HomeMy WebLinkAboutPLANNING MINUTES 1997-08-05 15638 MINUTES OF THE 748TH REGULAR MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, August 5, 1997 the City Planning Commission of the City of Livonia held its 748th Regular Meeting in the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan. Mr. James C. McCann, Chairman, called the meeting to order at 7:30 p.m.. Members present: James C. McCann Daniel Piercecchi Michael Hale Robert Alanskas John Walsh* Elaine Koons Messrs. John J. Nagy, Planning Director; H. G. Shane, Assistant Planning Director; and Scott Miller, Planner II, were also present. Mr. McCann informed the audience that if a petition on tonight's agenda involves a rezoning request, this Commission only makes a recommendation to the City Council who, in turn, will hold its own public hearing and decide the question. If a petition involves a waiver of use request and the request is denied, the petitioner has ten days in which to appeal the decision to the City Council; otherwise the petition is terminated. The Planning Commission holds the only public hearing on a preliminary plat and/or a vacating ( petition. Planning Commission resolutions become effective seven days after the resolutions are adopted. The Planning Commission has reviewed the petitions upon their filing and have been furnished by the staff with approving and denying resolutions. The Commission may use them or not use them depending upon the outcome of the hearing tonight. Mr. Piercecchi, Secretary, announced that the first item on the agenda is a Motion to hold a public hearing pursuant to Council Resolution#235-97 requesting the Planning Commission to hold a public hearing to determine whether or not to amend Section 23.05 of the Livonia Zoning Ordinance to shorten the length of time between receipt of a petition to a recommendation being made to the City Council by the Planning Commission from 90 days to 60 days. * Mr. Walsh arrived at this time. Mr. McCann: This is a petition that was sent to us by the City Council in order to amend the ordinance so that we may turn these petitions over in a quicker time. On a motion duly made buy Mr. Alanskas, seconded by Mr. Walsh and unanimously approved, it was 15639 #8-125-97 RESOLVED that, the City Planning Commission, pursuant to Council Resolution#235-97, and pursuant to Section 23.01(a) of Ordinance#543, the Zoning Ordinance of the City of Livonia, as amended, does hereby NNW establish and order that a public hearing be held to determine whether or not to amend Section 23.05 of the Livonia Zoning Ordinance to shorten the length of time between receipt of a petition to a recommendation being made to the City Council by the Planning Commission from 90 days to 60 days. FURTHER RESOLVED that, notice of such hearing be given as provided in Section 23.05 of Ordinance#543, the Zoning Ordinance of the City of Livonia, as amended, and that thereafter there shall be a report and recommendation submitted to the City Council. Mr. McCann, Chairman, declared the motion is carried and the foregoing resolution 11:12 AMadopted. Mr. Piercecchi, Secretary, announced that the next item on the agenda is a Motion to hold a public hearing to determine whether or not to amend Section 23.06 of the Livonia Zoning Ordinance so as to set a time limit within which the City Council must either grant or refuse a request for a change of zoning. Mr. McCann: This is a petition coming forth from the City Planning Commission, and in consideration of the Council's request to have a definite period of time for the Planning Commission to get these petitions through the system, we thought it would be appropriate to also look to the City Council to have time limits there so that the petitioners would have some idea going in how long it would take to get their items through. On a motion by Mrs. Koons, seconded by Mr. Walsh and unanimously approved, it was #8-126-97 RESOLVED, that the City Planning Commission, pursuant to Section 23.01(b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, does hereby establish and order that a public hearing be held to determine whether or not to amend Section 23.06 of the Livonia Zoning Ordinance so as to set a time limit within which the City Council must either grant or refuse a request for a change of zoning. On a motion by Mr. Hale, seconded by Mr. Alanskas and unanimously approved, it was #8-127-97 RESOLVED that, the minutes of the 378th Special Meeting held by the City Planning Commission on July 15, 1997 are hereby approved. Mr. McCann, Chairman, declared the motion is carried and the foregoing resolution adopted. Mr. Piercecchi, Secretary, announced that the next item on the agenda is Approval of the minutes of the 747th Regular Meeting and Public Hearings held on July 22, 1997. On a motion by Mr. Alanskas, seconded by Mrs. Koons and approved as amended, it was #8-128-97 RESOLVED that, the minutes of the 747th Regular Meeting and Public Hearings held by the City Planning Commission on July 22, 1997 are hereby approved as amended. A roll call vote on the foregoing resolution resulted in the following: AYES: Piercecchi, Hale, Alanskas, Walsh, Koons ``" NAYS: None ABSENT: None ABSTAIN: McCann Mr. McCann, Chairman, declared the motion is carried and the foregoing resolution adopted. Mr. McCann: We will now begin with the Miscellaneous Site Plan section of our agenda. Members of the audience may speak in support or opposition to these items. Mr. Piercecchi, Secretary, announced that the next item on the agenda is Petition 97-7-8- 18 by Communicare Health Services requesting approval of all plans required by Section 18.58 of the Zoning Ordinance in connection with a proposal to construct an assisted living facility on property located at 15670 Newburgh Road in the Southwest 1/4 of Section 17. Mr. Miller: This site is located on the east side of Newburgh Road between Five Mile and Ladywood Avenue. They are proposing to construct a 45,621 sq. ft. assisted living apartment building. The structure would be two stories in height and contain 62 units. It would be known