HomeMy WebLinkAboutPLANNING MINUTES 1963-12-17 li: 4056 MINUTES OF THE 157TH REGULAR MEETING AND A PUBLIC HEARING BY THE CITY PLANNING COMMISSION OF THE CITY .:F LIVONIA On Tuesday, December 17, 1963, the City Planning Commission of the City of Livonia, held the 157th Regular Meeting and a Public Hearing at the Livonia City Hall, 33001 Five Mile Road, Livonia, Michigan. Mr. Edward Milligan, Chairman, called the 157th Regular Meeting to order at approximately 8:05 p.m. with four interested persons present in the audience. Members present: James Cameron Donald Huestead W. E. Okerstrom Edward Milligan Robert L. Angevine Charles Walker AK Members absent: *Milton Ingold **Dennis Anderson Daniel Allen Mr. Milligan announced the first item on the agenda is Petition M-305 by William Dyal and Albert Langer, requesting the approval to use said premises for the purpose of erecting apartments on property located on the east side of Fairfield, approximately 350 feet South of Five Mile Road and 150 feet West of Hubbard Road, in the Northwest 1/4 of Section 22. Public Hearing December 10, 1963, advisement. No one was present representing the petitioner. 1: Mr. Milligan stated there are 60 units involved in all and parking for 81 plus 39 cars. Mr. Walker questioned how entire area would come out as far as density is concerned. There was no one present to answer question. Mr. Okerstrom suggested that inasmuch as commission does not have a full report on item, commission should have further study. Commission should have density report and ingress and egress is not sufficient according to site plan. Stated he had not had an opportunity to look at site plan before tonight. Mr. Angevine commented that there would be a long dead end street. Mr. Milligan stated that the Public Hearing December 10, 1963, the petitioner informed commission that he is working in area to clear away trees, etc. Petitioner would like to tear down houses but cannot do so until the petition is act d upon. Petitioner also stated that if commission delays action it would be a hardship on him. However, Mr. Milligan stated he did feel commission should have more information. Mr. Milligan stated that item would be taken under advisement until January 7, 1964 at which time commission should have a more fully developed site plan. Mr. Milligan announced that the next item on the agenda is Petition Z-620 by Rodney C. Kropf, for Ernest McCausland who is requesting the rezoning of property located on the North side of Seven Mile Road, 150 feet test of Parkville Avenue in the Southwest 1/4 of Section 1, from RUFB to C-2. Public Hearing November 19, 1963, advisement. Mr. Kropf was present. a te 4057 Mr. Milligan read letter dated December 17, 1963 from Robert E. Thorne, Sergeant, Traffic Bureau, Department of Public Safety. Also stated he had tried to contact Mr. James E. Mies, Attorney for Tony Sinacola, etal regarding Petition Z-624 requesting a Ahange of zoning in the Northwest 1/4 of Section 12 but had failed to do so. Stated there is interest on their part to rezone property on the South side of Seven Mile Road to C-2 too. Question as to whether petitioner will remove homes or not. Mr. Okerstrom stated that if Mr. Mies' clients don't object to C-2 across the street then commission shouldn't give it much consideration either. Mr. Angevine brought to commission's attention that there will still be a RUF strip between the C-2 zoning and lot line of Lot 415. *Mr. Milton Ingold arrived at approximately 8:20 p.m. Mr. Kropf stated that Lot 415 has a common ownership (Frank J. Kane) and that there is a residence on the corner. The house will come down eventually. If the petition is approved, client will return with a use petition for a car wash. The property in the petition is the only part client has option on however may come back later for additional zoning but this is all client is interested in now. IL The property is 269' deep. Mr. Walker stated he wouldn't want Lot 415 left as it will be. Asked if owner would be interested in rezoning. Mr. Jaster (realtor ) stated owner would go along with it and that he could get petition. Mr. Kropf assured commission that a petition for change of zoning on the balance of Lot 415 would be filed prior to the City Council acting on Petition Z-620. Mr. Milligan stated that even though change of zoning would make