HomeMy WebLinkAboutPLANNING MINUTES 1999-05-25 16012 MINUTES OF THE 380th SPECIAL MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, May 25, 1999, the City Planning Commission of the City of Livonia held its 380th Special Meeting in the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan. Mr. James C. McCann, Chairman, called the Special Meeting to order at 8:10 p.m. Members present: James C. McCann Robert Alanskas Dan Piercecchi William LaPine Members absent: Elaine Koons Michael Hale Messrs. Al Nowak, Planner IV, Scott Miller, Planner II, and Bill Poppenger, Planner I were also present. Mr. McCann informed the audience that if a petition on tonight's agenda involves a rezoning request,this Commission only makes a recommendation to the City Council who, in turn, will hold its own public hearing, makes the final determination as to whether a petition is approved or denied. The Planning Commission holds the only public hearing on a request for preliminary plat and/or vacating petition. The Commission's recommendation is forwarded to the City Council for the final determination as to whether a plat is accepted or rejected. If a petition requesting a waiver of use or site plan is denied tonight,the petitioner has ten days in which to appeal the decision, in writing, to the City Council. Resolutions adopted by the City Planning Commission becomes effective seven(7) days after the date of adoption. The Planning Commission and the professional staff have reviewed each of these petitions upon their filing. The staff has furnished the Commission with both approving and denying resolutions which the Commission may, or may not, use depending on the outcome of the proceedings tonight. Mr. Piercecchi, Secretary announced the first item of the Special Meeting is Petition 99-5-2- 14 by Jonathon R. Crane on behalf of Airtouch Cellular requesting waiver use approval to construct a 150'wireless communications antenna for shared usage and its accompanying equipment shelter to be located on the north side of Six Mile Road between Farmington and Merriman Roads (within Rotary Park) in the Southeast 1/4 of Section 10. Mr. Nowak: The petitioner, Airtouch Cellular, is requesting waiver use approval to construct a wireless communication facility within Rotary Park, which is located on the north side of Six Mile Road east of Hubbard Road. The facility would be constructed in the easterly portion of hte 195 acre park site approximately 820 feet north of Six Mile Road and 470 feet west of the easterly park boundary line. The Rotary Park property is zoned PL, Public ` Land, and wireless communication facilities are a waiver use in this district pursuant to Section 18.42A of the Zoning Ordinance. The plans submitted 16013 with this request indicate that the proposed wireless communication facility will consist of a monopole antenna structure and an accompanying unmanned electronic equipment shelter. The monopole antenna support structure would vim.. be 150 feet in height, which is the maximum height allowed in all districts except in any M-1, M-2 or commercially zoned district within Sections 25-30 and that portion of Section 19 bounded by Schoolcraft Road, Eckles Road and the Expressway. The monopole elevation detail shows the petitioner's cellular antenna at a height of 120 feet above grade level and a future colocator at the top of the monopole. Located next to the monopole, the electronic equipment shelter will be 12.08'X 26.83' in size (324 sq. ft.) and 14 feet in height to the peak of the roof. The plans indicate that the equipment shelter will have a brick veneer and a shingled hip roof. On Monday, May 17, 1999,the petitioner submitted a landscape plan showing that clusters of evergreen trees are to be provided in the areas to the west and south of the cellular tower site. Mr. McCann: Is the petitioner here? Doug Webber, 1126 N. Main, Rochester, MI A presentation was made regarding the proposal and an explanation of the maintenance schedule was discussed. Mr. McCann, along with the other commissioners, expressed their concerned about the upkeep of the site and the increase of landscaping around the fence. The Planning Commission would like to see a row of evergreens inside the front fence. On a motion by Mr. LaPine, seconded by Mr. Alanskas, and unanimously approved, it was #5-50-99 RESOLVED that, pursuant to a Special Meeting and Public Hearing having been held by the City Planning Commission on May 25, 1999, on Petition 99- 5-2-14 by Jonathon R. Crane on behalf of Airtouch Cellular requesting waiver use approval to construct a 150' wireless communications antenna for shared usage and its accompanying equipment shelter to be located on the north side of Six Mile Road between Farmington and Merriman Roads (within Rotary Park) in the S.E. 1/4 of Section 10, which is zoned Public Land, the Planning Commission does hereby recommend to the City Council that Petition 99-5-2- 14 be approved subject to the following conditions: 1) That the Site Plan and Elevation Drawings marked Sheet 1, Job No.94404-874 prepared by Midwestern Consulting, with a revision date of February 12, 1999, is hereby approved and shall be adhered to; 2) That the Landscape Plan