The 1249' Regular Meeting of the Civil Service Commission was held on Thursday, June 19,
2008. The meeting was called to order at 6:00 p.m.

Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was
08-128 RESOLVED, That the minutes of the 1248' Regular Meeting held
Wednesday, May 21, 2008, be approved as submitted.
Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was
08-129 RESOLVED, That the Civil Service Commission does hereby
confirm the administrative approval of Shane House's request for an intermittent
unpaid medical leave of absence for a period not to exceed three (3) calendar
months, provided Mr. House does not exceed the twelve (12) week or 480 hours
allowed under the federal Family and Medical Leave Act (FMLA) and subject to
Mr. House providing required medical documentation to the Civil Service
Department.
08-130 RESOLVED, That the Civil Service Commission does hereby
confirm the administrative approval of Brian Edwards' request for an intermittent
unpaid medical leave of absence for a period not to exceed three (3) calendar
months, provided Mr. Edwards does not exceed the twelve (12) week or 480
hours allowed under the federal Family and Medical Leave Act (FMLA) and
subject to Mr. Edwards providing required medical certification to the Civil
Service Department.
08-131 RESOLVED, That the Civil Service Commission does hereby
confirm the administrative approval of Daniel West's request for an unpaid
medical leave of absence from June 6, 2008 through June 16, 2008, pursuant to
Civil Service Commission RULE 25, LEAVES, Section 25.5 Leaves of Absence.
08-132 RESOLVED, That the Civil Service Commission does hereby
confirm the administrative approval of the passing point of 70% or 14 out of the
maximum score of 20 on the Public Safely Telecommunication Examination

listening test; and 70% or 56 out of the maximum score of 84 on the written test
for Police Dispatcher (913 o.c.).
08-133 RESOLVED, That the Civil Service Commission does hereby
confirm the administrative approval of the Custodian (914 o.c.) eligible list.
08-134 RESOLVED, That having reviewed the expiring eligible lists for the
month of July 2008 — Assistant Branch Librarian (898 o.c.), Building Inspector
(868 o.c.), Building Mechanic IV (896 o.c.), Librarian 1 (891 o.c.), Police Crime
Analyst (895 o.c.), Equipment Operator III (1250 p.) and Fire Training
Coordinator (1226 p.), the Civil Service Commission does hereby confirm the
administrative approval to extend the Assistant Branch Librarian (898 o.c.),
Librarian I (891 o.c.), Police Crime Analyst (895 o.c.) and Equipment Operator III
(1250 p.) eligible lists for six (6) months to January 18, 2009.
The Commission received and filed the report of active Open -Competitive and Promotional
eligible lists as of June 1, 2008.
The Commission received and fled the Removal of Names from Active Eligible List Report for

The Commission received and fled the following:
Status of Temporary Employees Report for May 2008.
Non -Resident Report as of June 1, 2008.
Council Resolution #196-08 from the May 14, 2008 meeting, with minutes
to be approved May 28, 2008, approving the collective bargaining
agreement between the City of Livonia and AFSCME Union Local 1917 for
the period December 1, 2007 through November 30, 2010.
Affirmative Action Report for May 2008.
Mark Trybus, Equipment Operator 11, presented AFSCME Union Local 192 Grievance #08-04,
dated March 4, 2008, by stating he had a medical condition which affected his sleep and he
believed he was not called in to work overtime when he should have been. Mr. Trybus had a
note from his doctor restricting the hours he could work and he later obtained a new note from
a new doctor allowing him to work more hours.
Patrick A. Hogan, Director of Public Works, sent a letter dated December 14, 2007, to Derrick
Washington, which stated the accommodations required by Mr. Trybus' doctor would pose a
hardship on the department. Mr. Trybus stated he didn't receive a copy of that letter until after
he came back from his vacation, which was from December 13, 2007 to January 5, 2008.

