The meeting was called to order at 5:30 p.m. Members Present: Ronald Campau, Chairperson Charlotte S. Mahoney Harry C. Tatigian Also Present: Charles Locke, President, AFSCME Union Audrey Young, Chief Roads Steward, Local 192 AFSCME Union Local 192 Chris Smith, Equipment Maintenance Robert F. Washington, Personnel Analyst II Brian Wilson, Superintendent of Public Gretchen Guisbert, Secretary III Service The Chairperson stepped down to second the following motions, until Ms. Mahoney could be present: Upon a motion by Mr. Tatigian, seconded by Mr. Campau and adopted, it was 09-100 RESOLVED, That the minutes of the 1258th Regular Meeting held Wednesday, March 18, 2009, be approved as submitted. 09-101 RESOLVED, That having reviewed the letter of March 25, 2009, from Karla Sadler, Clerk -Typist I, and approved for submission by Karen Kapchonick, Superintendent of Parks and Recreation, requesting approval to use six (6) additional sick leave days for family illness, the Civil Service Commission does hereby confirm the administrative approval of Ms. Sadler's request to use six (6) additional sick leave days for family illness. 09-102 RESOLVED, That having reviewed the letter of April 8, 2009, from Debra Finkbeiner, Clerk I, and approved for submission by Kathleen Monroe, City Librarian, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby confirm the administrative approval of Ms. Finkbeiners request for an unpaid medical leave of absence for a period not to exceed ninety (90) days beginning on April 1, 2009, with an expected return to work date of May 1, 2009; AND BE IT FURTHER RESOLVED, This unpaid medical leave is subject to Ms. Finkbeiner providing additional medical certification from her personal physician should she need to extend her unpaid medical leave of absence beyond May 1, 2009. 09-103 RESOLVED, That having reviewed the Departmental Correspondence of March 16, 2009, from Jeffrey Ronayne, Senior Police Officer, Paget 1259' Regular Meeting Arn115,2009 as approved for submission by Robert Stevenson, Police Chief, requesting carry over of vacation days based on a projected refirement date of March 31, 2012, the Civil Service Commission does hereby confirm the administrative approval to carry over excess vacation days; AND BE IT FURTHER RESOLVED, that the maximum number of days permitted for payoff at retirement is sixty-eight (68) as established in accordance with the Livonia Police Officers Association contract, Article 22.9, Vacation Accrual and Civil Service Commission Rule 25, LEAVES, Section 25.1 Annual Leave (Vacation), paragraph (f), AND BE IT FURTHER RESOLVED, that the maximum number of days is based upon the employee qualifying for the bonus vacation days for not using more than five (5) sick leave days annually in the three (3) years immediately prior to retirement. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was 09-104 RESOLVED, That the Civil Service Commission does hereby confirm the passing points of 96 (70.5%) on the IPMA-HR Clerical Series (CSI - A); 29 (72.5%) on the Watson -Glaser Critical Thinking Appraisal; and 25 (50%) on the Wonderlic Personnel Test, for the written examination for Program Supervisor (922 o.c.). 09-105 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Account Clerk III (921 o.c.). 09-106 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Police Sergeant (1292 p.). 09-107 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Police Lieutenant (1291 p.). 09-108 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Heating Inspector (923 o.c.). 09-109 RESOLVED, That the Civil Service Commission does hereby confirm the administrative approval of the eligible list for Program Supervisor — Office Manager (922 o.c.). Robert Biga, Human Resources Director, explained that there was a question about a Temporary Employee on the Status of Temporary Employees report from February 2009. This matter was reviewed and that person should have been granted regular status. The paperwork is being processed regarding this matter. Current Open -Competitive and Promotional Eligible Lists as of April 1, 2009. d. Affirmative Action Report for March 2009. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and adopted, it was 09-110 RESOLVED, That having reviewed the expiring eligible lists for the month of May 2009 — Clerk -Typist (889 o.c.) and Library Aide II (1278 p.), the Civil Service Commission does hereby approve the extension of the Clerk Typist (889 o.c.) list for three (3) months until August 2009. f. Removal of names from active eligible list report for the month of April 2009. Letter of March 5, 2009, from Robert F. Biga, Human Resources Director, to the City Council, transmitting the tentative agreement between the City of Livonia and the Livonia Fire Fighters Union, for the period December 1, 2008 through November 30, 2012. h. Letter of March 23, 2009, from Robert F. Biga, Human Resources Director, to the City Council, requesting to withdraw the Implementation of Dental and Optical Offsite Administrative Agreement, due to the proposals being expired. 