HomeMy WebLinkAboutPLANNING MINUTES 1971-04-06 9120 MINUTES OF THE 228th REGULAR MEETING {1:0AND A PUBLIC HEARING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, April 6, 1971, the City Planning Commission of the City of Livonia, held its 228th Regular Meeting and a Public Hearing in the Planning Commission office located at 13325 Farmington Road, Livonia, Michigan. Mr. H. Dow Tunis, Vice-Chairman, called the Public Hearing to order at approxi- mately 8:15 p.m. Members present: Raymond W. Tent Robert Colomina Joseph Falk H. Dow Tunis Francis M. Hand Charles Pinto Joseph Talbot *Marvin Moser Members absent: Daniel R. Andrew Messrs. John J. Nagy, Planning Director; Ralph H. Bakewell, Planner III; and Robert M. Feinberg, Assistant City Attorney, were also present. Mr. Hand announced the public hearing item is Petition 71-3-2-11 by Jewel Real Estate Company requesting to be granted a waiver use permit to operate a real estate office in existing building located on the west side of Farmington Road between Roycroft and Rayburn in the Southeast 1/4 of Section 16. Mr. Jerry Lacoursiere was present representing the petitioner and stated they wished to move their business to Livonia from Garden City. Discussion was held concerning the landscaping that was supposed to have been done by the owner of the building in connection with his original waiver use approval. Mr. Nagy stated that landscaping is the problem of the owner, not the tenant. Mr. Hidden, owner of the building, stated that the landscaping has not been completed because of the weather. Mr. Hand stated that the tenant should not be penalized because the owner has not submitted a landscape plan. Mr. Julius Gray, a resident was present and stated that the people who are Coventry Gardens Civic Association are concerned about the upkeep of the property and about the height of the lights in the parking lot. There was no one else present wishing to be heard regarding this petition. Mr. Tunis, Vice-Chairman, declared the public hearing on this item closed. On a motion duly made by Mr. Tent, seconded by Mr. Hand, and unanimously adopted, it was 1L4 #4-86-71 RESOLVED that, pursuant to a public hearing having been held on April 6, 1971 on Petition 71-3-2-11 as submitted by Jewel Real Estate Company requesting to be granted a waiver use permit to operate a real estate office in existing building located on the west side of Farmington Road between Roycroft and Rayburn in the 9121 Southeast 1/4 of Section 16, the City Planning Commission does hereby determine to defer action on this petition until such time as an acceptable landscape plan is submitted by the owner of the building in accordance with the conditions of approval of Petition. Nuser entered the meeting at this time. ?qnd announced the next item on the agenda is a letter dated March 2, 1971 from Willard E. Lockwood requesting an extension of waiver use approval (Petition 66-4-2-9) to operate a Farm Produce Marcket located on the west half of Lot 6 and all of Lot 7 of Horton's Newburgh Subdivision in the Northeast 1/4 of Section 31. -u a motion duly made by Mr. Moser, secbnded by Mr. Talbot, and unanimously .dopted, it was i4-87-71 RESOLVED that, pursuant to a request dated March 2, 1971 from Willard E. Lockwood requesting an extension of waiver use approval (Petition 66-4-2-9) to operate a Farm Produce Market located on the west half of Lot 6 and all of Lot 7 of Hdrton's Newburgh Subdivision in the Northeast 1/4 of Section 31, the City Planning Commission does hereby determine to grant an extension for a period of one year, such approval to expire on June 20, 1972 for the following reason: (1) It is a logical interim use for the property prior to the time it reaches its maximum commercial potential. and with the following conditions: (1) That all free-standing signs shall be removed from the site. (2) That all wall signs fixed to the warehouse and produce stand with the exception of those permitted by the Zoning Ordinance shall be removed from the buildings. (3) That the plastic covering the front of the open-air produce stand shall be removed. (4) That the warehouse building and produce stand shall be painted. (5) That the petitioner refrain from displaying any produce or related merchandize in the required front yard. (6) That all produce and related materials will be displayed only within the open-air stand or in the back of the buildings. (7) That parking lot stop blocks of railroad ties, concrete or other similar material shall be installed within the parking lot to give organization and direction to the parking area and eliminate the random parking along the right-of-way. (8) All of the above conditions must be complied with by September 1, 1971 and in the event they are not complied with, the Commission reserves the right to terminate the waiver use approval. FURTHER RESOLVED, that notice of the above public hearing was sent to property owners within 500 feet, petitioner and City Departments as listed in the Proof of Service. 