MINUTES OF THE 175TH REOULAT, MEETING
and
PUBLIC HEARING OF THE CITY PLANNING
COMMISSION OF THE CITY OF LIVONIA
On Tuesday, August 31, 1965, the City Planning Commission of the City of Livonia
held the 175th Regular Meeting and a Public Hearing at the Livonia City Hall,
33001 Five Mile Road; Livonia, Michigan. Mr: Charles W. Walker, Chairman,
called the Public Hearing to order at approximately 3;30 p.m. with fifty inter-
ested persons in the audience.
Member present: Raymond W, Tent Charles W, Walker Bob R. Whitehead
James Cameron Harry Wrightman Donald .C. Pollock
Donald Heusted John J. Ward
Members absent: Myra Chandler
Messrs. Don Hull, Planning Director; John Jo Nagy, Assistant Planning Director,
Harry C; Tatigian, First Assistant City Attorney, were present,
Mr. Whitehead announced the first item on the a;,enda is Petition 65-8-1-5
by Rodney C, Kropf for Burt Freedman requesting the rezoning of
property located on the north side of Seven Mile Road, approximately
2;630 feet east of Newburgh Road in the Southeast 1/4 of Section
5, from RUFC to C-2, Mr. Kropf TAT: present,
Mr. Kropf requested the chairman to inquire is: Mrs, Grace Franjac, 37355 Bight
Mile Road, was in the audience, It was established that Mrs, Franjac was not
present.
Mr. Kropf stated that this petition wao filed under option and that the party
named in the petition no longer has an interest in the property. When he talked
to Mrs. Franjac (owner of property) she indicated to him t':+. ?t she might wens to
have petition continued. She asked for change of zoning nc;1 , before area is
totally developed but did not know -.hat is intended for that piece of property.
Unless Mrs. Franjac asks that petition be continued, stated he would ask that
it be withdrawn,

Mr. Whitehead announced the next item on the agenda is Petition 65-8-1-6
by Rodney C. Kropf for Harry S. Wolfe, requesting the rezoning of
pro_:erty located on the west side of Farmington Road, approximately
1,000 feet north of Schoolcraft Road in the Southeast 1/4 of Section
21, from a-2 to R-7. Mr. . Kropf was presents •
Mr. Kropf stated client still felt this is a desirable site for apartments.
With approximately five acres (after dedication to;: roadway), this will be a
.small apartment complex-four units or less, This site is not prone for single
residential development.

Mr. Whitehead announced the next item on the agenda is Petition 65-8-1-7
by Richard T. Gieryn for owners, Henry S. Alper, Robert L,
Alper, Joshua J. Stone, Donald A. Krupp,r-- Green.. Aubrey H.
"4% Ettenheimer and Leonard R. Farber, requesting the rezoning of
property located at the southeast corner of Five Mile Road and
Eckles Road in the northwest 1/4 of Section 19 from R-1 to C-2.
Mr. Gieryn was present.
Mr. Gieryn stated request was motivated by the change in the area by the advent
of a new expressway. We own parcel immediately to the south. At the previous
public hearing there had been no ojection from people to the rezoning as
presented.
No one else was present wishing to be heard either in favor of or opposed to
petition as presented.

Mr. Whitehead, announced the next item on the agenda is Petition 65-8-1-9
by William A. Woods, Sr., Citizens Beauty School, Inc. ,
requesting the rezoning of property located on the east side
of Lathers, immediately south of the alley, south of Seven Mile
Road in the northeast 1/4 of Section 12, from RUQ to P„
The petitioner nor a representative was present. No one else was present
wishing to be heard either in favor of or opposed to petition as presented.
Mr. Walker, chairman, announced that item would be taken under advisement.
Mr. Whitehead announced the next item on the agenda is Petition 65-8-1-10 by
Stephan F. Slavik, President of Barton Inc., requesting the
rezoning of property located on the east side of ra.:-nington Road,
approximately 560 feet north of Six Mile Road in the southwest 1/4
of Section 10, from R-3-C to PS. Mr. Slavik wa: r.rescnt,
Mr. Alex Sparrow, 14705 Flamingo, questioned for what purpose under the PS
zoning is property going to be used. Mr. Slavik stated there is no definite
use at this titan but that it would be some general use perz'itted under the
ordinance.,
Mr. Donald Rigo, 17371 Bell Creek Lane, stated parcel in question is large and
a number of professional services could be established- not just one. He is
concerned about the screening and also asked if there is any way residents
could be notified of what is going into area before use is established.
Mr. Hull is €orned those present that on August 4, 1965 a neva ordinance was
adopted in which only a limited number of uses are permitted in a PS area
without Planning Commission approval. This would mean that there would be
a public hearing and residents notified before use permit is granted.
The permitted uses as cited in the ordinance were read.
Mr. Reino Tuon3 'i. 17461 Bell Creek Lane, stated that on the southwest corner
there is an area properly zoned but has been vacant for years. Questioned
if PS is granted, and if at some future date the property were sold, would

