MINUTES OF STUDY MEETING HELD JANUARY 7, 2013
Meeting was called to order at 8:00 p.m. Present: John Pastor, Thomas
Robinson, Maureen Miller Brosnan, Brandon Kritzman, James McCann, Joe Laura, and
Laura Toy. Absent: None.
Elected and appointed officials present: Todd Zilincik, City Engineer; Mark
Taormina, Director of Planning and Economic Development; Don Knapp, City Attorney;
Terry Marecki, City Clerk; and Jack E. Kirksey, Mayor.
McCann mentioned Violet `Dee Dee' Dittmar passed away on December 27, 2012. He
recognized how she actively volunteered with Livonia Town Hall, Friends of the Library,
and Greenmead. She will be dearly missed.
Laura mentioned Mrs. Lina Soave, mother of Maria, Leo, Dominic and Mike Soave,
passed away on December 30, 2012; he extended condolences to the family and asked
for a moment of silence.
President Toy gave a shout out to Tom Wozniak, former President of Rosedale
Gardens Homeowners Association, who has been ill. She wished him a speedy
recovery.
Laura congratulated Tammy Bonifield and Julie Robinson the newest members of the
Livonia Public School Board.
Mayor Kirksey wished everyone a Happy New Year. He said there are 38,000
households, over 4,000 businesses, 560 miles of sidewalks and 370 miles of streets. He
reported the City did plow the streets for the entire City 10 days ago and they have
salted intersections. Basically, people are shoveling their snow. Civic Associations may
want to work with anyone that is not shoveling. The Mayor thanked the DPW workers
for their hard work.

Dan Spurling, President, Livonia Anniversary Committee, presented the request
to the Council and was ready to answer any questions from the Council.
President Toy asked Mr. Spurling if this event was still the second largest if it is
now the largest event of this type in the state. Spurling said with the Michigan
State Fair being discontinued, it is now the largest event in the State of Michigan
of this type.

Dan Spurling, President, Livonia Anniversary Committee, presented the request
to the Council noting an amendment in the time for the closure of Farming Road
to begin at 5:30 P.M.; he was ready to answer any questions from the Council.
Kritzman noted that there has been an issue pointed out to him that members
of the YMCA has been prevented from getting through to the YMCA parking lot
by employees of the Livonia Police Department. Spurling acknowledged there
have been traffic related issues in the past and said he would look into the
matter. Pastor said the members of the YMCA can easily access the YMCA
parking lot by entering in off of Stark Road, he noted that Lyndon west to Stark
will be closed off to traffic.

4. REQUEST TO DISPLAY BANNERS ON FARMINGTON ROAD AND FIVE MILE

Dan Spurling, President, Livonia Anniversary Committee, presented the request
to the Council and was ready to answer any questions from the Council. He said
this is the same as what they have requested in the past.
President Toy recalled some concerns with people cutting through the Wood
Creek Farms Subdivision and asked Mr. Spurling what was being done to
remedy that situation; he said signs have been made up to close those roads to
local traffic only.

5. REQUEST FOR AUTHORIZATION TO PURCHASE INTEGRATED
FIREFIGHTER TRACKING SYSTEM UTILIZING ADDITIONAL DHS
ASSISTANCE TO FIREFIGHTER GRANT (AFG) FOR 2011: Livonia Fire &
Rescue, re: that will incorporate a transmitter in the breathing apparatus
previously purchased through this grant with the City's share being 20%
($67070.80).
Shadd Whitehead, Fire Chief, presented the request to the Council. He said the
department has been fortunate enough to be extended an additional
appropriation under an earlier grant award through the DHS Assistance to
Firefighters Grant (AFG) for 2011. This additional appropriation will be used to
purchase an electronic firefighter tracking system (ISI EchoTracer System) that
incorporates a transmitter imbedded in each of the department's SCBAs. This
system is a critical component in overall fire ground accountability and will now
allow rescue teams (known as Rapid Intervention Team or RIT) to quickly locate
trapped or lost firefighters engaged in interior firefighting operations. This total
project cost is $30,354. The Federal share for this grant is $24,283.20, with the
department's share at 20% of the total project cost being $6,070.80. Chief
Whitehead was ready to answer any questions from the Council.

