M by the President of the Council, Harry S .'Wolfe Roll was called with the following result. Present-- Harry S Wolfe, Wilson W. Edgar, Raymond E. Grimm, Nettie Carey, William Taylor and John Whitehead, and Harvey Jahn. Absent--None. The minutes of the twenty-sixth regular meeting held on December 18, 1950, were read and on motion of Councilman Whitehead, seconded by Councilman Jann and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was : /9.Y-c' RESOLVED, that the minutes of the twenty-sixth regular �•• meeting of the Council held December 18, 1950, be and hereby are approved as read, An ordinance introduced by Councilman Taylor at the last meeting of the Council held December 18, 1950, entitled• AN ORDINANCE TO AMEND A PORTION OF SECTION 28 OF THE ZONING MAP OF THE CITY OF LIVONIA OF ORDINANCE NO 7 ENTITLED• " AN ORDINANCE TO ESTABLISH DISTRICTS IN THE CITY OF LIVONIA, TO REGULATE THE USE OF LAND AND STRUCTURES THEREIN; TO REGULATE AND LIMIT THE HEIGHT, THE AREA, THE BULK AND LOCATION OF BUILDINGS, TO REGULATE AND RESTRICT THE LOCATION OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIC USES; TO REGULATE AND DETERMINE THE AREA OF YARDS, COURTS AND OTHER OPEN SPACES; TO REGULATE THE DENSITY OF POPULATION; TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE, TO PROVIDE FOR A BOARD OF APPEALS, AND ITS POWERS AND DUTIES; TO PROVIDE A PENALTY FOR THE VIOLATION OF THE TERMS THEREOF, AND TO ADOPT TEL ZONING ORDINANCE OF THE TOWNSHIP OF LIVONIA, AMENDMENTS THERETO AND ZONING MAP", AND SECTION 3(A) OF SAID ORDINANCE NO 7. NAYS: None The President declared the foregoing ordinance adopted and effective as of the date of publication, January 19, 1951 Communication dated December 15, 1950, from H 0 Johnson, Superin- tendent of Schools, addressed to Mayor Jesse Ziegler was read, and comments thereon were made by the Mayor. On motion of Councilman Edgar, seconded by Councilman Whitehead and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was : /9-309 RESOLVED, that the Department of Public Works and the City Engineer make a survey of school grounds at Bentley High School as to parking facilities. Wm, William L Marvin, Traffic Engineer in the Michigan State Highway Department, made recommendations to the Council as to parking on Plymouth Road. On motion of Councilman Taylor, seconded by Councilman Grimm and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was . /23/0 RESOLVED, that the plans for proposed parking control on U. S. 12 (Plymouth Road) be referred to the City Planning Commission and the Police Department for study and recommendations. A report from the insurance committee was read and Councilman Jahn made a motion that the following resolution be adopted: /i3// RESOLVED, that the following insurance premiums are approved and that the same be paid by the City Treasurer: Insurance Policy #L4231-951118 F.W.D Truck $71.72 Bonds for deputy treasurers $60.00 Page 264 The foregoing motion was seconded by Councilman Whitehead and a roll call vote was taken with the following result. r.. A communication from W A Albitus, supported by his oral statement and that of several of his neighbors, together with a petition of certain pro- perty owners in Section 35, was presented to the Council On motion made by Councilman Grimm, seconded by Councilman Edgar and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was . /931.2 RESOLVED, that the communication and petition pertaining to Cathedral Avenue and proposed plats adjoining same be referred to the City Planning Commission for its study and recommendations. ir... Herbert merry, City Auditor, discussed the audit prepared by him for the period of six months ending November 30, 1950, and made certain recommendations Councilman Edgar made a motion that the following resolution be adopted. ,9--7/3 RESOLVED, that the City Treasurer cause to be established and maintained in the First National Bank of Plymouth in Plymouth, Michigan, a special bank account; that all monies on performance bonds and all trust funds be deposited in said special bank account and that all withdrawals or disbursements from said bank account be by checks duly signed and countersigned in the same manner as checks drawn on the regular account of the City of Livcnia, except that checks drawn on said special account shall have on their face the words "special account" The foregoing motion was seconded by Councilman Whitehead and a roll call vote was taken with the following result• YEAS: Raymond E Grimm, Wilson W Edgar, John Whitehead, Nettie Carey, Harvey Jahn, William Taylor and Harry S li;olfe. NAYS: None Page 265 The President declared the foregoing resolution passed imam Councilman Jahn made a motion that the following resolution be adopted: IY3/ RESOLVED, that the City Treasurer be and hereby is authorized and directed to establish and maintain in his office a permanent change fund of $200.00 to be drawn from the general funds of the City and to remain a part of said general funds The foregoing motion was seconded by Councilman Taylor and a roll call vote was taken with the following result : YEAS: Raymond E Grimm, Wilson W Edgar, John Whitehead, Nettie Carey, Harvey