it be easier then to get the zoning changed from PS to a commercial zoning.
Mr. Walker assured those present that the commission has discussed screening
and fencing in this area. Commission has been disappointed in screening in
areas.
Mr. Cameron stated that if property is sold and new owner petitioned for re-
zoning to commercial that it would require another public hearing and notif i-
cation of property owners.
Mr. Walker announced item would be taken under advisement.
Mr. Whitehead announced that the next item on the agenda is Petition 65-8-1-13
by David A. Goldman, Attorney for A. & W. Management Company
requesting the rezoning of property located north of Six Mile Road
and west of Farmington Road in the southeast 1/4 of Section 9, from
R-3-C to C-1. The petitioner nor a represent/five was present.
Mr. Ralph Maly, President of Burton Hollow Civic Association, 34651 Six Mile
Road, submitted a petition with an additional 127 signatures of rer•4dents
in Helman Park Subdivision, objecting to petition as presented.
Mr. Hull stated petitioner contacted him and said he 'ould not be present at
this meeting.
Mr. Donald Rigo, 17371 Bell Creek Lane, President of Burton Hollow Woods Civic
Association,reminded commission of previousobjections to petition.
Mr. Walker read letter dated May 14, 1965 from Benton Yates, Supt. of Livonia
I) Public Schools objecting to petition as presented.
Councilman Edward G. Milligan, 16115 Burton Cour, stated while a rmember of the
Planning Commission, the commission spent a lot of time stpA,'ng vrning and
because the northwest section of the city was not developed, it was decided
by the commission that it would be well to subdivide the area into large lots.
Believe K-Mart as such is a good business in a large city, however, did
believe it contrary to the master plan of the City of Livonia. Many of his
neighbors have come down to talk to him about this petition, therefore, did
some investigation of available sites. Found there are a number of sites
within the city along the future 1-96 Schoolcraft section which would
be more ideal in that residents from other communities could get in and out
of the city conveniently. Suggested petitioner withdrawing his petition and
offered to devote his time in helping petitioner consider some of the sites
along 1-96 which bl had looked at.
Mrs. Arthur Reckling, 32567 Greenland Court, thought this a nice section of the
city and felt request out of place.
Mr. Walker announced that item would be taken under advisement.
Mr. Whitehead announced the next item on the agenda is Petition 65=8 1-14 by
Willian N. Ponder, Attorney for John D. Smith and Harold Carl
Liscombe, requesting the rezoning of property located on the
south side of Five Mile Road between Harrison and Lyons in the
northeast 1/4 of Section 24, from C-1 and RUF to C-2. Mr. Ponder
was present.

Mr. Walker read letter dated August 17, 1965 from William N. Ponder requesting

that petition be withdrawn.
Mr. Walker announced that item would be taken under advisement.
Mr. Whitehead announed the next item on the agenda is Petition 65-8-1-17
by Gary Goldberg, requesting the rezoning of property located
on the east side of Middlebelt Road between Bretton and St. Martins
in the southwest 1/4 of Section 1, from RUF to C-2. Mr. Goldberg
was present.
Mr. Rodney Kropf, 32510 Plymouth Road asked dimensions of property in question,
It was established property is 265' x 300' .
No one else was present wishing to be heard either in favor of or opposed to
petition as presented.
Mr. Walker announced that Petition 65-8-1-17 would be taken under advisement.
Mr. Whitehead announed the next item on the agenda is Petition 65-8-2-2
by Rev. James V. Shaffer, Livonia Assembly of God, requesting
to be granted a waiver use permit to hold a day nursery school
in the church building which is located on the south side of
Seven Mile Road between Loveland and Woodring in the northwest
1/4 of Section 10. Rev. Shaffer was present.

