the City
Planning Commission on its own motion to determine whether
or not to amend Ordinance #543 , the Zoning Ordinance so as
to revise the offstreet parking requirements for housing
for the elderly, the City Planning Commission does hereby
recommend to the City Council that Petition 74-6-6-2 be
approved for the following reasons:

(1) This language amendment will alow for a more
reasonable and workable parking ratio as it
relates to the development of housing for the
elderly.
(2) This proposed amendment will bring the offstreet
parking schedule as it relates to housing for the
IL elderly more in line with what surrounding communities
require and that recommended by the State Commission
for the Ageing.
FURTHER RESOLVED, that notice of the above public hearing
was published in the official newspaper, the Observer-
Eccentric, under date of June 20 , 1974 and notice of
such hearing was sent to the Detroit Edison Company
/ Chesapeake & Ohio Railway Company, Michigan Bell Telephone
Company, Consumers Power Company and City Departments
as listed in the Proof of Service.
The Chairman declared the motion carried and the foregoing resolution
adopted.
Mr. Kluver announced the next item on the agenda, p_ eliminary plat
approval for Jeffries Freeway Industrial Park Subdivision
propsed to be located on the west side of Stark Road, south
of the Industrial Road, in the North 1/2 of Section 28.
The Chairman, Daniel R. Andrew, •passed the gavel toMr. Kluver, Vice-
Chairman, at this time.
Mr. Kluver: Is there any correspondence on this petition?

Mr. Nagy: Traffic Bureau, and they have no objections. A
4 letter from Mr. Kerby states they have no objections.
The Fire Marshall indicates no objections. The City
Engineering Department reports no apparent engineering
problems connected with the development of the plat.
Dan Gilmartin, Industrial Coordinator gave verbal
recommendation at the study meeting.
John Dyer: I am also representing Bob Bennet, owner of Lot #805
Representing I object to layout of lots #805 and #806. There are
his mother no provisions for roads at the back end of these lots.
Lot #806 It would leave lots in the size of 223 ft. We would
wish the road in order to. increase the saleability of
these lots.
Mr. Hand: The subdivider is paying for this road, is that right?
Mr. Nagy: Yes , they are paying for all these improvements.
Mr. Hand: Why then sir, can't you provide for your own?
How long have you been aware of this plan?
Mr. Dyer: One week.
Mr. Hand: Who do you expect to put in that road?
Mr. Dyer: We expect City's cooperation. We will be land-locked.
4 Mr. Nagy: You might get together with the owner of Lot #18 and
see if you can combine your property with him so as to
provide three lots where there is presently only one.
Joe Goodison: I am in a worse situation. I did not know about Lot
Lot #807 #18 until one week ago.
Mr. Scruggs: To the owner of the property - Have you ever tried
to purchase land from the above?
Joe Goodison: No.
There was no one else present wishing to be heard and the Chairman
closed the public hearing on this item.
On a motion duly made by Mr. Hand and seconded by Mr. Scruggs, it was
#7-140-74 RESOLVED that, pursuant to a public hearing having been
held on July 9, 1974 , the City Planning Commission does
hereby recommend to the City Council that preliminary
plat of Jeffries Freeway Industrial Park Subdivision
be approved for the following reasons :

(1) The Preliminary Plat conforms to the M-1 Zoning
District regulations.
(2} The preliminary plat conforms to the requirements
of Zoning Ordinance #543 and the Subdivision Rules
and Regulations of the City of Livonia.

(3) It has been recommended for approval by the
Industrial Development Coordinator.
FURTHER RESOLVED, notice of the above hearing was sent
to the abutting property owners proprietor, City Depart-
ments as listed in the proof of Service and copies of
the plat together with notice have been sent to the
Building Department, Superintendent of Schools , Fire
Department, Police Department and Parks and Recreation
Department.
A roll call vote on the foregoing resolution resulted in the
following:
AYES: Friedrichs, Scruggs, Talbot, Hand, Khuver
ABSENT: Pinto, Falk, Taylor
ABSTAIN: Andrew
The Vice Chairman declared the motion carried and the foregoing
resolution adopted.
The Vice Chairman returned the gavel to the Chairman at this time.