Jahn, William Taylor and Harry S. Wolfe. NAYS: None The President declared the foregoing resolution passed Councilman Carey made a motion that the following resolution be adopted: /73/S RESOLVED, that a special form of pay roll check shall hereafter be used by the City of Livonia for the disbursement of salaries to employees in amounts less than $200 00; that said checks shall be used for the payment of all employees salaries but shall not be used for the payment of compensation to officers of the City of Livonia and that said check shall bear on their face the following words, "not to exceed the sum of $200.00" and "pay roll check". The foregoing motion was seconded by Councilman Grimm and a roll call vote was taken with the following result : TEAS. NAYS: None The President declared the foregoing resolution passed Councilman Taylor made a motion that the following resolution be adopted. /93/6 RESOLVED, that Herbert M. Ferry be and hereby is retained as City Auditor of the City of Livonia for the fiscal year commencing December 1, 1950, and the amount of his compensation for such year be and hereby is fixed in the sum of $1500.00 The foregoing motion was seconded by Councilman Jahn and a roll call vote was taken with the following result: Page 266 YEAS: Raymond E Grimm, Wilson W. A ten minute recess was called, following which the meeting was resumed with all members of the council present. A request was made by the Police Department for an appropriation to be used in purchasing a stock of extra parts for automobiles. Councilman Jahn made a motion that the following resolution be adopted: /9,3/7 RESOLVED, that the Police Department be and hereby is granted an additional appropriation of $502 66 to be used in the purchase of extra parts for automobiles, that said appropriation be charged against the contingency fund and that the parts to be purchased be identified by requisition #R22. The foregoing motion was seconded by Councilman Whitehead and a roll call vote imi was taken with the following result: YEAS: Raymond E Grimm, Wilson W. Hagen, Director of Public Safety, requested an additional appropriation to be used in employing more Police Officers, made necessary by the Civilian Defense Program and other conditions On motion of Councilman Grimm, seconded by Councilman Jahn and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was• /93/S- RESOLVED, that the President appoint a special committee to meet with the Director Of Public Safety, the Chief of Police and the Civil Service Commission and to make recommendations to the Council 1.6 on January l5, 1951, as to the advisability of an additional appro— priation to be used in employing additional police officers. The President then appointed Councilmen Grimm, Jahn and Edgar Page 267 Proposed plat of Livonia Farms was presented to the Council and on motion of Councilman Taylor, seconded by Councilman Grimm and unanimously carried ism by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was . 173/9 RESOLVED, that the proposed plat of Livonia Farms be referred to the City Planning Commission for study and recommendations. Lester French, Director of Public Works, requested an appropriation for installation of water in the new Public Works Building on Farmington Road Councilman Edgar made a motion that the following resolution be adopted: 7-7,..3 _20 RESOLVED, that the bid in the amount of $5521.73 received by the Department of Public Works from Thomas Sinacola of 29205 Seven Mile Road, for installing a 6 inch water main in the Public Works Building on Farmington Road, including all materials, be and hereby is accepted; that an appropriation be and hereby is made from the contingency fund in the above amount, that payment of said sum of $5521.73 by the City Treasurer is hereby authorized on final completion of said work and that the Mayor and City Clerk are hereby authorized and directed to affix the signature of the City of Livonia to a proper contract for the installation of said water main. None The President declared the foregoing resolution passed Communication dated January 4, 1951, from the Detroit Concrete Products Corporation was read. Councilman Taylor made a motion that the following resolution be adopted: (-2 -5-z / RESOLVED, that the written request of Detroit Concrete Products Corporation dated January 4, 1951, for an extension of time to July 1, 1951, for the performance of the contract for re-surfacing of streets in Rosedale Gardens, be and hereby is approved and granted. The foregoing motion was seconded by Councilman Grimm and a roll call vote was taken with the following result. page 268 YEAS: Raymond E Grimm, Wilson VT. Lester French, Director of Public Works, requested instructions as to obtaining bids for completion of the Public Works Building. Councilman Jahn made a motion that the following resolution be adopted: RESOLVED, that the Department of Public Works be and hereby is authorized and directed to advertise for bids for the completion of the Public Works Building on Farmington Road. The foregoing motion was seconded by Councilman Taylor and a roll call vote was taken with the following result: YEAS: Raymond