Mr. Walker announced that item would be taken under advisement.
Mr. Whit ,head announced the next item on the agenda is Petition M-343 by
Micki Huysken, President of North Livonia Nursery, requesting
to be granted a waiver use permit to hold a nursery school in the
St. Andrews Episcopal Church located on the east side of Hubbard
Road, approximately 1,550 feet south of Six Mile Road in the
northeast 1/4 of Section 15. There was no one present representing
the petition.
Mr. Ted Teslik, 16333 Hubbard Road, stated he would like more information.
Is the group planning to have just Livonia children or are they planning
to bus children in from Detroit. Will the number of children per section
stop at twenty.
Mrs. Rodger Swain, 31545 Grove, stated she has been a member of a cooperative
nursery in the past and the nursery is regulated by the Michigan Cooperative
Nursery at twenty children per section. There could only be two sections
per day. There will never be a school bus. The mothers car-pool the children
to and from the nursery each day.
Mr. Pollock stated he would like more information in writing.
Rev. Shaffer stated their petition is not for a cooperative nursery but for a
day care center. There will be no more than 30 children to start.

Mr. Walker requested Rev. Shaffer to put something in writing/to the nuaber
of children and how the children will get to and from the nursery. •

Mr. Pollock asked Rev. Shaffer if the children would be children from the church
or would this be a co mmunity enterprise. Rev. Sh+ifer stated the children will
not be just from the church. The total number of children is regulated by
the square footage of the building and by the state.
Mr. Tatigian referred to Section 1906 of the Zoning Ordinance #543 in that
the commission could attach any condition to its approval which it determines
as necessary to accomplish the re. aonable application of the special re-
quirements.
Mr. Walker announced that item would be taken under advisement.
Mr. Whitehead announced the next item on the agenda is the proposed Nottingham
Woods Subdivision located on the southeast corner of Six Mile Road
and Hubbard Road in the northeast 1/4 of Section 15. Messrs. William
Ponder, Attorney and Jacob Menuck were present.
Mrs. Roy Puckett, 31642 Grove, objected to Grove going through.
Mr. Hull informed those present that the petitioner prepared two plans at the
request of the commission so that the Commission could examine both possibilities,
Mr. William Hitter, 31522 Grove, stated those on Grove are taking strong
objection to Grove going through. Stated there are 18-20 children in the area.
Mrs. Puckett stated that the reason residents moved onto Grove was because the
street was a dead-end street.
Mr. C. A. Richeson, 31511 Vargo stated the MerriEan Six Improvement Association
gives its support to keeping street closed.
There were 25 present in favor of this development of 1/2 acre lots if Grove
stays closed. •
Mr, Walker announced that item would be taken under advisement.
Upon a motion duly made by Mr. Whitehead, seconded by Mr. Cameron and unanimously
adopted, it was

Public Hearing held on Tuesday, August 31, 1965 at approximately
9:35 p.m.
The Chairman, Mr. Walker, declared the motion is carried and the Public Hearing
is adjourned.

Mr. Walker, Chairman, called the 175th Regular Meeting to order at 10:05 p;m;
with approximately the same number of persons in the audience as present at
the Public Hearing.
Mr. Whitehead announced the first item to be considered is the proposed

Nottingham Woods Subdivision, being a part of the Northeast 1/4
of Section 15, and located on the southeast corner of Six Mile
Road and Hubbard Road. Public Hearing 8/31/65. Messrs. William
Ponder, Attorney .nd Jacob Menuck were present.
Mr. Walker referred to letter from the Fire Department regarding the City of
Livonia standard radius for cul-de-sac to be 60 feet whereas in proposed plat
it shows a 50 foot radius. Also that Grove street remain a dead gild street.
Mr. Ward stated he is concerned about the 24 foot width of the pavement. Mr.
Menuck stated the houses are 50 feet from the lot line which will make them
63 feet from the pavement. He felt cars would not be parked on the street
because of the width and length of drives.
Upon a motion duly made by Mr. Tent, seconded by Mr. Wrightman and unanimously
adopted, it was
#8-144-65 RESOLVED that, pursuant to a Public Hearing having been held on
August 31, 1965, the City Planning Commission does hereby
recommend to the City Council that the preliminary plat of
Nottingham Woods Subdivision located on the southeast corner of
Six Mile and Hubbard Roads in the Northeast 1/4 of Section 15
be approved subject to the cul-de-sac being increased to a radius
of 60 feet for the following reasons:
(1) It is of sufficient design calibre to justify our
tri approval, and
(2) It is in harmony with the adjacent development, and
FURTHER RESOLVED, notice of the above hearing was sent to the
abutting property owners, proprietor, City Departments as listed
in the Proof of Service and copies of the plat together with
notice having been sent to the Building Department, Superintendent
of Schools, Fire Department, Police Department, Parks & Recreation
Department and Mebers of the Plat Committee.
The Chairman, Mr. Walker, declared the motion is carried and the foregoing
resolution is adopted.
Mr. Whitehead announced the next item on the agenda is Petition 65-8-1-5
• by Rodney C. Kropf for Burt Freedman requesting the rezoning
of property located on the north side of Seven Mile Road,
approximately 2,630 feet east of Nw.?burgh Road in the southeast
1/4 of Section 5, from RUF-C to C-2. Public Hearing 8/31/65. Mr.
Kropf was present.
Mr. Kropf stated there is a question of true ownership of the property and
if commission rules the petition is invalidly filed e. Mr. lasskeed whethted heeider petitioier
would be entitled to refund of f it ing
so.
Mr. Kropf asked that item be taken under advisement until next meeting in

