HomeMy WebLinkAboutPLANNING MINUTES 1971-10-04 L. 9277 MINUTES OF THE 260th SPECIAL MEETING AND PUBLIC HEARINGS HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Monday, October 4, 1971 the City Planning Commission of the City of Livonia held its 260th Special Meeting and Public Hearing at the Engineering Building, 13325 Farmington Road Livonia, Michigan. Mr. Daniel R. Andrew, Chairman, called the Public Hearing and 260th Special Meeting to order at approximately 9:00 p.m. Members present: Charles Pinto H. Dow Tunis Joseph Talbot Daniel Andrew Francis Hand. Joseph Falk Herman Kluver Members absent: Suzanne Taylor (working) Messrs. John J. Nagy, Planning Director and Robert M. Feinberg, Assistant City Attorney, were also present. Mr. Hand announced the first item on the agenda is Petition 71-8-2-30 by Donald C. Deremo, Attorney for Andrew Ansara, requesting to be granted a waiver use permit to construct a Big Boy Restaurant on property located on the east side of Middle- belt, north of Seven Mile Road in the Southwest 1/4 of Section 1. Mr. Andrew questioned Mr. Deremo as to the hours of operation of the proposed Big Boy Restaurant. Mr. Deremo stated that hours of operation would be from 7:00 a.m. to 1:00 a.m. Mr. Andrew asked if this is a franchise operation. Mr. Ansara stated this is not a franchise operation; they will operate this restaurant themselves just as the restaurant they now operate at Eight Mile and Farmington. Mr. Andrew questioned what effect Mr. Deremo thought the elimination of left turns would have on the operation of this business . Mr. Deremo stated he could see no serious conflict with that if the Police Department felt it advisable to eliminate left hand turns and they would have no objection. Mr. Andrew questioned Mr. Nagy as to how far north from the intersection this parcel lies. Mr. Nagy stated approximately three hundred feet north of the north right-of-way line of Seven Mile Road. Mr. Andrew requested to know under whose jurisdiction this road is in terms of controlling left-hand turning movements . 9278 i: Mr. Nagy stated Middlebelt Road is under Wayne County Road Commission jurisdiction, however, there is a mutual agreement with the City of Livonia and the Road Commis- sion in terms of trying to coordinate these kinds of traffic problems. Mr. Pinto questioned how fixed is the site plan in terms of being receptive to some minor modifications so as to improve the parking layout, pedestrian circulation and landscape treatment of the site. Mr. Ansara stated they are open to suggestions and will cooperate in every way with the Planning Commission and the City of Livonia in an effort to prepare a site plan that will be mutually acceptable by all parties concerned. Mr. Pinto asked if, in order to illustrate some of the points he would like to raise in this regard, would the staff present to the petitioner its modified site plan illustrating the area of the site plan improvement. Mr. Nagy presented the modified plan to the petitioner. There was a brief discussion relative to the modifications in the plan after which the petitioner agreed to all the changes as indicated on the modified site plan. There was no one present in the audience wishing to be heard regarding this item. Mr. Andrew, Chairman, declared the public hearing on this item closed. tV On a motion duly made by Mr. Pinto, seconded by Mr. Talbot, and unanimously adopted, it was #10-268-71 RESOLVED that, pursuant to a Public Hearing having been held on October 4, 1971 on Petition 71-8-2-30 as submitted by Donald C. Deremo, Attorney for Andrew Ansara, requesting to be granted a waiver use permit to construct a Big Boy Restaurant on property located on the east side of Middle- belt, north of Seven Mile Road in the Southwest 1/4 of Section 1, the City Planning Commission does hereby recom- mend to the City Council that Petition 71-8-2-30 be approved together with Site Plan #CM-71-9, prepared by the Planning Department, dated 9/7/71, as approved on October 4, 1971 by the City Planning Commission and signed and agreed to by the petitioner, which plan is determined to be consistent with the requirements of Ordinance #788, Livonia Mall Vicinity Control Ordinance, for the following reasons: (1) It complies with all of the requirements of the Zoning Ordinance #543, Section 11.03(c) . (2) The proposed use is compatible to the surrounding uses of the area. CONDITION OF APPROVAL: 10 (1) This waiver use approval is expressly conditioned upon • 9279 the submission of a detailed landscape plan by the petitioner within thirty (30) days from the date of this resolution, which landscape plan shall be subject to approval by the City Planning Commission; and, that all landscape material as shown on the approved plan shall be installed before issuance of a Certificate of Occupancy. FURTHER RESOLVED that, notice of the above Public Hearing was sent to property owners within 500 feet, petitioner and City Departments as listed in the Proof of Service. The Chairman declared the motion carried and the foregoing resolution adopted. Mr. Hand announced the next item on the agenda is a motion by the City Planning Commission on its own motion to hold a public hearing to determine whether or not to rezone lands located along the east and west right-of-way lines of Middlebelt Road between Five Mile and Six Mile Roads for the purpose of implementing the land use plan dated September, 1971. On a motion duly made by Mr. Tunis, seconded by Mr. Kluver, and unanimously adopted, it was #10-269-71 RESOLVED that, pursuant to Section 23.01 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, the City Planning Commission does hereby establish and order that a public hearing be held to determine whether or not to rezone land located along the east and west right-of-way lines of Middlebelt Road between Five Mile and Six Mile Roads for the purposes of implementing the land use plan dated September, 1971. FURTHER RESOLVED, that a hearing be held and notice be given as providedinSection 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, and that • there shall be a report submitted and recommendation thereon to the City Council. The Chairman declared the motion carried and the foregoing resolution adopted. Mr. Hand announced the next item on the agenda is a motion by the City Planning Commission on its own motion to hold a public hearing to determine whether or not to amend the Subdivision Rules and Regulations so as to provide for entrance markers at appropriate locations leading into subdivisions. On a motion duly made by Mr. Hand, seconded by Mr. Falk, and unanimously adopted, it was IFL #10-270-71 RESOLVED that, pursuant to the provisions of Act 285 of the Public Acts of Michigan 1931, as amended, the City Planning Commission does hereby establish and order that a public hearing be held to determine whether or not to amend Part III of the .Master Plan of the City of Livonia, Subdivision Rules and Regulations, so as to provide for entrance markers at appropriate locations leading into subdivisions. L. 9280 FURTHER RESOLVED that, notice of time and place of said public hearing shall be published in a newspaper of general circulation in the City of Livonia and a notice by registered United States mail shall be sent to each public utility or railroad company owning or operating any public utility or railroad within the City of Livonia in accordance with the provisions of Act 285 of the Public Acts of Michigan of 1931, as amended. The Chairman declared the motion carried and the foregoing resolution adopted. Mr. Hand announced the next item on the agenda is a motion by the City Planning Commission to amend the Planning Commission Rules of Procedure by adding Section 11 to Article VI so as to incorporate the meaning of an abstaining vote. On a motion duly made by Mr. Tunis, seconded by Mr. Kluver, and unanimously adopted, it was #10-271-71 RESOLVED that, pursuant to the 260th Special Meeting held by the City Planning Commission on Monday, October 4, 1971, the City Planning Commission does hereby determine to amend Article VI of its Rules of Procedure by adding thereto Section 11, which shall read as follows: Abstaining: A Commissioner who abstains shall be considered as present but not voting.