E. Grimm, Wilson W Edgar, John Whitehead, Nettie Carey, Harvey Jahn, William Taylor and Harry S. Wolfe NAYS: None The President declared the foregoing resolution passed. The Council next considered the request of the Justice Court for an additional appropriation. Councilman Taylor made a motion that the following resolution be adopted: /9-3-23 RESOLVED, that an additional appropriation of $200.00 for the Justice Court be and hereby is granted, the purpose of the same being to secure additional clerical help, provided, however, that payment of compensation to all clerical help of the Justice Court shall be made in the same manner as payment to other employees and in conformance with Civil Service procedure The foregoing motion was seconded by Councilman Carey and a roll call vote was taken with the following result: YEAS* Raymond E. Communication dated January 5, 1951, from Argonaut Realty Division of General Motors Corporation was read, wherein paving of certain streets was requested On motion of Councilman Carey, seconded by Councilman Jahn and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was : 19-326- RESOLVED, that communication from Argonaut Realty Division dated January 5, 1951, be and hereby is referred to Lester French, Director of Public Works and William Brashear, City Attorney, for their report and recommendations. The City Clerk read to the Council a communication dated January 4, 1951, signed by Leo 0. Nye, Justice of the Peace and appointing the Head of the Violations Bureau subject to Council's approval. Councilman Jahn made a motion that the following resolution be adopted. /9-3..26 RESOLVED, that the appointment by Leo 0. Nye, Justice of the Peace of Blanche martin as Head of the Violations Bureau and Clerk of the Justice Court be and hereby is approved. The foregoing motion was seconded by Councilman Carey and a roll call vote was taken with the following result. YEAS: Raymond E. Grimm, Wilson W. The appointment of Bert McKinney by the Mayor as City Assessor was presented to the Council Councilman Jahn made a motion that the fallowing resolution be adopted- /7 3a 7 RESOLVED, that the appointment of Bert McKinney as City Assessor be and hereby is approved and that said assessor be pain a compensation of $1200 00 per year for his services The foregoing motion was seconded by Councilman Carey and a roll call vote was taken with the following result: YEAS• Raymond E Grimm, Wilson W Edgar, John Whitehead, Nettie Carey, Harvey Jahn, William Taylor and Harry S. The appointment of Clyde Bentley and Albert Backer by the Mayor as IIIMembers of the Board of Review (of tax assessments) was presented to the Council. Councilman Carey made a motion that the following resolution be adopted: 4 ,.-3;.2 S RESOLVED, that the appointment of Clyde Bentley for a term of two years and of Albert Nacker for a term of one year as members of the Board of Review (tax assessments) be and hereby is approved. Petition #25 of Anna B Slapinskas was presented to the Council On motion of Councilman Grimm, seconded by Councilman Carey and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was : 3,3k3 RESOLVED, that Petition #25 for change of zoning classification be and hereby is referred to the City Planning Commission for hearing thereon and report and recommendations according to law. A letter was read from residents in the vicinity of Irving Street and Seven Mile Road. On motion of Councilman Whitehead, seconded by Councilman Edgar and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was: ILE g 33/ RESOLVED, that the petition of residents in the vicinity of Irving Street and Seven Mile Road far abatement of nuisance be and hereby is referred to the City Attorney. Page 272 Councilman Jahn made a motion that the following resolution be adopted: R 33 WHEREAS, there is an unexpended balance in the Construction Fund created far the extension of water mains under Ordinances No. 114 b"" and 15, adopted by the Township of Livonia, December 19, 1949, in the amount of $23,684.43, 'SHE EAS, the further sum of $5,793.00 has been received by the Livonia Water Board from property owners having property on Lathers Avenue to be used as contribution toward construction of a Water Main, RESOLVED, that the resolution passed by the Council of the City of Livonia on December 18, 1950, pertaining to the extensions and improvements hereinafter described, be and hereby is rescinded, and further RESOLVED, that the City Clerk be instructed to make application to the Michigan Municipal Finance Commission for permission to add the following streets to those listed in Ordinance No 15 for construction of water mains; such extensions and improvements to be located as follows : Oporto From Five Mile To Puritan Bainbridge From Five Mile South to existing main Lathers From existing main North of Curtis to Lot 30 of Parkview Acres Subdivision FURTHER RESOLVED, that the estimated cost of the above mains in the amount of $26,791.57, prepared by Herald F. Hamill, Engineer, be approved. Wolfe. NAYS: None. The President declared the foregoing resolution passed. Councilman Grimm then introduced the following ordinances . Page 273 NO AN ORDINANCE TO AMEND SECTIONS 2 C, 4 0 AND 12 0 OF ORDINANCE NO 16 OF THE QTY OF LIVONIA, ENTITLED: "AN ORDINANCE REGULATING THE INSTALLATION AND MAINTENANCE OF ELECTRIC WIRING, ELECTRIC DEVICES AND FT.FCTRIC MATERIAL; AND PROVIDING FOR PERMITS, INSPECTIONS AND LICENSES WITH RESPECT THERETO AND A PENALTY FOR VIOLATION THEREOF " THE CITY OF LIVONIA ORDAINS: Section 1. Section 2.0 of Ordinance No. 16 of the City of Livonia entitled. "An Ordinance Regulating the Installation and Maintenance of Electric Wiring, Electric Devices and Electric Material; and Providing for Permits, Inspections and Licenses with Respect Thereto and a Penalty for Violation Thereof," is hereby amended to read as follows. 