The meeting was called to order at 5:30 P.M. Members Present: Ronald E. Campau, Chairperson Charlotte S. Mahoney Harry C. Tatigian Also Present: Gregory Arnold, Battalion Chief Alan W. Washington, Personnel Analyst II Gretchen Guisbert, Secretary III Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That having reviewed the letter of March 30, 2004, from Elsie Graham, Clerk I, as approved for submission by Val Vandersloot, City Clerk, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby grant an unpaid medical leave of absence for twelve (12) weeks, from April 1, 2004, through June 24, 2004. AND BE IT FURTHER RESOLVED, That should Ms. Graham's physician medically release her to return to work prior to her scheduled return date, that she will report to her supervisor to coordinate a return to work examination with the City physician. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That having reviewed the letter of April 1, 2004, from Val Vandersloot, City Clerk, requesting a promotional examination for Elections Record Clerk and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open to employees of the City of Livonia who, by the closing date of the announcement, are: Employed in the Office of the City Clerk; and Have status as an Elections System Operator; and Paget 1199th Regular Meeting April 7, 2004 Have experience in the City Clerk's Office with a thorough knowledge and understanding of its procedures, in particular, procedures relating to Michigan Election laws; and Have experience working with the Qualified Voter File and/or Optech Eagle voting system. PARTS OF EXAMINATION AND WEIGHTS INTERVIEW -80% DEPARTMENTAL RATING -20%, 'In the event there is only one qualified applicant, the Parts of Examination and Weights will be 100% Departmental Rating. Due to a staff shortage as a result of the aggrieved employee's release from duty to permit attendance to this Commission meeting, the discussion commenced regarding Livonia Fire Fighters Union (LFFU) Grievance #747-033, from Daniel Lee, Fire Engineer, concerning call-in overtime. Briefly, Union representative Gary Scheske, Fire Fighter, stated that Daniel Lee, Fire Engineer, missed twenty-four (24) hours of overtime because the contract language conceming overtime call -out procedure wasn't followed. Mr. Campau inquired how it wasn't followed. Mr. Scheske stated that the overtime procedure is outlined in Appendix Bl and B4 in the LFFU contract and that the overtime preference is awarded by position to the most senior employee, with the least accumulated overtime. Mr. Tatigian stated that the Fire Chief responded in his letter of September 19, 2003, that in order to have a grievance, reference must be made to the specific provision of the Agreement, which was allegedly breached. The letter also refers to the response issued by Captain Arnold on September 9, 2003 in which Captain Arnold stated he followed the established overtime call - out procedure. Mr. Scheske agreed the Battalion Chief did go through one eligible unit but he was unable to find somebody on that unit to work. Overtime was then offered to Driver Conti and Lt. Sutliff, both of whom had more overtime hours than Dan Lee. Mr. Scheske continued that Mr. Lee was present at Station 5 that morning and was eligible for preference due to his lower amount of recorded overtime. Mr. Tatigian briefly clarified that Firefighter Lee's previous grievance concerning overtime call out was not precedent setting and this grievance would be considered on it's own merits. He went on to review that the Battalion Chiefs response to this grievance identified that anybody readily available from the off going shift was asked to work. Mr. Scheske read Appendix B1 of the contract. He stated that the union's position was that the call-in procedure required to first call in from the Kelly lists and then, if unsuccessful, by scanning the overtime list for remaining employee(s) going off shift with the preference granted to those with the lowest amount of overtime hours. Mr. Scheske stated that Battalion Chief Arnold went through the list by calling everybody that was on Kelly 1; however, no one accepted the overtime. In his letter, Battalion Chief Arnold further stated that after going through the required Kelly lists, he asked Driver Conti and Lt. Sutliff. Mr. Scheske repeated that Dan Lee was on duty that day and he should have been offered the overtime because of lower accumulated overtime hours. Page 1199th Regular Meeting April 7, 2004 Mr. Campau asked to hear the City's response. Chief Brandemihl stated he thought about asking for reconsideration of Mr. Lee's previous Grievance 747-032, which was heard two months ago, but due to the untimeliness, he declined to do that. Chief Brandemihl continued that he wanted to inform the Commission that they based their previous decision upon a document