HomeMy WebLinkAboutCOUNCIL MINUTES 1950-10-23 Page 178 MINUTES OF THE TWENTY-FIRST REGULAR LIEI,IING OF THE COUNCIL OF THE CITY OF LIVONIA OCTOBER 23, 1950 The twenty-first regular meeting of the Council of the City of Livonia was held on October 23, 1950, at 33110 Five Mile Road, Livonia, Michigan. The meeting was called to order at approximately 8:08 P. M. by the President of the Council, Harry S. Wolfe. Roll was called with the following result: Present-- Harry S. Wolfe, Wilson W Edgar, Raymond E Grimm, Harvey Jahn, Nettie Carey, William Taylor and John Whitehead Absent--None. The minutes of the nineteenth regular meeting of the Council held October 16, 1950, were read and approved Communication from Central Ambulance Service dated October 21, 1950, was placed on file and Ralph Heppner of that firm made an oral statement to the Council of the rates charged for ambulance service Miss Emilie Sargent, Mrs. Wendt and Mrs 3elchoir appeared before the Council on behalf of the Visiting Nurse Association and explained the work of that organization and the means of financing same. Councilman Harvey Jahn made a motion that the following resolution be adopted: A 01,4 WHEREAS, the Visiting Nurse Association has previously rendered service to the people of the Township of Livonia and later to the people of the City of Livonia; and WHEREAS, all bills of such service up to and including September 1, 1950, have been paid; and WHEREAS, the Visiting Nurse Association is about to continue its service with the consent of the Council; therefore, it is RESOLVED, that the sum of $125.00 per month is hereby appro- priated for nursing services to be furnished by the Visiting Nurse Association during the period commencing on this date and ending November 30, 1950, and that the disbursement of such money is hereby placed under the control and examination of the Mayor. Am- The foregoing motion was seconded by Councilman John Whitehead and a roll call vote was taken with the following result: Page 179 YEAS: Raymond E Grimm, Harvey Jahn, Milson W. Edgar, Nettie Carey, John Whitehead, Harry S Wolfe and William Taylor NAYS: None. Min The President declared the foregoing resolution passed. Councilman Raymond E Grimm made a motion that the following resolution be adopted: P -'01 ? RESOLVED, that the bill of Mae P Nye in the amount of $425.00 for use of her property by the City of Livonia as dumping grounds during the period commencing October 1, 1950, and ending April 1, 1951, be and hereby is approved and the City Treasurer is directed to pay the same. The foregoing motion was seconded by Councilman William Taylor and a roll call vote was taken with the following result : YEAS: Raymond E Grimm, Harvey Jahn, Wilson W Edgar, Nettie Carey, John Whitehead, Harry S Wolfe and William Taylor NAYS: None The President declared the foregoing resolution passed. Fire Chief, Calvin Roberts and Police Chief, George E Harmon made a statement in regard to the salary schedule heretofore submitted by the Civil Service Commission and approved by the Council A ten minute recess was called at 9:50 P. M., following which the meeting was resumed with all of the members present named as present in the roll call of this meeting A discussion took place as to the approval of the interim and annual budgets These budgets, as prepared by the Mayor, revised by the Council and recomputed and retyped under the direction of the City Auditor and City Clerk were read and considered by the Council Councilman Wilson W.. Edgar made a motion that the following resolution be adopted: A RESOLVED, that the interim budget of the City of Livonia for the period commencing June 1, 1950, and ending November 30, 1950, and the complete budget for the next fiscal year commencing December 1, 1950, and ending November 30, 1951, both of which budgets were prepared by the Mayor and submitted by him to the Council on September 15, 1950, as required by Section 3, Chapter VII of the Charter, and as Page 180 revised by the Council, be and hereby are determined and adopted as provided by the Charter; that all proceedings on said budgets be and hereby are approved as being in full conformance with the Charter, it appearing that proper notice of public hearing thereon was duly pub- "m lished in the Livonian on September 29, 1950, and that pursuant to such notice a public hearing was duly held on October 9, 1950, at the nineteenth regular meeting of the Council, and was thereafter duly adjourned to October 16, 1950, and again on that date duly adjourned to October 23, 1950, the date of the present meeting; that,in ander to raise the amount necessary to be raised by taxation, a tax levy of one (1) mill; i.e., one-tenth (1/10) of one (1) per centum of the assessed value of all real and personal property subject to taxation in the City of Livonia, is hereby made and approved; and that this resolution together with the summary of said budgets, as adopted herein, be pub- lished with the minutes of this meeting. The foregoing