area an isolated strip, that the other property would be C-2 in the future. Should commission take first step now or not. Mr. Okerstrom suggested that commission wait until other petition is filed and take action on both petitions at the same time. Mr. Milligan informed commission that even if Lot 415 is entirely rezoned to C-2 there will still be a strip of RUF between Lot 415 and the existing C-2 area. Mr. Walker stated favorable action tonight by commission will lead to rezoning to Parkville. Mr. Angevine questioned the erection of a wall as required by the Zoning Oidiz.ance. Mr. Kropf stated that this is another reason why his client is interested in the Kane's rezoning entire lot. Upon a motion duly made by Mr. Walker and seconded by Mr. Angevine, it was 1[400 #12-243-63 RE :LVED that, pursuant to a Public Hearing having been held on November 19, 1963, on Petition Z-620, by Rodney C. Kropf, for Ernest McCausland requesting the rezoning of property located on the North side of Seven Mile Road, 150 feet West of Parkville Avenue in the Southwest 1/4 of Section 1, from RUFB to C-2, the Gity Planning Commission does hereby recommend to the City 110 4058 Council that Petition Z-620 be granted because the land in question is most logically suited for C-2 zoning as demonstrated by the letter dated December 17, 1963 from Robert E. Thorne, Sergeant, Traffic Bureau, Department of Public Safety, and FURTHER RESOLVED, notice of the above hearing was published in the official newspaper, The Livonian-City Post under date of October 30, 1963, and notice of which hearing was sent to the Detroit Edison Company, The Consumers Power Company, Michigan Bell Telephone Company, Chesapeake & Ohio Railway Company, City Departments, and petitioner as listed in the Proof of Service. A roll call vote on the foregoing resolution resulted in the following: AYES: Ingold, Walker, Huestead and Angevine NAYS: Cameron, Okerstrom and Milligan Mr. Milligan declared the foregoing mctica is carried and the resolution is adopted. #12-244-63 7.3SOLVED that, the City Planning Commission does hereby approve the mirntes of meetings October 15, 1963 and October 22, 1963. A roll call vote on the foregoing resolution resulted in the following: AYES: Cameron, Walker, Okerstrom, Huestead, Angevine and Milligan NAYS: None NOT VOTING: Ingold The Chairman declared the motion is carried and the foregoing resolution is adopted. Upon a motion duly made by Mr. Walker, seconded by Mr. Okerstrom and unanimously adopted, the City Planning Commission does hereby adjourn the 157th Regular Meeting at approximately 8:55 pm. Mr. Milligan, Chairman, called the Public Hearing to order at 9:35 p.m. with all those present who were present at the time of the Regular Meeting in addition **to 75 more interested persons and Planning Commissioner Dennis Anderson. Mr. Milligan announced the first item on the Public Hearing is Petition Z-622 by Mr. John Griffin, Agent for the H. D. Wilson Company who is requesting the rezoning of property located on the Northeast corner of Middlebelt and West Chicago Roads in the Northwest 1/4 of Section I 36, from R1B to C-2. Mr. Griffin submitted sketch showing proposed gasoline station would be located on the corner 150' sc,Lare of Middlebelt and West Chicago Roads and that the remainder of the parcel along West Chicago would be C-2 too. The piece 249' x 2991 along Middlebelt Road and 350' North of West Chicago Road does not show any 4059 change of zoning because at a later date client will donate piece for a public library. This piece of property is not included in petition. The only attachment is that the library be called Charles Wilson Library but if city wants to use property for something else it can do so. There were 15 persons present objecting to petition. Mr. Milligan read letter dated December 9, 1963 from Mrs. Alice McCann objecting to petition. Mr. Guy M. Holwig, 29147 West Chicago stated he did not feel gasoline station proper for this area. The addition will add to traffic hazard and there is a need for more school parking. Mr. Ed Demick, 9643 Garden, President of Wilson P.T.P. stated it was his understanding that property was to remain R-1. The block is a traffic hazard now and P.T.A. is objecting to petition. Mr. Milligan assured audience that property to be used for gasoline station does not abut school