order to allow him time to get in touch again with Mrs. Franjac. Stated he
thought she would be present tonight. Mr. Hull stated he talked to Mrs.
Franjac and she had asked that the petitnn be rejected.
Mr. Tent recalled that at the original hearing she objected to the petition.
He felt the petition was a mixed up affair and best it should be disposed of.
Mr. Hull referred to Section 23.03 of Zoning Ordinance #543 regarding filing
fees.
Mr. Wrightman made the following motion which he later withdrew;
RESOLVED that, pursuant to a Public Hearing having been held
on August 31, 1965, on Petition 65-8-1-5 as submitted by
Rodney C. Kropf for BurtFreedmanfor a change of zoning on
the north side of Seven Mile Road, approximately 2,630 feet
east of Newburgh Road in the Southeast 1/4 of Section 5, from
RUFC to C-2, the City Planning Commission does hereby recommend
to the City Council that Petition 65-8-1-5 be denied because
the owner of record does not wish the rezoning at this time,
and
FURTHER RESOLVED, notice of the above hearing was published in
the official newspaper, Livonian Observer and City Post, under
date of August 11, 1965 and notice of which hearing was sent to
the Detroit Edison Company, The Chesapeake & Ohio Railway Company,
Michigan Bell Telephone Company, The Consumers Power Company,
City Departments and petitioners as listed in the Proof of
Service.

Mr. Tatigian suggested that instead of denying petition the commission dismiss
petition and referred to Section 23.01 (c) Zoning Ordinance #543. The City
Council would then not be required to hold another public hearing.
Upon a motion duly made by Mr. Wrightman, seconded by Mr. Heusted and
unanimously adopted, it was
#8-145-65 RESOLVED that, the City Planning Commisei )n does hereby
dismiss Petition 65-8-1-5 as submitted by Rodney C. Kropf
for Burt Freedman for a change of zoning on the north
side of Seven Mile Road, approximately 2,630 feet east of
Newburgh Road in the Southeast 1/4 of Section 5, from RUFC
to C-2, because compliance has not been made with Section 23.01
(c) of Zoning Ordinance No.543 in so far as ownership of the
property is concerned.
Mr. Walker, Chairman, declared the motion is carried and the foregoing
resolution Ln adopted.
Mr. Whitehead announced the next item on the agenda is Petition 65-8-1-6
by Rodney C. Kropf for Harry S. Wolfe, requesting the rezoning
of property located on the west side of Farmington Road,
approximately 1000 feet north of Schoolcraft Road in the
Southeast 1/4 of Section 21, from R-2 to R-7. Public Hearing
8/31/65. Mr. Kropf was present.
Mr. Kropf requested that petition be held over in order that Petition 65-8-1-25
and this petition could be acted upon at the same time.