9122 Mr. Tunis, Vice-Chairman, declared the motion carried and the foregoing resolution is adopted. Mr. Hand announced the next item on the agenda is Petition 71-3-5..2 by Jack B. Anglin requesting to remove stockpiled topsoil from property located north of Six Mile Road, east of Wayne Abed in the Sbuthwest 1/4 of Section 9. On a motion duly made by Mr. Talbot and seconded by Mr. Pinto, it was #4-89-71 RESOLVED that, in conformance with Section 18.13D of Ordinance #543, the Zoning Ordinance of the City of Livonia, the City Planning Commission does hereby grant Petition 71-3-5-2 by Jack B. Anglin requesting to remove stockpiled topsoil from property located north of Six Mile Road, :ast of Wayne Road in the Southwest 1/4 of Set=tiotl 9, subject to compliance with regulations of the Engineering iivision and Police Department, for a period of one year. FURTHER RESOLVED, that the applicant shall deposit with the ih; City Clerk a corporate surety bond in the amount of $5,000 and a cash bond in the amount of $500.00; such bonds shall be for an indefinite period until released and discharged by resolution of the City Planning Commission; and further that the applicant shall apply for and obtain the permit herein authorized within thirty (30) days from the date of this letter. roll call vote on the foregoing resolution resulted in the following: AYES: Colomina, Moser, Pinto, Talbot, Tent, Tunis, Hand NAYS: None ABSENT: Andrew ABSTAIN: Falk Jr. Tunis, Vice-Chairman, declared the motion carried and the foregoing resolution adopted. On a motion duly made by Mr. Falk, seconded by Mr. Tent, and unanimously adopted, it was #4-88-71 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, does hereby establish and order that a public hearing be held to determine whether or not to rezone property located on the west side of Farmington Road, north of Joy Road in the Southeast 1/4 of Section 33, being legally described as follows: That part of the S. E. 1/4 of Section 33, T. 1 S. , R. 9 E., City of Livonia, Wayne County, Michigan, des- cribed as beginning at a point on the East line of said section distant N. 1° 43' 20" E, 320.66 ft. from the S. E. corner of Section 33 and proceeding thence from said point of beginning N. 88° 16' 40" W, 37.95 ft., thence N. 30° 33' 40" W. 464.92 ft. , thence 9123 S. 88° 16' 40" E. 286.25 ft. to the E. line of said Section, thence S. 1° 43' 20" W. along said section line 393.05 ft. to the point of beginning. Except the East 60 feet thereof containing .93 acres more or less as determined from Wayne County Records. from P. L. to R-1. FURTHER RESOLVED, that a hearing be held. and notice be given as provided in Section 23.05 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, and that there shall be a report submitted and recommendation thereon to the City Council. _lc. Tunis, Vice-Chairman, declared the motion carried and the foregoing resolution __'opted. 0o a motion duly made by Mr. Tent, seconded by Mr. Colomina, and unanimously adopted, it was 13-90-71 RESOLVED that, the City Planning Commission, pursuant to Section 23.01 of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, and pursuant to Council Resolution #188-71, does hereby establish and order that a public hearing be held to determine whether or not to amend Part V of the Master Plan of the City of Livonia, the Master School and Park Plan, so as to incorporate Tax Parcel 09G1 located at the northwest inter- section of Six Mile Road and Farmington Road in Section 9, as a park site, being legally described as follows: The E. 1/2 of the S. E. 1/4 of Section 9, T. 1 S., R. 9 E. , City of Livonia, Wayne County, Michigan, except the south 60 feet thereof; also except the north 125 feet of the south 185 feet of the east 185 feet thereof; also except the east 60 feet thereof. FURTHER RESOLVED that, notice of time and place of said public hearing shall be published in a newspaper of general circulation in the City of Livonia and a notice by registered United States mail shall be sent to each public utility or railroad company owning or operating any public utility or railroad within the City of Livonia in accordance with the provisions of Act 285 of the Public Acts of Michigan of 1931, as amended. .;:r. O'Connor, Lindhout Associates, regarding submission of additional items required by the Planning Commission in connection with Petition 70-9-2-19 by Ward Memorial Church. motion duly made by Mr. Colomina, seconded by Mr. Tent, and unanimously adopted, it was 11: /' -91-71 RESOLVED that, pursuant to letter dated March 9, 1971 from Thomas F. O'Connor, Lindhout Associates, regarding submission of additional items required by the Planning Commission in connection with Petition 9124 70-9-2-19 by Ward Memorial Church, the Planning Commission does hereby grant its approval of the Landscape Plan by Green Ridge Nursery and the Outdoor Lighting Plan #E-5, Sheet 6808, subject to the following added condition: (1) That a maintenance-free fence shall be installed on Lot #38 beginning from the front of the house Setback line to the rear of the residential lot line; cost to be shared equally between the Church and the owner of Lot A18. On a motion duly made by Mr. Hand and seconded by Mr. Colomina, it was #4-92-71 RESOLVED that, the minutes of the meeting held by the Planning Commission on February 23, 1971 are approved.