2.1 No permit for the installation, alteration or maintenance of electric wiring, electric devices or electric material shall be issued until a permit fee of One Dollar ($1 00) together with the inspection fees herein provided, have been paid into the City Treasury; provided, however, that where the inspection fees, at the time of application for permit, total Three Dollars ($3 00) or less, then the permit fee shall be fifty cents ($0.50). 2 2 The following fees shall be charged for inspection of electrical installations, devices, apparatus and equipment in the City of Livonia: (a) Incandescent Light Wiring One circuit or less $2.50 Each additional circuit 25 If the additional circuits are installed after the original permit has been filed, the maximum fee will prevail. (b) Incandescent Light Fixtures First 50 sockets or less $2 00 Each additional 25 sockets or fraction thereof 1.00 (c) Combined Wiring & Fixtures When inspected on one trip, one circuit or less and 50 sockets or less $3 50 Each additional circuit 25 (d) Electric Ranges or Water Heating A single electric range or water heater $2 50 Each additional range or water heater .50 When range or heater may be inspected on the same trip with wiring or fixture inspections, for each range or water heater 50 Page 274 (e) Electric Signs 50 lamp or 500 V.A. or less $2.50 Each additional 20 lamp or 200 V A or fraction thereof .25 (f) Motors and Generators For the installation of a single motor or generator 1 H P or less 1.00 Greater than 1 H P up to 10 H.P. inclusive 2 00 Greater than 10 H.P. up to 20 H P inclusive 3.00 Greater than 20 H P up to 30 H. P inclusive 4 00 Over 30 H P. 5.00 When more than one machine is to be installed on the same premises by the same party, and may be inspected at the same time, a charge shall be made for the largest machine according to the above schedule plus 50 cents for each additional unit. When several motors of less than 1/4 H.P. are properly connected to the same circuit, the fee charged shall be based tamp upon the number of such circuits as for wiring of incandescent lighting. (g) Meter Permits For temporary service only $1.00 Fixture permit fee includes meter permit for permanent service only (h) Furnace Wiring For the installation of one furnace and/or temperature control equipment with motor up to and including 1 H.P $2 00 Where motor size exceeds 1 H.P., charge is for power See Item (f) Where there is no motor connected with the above installation 1.00 For two or mare furnaces and/or temperature control equipment in the same building, the above fees apply plus 50 cents for each additional. Where permit covers a c c*nbinati on of wiring circuits and furnace equipment, add one-half of the above fee to the regular charge for cirauat wiring. Page 275 (i) Miscellaneous When additional inspections are made necessary by reason of the inspector being called prematurely, or due to non-compliance with the rules, an additional charge of $1.50 per trip will be made For the inspection of electrical apparatus for which no fee is herein provided and for the inspection of temporary installations for decorative, advertising and theatrical purposes, a fee of $3.00 per hour, or fraction thereof, shall be charged 2.3 Any permit issued under the provisions of this ordinance may be cancelled by the Bureau of Inspection on written request from the holder of such permit, but only in the event such written request is made within six months from the date of issuance of the permit and prior to any inspection or other action under the permit, including any exercise of privileges granted by the permit In the event anp permit is cancelled on request of a holder thereof, as above provided, there shall be no refund of the permit fee or any part thereof, but the City Treasury shall make a refund of 75% of all inspection fees paid in connection with such unused permit Section 2. Section 4 0 of said Ordinance #16 is hereby amended to read as follows Ler 4.1 No alterations or additions shall be made in the existing wiring of any building, nor shall any building be wired for the placing of any electric lights, motors, heating devices, or any apparatus requiring the use of electrical current at a potential over 30 volts, nor shall any alterations be made in the wiring in any building after inspection, without first notifying the Bureau of Inspection and securing a permit therefor Applications for such permit, describing such work, shall be made by the person, firm or corporation installing same and permit when issued shall be to such applicant. 