motion was seconded by Councilman John Whitehead and a roll call vote was taken with the following result: YEAS: Rwmond E Grimm, Harvey Jahn, Wilson W. Edgar, Nettie Carey, John Whitehead, Harry S. Wolfe and William Takyla'. NAYS: None. The President declared the foregoing resolution passed Badges were presented by Police Chief, George E Harmon to the Mayor and the Council and the heads of all departments. Communication from Board of Supervisors dated October 21, 1950, con- cerning seating of additional supervisor, William W. Brashear, on Tuesday, October 2L., 1950, was read and placed on file. Reports of the Department of Health, Allen J. Buxton, Plumbing Inspector and Millard 0 Babcock, Electrical Inspector concerning Glenbrook Hospital were read and placed on file. Letter of resignation of Sidney Dethloff as a member of the Zoning Board of Appeals was read and placed on file On motion of Councilman Wilson W. Edgar, seconded by Councilman William Taylor and unanimously carried, it was: A c2-31 RESOLVED, that a letter of appreciation be sent to Mr Dethloff. The foregoing motion was seconded by Councilman Nettie Carey and a roll call vote was taken with the following result: YEAS: Raymond E. Grimm, Harvey Jahn, Wilson W Edgar, Nettie Carey, John Whitehead, Harry S. Wolfe and William Taylor. NAYS: None. The' President then declared the foregoing resolution passed Communications from the City Planning Commission, as to petitions 8 to 15 inclusive, were read and placed on file On motion of Councilman John Whitehead, seconded by Councilman Harvey Jahn and unanimously carried by the affirmative vote of all of the Councilmen named as present in the roll call of this meeting, it was t 4- 23i RESOLVED, that a vote be taken at this time on the ordinance introduced by Councilman Wilson "ri Edgar at the Fifteenth regular meeting of the Council held on September JJ. , 1950, entitled: "An Ordinance Amending Ordinance No. 7 Of The City Of Livonia Entitled: 'An Ordinance To Establish Districts in The City Of Livonia; To Regulate The Use Of Land And Structures Therein; To Regulate And Limit The Height, The Area, The Bulk And Location Of Building; To Regulate And Restrict The Location Of Buildings Designed For Specific Uses; To Regulate And Determine The Area Of Yards, Courts And Other Open Spaces; To Regulate The Density Of Population; To Provide For The Administration And Enforcement Of This Ordinance; To Provide For A Board Of Appeals, And Its Powers and Duties; To Provide A Penalty For The Violation Of The Terms Thereof; And To Adopt The Zoning Ordinance Of The Township Of Livonia, Amendments Thereto And Zoning Map,' " a public hearing on said ordinance having taken place before the City Planning Commission and the report and recommendations of said commission thereon having been made to the Council. At the request of the President, the clerk read to the council the ordinance described in the last mentioned resolution. The president then asked the clerk to take a roll call vote on said ordinance and a roll call vote was taken by the clerk with the following result: YEAS: Wilson W Edgar, John Whitehead, Harvey Jahn, Nettie Carey and Harry S. Grimm introduced the following ordinance: NO. c„ AN ORDINANCE TO AMEND PORTIONS OF SECTIONS 31, 32 AND 25 OF THE ZONING MAP OF THE CITY OF LIVONIA OF ORDINANCE NO. 7 ENTITLED: "AN ORDINANCE TO ESTABLISH DISTRICTS IN THE CITY OF LIVONIA; TO REGULATE THE USE OF LAND AND STRUCTURES THEREIN; TO REGULATE AND LIMIT THE HEIGHT, THE AREA, THE BULK AND LOCATION OF BUILDINGS; TO REGULATE AND RESTRICT THE LOCATION OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIC USES; TO REGULATE AND DETERMINE THE AREA OF YARDS, COURTS AND OTHER OPEN SPACES; TO REGULATE THE DENSITY OF POPULATION; TO PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE; TO PROVIDE FOR A BOARD OF APPEALS, AND ITS PG E'RS AND DUTIES, TO PRO- VIDE A PENALTY FOR THE VIOLATION OF THE TERMS THEREOF; AND TO ADOPT THE ZONING ORDINANCE OF THE TOWNSHIP OF LIVONIA, AMENDMENTS THERETO AND ZONING MAP", AND SECTIONS 3(A) AND 11 OF SAID ORDINANCE NO 7 THE CITY OF LIVONIA ORDAINS: w.. The following definitions are hereby adopted: (a) Zoning Ordinance as hereinafter used in this ordinance, is defined asinance No of the City of Livonia entitled: "An Ordinance To Establish Districts In The City Of Livonia; To Regulate The Use of Land And Structures Therein; To Regulate And Limit The Height, The Area, The Bulk And Location Of Buildings; To Regulate And Restrict The Location Of Trades And Industries And The Location Of Buildings Designed For Specific Uses; To Regulate And Determine The Area Of Yards, Courts And Other Ogen Spaces; To Regulate The Density of Population; To Provide for The Administration And Enforcement Of This Ordinance; To Provide For A Board of Appeals, and Its Pcwers and Duties; To Provide A Penalty For The Violation Of The Terms Thereof; And To Adopte The Zoning Ordinance Of The Township of Livonia, Amendments Thereto and Zoning Map", as