Audrey Young, Chief Roads Steward, AFSCME Union Local 192, stated that other employees
returning from medical leave are put back in their regular spot on the call -out list.
Mr. Campau referenced four dates in March where the department called Mr. Trybus and there
was no contact made. Mr. Trybus responded that he was referring to the time in December
and January. One issue Mr. Trybus had was not being called on January 1, 2008; the second
issue was that he was put at the bottom of the list for call-in after January 3rd, but didn't receive
notification until he returned from vacation on January Sh. He alleged he was back in town on
January 1 and he should have been called.
Brian Wilson, Superintendent of Public Service, stated a letter dated December 6, 2007, from
Derrick Washington, outlined Mr. Trybus' restrictions along with a copy of the doctor's note.
The department reviewed the matter, but due to the nature of the department's work and its
responsibility to respond to emergencies, it was unreasonable to accommodate Mr. Trybus'
sleep schedule. The department suggested a temporary accommodation allowing Mr. Trybus
to remain in the Equipment Operator position, excusing him from call -ins, and allowing him to
work scheduled overtime if Mr. Trybus notified his supervisor ahead of time that he may have
to leave if that overtime interfered with his sleep schedule as outlined by Mr. Trybus' doctor.
The response to the letter was sent back to Mr. Washington who notified Mr. Trybus by
telephone prior to the holiday, but Mr. Trybus was not in agreement with the conditions listed in
the response letter. Mr. Washington sent a letter to Mr. Trybus on January 3, 2008 indicating it
was his responsibility to provide any additional medical information if modifications to the
proposed accommodations could be made. The department awaited further information from
Mr. Trybus regarding any change in his medical certification. On February 20, 2008 Mr.
Trybus provided medical certification lifting his restrictions. The department doesn't feel Mr.
Trybus should be paid for time Mr. Trybus did not work and no contract violation occurred.
Charles Locke, President, AFSCME Union Local 192, stated that Mr. Trybus' not being called
on January 1, 2008 was a contract violation, whether Mr. Trybus came in or not and he
believed he should be paid for the twelve (12) hours on January 1, 2008.
Mr. Wilson stated there was no confusion about not calling Mr. Trybus on January 1, 2008,
because the department was complying with the restrictions listed on the doctor's note, but Mr.
Trybus was unhappy with the accommodations.
Ms. Mahoney inquired if Mr. Trybus remembered a telephone conversation with Mr.
Washington prior to his going away on vacation. He stated he did not remember. When asked
the same question, Mr. Washington responded that he did recall talking to Mr. Trybus on the
phone prior to the holiday.
Ms. Mahoney indicated she would be inclined to deny the grievance because she doesn't
believe the City should be responsible for an "if I was called, I would have come in" situation,
but she also indicated that Mr. Trybus should be moved to the top of the call-in list for the next
call -outs.
Mr. Tatigian expressed sympathy for anyone dealing with sleep problems and he also
expressed his gratitude to all the employees who worked in emergency weather conditions to
clear the streets.