The Secretary announced the next item on the agenda, motion by the
City Planning Commission on its own motion pursuant to
Section 23.01 of Ordinance #543 , the Zoning Ordinance
of the City of Livonia, as amended, to hold a public
hearing to determine whether or not to rezone property
located on the east side of Newburgh Road, south of
Five Mile Road in the Northwest 1/4 of Section 20 ,
from C-1 and R-7 to R-6.
On a motion duly made by Mr. Kluver, seconded by Mr. Scruggs
and unanimously adopted, it was
#7-141-74 RESOLVED that, pursuant to Section 23.01 of Ordinance
#543, the Zoning Ordinance of the City of Livonia,
the City Planning Commission does hereby establish
and order that a public hearing be held to determine
whether or not to rezone property located on the east
side of Newburgh Road, south of Five Mile Road in the
Northwest 1/4 of Section 20 , from C-1 and R-7 to R-6 .
FURTHER RESOLVED that, a hearing be held and notice
be given as provided in Section 23.05 of Ordinance
#543 , the Zoning Ordinance of the City of Livonia,
as amended, and that there shall be a report submitted
and recommendation thereon to the City Council.
The Chairmandeclared the motion carried and the foregoing resolution
adopted.
The Secretary announced the next item on the agenda, motion by the
City Planning Commission on its own motion pursuant to
Section 23.01 of Ordinance #543 , the Zoning Ordinance

hearing to determine whether or not to rezone property
located on the south side of Five Mile Road, approxi-
mately 800' west of Levan Road in the Northwest 1/4
of Section 20, from C-1 to R-6 .
On a motion duly made by Mr. Talbot and seconded by Mrs. Friedrichs
and unanimously adopted it was
#7-142-74 RESOLVED that, pursuant to Section 23.01 of Ordinance
#543, the Zoning Ordinance of the City of Livonia,
the City Planning Commission does hereby establish
and order that a public hearing be held to determine
whether or not to rezone property located on the south
side of Five Mile Road, approximately 800' west of
Levan Road in the Northwest 1/4 of Section 20 , from C-1
to R-6.
FURTHER RESOLVED that, a hearing be held and notice
be given as provided in Section 23. 05 of Ordinance
#543, the Zoning Ordinance of the City of Livonia,
as amended, and that there shall be a report submitted
and recommendation thereon to the City Council.
The Chairman declared the motion carried and the foregoing resolution
adopted.
The Secretary announced the next item on the agenda, motion by the
City Planning Commission on its own motion pursuant to
Section 23.01 of Ordinance #543 , the Zoning Ordinance
of the City of Livonia, as amended, to hold a public
hearing to determine whether or not to amend Article
XVIII of Ordinance #543, the Zoning Ordinance of the
City of Livonia, as amended, as it relateso the
regulations and control of signs, specifically political
signs.
On a motion duly made by Mr. Hand, seconded by Mr. Kluver and
unanimously adopted it was
#7-143-74 RESOLVED that, pursuant to Section 23 .01 of Ordinance
#543, the Zoning Ordinance of the City of Livonia,
as amended, the City Planning Commission does hereby
establish and order that a public hearing be held
to determine whether or not to amend Article XVIII
of Ordinance #543, as it relates to the regulations and
control of signs , specifically political signs.

be given as provided in Section 23.05 of Ordinance
#543, the Zoning Ordinance of the City of Livonia,
as amended, and there shall be a report submitted
and recommendation thereon to the City Council.

The Secretary announced the next item on the agenda, Petition
74-6-8-20P by John 011ar requesting approval of all
plans required by Section 18.58 of Ordinance #543 ,
the Zoning Ordinance of the City of Livonia, as
amended, by Ordinance #988 submitted in connection
with a proposal to construct an addition to an
existing commercial building located on the north
side of joy Road between Deering and Cardwell in
Section 36.
On a motion duly made by Mr. Hand, seconded by Mr. Kluver and
unanimously adopted it was
#7-144-74 RESOLVED that, the City Planning Commission does hereby
determine to table until the Commission's meeting of
July 23, 1974 the Petition 74-6-8-20P by John 011ar
requesting approval of all plans required by Section
18.58 of Ordinance #543 , the Zoning Ordinance of the
City of Livonia, as amended by Ordinance #988 submitted
in connection with a proposal to construct an addition
to an existing commercial building located on the north
side of Joy Road between Deering and Cardwell in Section
36.
The Chairman declared the motion carried and the foregoing resolution
adopted.
The Secretary announced the next item on the agenda, Petition
74-6-8-24P by William Abney requesting approval of
all plans required by Section 18. 58 of Ordinance
#543, the Zoning Ordinance of the City of Livonia,
as amended by Ordinance #988 , submitted in connection
• with a proposal to construct a commercial building
on property located on the northeast corner of Middle-
' belt and Terrence in Section 13.
On a motion duly made by Mr. Kluver, seconded by Mr. Scruggs and
unanimously adopted, it was
#7-145-74 RESOLVED that, pursuant to Section 18.58 of Ordinance
#543, the Zoning Ordinance of the City of Livonia,
as amended by Ordinance #988, the City Planning
Commission does hereby approve Petition 74-6-8-24P by
William Abney requesting approval of all plans required
by Section 18.58 submitted in connection with a proposal
to construct a commercial building on property located
on the northeast corner of Middlebelt and Terrence in
Section 13 , subject to the following conditions:

(1) That Site Plan 47403 , Sheet #1, dated July 6 , 1974
prepared by I.S.Rogala, Architect/Associates ,
which is hereby approved shall be adhered to.

(2) That Building Elevation Drawing #7403, Sheets
#4 and #5 , dated May 31 , 1974, prepared by
I.S.Rogala, Architect/Associates which is
hereby approved shall be adhered to, except that
the north elevation shall be constructed of
brick material.
(3) That a landscape plan shall be submitted to the
Planning Commission for approval within thirty
days from the date of this resolution.
(4) That the Planning Commission recognizes that the
Zoning Ordinance requires the construction of an
unpierced masonry screen wall along the north and
east property lines and further that this Site
Plan approval is not to be construed as making
mandatory the construction of the wall as that
condition is imposed upon this petitioner as a
requirement of the Zoning Ordinance. -

74-7-8-26 by Louis G. Redstone Associates , Inc.
requesting approval of all plans required by Section
26.02 of Ordinance #543 , the Zoning Ordinance of the
City of Livonia, as amended by Ordinance #613 , sub-
mitted in connection with a proposal to build an
office building on property located on the south side
of Eight Mile Road between Brentwood and Angling in
Section 1.
On a motion duly made by Mr. Kluver, seconded by Mr. Hand and
unanimously adopted it was
#7-146-74 RESOLVED that, pursuant to Section 26 .02 of Ordinance
4543, the Zoning Ordinance of the City of Livonia, as
amended by Ordinance #613, the City Planning Commission
does hereby recommend to the City Council that Petition
74-7-8-26 by Louis G. Redstone Associates , Inc. re-
questing approval of all plans submitted in connection
with a proposal to build. an office building on property
located on the south side of Eight Mile Road between
Brentwood and Angling in Section 1 , be approved subject
to the following conditions: . •

IL (1) That Site Plan #2104 , Sheet SR #1 , by Louis G.
v Redstone Associates , Inc. , dated 3/19/74 which
is hereby approved shall be adhered to.
(2) That Building Elevation #2104, Sheet #4 prepared
by Louis G. Redstone Associates , Inc. , which is

hereby approved, shall be adhered to.
(3) That the petitioner be required to submit to the
Planning Commission for approval a detailed landscape
plan within ninety days from the date of this approval.
(4) That a plan showing any proposed signs to be erected
on the site shall be submitted to the Planning Commission
for approval.
(5) Upon completion of the structure and prior to receipt
of Certificate of Occupancy the frame structure
located on the north end of the property shall be
removed or razed.
The Chairman declared the motion carried and the foregoing resolution
adopted.
The Secretary announced the next item on the agenda, approval
of the minutes of the 276th Regular Meeting held
by the City Planning Commission on June 11, 1974.
On a motion duly made by Mr. Talbot, and seconded by Mrs.
Friedrichs it was
#7-147-74 RESOLVED that, the minutes of the 276th Regular Meeting
of the City Planning Commission held on June 11 , 1974
are hereby approved.

minutes of the 277th Regular Meeting held by the
City Planning Commission on June 25, 1974.
On a motion duly made by Mr. Hand, seconded by Mr. Kluver and
unanimously adopted it was
#7-148-74 RESOLVED that, the minutes of the 277th Regular Meeting
of the City Planning Commission held on June 25 , 1974
are hereby approved.
The Chairman declared the motion carried and the foregoing resolution

resolved that, the 278th Regular Meeting of the City Planning
Commission held on July 9, 1974 , was adjourned at 9 :50 p.m.