amended (b) The term Zoning Map,, as used in this ordinance, is hereby defined to mean the Zoning Map adopted in Section 3 of said Zoning Ordinance. (c) The term Petition or Petitions, as used in this ordinance, is defined to mean petitions to amend said Zoning Ordinance filed with the Council and referred to the City Planning Commission for report and recommendations. Page 183 Section 2. The report and recommendations of the City Planning Commission on Petitions No 8, 9, 10, 11, 12 and 14 to amend said Zoning Ordinance are hereby accepted and adopted Section 3. Portions of Sections 31, 32 and 25 of the Zoning Map of ... the City of Livonia of said Zoning Ordinance, as amended, and Section 3(A) of said Zoning Ordinance, are hereby amended as follows: (a) Said petition No. 8 is hereby granted and the zoning classification of the premises described in said petition is hereby changed from AG-1-C to C-1 (b) Said petition No. 10 is hereby granted and the zoning classification of the premises of said petition is hereby changed from AG-1-B to C-1. (c) Said petition No. 12 is granted to the extent provided in the following Section 4 of the present ordinance. (d) Said petition No. 14 is granted only to the following extent: That portion of the property described in said petition to a depth of 300 feet, measured from the center line of Plymouth and Middlebelt Roads, is hereby changed to a C-2 classification; provided, however, that there shall be observed by all persons a building line set back of at least 60 feet from the center of both Plymouth and Middlebelt Roads. (e) The classification and district changes made by granting said petitions 8, 10 and 14 shall be included in Section 3(A) of r.. said Zoning Ordinance as amended (f) Those portions of Sections 31, 32 and 25 of said Zoning Map, which include the premises described in said petitions No. 8, 10 and 111, are hereby amended to conform to the changes made in the foregoing paragraphs (a), (b), and (d) of this section; and the attached amended Zoning Map No. 2, showing such changes and amendments, is here- by approved and made a part hereof Section 4. Section 11 of said Zoning Ordinance is hereby amended by adding to sub—section 11 01 thereof, immediately following paragraph (g) therein, the f ollowing: The Zoning Board of Appeals may permit the erection of a motel court in a C-1 t strict provided that each unit is provided with a lot area of Six hundred (600) square feet for the first room of eighty (80) or more square feet and an additional area equal to twice the room area for each additional room of eighty (80) square feet or more, and provided that each unit or group of units shall have two side yards of not less than ten (10) feet each, a front yard not less than twenty-five (25) feet, a rear yard of not less than ten (10) feet and separate buildings shall be not less than ten (10) feet apart; and further provided that each unit shall have one (1) room with not less than one hundred fifty (150) square feet of floor area, a bathroom with running hot and cold water of not less than twenty-five (25) square feet of floor area, and not less than fifty (50) square feet of floor area for a kitchenette if provided; Page 184 and further provided that each living unit shall be provided with one off-street parking space not less than eight (8) feet wide and twenty (20) feet long with appropriate hard surfaced area that it may be used in wet weather; and further provided that no guest shall occupy such accommodations for a period of more than one month within any calendar year. A "motel" is defined as a business comprising at least three (3) or more dwelling units so arranged as to furnish over-night accommodations for transient guests Section 5. Pursuant to the report and recommendations of the City Planning Commission, said petition No 9 is hereby denied and said petition No 11 is hereby dismissed Section 6 All proceedings on said petitions No. 8, 9, 10, 11, 12, and 14 are hereby approved, a public hearing thereon having been duly held as provided by law and proper notice of such hearing, including full description of the premises described in said petitions, having been duly published. Section 7. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect Section 8. Should any portion of this ordinance be held invalid for any reason, such holding shall not be construed as affec ting the validity of any of the remaining portion of this ordinance Petition No 16 of Clarence W Rathburn et al. for change of zoning classification was presented to the council On motion of Councilman Raymond E. Grimm, seconded by Councilman William Taylor and unanimously carried by the affirmative vote of all councilmen named as present in this meeting, it was: �3 RESOLVED, that Petition No. 16 of Clarence 1 Rathburn et al for change of zoning classification be and hereby is referred to the City Planning Commission for report and recommendations On motion of Councilman Harvey Jahn, seconded by Councilman Raymond E.