which reported Dan Lee wasn't called for overtime in a timely fashion. Chief Brandemihl stated he had no knowledge of that document and that document was a personal document of then Sr. Captain Gregg Arnold. Chief Brandemihl believed somebody obtained that document by going through Sr. Captain Arnold's personal effects and he stated he had no idea that the document was going to be presented. He also stated Senior Captain Arnold had since been promoted to Battalion Chief. Chief Brandemihl stated Battalion Chief Arnold understands the call-in procedure and could explain it. Chief Brandemihl explained that the only obligation was to call two respective Kelly's; Kelly 1X and Kelly 1, and after that, there was no further contractual obligation. They could have, pursuant to contract, taken equipment out of service but elected to ask staff on shift to work overtime. Chief Brandemihl summarized Battalion Chief Arnold decided to see if he could fill that position with individuals on duty and that the contract was adhered to. The Commissioners requested a few minutes to read over the labor contract language referenced in Appendix B1 and B4. Mr. Campau stated that under section B4, Battalion Chief Arnold shouldn't have been required to do anything more than call Kelly 1X and Kelly 1. Mr. Scheske stated that the City's obligation for overtime call-in didn't stop with just calling in the two Kellys, but required to continue going down until the list on both Units was exhausted. He continued that the person in the position or rank with the least amount of overtime hours going off duty that morning, which was Dan Lee, should have gotten the overtime opportunity. Further, he explained the overtime opportunity is equalized throughout all the shifts by following that procedure. Chief Brandemihl responded that there is no requirement to go beyond calling the two respective Kelly lists. Mr. Tatigian clarified that Chief was relying on the language in Appendix B4 that says "If there are no available employees on the shift who are on Kelly days, then the call-back will be from an employee on the other shift, provided that as a result of acceptance of said call-back, the employee is not scheduled for three consecutive days of work." Mr. Campau clarified that article B4 does not go beyond. Mr. Scheske stated that article B1 kicks in again. Mr. Tatigian continued that he was in agreement with Commissioner Mahoney that they couldn't compensate people for work they haven't done. Mr. Campau inquired why other contract language should follow after Appendix B4. Mr. Scheske explained that the current shift wasn't exhausted, Dan Lee had not been contacted, and that Dan Lee had been on the same shift as the two employees who had been offered overtime. Mr. Campau inquired why Dan Lee should have been called before anybody else. Mr. Scheske replied that Dan Lee had less overtime hours. Mr. Scheske repeated that in trying to fill the overtime position, Battalion Chief should have asked employees with the lowest amount of overtime. Mr. Campau inquired where that language was in the contract. Mr. Scheske replied that it was in Appendix B1. Mr. Tatigian asked Mary Rutan, Human Resources Director, if Appendix B was part of the original agreement. Ms. Rutan replied she wasn't sure of the date that Appendix B was added to the contract. Mr. Scheske added that this was part of the contract that had been added following Page 4 1199th Regular Meeting Apnl1, 2004 312 arbitration. Ms. Mahoney inquired if the language if Appendix B4 was exhausted, then Item B1 of the Appendix was applicable. Mr. Scheske stated the contract language didn't end after Kelly 1 and Kelly 1X were called. Ms. Mahoney clarified there is no specific reference in #4 that says after completing it, you must follow #1. Battalion Chief Arnold testified that they did exactly as Mr. Scheske described; they went through the two Kellys, and then it became the most timely means of getting people to fill these slots on these trucks without consideration of the number of hours that the employees have in their overtime banks. This resulted in Driver Conti being called ahead of Dan Lee. Mr. Campau inquired if this was always past practice. Battalion Chief Arnold responded that it was and that until a determination is made as to the interpretation, they will slop after the first two Kelly's are called and if there is a manpower shortage, then a piece of equipment may have to be shut down. Mr. Tatigian discussed the difference between the two paragraphs with paragraph #4 referring to Kelly days and of closing down the station, and paragraph #1 referring to particular shifts and overtime call-backs based on reverse analysis of who has the most overtime and who has the least. Mr. Campau stated the language in Appendix B1 prevails. Mr. Tatigian inquired where it was that it required call