MINUTES OF THE FIFTEENTH REGULAR MRRTING
OF THE COUNCIL OF THE CITY OF LIVONIA
SEPTEMBER 114, 1950
The fifteenth regular meeting of the Council of the City of Livonia was
held on September 114, 1950, at 33110 Five Mile Road, Livonia, Michigan The
meeting was called to order at approximately 8:10 P M by the President of the
Council, Harry S Wolfe Roll was called with the following result: Present--
Harry S Wolfe, Wilson W Edgar, Raymond E. Grimm, Harvey Jahn, Nettie Carey,
William Taylor, and John Whitehead Absent--None
The minutes of the fourteenth regular meeting of the Council held on
August 28, 1950 were read and approved
Edwin Conway, member of the City Planning Commission, and Mr Waring
1 of Waring and Johnson presented to the Council a tentative plan for a Civic Center.
On motion of Councilman Harvey Jahn, seconded by Councilman William Taylor and
unanimously carried by the affirmative vote of all of the Councilmen named as
present in the roll call of this meeting, it was -
i) I71 RESOLVED, that the City Council does hereby express its full
accord with the work of the City Planning Commission in preparing a
tentative plan of a Civic Center; and does further express the hope
that said plan will be developed and completed.
The clerk presented to the Council the proposed plat of Candace Sub-
division which was tentatively approved by the Council at its thirteenth regular
meeting held on August 21, 1950 On motion of Councilman Harvey Jahn, seconded
by CouncilmanWilson W Edgar and unanimously carried by the affirmative vote of
all of the Councilmen named as present in the roll call of this meeting, it was:
1 i7 q RESOLVED, that the plat for Candace Subdivision be and hereby
is approved by the Council on condition that the same be examined and

Communication from the City Planning Commission relative to parks was
read On motion of Councilman Wilson til Edgar, seconded by Councilman Raymond E
Grimm and unanimously carried by the affirmative vote of all of the Councilmen
named as present in the roll call of this meeting, it was :
K} 18o RESOLVED, that the communication from the City Planning
Commission pertaining to parks be referred to the Department of Parks
and Recreation.
Communication from Roland R Seghi was read and considered On motion
of Councilman Raymond E Grimm, seconded by Councilman William Taylor and unanimously
16 carried by the affirmative vote of all of the Councilmen named as present in the
roll call of this meeting, it was:

relation to a liquor license be and hereby is referred to the Department

Communication from Walter J Smith was read and considered On motion
of Councilman Nettie Carey, seconded by Councilman William Taylor and unanimously
carried by the affirmative vote of all of the Councilmen named as present in the
roll call of this meeting, it was •
16 PIAL RESOLVED, that the communication of Walter J Smith with
reference to employment as a purchasing agent be placed on file for
future reference and that Mr Smith be so advised and the Council's
appreciation for his letter stated
Communication of Donald Roach of Livonia Drug was read and considered
On motion of Councilman William Taylor, seconded by Councilman Raymond E. Grimm
and unanimously carried by the affirmative vote of all of the Councilmen named as
present in the roll call of this meeting, it was:
A /Pi RESOLVED, that the City Council does hereby express its full
approval of the issuance of a SDD Liquor License to Livonia Drug ( Donald
111 Roach, proprietor) and does hereby request the Mayor to write to the
Michigan Liquor Control Commission expressing the Councilts approval of
such license.

Petition of residents in the neighborhood of the Myron H Beals Post
No. 32 was read and considered On motion of Councilman Raymond E Grimm, seconded
by Councilman Harvey Jahn and unanimously carried by the affirmative vote of all of
the Councilmen named as present in the roll call of this meeting, it was:
H- '5" RESOLVED, that the communication from residents in the neighbor—
hood of the Myron H Beals Post No 32 be referred to the Director of
Public Safety for investigation and report; and that the Commander of the
Myron H seals Post No 32 be requested to have representation at the
next regular meeting of the Council
Petition No 13 of Marion E Dipboye etal and petition No. 14 of
Clarence W. Rathburn etal for change of zoning classification were filed and on
motion duly made by Councilman Filson W. Edgar, seconded by Councilman Raymond E
Grimm and unanimously carried by the affirmative vote of all of the Councilmen
named as present in the roll call of this meeting, it was •

referred to City Planning Commission for hearing and recommendations.
Financial report of Leo 0 Nye, Justice of the Peace, was presented and
placed on file
The City Clerk presented certain bills for payment Councilman Wilson W
Edgar made a motion that the following resolution be adopted:
RESOLVED, that the following bills be and hereby are approved
and the same be paid by the City Treasurer Bills were allowed and
charged against the following departments in the following respective

The foregoing motion was seconded by Councilman John Whitehead
and a roll call vote was taken with the following result.