marked Sheet 2, Job No. 94404-874, prepared by Midwestern Consulting, dated May 5, 1999, is hereby approved, with the addition of a row of evergreen trees (variety, size and spacing to be approved by the Planning Department)that shall be planted just inside the fence along the north line of the Lease Area from the gate to the east boundary, on the condition that all proposed landscape materials shall be installed to the satisfaction of the Inspection Department; and 16014 3) That the equipment shelter building shall be constructed out of full-face 4" brick on all four sides, no exceptions. ""' for the following reasons: 1) That the proposed use complies with all of the special and general waiver use standards and requirements as set forth in Sections 18.42A and 19.06 of the Zoning Ordinance #543; 2) That the subject site has the capacity to accommodate the proposed use; and 3) That the proposed use is compatible to and in harmony with the surrounding uses in the area. FURTHER RESOLVED that, notice of the above hearing was given in accordance with the provisions of Section 23.05 of Zoning Ordinance #543, as amended. Mr. McCann, Chairman, declared the motion is carried and the foregoing resolution adopted. Mr. Piercecchi, Secretary, announced the next item of the Special Meeting and Public Hearing is Petition 99-5-2-15 by Richard Connor Riley &Associates, L.L.C. on behalf of AT&T Wireless Services, Inc., requesting waiver use approval to erect and construct a 150' wireless communications antenna with co-location ',ow- opportunities and is accompanying equipment shelter to be located on the south side of Pembroke Avenue between Farmington and Merriman Roads (within Jaycee Park) in the Southwest 1/4 of Section 3. Mr. Nowak: The petitioner, A T & T Wireless Services, Inc., is requesting waiver use approval to construct a wireless communication facility within Jaycee Park, which is located south of Pembroke Avenue immediately west of the Tyler Elementary School property. The facility would be constructed in the westerly portion of the 56 acre park site approximately 1,000 feet south of Pembroke. The Jaycee Park property is zoned PL, Public Land, and wireless communication facilities are a waiver use in this district pursuant to Section 18.42A of the Zoning Ordinance. The plans submitted with this request indicate that the proposed wireless communication facility will consist of a monopole antenna structure and an accompanying unstaffed electronic equipment shelter. The monopole antenna support structure would be 150 feet in height, which is the maximum height allowed in all districts except in any M-1, M-2 or commercially zoned district within Sections 25-30 and that portion of Section 19 bounded by Schoolcraft Road, Eckles Road and the Expressway. The elevation plan shows the petitioner's cellular antenna at the top of the proposed monopole with 2 future colocators at lower heights on the monopole. Located next to the monopole, the electronic equipment shelter will be 12'X 20' in size (240 sq. ft.) and 10 feet in height. N. Mr. McCann: Is the petitioner here? 16015 Richard Connor Rilly, 30150 Telegraph Road„ Suite 420, Bingham Farms, Michigan, presented his proposal and explained their maintenance schedule. On a motion by Mr. LaPine, seconded by Mr. Alanskas, and unanimously approved, it was #5-51-99 RESOLVED that, pursuant to a Special Meeting and Public Hearing having been held by the City Planning Commission on May 25, 1999, on Petition 99- 5-2-15 by Richard Connor Riley & Associates, L.L.C. on behalf of AT&T Wireless Services, Inc., requesting waiver use approval to erect and construct a 150' wireless communications antenna with co-location opportunities and its accompanying equipment shelter to be located on the south side of Pembroke Avenue between Farmington and Merriman Roads (within Jaycee Park) in the Southwest 1/4 of Section 3, which is zoned Public Land, the Planning Commission does hereby recommend to the City Council that Petition 99-5-2- 15 be approved subject to the following conditions: 1) That the Enlarged Partial Site Plan, marked Drawing No. 3185-03 prepared by Christopher Wzacny &Associates, dated April 21, 1999, is hereby approved and shall be adhered to; 2) That the Elevations Plan, marked Drawing No. 3185-004, prepared by Christopher Wzacny &Associates, dated April 21, 1999, is hereby approved and shall be adhered to, except that the barbed wire shown at the top of the chain link fence enclosing the lease area is not approved `411Mir and shall not be installed; 3) That the proposed landscaping shown on the above referenced Enlarged Partial Site Plan shall be installed to the satisfaction of the Inspection Department; and 4) That the equipment shelter building shall be constructed out of full-face 4-inch brick on all four sides, no exceptions. for the following reasons: 1) That the proposed use complies with all of the special and general waiver use standards and requirements as set forth in Sections 18.42A and 19.06 of the Zoning Ordinance #543; 2) That the subject site has the capacity to accommodate the proposed use; and 3) That the proposed use is compatible to and in harmony with the surrounding uses in the area.