Mr. Campau reminded the union representatives to state which applicable part of the contract
was violated when submitting grievances.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was
08-135 RESOLVED, That having reviewed AFSCME Union Local 192
Grievance #08-04, dated March 4, 2008, from Mark Trybus, Equipment Operator
II, regarding being put back on the call -out list, and having discussion with Mr.
Trybus, Equipment Operator II; Audrey Young, Chief Roads Steward, AFSCME
Union Local 192; Charles Locke, President, AFSCME Union Local 192; Brian
Wilson, Superintendent of Public Service; Robert F. Biga, Human Resources
Director; and Derrick L. Washington, Personnel Analyst II, the Civil Service
Commission does hereby deny the grievance, with the understanding that Mr.
Trybus will be placed at low hours on the overtime call -out list.
Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was
08-136 RESOLVED, That having reviewed the letter of May 19, 2008, from
Charlene Studstill, Program Supervisor, as recommended for approval by Robert
F. Biga, Human Resources Director, requesting permission to carry over
vacation days in excess of the maximum based on a new projected retirement
date of May 18, 2011, the Civil Service Commission does hereby approve Ms.
Studstill's request to carry over excess vacation days up to a maximum payout
of fifty-seven (57) days as provided by Civil Service RULE 25, LEAVES,
Section 25.1.
Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was
08-137 RESOLVED, That having reviewed the letter of May 22, 2008, from
Lyle Trudell, Assistant Superintendent of Parks and Recreation, as
recommended for approval by Karen Kapchonick, Superintendent of Parks and
Recreation, requesting permission to carry over vacation days in excess of
the maximum based on a new projected retirement date of December 31, 2011,
the Civil Service Commission does hereby approve Mr. Trudell's request to carry
over excess vacation days up to a maximum payout of fifty-seven (57) days
as provided by Civil Service RULE 25, LEAVES, Section 25.1.
Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was
08-138 RESOLVED, That having reviewed the letter of June 2, 2008, from
Curtis Caid, Acting Chief of Police, requesting an extension of temporary
employment of the Communications Supervisor, the Civil Service Commission
does hereby approve the request with the understanding that Mr. Sellinger's
service should be terminated for a minimum of two (2) weeks before being
rehired.

Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was
08-139 RESOLVED, That having reviewed the letter of May 21, 2008, from
Karla Sadler, Clerk -Typist I, as approved for submission by Karen Kapchonick,
Superintendent of Parks and Recreation, requesting to take the Clerk -Typist II
promotional examination, the Civil Service Commission does hereby deny the
request based on the AFSCME Union Local 192, Article 12, SENIORITY, A., and
recommends that Ms. Sadler fulfill the two-year service requirement as a regular
Clerk -Typist I, before being allowed to lest for the Clerk -Typist II promotional
examination.
Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was
08-140 RESOLVED, That having reviewed the memorandum of June 17,
2008, from Robert F. Biga, Human Resources Director, regarding the
reinstatement of Sharon Dolmetsch, the Civil Service Commission does hereby
approve the reinstatement in accordance with Civil Service rules, with the
following conditions:
1. Ms. Dolmetsch was paid off for her accumulated vacation and sick time.
She will accrue additional vacation and sick time as a reinstated employee
which means that she will get vacation credit for the month of June and will
get one (1) sick leave day per month for the remainder of her employment.
Her vacation credits will be computed on the basis of an employee with
twenty-nine (29) years of service.
2. Ms. Dolmetsch received a longevity payment upon her termination. She will
be eligible for additional longevity credits from her dale of reinstatement until
November 30, 2008. Her prorated longevity payment plus what she has
received earlier will not exceed the maximum for a twenty-nine year
employee.
3. Ms. Dolmetsch was paid for 60% of 691 hours of sick leave. Since the
maximum number of sick days for payout purposes is 60% of 225 days
(60% of 1800 hours), she is eligible for payout up to the maximum permitted
for an employee with twenty-nine (29) years of service.
4. Ms. Dolmetsch was paid for the maximum number of vacation days;
therefore, she is not eligible for additional payout upon her eventual
retirement.
5. Ms. Dolmetsch will not be eligible for additional personal business days,
since she will not have six (6) months of service left in the calendar year.
She will be eligible for additional personal business days after January 1,
2009.
6. Ms. Dolmetsch will not receive any retirement service credit for her
temporary service time from May 5, 2008 to June 11, 2008. She will receive
service credit from her effective date of reinstatement on June 11, 2008.
7. Since this situation was through no fault of the employee, she will be
returned to the Defined Benefit retirement plan in order to accumulate the
necessary thirty (30) year service credit for eligibility for retirement.
8. Ms. Dolmetsch's adjusted service time will be used to calculate a date by
which she will attain thirty (30) years of retirement service credit.