6. REQUEST TO ACCEPT A DELEGATION AGREEMENT WITH THE STATE OF
MICHIGAN, BUREAU OF FIRE SERVICES, GIVING LIVONIA FIRE AND
RESCUE AUTHORIZATION TO INSPECT CONSUMER FIREWORKS RETAIL
SALES FACILITIES: Department of Fire & Rescue, re: for the year 2013.
Shadd Whitehead, Fire Chief, presented the request to the Council. He said the
department has been offered the opportunity to locally inspect all Fireworks Sales
Facilities within our jurisdiction. The State of Michigan, Bureau of Fire Services has
instituted a Delegation Agreement for the year 2013. The agreement allows local
jurisdictions, who have State Certified Inspectors on staff, to conduct these
inspections. The delegated inspections will be completed in accordance with MCL
28.470. All training, report forms and reporting formats will be provided by the
Department of Licensing and Regulatory Affairs, Bureau of Fire Services as well as
following all currently enacted inspection procedures for the Bureau of Fire Services.
At this time, the fee structure will be a reimbursement of 80% of the annual permit
fee to the municipality conducting the inspection. State of Michigan annual permit
fees are $1,000 for permanent structures and $600 for tents.

7. REQUEST TO EXTEND AUTHORIZATION TO PURCHASE PULSAR
BRIQUETTES FROM SOLE SUPPLIER: Department of Parks & Recreation, re:
for the period through December 31, 2013, from B & B Pools and Spas at 2012
pricing. (CR 371-11)
Lyle Trudell, Interim Superintendent, Parks and Recreation, presented the
request to the Council. He said they are asking Council to extend our purchasing
of Pulsar Briquettes from B & B Pools and Spas, Bill Babcock, 29440 Six Mile
Road, Livonia, MI 48152 which is the sole supplier for this specific brand (Pulsar
Briquettes) in the State of Michigan and northern Ohio. They have agreed to
keep the price at $105.00 per 50 Ib. bucket. This price will be good through
December 31, 2013. As Council may be aware they have Pulsar chlorine feeders
that require a specific chemical. Any use of non-specified chemicals in our units
could result in an explosion and/or poisonous gases. They anticipate purchasing
300 buckets at $105.00 per bucket for a total cost of $31,500.00. This would be
expended from funds budgeted.

8. AWARD OF CONTRACT: Department of Parks & Recreation, re. for design,
proofs, editing, printing and sorting of "L" Magazine for the period of April 2013 to
March 2015.

Lyle Trudell, Interim Superintendent, Parks and Recreation, presented the
request to the Council. He said the Department of Parks and Recreation has
taken bids for the printing of the L Magazine. Specifications were prepared by the
Department, and an advertisement for bids was placed in the Thursday,
November 29, 2012 issue of the Livonia Observer and on the MITN website.
Four bids were opened in the presence of the Bid Committee at 2:00 p.m. on
December 11, 2012. One company declined. They are asking Council to award
the bid to the low bidder ID Enterprises, Mr. Michael Frasier, President and
Owner, 32788 Five Mile Rd., Livonia, MI 48154. Their specifications asked for
the cost to include design (cover & typesetting), three proofs, editing, printing and
sorting. Based on the bids that they have received, they would recommend that
the City Council authorize the Mayor and City Clerk execute a contract for an
amount not to exceed $43,000.00 per contract year. Sufficient funds have been
budgeted for 2012-2013.

9. AWARD OF CONTRACT: Department of Parks & Recreation, re. for ad
solicitation to help offset the cost of the "L" Magazine, mailed three (3) time per
year for a period of two (2) years.
Lyle Trudell, Interim Superintendent, Parks and Recreation, presented the
request to the Council. He said the Department of Parks and Recreation has
taken bids to have a company solicit ads for the department's "L" Magazine that
is mailed 3 times per year to our residents. The revenue generated by the ads
will help offset the cost of printing and postage for the "L" Magazine. The
anticipated revenue after expenses could range from $1,000.00 to $3,000.00 per
issue depending on the amount of ad sales. Specifications were prepared and an
advertisement for bids was placed in the Thursday, November 29, 2012 issue of
the Livonia Observer and on the MITN website; only one bid was received.
Based on their review of the bid and their current experience with Advantage
Marketing Solutions, they are recommending that the City Council authorize the
Mayor and the City Clerk to execute a 2 year contract for ad solicitation with
Advantage Marketing Solutions, LLC, Mr. Terry Krieg, President, 39500 Orchard
Hill Place, Ste. 155, Novi, MI 48375.