4.2 This section shall not apply to maintenance and repairs on the premises of a person, firm or corporation regularly employing qualified electricians fcr that purpose, nor such minor repair work as repairing flush and snap switches, replacing fuses, changing lamp sockets and receptacles, taping bare joints or repairing drop cords 4.3 All permits issued under the provisions of this ordinance shall terminate on the expiration of six months frau the date of issuance unless exercised within such period of time. Section 3 Section 12.0 of said Ordinance #16 is hereby amended to read as follows: Page 276 12 1 The provisions of this ordinance shall not apply to the f oll ovri ng: (a) The installing of radio receiving sets and equipment, except the installation of convenience outlets for power supply (b) Apparatus and equipment installed by ar for any public utility operating under jurisdiction of the Michigan Public Service Commission and used primarily for the generation or distribution of electric current or for signal or communication purposes. 12.2 Nothing herein contained shall prohibit any bona fide owner from personally installing, altering or repairing electrical wiring and apparatus in or on a single family residence owned and occupied by such person, even though such bona fide owner does not have a Journeyman's or Contractor's license; provided, however, that such owner shall obtain the necessary permit, pay the fees required, do the work himself, apply for inspections and receive a certificate of inspection from the Electrical Inspector. Section 14. THE CITY OF LIVONIA ORDAINS: Section 1. Section 3.0 of Ordinance No. 17 of the City of Livonia entitled• "An Ordinance Regulating the Installation and Maintenance of Plumbing and Drainage, and of Materials Used in Plumbing and Drainage; and Providing for Permits, Inspections and Licenses with Respect Thereto and a Penalty for Violation Thereof," is hereby amended to read as follows: 3 1 No permit for the installation, alteration or maintenance of plumbing and drainage, or materials used in plumbing and drainage, shall be issued until a fee of One Dollar ($l 00) together with the inspection fees herein provided, have been paid into the City Treasury. 3.2 The following fees sha71 be charged for inspection of plumbing and drainage installations, materials and equipment in the City of Livonia. Tanks not exceeding 350 gal. $2.00 Exceeding 850 gallons )4 00 (e) dater Treatment Devices : Installation Permits 5.00 Transfer of Permit (General) 1 00 (f) Miscellaneous : Men additional inspections are made necessary by reason of the inspector being called prema- turely, or due to noncompliance with the rules, an additional charge of $1 50 per trip will be made For the installation of or special inspection of plumbing or drainage equipment not herein specifically prescribed, a fee not exceeding $3.00 per hour or fraction thereof shall be charged to cover inspection services. 3.3 Any permit issued under the provisions of this ordinance may be cancelled by the Bureau of Inspection on written request from the holder of such permit, but only in the event such written request is made within six months from the date of issuance of the permit and prior to any inspection or other action under the permit, including any exercise of privileges granted by the permit. In the event any permit is cancelled on request of a holder thereof, as above provided, there shall be no refund of the permit fee or any part thereof, but the City Treasurer shat 1 make a refund of 75% of all inspection fees paid in connection with such unused permit. Section 2. Section 5 0 ofsaid Ordinance No. 17 is hereby amended to read as f ollows : 5 1 No person or persons snail excavate or obstruct any public or private street, alley or other thoroughfare within the City of Livonia, for the purpose of installing plumbing cr sewerage, cr connect to any private or public sewer within the City of Livonia; commence the construction, reconstruction, alteration or repair of a plumbing or sewerage system within the City of Livonia, without first obtaining a permit so to do frau the Bureau of Inspection of the City of Livonia, provided, however, that no permit will be necessary for the repair of leaks, unstopping of sewers or waste pipes, replacing of broken fixtures, installing water coolers or refrigerators where no connection to sewer is required 5.2 All such permits shall be subject to the rules and regulations of the State Plumbing Code and of the Bureau of Inspection of the City of Livonia Page 279 5 3 All applications for permits shall be made to the Bureau of Inspection of the City of Livonia in such manner as required by the State Plumbing Code. 5.14 All permits issued under the provisions of this ordinance shall terminate on the expiration of six months from the date of issuance unless exercised within such period of time. Section 3. All ordinances or parts or ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full farce and effect The foregoing ordinances were placed on the table for consideration.