Mr. Ward stated he felt this particular petition would not be in the best
interest of the City and that it should be denied.
Upon a motion duly made by Mr. Ward, seconded by Mr. Tent and unanimously
adopted, it was
#8-146-65 RESOLVED that, pursuant to a Public Hearing having been held
on August 31, 1965, on Petition 65-8-1-6 as submitted by
Rodney C. Kropf for Harry S. Wolfe for a change of zoning on
the west side of Farmington Road, approximately 1000 feet north
of Schoolcraft Road in the Southeast 1/4 of Section 21, from
R-2 to R-7, the City Planning Commission does hereby recommend
to the City Council that Petition 65-8-1-6 be denied because
the conflict with the lights and other activities adjacent to
the Ford Centennial Field would not render this land desirable
for multi-family use, and
FURTHER RESOLVED, notice of the above hearing was published
in the official newspaper, Livonian 0b. erver and City Post,
under date of August 11, 1965 and notice of which hearing was
sent to the Detroit Edison Company, The Chesapeake & Ohio
Railway Company, Michigan Bell Telephone Company, The Consumers
Power Company, City Departments, and petitioners as listed in

resolution is adopted.
Mr. Whitehead announced the next item on the agenda is Petition 65-8-1-7 by

1/4 of Section 19, from R-1 to C-2. Public Hearing 8/31/65,
Mr,. Gieryn was present.
Mr. Cameron questioned ingress and egrcos to motel. Mr. Gieryn stated they
have not taken any action in as much as there had been no action on petition
as yet.
Upon a motion duly made by Mr. Wrightman and seconded by Mr. Ward, it was

August 31, 1965, on Petition 65-8-1-7, as submitted by Richard

J, Stone, Donald A. Krupp, Abe Green, Aubrey H. Ettenheimer
and Leonard R. Farber for a change of zoning on the southeast
corner of Five Mile Road and Eckles Road in the Northwest 1/4
of Section 19. from R-1 to C-2, the City Planning Commission
does hereby recommend to the City Council that Petition 65-8-1-7
be granted for the following reasons:
(1) There is a need for this use in this area, and
(2) It is a logical transition use from the adjacent interchange
land, and
(3) It is desirable to rezone land for non-residential purposes
prior to development of adjacent residential areas, and

A roll call vote on the foregoing resolution resulted in the following:
AYES: Ward, Heusted, Tent, Wrightman, Pollock, Whitehead and Walker
NAYS: Cameron
Mr. Walker, Chairman, declared the motion is carried and the foregoing reso-
lution is adopted.
Mr., Whitehead announced the next item on the agenda is Petition 65-8-1-9
by William A. Wood, Sr., Citizens Beauty School, Inc., requesting
the rezoning of property located on the east side of Lathers,
immediately south of the alley, south of Seven Mile Road in the
Northeast 1/4 of Section 12, from RUF to P. Public Hearing
8/31/65.
Mr. Tent stated that at the original hearing the commission granted petitioner
permission to use property for parking and as yet he has not done so.
Mr. Hull stated there was a conflict, the ordinance does not permit parking
in RUF districts. Stated he has made a field inspection and felt there is
adequate parking in the general area but may not be as convenient as petitioner
1r) may like. There is parking within 75 feet to 125 feet of the building.
Upon a motion duly made by Mr. Cameron, seconded by Mr. Wrightman and unanimously
adopted, it was

Auust 31, 1965, on Petition 65-8-1-9 as submitted by
William A. Wood, Sr., Citizens Beauty School, Inc.. for a change
of zoning on the east side of Lathers, immediately south of the
alley, south of Seven Mile Road in the Northeast 1/4 of Section
12, from RUF to P, the City Planning Commission does hereby
recommend to the City Council that Petition 65-8-1-9 be denied
for the following reasons:
(1) This rezoning constitutes non-residential encroachment into
a completely residential neighborhood, and
(2) It is questionable whether there is sufficient need for this
additional parking to justify this rezoning at this time, and

date of August 11, 1965 and notice of which hearing was sent to

Mr. Whitehead announced the next item on the agenda is Petition 65-8-1-10

residential development, and

Mr. Pollock suggested that for this type of nursery that the City have on.
file regulations for use of such nursery as spelled out by the State and that

Planning Commission todetermine whether or not to hold a
Public Hearing on a proposed amendment to the Master School

adjacent to and east of the Junior High School site in
Section 17.
Upon a motion duly made by Mr. Ward and seconded by Mr. Wrightman, it was

Commission of the City of Livonia on its own motion does hereby
establish and order that a Public Hearing be held in the C'ty

Master School and Park Plan, Part V of the Master Plan of the
City of Livonia, should be amended so as to include the following

preventing establishing M-1 zoning uses, have been removed. Stated he is
not trying to save money but to save time in asking that commission