property. Dr. Barnes, 9646 Garden stated proposed gasoline station would not add to value of land in area. It would be a traffic hazard and corner is bad now. Mr. Jerry Scully, 36060 West Chicago stated request is in most populated area in city. Suggested property be acquired for recreational area for all residents. Mr. James Walsh, 29044 Hathaway submitted a map showing twenty-three gasoline stations in a one mile square area (Plymouth and Joy Roads and Merriman and Inkster Roads). Mr. Okerstrom temporarily left meeting at approximately 10:00 p.m. Mr. Milligan asked petitioner whether client would consider another zoning classification other than C-2. Mr. Griffin stated a gasoline service station isin their plans and use is allowed only in C-2. Mr. Ingold asked about PS zoning classification. Mr. Griffin stated PS would not be economically good for client at this time. Mr. Walker stated he thought there was enough C-1 or C-2 in area. Thought property should be developed in PS zoning classification or for public use. Mr. Okerstrom returned to meeting at approximately 10:05 p.m. Mr. Walker suggested Mr. Griffin return to client and come back to commission with something mae compatible with existing property owners. Mr. Wiliam Warren, 30235 Hoy, Principal, Emerson School, stated a C-1 or C-2 change of zoning presents many problems to school children. Mr. Milligan stated that item would be taken under advisement until January 7, 1964. Mr. Milligan announced that the next item on the agenda is Petition Z-623 by W. Warren Shelden for Shelden Land Company, who is requesting the li: 4060 rezoning of property located on the East side of Farmingtan Road, approximately 900 feet South of Plymouth Road, directly South of Shelden Shop Center in the Northwest 1/4 of Section 34 from C-2 and R-2 to R-3. Mr. Shelden was present and stated that the hopeof a regional shopping center is out of the question with existing Wonderland and proposed Sears and that this request would serve as a buffer between present zoning classifications. Mr. Okerstrom asked whether dead end streets to the South would be continued. Mr. Shelden stated they plan R-3 use with streets going through. Mr. Carlyle Harrington, 9814 Loveland asked petitioner wheth*r large rental apartments would be kept in any better condition than other presently owned rental units. Objected to petition because of traffic problem of people coming into Shelden Center. Mr. Jerry Scully, 36060 West Chicago stated land would be ideal for apartments. Mr. F. M. Byrd, Jr., 9834 Shadyside asked about play area for children. Mr. Shelden stated that play area has been rented to the City of Livonia for ';1 a year and that now company needed area for return on its investment. Mr. William Ponder, 32510 Plymouth Road thought it would be a good thing to go along with request. Change of zoning classification would make a good transitional area. Mr. Rodney C. Kropf, 30320 West Chicago, representing Mai Kai, thought change of zoning would be asset to area. Mr. Robert Conroy, 9840 Shadyside stated there is a need in this area for recreational facilities. Suggested commission look into what is necessary to secure property for recreational use. Mr. Byrd asked why land couldn't be developed into R-1 or R-2 use. Mr. Shelden stated it did not lend itself to rental units and that Sheldon Land Company intended to develop area itself. Mr. Walker asked whether recreational equipment could be relocated on property that will not be used for R-3. Mr. Shelden stated they would agree to this. Mr. Milligan stated that item would be taken under advisement until January 7, 1964. Mr. Milligan announced that the next item on the agenda is Petition Z-624 by James E. Mies, Attorney for Tony Sinacola, etal, who is requesting 10 the rezoning of property located on the South side of Seven Mile Road, approximately 532 feet East of Middlebelt Road in the North- west 1/4 of Sebtion 12, from R1B to C-2, Mr. Mies stated they wish to develop area C-2 because of changing conditions. Stated clients intent to relocate three homes on residential property. Clients are going to develop property themselves but have nothing definite in mind now. 4061 Mr. Walker asked if clients were involved in property that is R-3. Mr. Mies answered that it is independent of this and is not related to R-3 behind. Mr. Rodney