in of the second shift. Mr. Campau responded it didn't; it just stated that the person with the least amount of overtime is to be called first. Chief Brandemihl stated when a Firefighter is needed, they go to the Kelly list that is off, and to the member that has the least amount of overtime accrued. If a Firefighter or Driver is needed, then they usually go to the individual that has the least amount of hours first. Mr. Campau inquired what is Kelly 1X and Kelly 1. Chief Brandemihl clarified both shifts are broken up into Kellys with three Kellys per shift. In this case, two Kellys are working on any given day so four Kellys are off. Battalion Chief Arnold distributed a worksheet listing the Kellys and explained that the Kelly that was off that day was 1X, so he called these individuals. A Driver was needed so he checked for Drivers and went to those with the least amount of overtime hours. That person is called in first, and then he worked his way through the rest of the list. Ms Mahoney inquired if lists are maintained for all employees. Battalion Chief Arnold responded that there were. He clarified that Dan Lee and Joe Conti were not reflected on the two Kelly lists because they were working. After going through the Kelly 1X and the other unit's Kelly 1, an employee was still needed to ride equipment so he went to whomever he could get, and Conti was called before Lee. Battalion Chief Arnold confirmed he did not look at hours once he had been through the two Kelly lists because they have never done that in the past. Mr. Tatigian inquired if the command officers discriminated against Fire Fighter Lee or if they showed favoritism by giving overtime to certain people. Battalion Chief Arnold stated that there was no prejudice or favoritism in making overtime assignments. Mr. Scheske stated that twenty-four (24) hours of time and a half was a sizable amount of money. Mr. Tatigian reiterated that the Battalion Chief stated that he followed the established procedure. Ms. Mahoney reiterated, from Mr. Lee's previous call-in grievance, that there would never be a time when she would vote to pay somebody for work they didn't do. Ms. Mahoney also stated she was concerned that there is a discrepancy between what the Union believes is the process and what Management has followed as the process and this disparity has to be corrected. Battalion Chief Arnold repeated that after he had gone through the two (2) lists, it was past 8:00 a.m. and people were holding over to ensure they had sufficient staff to man the trucks. When Page 1199th Regular Meeting April 7, 20D4 people are willing to work, they are given overtime. Mr. Campau inquired if there was any record of who had been called. Battalion Chief Arnold replied that there wasn't, it was just his word that he called all of the people on the Kelly 1X or Kelly 1. Since this problem arose, however, they now have a list on which they document who was called, if there was an answering machine, if the employee had been contacted, or if there was no answer. Ms. Mahoney clarified that the procedure was just for the Kelly lists and that Management's interpretation was that paragraph 1B in the Appendix doesn't apply for anything beyond that. Mr. Scheske again disagreed and stated, the grievant, Dan Lee wished to address the Commission. Dan Lee stated he could appreciate how difficult the Battalion Chiefs task was when call -ins were needed. Mr. Lee continued that the problem was the overtime. He further stated that B1 of the Appendix says "the initial date of the applicable contract, an overtime time list will be established according to seniority, with the most senior employee being placed at the top of the list and the least senior employee at the bottom of the list." He continued to read, "Thereafter, position rotation on the call-back list shall be based upon accumulated charged overtime hours with eligibility for call-back being first offered to the employee with the least accumulated Department overtime hours on said list." Mr. Lee explained that Lt. Sutliff had 126-3/. overtime hours plus 24 hours on the day in question, bringing it up to 150 hours; Driver Conti had 49 hours plus the 24 hours on the day in question, bringing it up to 73. At the time of this call in he had 48 3/., just below the 49 hours. Mr. Lee staled the call back procedure for the overtime hours outlined in 31 doesn't say the Battalion Chief has to stop after calling the two Kellys. He further explained Driver Conti was on his same work schedule and they were both working that day. Mr. Lee continued that the two gentlemen in question were working at Station 1, and he was at an outlying station. No phone calls for overtime were made based on the accumulated hours on that list. Mr. Lee referenced the overtime list that the Battalion Chief had in his office and stated it was shown to them