as Beacon Rose of 15641 Livonia. This facility would be serviced by two parking lots, one to the north and one on the south side of the building. These parking lots would be accessible by two drives off Newburgh Road. These two parking lots would also be connected by a drive in front of the building with a circular drive off the main entranceway. They are required to have 36 parking spaces and the plan shows 39 spaces. They are required to have 15% of the site landscaped and 33% of the site is landscaped. The building would be constructed out of a combination brick and vinyl siding. The brick would be on the first floor and the vinyl siding on the second floor. Also, the indented areas would be brick on the second floor. The roof and the overhangs would be covered by asphalt shingles. The rear elevation would be similar to the front elevation - brick for the first floor and the indented areas and vinyl siding for the second floor. The stairwell towers would also be brick. Mr. Nagy: There is no new correspondence. Mr. McCann: Is the petitioner here tonight? Chuck Tangora: I will reintroduce to you Karla Trott who is the architect who made the presentation at the public hearing for the zoning. She wasn't before the Study session last week, but she works for the firm and is very familiar with this, so I will call upon her and let her answer any questions regarding the site plan and the building elevations you have before you. r.. Karla Trott: Basically we have made the changes we discussed at the meeting a month ago to the drive as had been discussed. As he showed, there are two entrances to the drive and I believe the only change requested at the last Study Meeting was the addition of more brick and the renderings show that. If there are any questions you have regarding those issues, I would be happy to answer them. Mr. Hale: Mr. McCann, is this a change in what you had suggested? I thought you had suggested to put brick only on the indented areas. Mr. McCann: No. Originally they had brick all the way across the bottom and they were taking the brick all the way up to the roof line in the two indented areas in the front and the back and per Mr. Piercecchi, he requested that the stair towers be bricked to break the rear areas up. They have done both of those. Mr. Alanskas: I think you did a very nice job on the building, but you might want to explain to our audience what assisted living is in case you have some customers out there that want to go to your facility. 15642 Ms. Trott: I am not sure if I'm best qualified to do that or Mr. Paulini. He is here representing Communicare Health Services. Len Paulini with Communicare Health Services: Assisted living is a rapidly growing trend as you well know. In the country today there are approximately 40,000 assisted living residences in the United States right now serving in excess of 1,000,000 people. It is not nursing care. That is a common misconception. It is designed basically for the healthy elderly and provides assistance with activities of daily living for the residences. These would include such things as assistance with grooming, perhaps some assistance with taking their medications, by that I mean with reminders. We do not administer medication, we remind the residents to take them. Their apartments are cleaned on a weekly basis. If they wish, we can provide assistance with bathing. We also would provide transportation to local shopping, to local activities and to their physicians. In a nutshell, that's what assisted living services comprise. The typical assisted living resident is a woman in her mid 80s, does not drive, generally rather healthy but perhaps somewhat frail. This type of individual would look for a facility such as Beacon Rose. Mr. Piercecchi: Would you care to tell the people who are tuned in what the basic costs run and if food is provided? Mr. Paulini: Typically the daily fee for an assisted living community such as this would `ow range from about $75 a day up to $115 a day depending on the type of accommodation, the size of the suite that the individual lives in. For that the resident would receive three meals a day, as well as snacks. There is a nurse on duty to assist them when and if needed. This includes transportation to local events as well as a full activity schedule and security for the individual. Those are the typical services provided. Mr. McCann: If there is no one else, a motion is in order. On a motion by Mr. Hale, seconded by Mr. Piercecchi and unanimously approved, it was #8-129-97 RESOLVED that, the City Planning Commission does hereby recommend to the City Council that Petition 97-7-8-18 by Communicare Health Services requesting approval of all plans required by Section 18.58 of the Zoning Ordinance in connection with a proposal to construct an assisted living facility on property located at 15670 Newburgh Road in the Southwest 1/4 of Section 17 be approved subject to the following conditions: 1) That the Site Plan marked Sheet L1.02 dated July 22, 1997 prepared by DSI is hereby approved and shall be adhered to; 2) That all light standards shall be shielded from adjacent properties ,` and shall not exceed 20 ft. in height; 3) That the three walls of the trash dumpster area shall be constructed out of the same brick used in the construction of the care facility and the wooden enclosure gates shall be maintained and when not in use closed at all times; 4) That the Landscape Plan marked Sheet L1.03 dated July 22, 1997 prepared by DSI is hereby approved and shall be adhered to; 5) That all disturbed lawn areas shall be sodded in lieu of hydroseeding; 6) That underground sprinklers re to be provided for all landscaped and sodded areas and all planted materials shall be installed to the satisfaction of the Inspection Department and thereafter permanently maintained in a healthy condition; 7) That the revised Exterior Building Elevation Plans prepared by DSI dated July 31, 1997 are hereby approved and shall be adhered to. Mr. McCann, Chairman declared the motion is carried and the foregoing resolution adopted.