Brian Wilson, Superintendent of Public Service, presented the Department of Public Works
Vehicle Idling Policy to the Commission and advised this was intended to reduce waste and
control costs. He explained that there are employees who leave a vehicle running if they stop
by the department for a few minutes. Foremen will remind employees to tum vehicles off. In
cold weather there are employees who start the City vehicles and let them run for 20 minutes
to wane up before going to their job assignment. The Department of Public Works reviewed
this policy with Union Local 192 and Union Local 1917 and the reason for the policy is due to
increased fuel costs and the adverse impact on the environment.
Ms. Mahoney thought it was a great suggestion, but was concerned how this would be policed.
Mr. Wilson assured that the intent was not to spend more in personnel costs by policing this
policy, but rather to reduce wasted fuel.
Charles Locke, President, AFSCME Union Local 192, stated the union doesn't want this to be
used as a tool against employees.
Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was
08-141 RESOLVED, That having reviewed the letter of June 10, 2008, from
Brian Wilson, Superintendent of Public Service and Patrick A. Hogan, Director of
Public Works, regarding the Department of Public Works Vehicle Idling Policy,
the Civil Service Commission does hereby approve the Department of Public
Works Vehicle Idling Policy.
Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was
08-142 RESOLVED, That having reviewed the letter of June 9, 2008, from
Alex Bishop, Director of Inspection, requesting an open -competitive examination
for Building Inspector and proposed qualifications and parts of examination and
weights, the Civil Service Commission does hereby approve the following
qualifications and parts of examination and weights:
QUALIFICATIONS
By the closing date of application, applicants must:
Be a citizen of the United States or resident alien with the right to work in
the United States; and
Have a high school diploma or equivalent; and
Be familiar with local, state and national building codes, have thorough
knowledge of construction methods and techniques and have some
knowledge of electrical, plumbing and heating codes; and
Have either:
a. At least five (5) years of full-time paid experience in responsible
residential and/or commercial building construction work, four (4)
years of which have been within the past ten (10) years; OR

b. At least three (3) years of full-time paid experience in responsible
residential and/or commercial building construction work within the
past ten (10) years, PLUS either
i. An Associate's degree related to a building construction
program from an accredited college or university; OR
ii. One (1) year of full-time paid experience as Building
Inspector (Registered in accordance with P.A. 54) within the
past five (5) years; OR
C. An equivalent combination of the above experience and education.
Have State of Michigan registration as Building Inspector and Plan
Reviewer or be able to become registered within six (6) months of hire.
Possess and maintain a valid Michigan driver's license with an acceptable
driving record.
NOTE: ORIGINAL COLLEGE TRANSCRIPTS, HIGH SCHOOL DIPLOMA OR GED
MUST BE SUBMITTED AT TIME OF INTERVIEW.
THE APPLICANT MUST PASS THE STATE CERTIFICATION FOR BUILDING INSPECTOR
WITHIN SIX (6) MONTHS FROM DATE OF HIRE. FAILURE TO DO SO SHALL BE CAUSE
FOR DISMISSAL

Background Investigation — Pass/Fail
NOTE: In the event the number of qualified applicants exceeds fifteen (15), an evaluation will
be made and the fifteen (15) applicants with the most appropriate combination of experience
and training will be invited to the Interview. Candidates must pass the Interview in order to be
placed on the eligible list.
Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was
08-143 RESOLVED, That having reviewed the letter of June 18, 2008, from
Karen Kapchonick, Superintendent of Parks and Recreation, requesting an
unpaid medical leave of absence for Amy Walker, Recreation Supervisor —
Special Events, the Civil Service Commission does hereby approve a thirty (30)
day unpaid medical leave of absence for Ms. Walker beginning June 12, 2008,
subject to receipt of appropriate medical documentation.
The Commission changed the dates and time of the August 2008 and September 2008
meetings to Thursday, August 21, 2008, at 6:00 p.m. and Thursday, September 25, 2008 at
5:30 p.m. Both meetings will still take place in the 5^ floor gallery of City Hall.