C. Kropf, 30320 West Chicago, representing Mr, Ernest McCausland, stated client has no objection to petition as submitted. No one was present objecting to petition. Mr. Milligan stated that item would be taken under advisement until January 7, 1964. Mr. Milligan announced that the next item on the agenda is Petition Z-625 by Bernard Edelman, President, Tomorrows Homes, Inc., who is requesting the rezoning of property located 1350 feet South of Seven Mile Road 1320 feet West of Newburgh Road, immediately South of Melody Manor Subdivision, also, a parcel of land situated 200 feet South of Seven Mile Road immediately West of Melody' Manor Subdivision in the Northeast 1/4 of Section 7, from RUA to RLA. Mr. William Ponder, 32510 Plymouth Road, representing the petitioner, stated that there are 42.5 acres and petitioner would like to plat in 80' lots rather than 1CO! lots. There are no surrounding subdivisions that this will conflict with. At present client will develop only 2/3 of property as the sewer will 110 not handle East 1/3 of property because of lowness of area. This section cannot be developed until the sewer is extended on Newburg Road. Anything larger than 80' lots in this area because of cost of developing, clearing woods, etc. would be prohibitive. Informed commission that Melody Manor Subdivision is basically 80' lots. Mr. Orville Barron, 38600 Six Mile Road, owner of 84 acres in Section 7 South of Schoolcraft College, informed commission that he had had several developers looking at his property but that when they found out lot requirement they were not interested. Mr. Walker asked what size lot Mr. Barron had found to be desirable and would move in area. Mr. Barron answered if someone else has 60' lots in area, then he would like also to have 60' lots. Mr. Robert Newsted, 18869 Nola Drive stated lots in Melody Manor Subdivision are 80' to 100' x 150' and that most of the property owners have built their own homes. Objected to size of lot being reduced in size and that Ye would like area abutting Nola Drive left large in size. Mr. Bernard Edelman stated that the Schoolcr.ft College would dedicate land so that the street on the West end of parcel can go through. Requesting 1,200 square foot lots (80' x 150') but some of the lots will be larger. Mr. Leroy Bennett, 18809 Nola, stated 80' lots in Melody Manor Subdivision are the exception rather than the rule. Asked about Hix Road and Express Way I: route. Mr. Edelman stated that the latest information he had is that Express Way route was to be 500' - 600' West of Hix Road. Mr. Milligan announced that this item would be taken under advisement until January 7, 1964. Pe-- 4062 Mr. Milligan announced that the next item on the agenda is Petition Z-626 by the City Planning Commission on its own motion to hold a Public Hearing to determine whether or not to rezone property located approximately 1330 feet South of Schoolcraft Road and 500 feet North of Chesapeake & Ohio Railroad, on the West side of Merriman Road, in the Northeast 1/4 of Section 27, from M-1 to M-2. Mr. Dan AndrewIndustrial Coordinator, stated that the North 4001 of Newman Farms (to Hawkins Drain) has been sold to two Redford Twp. concerns that will relocate within area within two years. The one plant has several 75 ton punch presses. Inasmuch as this is not specifically spelled out in Zoning Ordinance,they are requesting M-2 zoning classification to be sure. No one was present objecting to petition as presented. Mr. Milligan announced that this item would be taken under advisement until January 7, 1964. Mr. Milligan announced that the next item on the agenda is petition by the City Planning Commission to held a Public Hearing to determine whether or not to adopt the new proposed Zoning Ordinance and Zoning Map for the City of Livonia; said Ordinance and Map to be designated as Part IV of the Master Plan. No one was present objecting to petition. Mr. Milligan announced that this item would be taken under advisement until January 7, 1964. Upon a motion duly made by Mr. Angevine, seconded by Mr. Ingold and unanimously adopted, it was #12-245-63 RESOLVED that, the City Planning Commission does hereby adjourn the Public Hearing held on Tuesday, December 17, 1963, at approxi- mately 11:25 p.m. The Chairman declared the motion is carried and the Public Hearing is adjourned.