10. AWARD OF BID: Public Service Division, re: to purchase three (3) Single Axle
Dump Trucks as replacement vehicles from funds budgeted for this purpose.

Kevin Maillard, Director of Public Works, presented the request to the Council.
He said the Public Service Division has taken bids for Single Axle Dump Trucks
in accordance with the requirements of the Finance Ordinance. Specifications
were prepared by the Division and an advertisement for bids was placed in the
October 25, 2012 edition of the Livonia Observer. Bid invitations were placed on
the Michigan Inter-governmental Trade Network (MITN). Four (4) bids were
received and opened in the presence of the Bid Committee at 2.00p.m. on
November 1, 2012.

In addition, a Bid Evaluation was done by the Fleet Manager, regarding specific
information about each bid submitted, and his recommendation to award same to
Wolverine Freightliner-Westside. Wolverine Freightliner-Westside is low bidder
meeting specifications; the low bidder did not meet specification.
The dump trucks will be replacement vehicles and we will submit the
replacement vehicles for sale on MITN. These trucks have an average life
expectancy of 8 - 9 years and they have exceeded their life expectancy. The
trucks being replaced are 1995 and 1996 models.
The Public Service Division recommends that the low bid meeting specifications,
submitted by Wolverine Freightliner-Westside, 3000 William, Ypsilanti, MI 48198 be
accepted to supply the Public Service Division with three (3) Single Axle Dump
trucks for the price of$499,290.00.

11. AWARD OF CONTRACT FOR A TWO (2) YEAR CONTINUATION OF THE
LEASE OF FIVE ACRES OF CITY OWNED PROPERTY LOCATED AT 32000
GLENDALE AVENUE: Public Service Division, re: Public Service Division, re:
to Mid-Michigan Recycling, L.C. for wood processing and disposal service, with
an option to renew for an additional two (2) years. (CR 233-08)
Kevin Maillard, Director of Public Works, presented the request to the Council.
He said the Public Service Division has received a proposal from Mid-Michigan
Recycling for a two (2) year continuation of the lease of five acres of city owned
property for wood processing and disposal service, with an option to renew for
two (2) additional years if agreed on by both parties. Included in this proposal is
the requirement to continue to provide these services at no cost to both Livonia
residents, the Public Service Division, and the contractors that are providing tree

trim and removal activities for the City of Livonia. Mid-Michigan Recycling has
been leasing this property since 2008 with the current lease due to expire in
February of 2013. The Company originally approached the City as a result of the
Emerald Ash Borer problem and the agreement that they had with the State of
Michigan, Department of Agriculture to grind (chip) the Ash wood from the
diseased and dead trees. The ability for the City to dispose of the material that is
collected as part of the in-house tree trim and tree removal and the City's brush
pick-up programs allow us to save significant money on the cost of bulk brush
grinding and wood chip disposal services. The last time the City paid for these
services it cost approximately $50,000 per year.
This proposal calls for a $3,620.00 per month lease fee ($43,440.00 per year).
The proposal reflects a monthly lease increase of approximately 2%, over the
2012 monthly fee of $3,550.00. It is the recommendation of the Public Service
Division that Council grant a property lease to Mid-Michigan Recycling, G-5310
Dort Hwy., Flint, MI 48505, for a total of $86,880.00 over a two (2) year period,
with an option to renew for an additional two (2) years.

Robinson asked Maillard if this was the same facility that is used for leaf pick-up.
Maillard replied no and indicated that was across the street. Robinson asked if
the contract there was any language about using any City-owned equipment or
resources. Maillard replied no and said it was totally independent.