at the last grievance. Chief Brandemihl requested to know where the overtime hours sheet came from. Mr. Lee responded that all lists in question were requested through the shift commander at the time that he asked for them. Chief Brandemihl inquired who that was. Dan Lee responded that he would have to go back to see who was on shift that day, but as far as he recalled, it was Captain MacDonald. He also stated that at no time did any personnel go through anybody's desk drawers and take records. Mr. Tatigian stated the last sentence in paragraph 4 refers to Section 43, which he assumed referenced an article in the body of the original contract. Mr. Tatigian continued that Section 43 seemed to be unrelated, "Payment in Lieu of Promotion,' which had no bearing on this issue. Mr. Tatigian stated the referenced article probably meant Section 45, which reaffirms the process in B4. Mr. Lee stated Lt. Sutliff worked 72 hours straight, with 48 of those being overtime and Driver Conti had 24 hours also. Chief Brandemihl assured the Commission that this situation would not occur again and that safety is always a concern. Mr. Tatigian summarized he was not convinced that Management did anything wrong. Ms. Mahoney reiterated both sides need to sit down and clarify this for the public's best interest. Mr. Campau took exception and stated he believed B1 established the call-in order and B2, B3 and B4 follow. Page 1199th Regular Meeting April 7, 2004 Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and adopted, it was RESOLVED, that having reviewed the Livonia Fire Fighters Union (LFFU) Grievance #747-033, from Daniel Lee, Fire Engineer, regarding call-in overtime, and having had discussion with Alan Brandemihl, Fire Chief, Gregg Arnold, Battalion Chief, Gary Scheske, Fire Fighter and Dan Lee, Fire Engineer, the Civil Service Commission does hereby deny this grievance for reasons indicated. AYES: Tatigian and Mahoney NAY: Campau Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That the minutes of the 1191 Regular Meeting held Thursday, March 11, 2004, be approved as submitted. The Commission received and filed the Status of Temporary Employees Report for March 2004. The Chairperson stepped down to second the following motion: Upon a motion by Mr. Tatigian, seconded by Mr. Campau and unanimously adopted, it was RESOLVED, That having read AFSCME Union Local 192 Grievance #03-11, dated November 18, 2003, from all affected AFSCME 192 Union Local Employees, regarding call-in overtime, the Civil Service Commission does hereby approve the hearing of this grievance be postponed, at the request of Management, until the next regular meeting on May 20, 2004, as requested by Management and agreed to by the Union. The Commission received and fled the Non -Resident Report as of April 1, 2004. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That having reviewed the letter of March 9, 2004, from Jason Sturos, Recreation Supervisor (TA), as approved for submission by Ronald R. Reinke, Superintendent of Parks and Recreation, requesting approval of late dental reimbursement, the Civil Service Commission does hereby deny Mr. Sturos' request on the basis of lack of timeliness. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That having reviewed the letter of March 15, 2004, from Debra Finkbeiner, Clerk -Typist II, as approved for submission by Ronald R. Reinke, Superintendent of Parks and Recreation, requesting an unpaid medical leave of absence, the Civil Service Commission does hereby grant the unpaid medical leave of absence from March 11, 2004, through May 20, 2004. Reinke, Superintendent of Parks and Recreation, requesting a promotional examination for Account Clerk I and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia who, by the closing date of this announcement, have regular status and: Have a minimum of one year full-time paid work experience within the past three years in the use of computer menus and entering of data on computer terminals; and Have had a minimum of two years of full-time paid accounting, bookkeeping or related clerical experience, including experience with office machines; OR have had two years of college business courses or business school training; OR have had an equivalent combination. PARTS OF EXAMINATION AND WEIGHTS 100% Administrative Rating Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That having reviewed the letter of April 5, 2004, from Peter Kunst, Police Chief, requesting a promotional examination for Deputy Police Chief and proposed qualifications and parts of examination and weights, the Civil Service Page 1199th Regular Meeting April 7, 2004 Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia who, at the closing date of this examination, are employed as Captain in the Police Division of the Department of Public Safety and have regular status in the classifcation of Captain. PARTS OF EXAMINATION AND WEIGHTS Interview - 30% Departmental Rating - 35% Administrative Rating - 35%* Psychological Evaluation — Pass/Fail In the event there is only one qualified applicant for this position, the Parts of Examinafion and Weights will be 100% Administrative Rating. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That having reviewed the expiring eligible lists for May 2004 — Clerk (842 o.c.) and Clerk -Typist I (805-C o.c.), the Civil Service Commission does hereby approve to extend the eligible lists for Clerk 1 (842 o.c.) and Clerk -Typist I (805-C o.c.) for an additional six (6) months. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That the Civil Service Commission does hereby approve the EMPCO recommended passing point at the percentile score of sixty-seven (67) percent or the actual raw score of 63 for the written part of examination for Engineering Assistant 1 (1182 p.). Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That the Civil Service Commission does hereby approve the eligible list for Engineering Assistant 1 (1182 p.). Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That the Civil Service Commission does hereby approve the eligible list for Police Sergeant (1179 p.). Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That the Civil Service Commission does hereby approve the eligible list for Police Lieutenant (1180 p.). Page 10 1199th Regular Meeting Apn17, 2004 The Commission received and filed the following items: Council Resolution from the meeting of March 10, 2004, with minutes being approved March 24, 2004: CR# 88-04 Directing that a Closed Committee of the Whole meeting be held for the purposes of discussing the status of ongoing labor negotiations with the Police Department. CR# 92-04 Accepting the quote of Information Station Specialists, 3368 88th Avenue, Zeeland, Michigan 49464-0051, in the amount of $18,155.00 to provide the City with its own independent alert AM Emergency Advisory Radio System to be used for emergencies and other service messages. CR# 107-04 Approving the salary and benefit adjustments for the classification of Police Chief, for a 2% adjustment on base wages effective December 1, 2003; a 1% adjustment on base wages effective December 1, 2004 and a 3% adjustment effective December 1, 2005 and Continuation of current health care package, except that effective December 1, 2003, or as soon as same can be implemented, the drug co -pay will be $10.00 for generic drugs and $20.00 for brand name drugs and, if the Chief of Police retires during the period December 1, 2003 through November 30, 2006, his retirement health care benefits shall continue at the same drug co -pay, $10.00 for generic drugs and $20.00 for brand name drugs. b. Letter of March 22, 2004, from Jack Engebretson, Mayor, reappointing Ronald E. Campau, as a member of the Civil Service Commission for a six-year term, commencing the third Monday in April 2004 (4/19/04) and expiring on the third Monday of April 2010. C. Memorandum received March 25, 2004, from the Office of the City Council, announcing a vacancy in the Livonia City Council. J. Letter of March 24, 2004, from Jack Engebretson, Mayor, to City Council, confirming the reactivation of the position of Director of Public Safety and the appointment of Police Chief Peter Kunst, to fill that position. e. Affirmative Action Report for March 2004. Upon a motion by Mr. Tatigian, seconded by Ms. Mahoney and unanimously adopted, it was RESOLVED, That having reviewed the letter of April 2, 2004 from Michael Slater, Director of Finance, and Peter Kunst, Police Chief, as approved for submission to City Council by Mayor Jack Engebretson, regarding Voluntary Early Retirement Page 11 1199th Regular Meeting Apnl ], 2004 Offer for Members of the Livonia Police Lieutenants and Sergeants Association, and having had discussion with Mary E. Rutan, Human Resources Director, the Civil Service Commission does hereby approve the proposed Voluntary Early Retirement Program for Livonia Police Lieutenants and Sergeants, and recommends same to be forwarded to City Council for their review and consideration. Upon a motion by Ms. Mahoney, seconded by Mr. Tatigian and unanimously adopted, it was RESOLVED, That having reviewed the letter of April 5, 2004, from Peter Kunst, Police Chief, requesting a promotional examination for Police Captain and proposed qualifications and parts of examination and weights, the Civil Service Commission does hereby approve the following qualifications and parts of examination and weights: QUALIFICATIONS This examination is open only to employees of the City of Livonia who, at the closing date of this examination, are employed as a Senior Lieutenant or Lieutenant in the Police Division of the Department of Public Safety and have regular status in the classification of Lieutenant.