1. Council Resolutions from the March 9, 2009 meeting with minutes to be approved March 25, 2009: (1) #85-09, reappointing Jacob Ghannam, to the Board of Ethics for a three year term which will expire on March 1, 2012. (2) #86-09, reappointing Audrey Greenleaf to the Board of Ethics for a three year term which will expire on March 1, 2012. j. Council Resolutions from the March 25, 2009 meeting with minutes to be approved April 8, 2009: (1) #114-09, approving the request to appoint Kevin Maillard to the position of Director of Public Works, effective March 2, 2009. (2) #137-09, directing that a Closed Committee of the Whole meeting be held for the purpose of discussing the negotiation of the Livonia Fire Fighters Union tentative agreement for the period December 1, 2008, through November 30, 2012. Robert Biga explained that the Livonia Fire Fighters Union contract will be reported out at the City Council regular meeting for approval. Upon a motion by Mr. Tatigian, seconded by Mr. Cant and adopted, it was 09-111 RESOLVED, That having reviewed the Departmental Correspondence of March 23, 2009, from Nancy Mitts, Account Clerk I, as approved for submission by Shadd A. Whitehead, Fire Chief, requesting permission to carry over vacation days in excess of the maximum based on a new projected retirement date of November 29, 2010, the Civil Service Commission does hereby approve Ms. Mitts' request to carry over excess vacation days up to a maximum payout of fifty-seven (57) days as provided by Civil Service RULE 25, LEAVES, Section 25.1. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and adopted, it was 09-112 RESOLVED, That having reviewed the letter dated April 2, 2009, from Robert Stevenson, Police Chief, requesting to rehire Sharon Cracchiolo, as a Police Dispatcher, at a pay rate of Step 3 ($24.12, $1,929.60), the Civil Service Commission does hereby approve this request. Robert F. Biga, Human Resources Director, staled he met with John Pastor, Council Member, after his appointment to City Council and in reviewing his file, it was discovered he never opted out of the pension plan when he was a Council member before, but he was never in the pension plan. The question is whether or not he can be a member of the pension plan and questions such as these are the jurisdiction of the Civil Service Commission, not the Retirement Board. In reviewing the Ordinance, it is recommended that this matter be sent to legal counsel for the Retirement Board for their recommendation. Mr. Tatigian requested that all pertinent information be furnished to legal counsel of the Retirement Board. Upon a motion by Mr. Tatigian, seconded by Mr. Campau and adopted, it was 09-113 RESOLVED, That having reviewed the letters of March 25, 2009 from John Pastor, Council Member, regarding participation in the pension plan and prior service time, and having discussion with Robert F. Biga, Human Resources Director, the Civil Service Commission does hereby refer this matter to the legal counsel of the Retirement Board for their review and recommendation. Brian Wilson, Superintendent of Public Service, explained that AFSCME Union Local 192 Grievance #09-07 and #09-08 and a third grievance not on this Agenda are all similar in nature. The Department has had ongoing discussions on these grievances and they met yesterday to settle what they are going to do. They may have to come back to the Civil Service Commission with discussions about how this matter will work for the future. Mr. Wilson requested to postpone AFSCME Grievance #09-07 because of further discussions. He staled the intent was to pattern the settlement of the other grievance the same as Grievance #09-07. Mr. Campau inquired if Mr. Wilson wanted to postpone both #09-07 and #09-08 and Mr. Wilson replied that #09-08 was resolved, but #09-07 and the other grievance are similar. Mr. Campau asked Charles Locke, President, AFSCME Union Local 192, if he agreed with this and Mr. Locke said yes and no. Mr. Campau requested a yes or no answer. Mr. Locke replied he did not agree with the way Mr. Wilson wanted to settle this. Mr. Campau recommended Mr. Wilson and Mr. Locke have further discussion to try to resolve this and if they want to come back to the Civil Service Commission at the next meeting that would be fine. Both Mr. Wilson and Mr. Locke agreed to this. Page 6 1259'" Regular Meeting Arnl 15, 2009 Upon a motion by Mr. Tatigian, seconded by Mr. Cant and adopted, it was 09-114 RESOLVED, That having reviewed AFSCME Union Local 192 Grievance #09-07, and after discussion with Brian Wilson, Superintendent of Public Service and Charles Locke, President, AFSCME Union Local 192, the Civil Service Commission does hereby postpone the grievance, as agreed to by Management with the Union having no objections. The Civil Service Commission took a 5 -minute break and reconvened at 5:40 p.m. Ms. Mahoney entered the meeting at 5:40 p.m. To alleviate some of the negative impacts to employees voluntarily taking time off without pay during this period of economic uncertainty, Mr. Biga presented a draft resolution as a possible option. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was resolved that: 09-115 WHEREAS, the City of Livonia is encountering unusual economic conditions which are adversely affecting the City's budget; and WHEREAS, certain employees wish to be proactive to assist in providing resources to the City to retain other City employees; and WHEREAS, City policies require that individuals who do not work a complete calendar year must have their accrued leave banks and continuous service credits adjusted based on hours worked; and WHEREAS, The Civil Service Commission of the City of Livonia is empowered to enforce the Civil Service Commission Rules in a manner as to best effectuate the intent of the City Charter; and WHEREAS, the Civil Service Commission and elected officials wish to reduce the hardship endured by these employees; NOW, THEREFORE, BE IT RESOLVED, That the Civil Service Commission does hereby determine that employees who voluntarily take unpaid time off up to a maximum of thirteen (13) work days per year, prior to December 31, 2010, shall not have any reductions in accrued leave or other benefits such as, but not limited to, continuous service credit, longevity pay and insurance coverage for the period of time that they are off work or an unpaid status.