12. ADMINISTRATIVE RESPONSE TO COUNCIL RESOLUTION #470-12-
Engineering Division, re: a request for a sidewalk extension on the south side of
Ann Arbor Trail from Dowling Street to Rosedale Elementary School, submitted
by Bryan Garchar.
Todd Zilincik, City Engineer, presented the Administrative response to the
Council. He said this item presented at the November 26, 2012 Study Session
referring to the Administration for a Report and Recommendation. The
Engineering Department performed a field visit on Tuesday, November 27, 2012
to review the existing conditions and summarize the requirements for a sidewalk
extension. There are 10 parcels that are located along the south side of Ann
Arbor Trail, starting with Rosedale Elementary School and heading east. The
addresses, property owners and description of the frontage area as follows:

In order for the project to be designed, survey work will be required and necessary
for construction. The costs anticipated for this service are estimated at $3,200
($2,000 for design and $1,200 for construction). This will allow for the existing right-
of-way to be identified on the south side to ensure the sidewalk is placed within the
right-of-way. The identification of the existing right-of-way would provide notice to the
residents that may be required to relocate and or remove landscape items such as
decorative rocks, plants, sprinkler lines and heads, etc., within or in close proximity
of the right-of-way if the sidewalk was to be approved and constructed. For the five
(5) parcels where new sidewalk would be required, the proposed sidewalk would be
4-inches thick along the frontage and 6-inches thick across the driveway. On the
Livonia Public Schools property, where the proposed tie-in would occur, the sidewalk
would vary from 6- to 8-inches thick. Four (4) of the residential parcels will require
their existing drive approach (concrete or asphalt) to be saw cut, removed and
replaced with new 6-inch thick concrete sidewalk as the designated sidewalk. For
existing concrete drive approaches, there may be additional concrete approach work
depending on the layout of the proposed sidewalk, to ensure the small adjacent slab
is not above or below the newly constructed sidewalk. The following summarizes the
estimated cost for the five (5) parcels-

They recommend that the City of Livonia consider providing funding if approved at
address 36469 Ann Arbor Trail, since the existing property has sidewalk. In addition
to the parcels listed that would require newly constructed sidewalk along the south
side of Ann Arbor Trail from Dowling to Rosedale Elementary, the City would review
the existing sidewalk at the remaining parcels to determine if any necessary repairs
would be required and determine if they were homeowner responsibility or City's
responsibility. During their site visit, the Engineering Department did not see any
indication of a "mule path" along the frontage of the homes designating high-
pedestrian traffic. The right-of-way varies from 33 feet to 93 feet.
If the Council desires, the Engineering Department will follow up and contact
Rosedale Elementary School to see if they have any record of official letters
concerning safety or the Livonia Police Department to inquire about any issues
brought forth regarding pedestrians. They have checked back to 1995 for sidewalk
waivers at the (4) parcels to determine that none were requested. However, they
were unable to determine if any sidewalk waivers were requested or approved prior
to 1995.
The key item for construction of the proposed sidewalk is funding. The cost of the
sidewalk would be funded through a special assessment district (SAD) to each of the
residents. The residents would be required to maintain the sidewalk once installed.
The proposed sidewalk would require the City to initiate the SAD process, which
includes the following:
• Hold a hearing of necessity for consideration
• Engineering Department to design and bid out contract to construct sidewalk
• Hold a Public Hearing of the Roll, based on construction costs
• Award contract to construct sidewalk
• Bill property owner for cost to construct sidewalk
• If the proposed sidewalk extension is approved by the SAD process, the
timeline would be approximately 6-8 months with the goal to complete the
sidewalk before school starts in September, 2013
• The City does not anticipate any right-of-way purchase, but anticipates
placing the proposed sidewalk within the existing right-of-way and intends to
provide proper grading adjacent to existing storm inlets
• The City does not anticipate any cost to re locate utility poles or signs at this
time.
However, any underground utilities such as cable, phone, gas service leads should
be considered if a survey is required and as part of the cost (i.e. contingency funds)
It is their recommendation to hold a public hearing of necessity to determine if the
sidewalk is warranted.

Curtis Lipinski, 36555 Ann Arbor Trail, expressed his concerns regarding the
request for a sidewalk extension on the south side of Ann Arbor Trail from
Dowling Street to Rosedale Elementary School.
Bryan Garchar, 36549 Ann Arbor Trail, expressed his concerns relating to his
request for a sidewalk extension on the south side of Ann Arbor Trail from
Dowling Street to Rosedale Elementary School.
At the direction of the Chair, this Administrative response was received and filed.
Brosnan offered the resolution for the City Council to hold a Public Hearing with
regard to the request for a sidewalk extension on the south side of Ann Arbor
Trail from Dowling Street to Rosedale Elementary School for the Regular
Agenda.
Laura requested that the Administration look at the entire area and check with
the schools and police to see if there have been any incidents or safety concerns
and update Council with their findings.