The President then declared the foregoing resolution was passed
The council then examined with great interest, the proposed seal
for the City of Livonia designed by Cylania A. Schaible Councilman Harvey
Jahn made a motion that the following resolution be adopted:
A I P7 RESOLVED, that the proposed seal prepared by
Cylania A. Schaible for the City of Livonia be and hereby
is adopted by the Council of the City of Livonia and is
identified by the signature of the Council President
Harry S. Wolfe, and it is FURTHER RESOLVED, that the appreci-
ation of the city for the splendid work of Cylania A Schaible
for preparing the seal is hereby expressed.
The foregoing motion was seconded by Councilman Raymond E
Grimm and a roll call vote was taken with the following result:

Councilmen named as present in the roll call of this meeting, it was-

uAINTENANCE OF PLUMBING AND DRAINAGE, AYD OF
MAT hIALS USED IN PLUMBING AND DRAINAGE; AND
PROVIDING FOR PERMITS, INSPECTIONS AND LICENSES
WITH RESPECT THERETO AND A PENALTY FOR VI0—
LATION THEREOF
The City of Livonia Ordains
Section 1 0 Adoption of Plumbing Code and Statutes by Reference
1.1 The latest edition of the Plumbing Code and Statutes of the State
of Michigan, published under the entitlement of "Plumbing Law, Rules and Regulations
of the State Plumbing Board of Michigan pertaining to the Licensing of Plumbers,
the Supervision and Inspection of Plumbing and the Adoption and Enforcement of
Uniform Minimum Standards Governing the Construction, Installation and Inspection
of Plumbing and Drainage, Seventh Edition, 1949," and all subsequent editions thereof,
16 as approved by the State Plumbing Board, are hereby adopted by the City of Livonia
and by this reference are made a part of this ordinance with the same effect as if
said code, statutes, rules and regulations were word for word repeated herein.
1 2 Said Plumbing Code shall be published by providing to the public in
the office of the City Clerk not less than fifty (50) printed copies in book form
available for inspection by and distribution to the public at all times The charge
for such book shall be $1 00 each A complete copy of said code shall be available
for public use and inspection at the office of the City Clerk and publication of this
ordinance shall constitute notice to such effect
Section 2.0 Inspection and Permit Authority
2 1 The Bureau of Inspection shall be and is hereby given jurisdiction,
subject to review hereinafter provided, over the inspection of all plumbing and
drainage installations, including changes, repairs and additions thereto, within
the City of Livonia, and shall have authority to make reasonable rules and re—
gulations in relation thereto, to issue pernLts and certificates and to do such
other things as may be necessary to the effect and enforcement of this ordinance
2 2 The Chief Inspector shall appoint a Plumbing Inspector who shall
inspect all plumbing and drainage installations and report to the Bureau of
Inspection The Plumbing Inspector may be engaged by contract to handle inspections
for such percentage of the inspection fees as may be fixed by resolution of the
Council, in which event he shall not be subject to Civil Service, otherwise he shall
be subject to Civil Service.
2 3 The Plumbing Inspector, except as otherwise herein provided, is hereby
given all of the powers and duties of the Plumbing Inspector set forth in the code,
statutes, rules and regulations adopted in Section 1.0 of this ordinance
Section 3 0 Fees for Permits and Inspections
3.1 No permit for the installation, alteration or maintenance of plumbing
and drainage, or materials used in plumbing and drainage, shall be issued until a
fee of Two Dollars ($2 00) together with the inspection fees herein provided, have
been paid into the City Treasury

3.2 The following fees shall be charged for inspection of plumbing and
drainage installations, materials and equipment in the City of Livonia-

When additional inspections are made necessary by
reason of the inspector being called prematurely,
or due to noncompliance with the rules, an additional
charge of $1.50 per trip will be made For the
installation of or special inspection of plumbing or
drainage equipment not herein specifically pre-
scribed, a fee not exceeding $3.00 per hour or fraction
thereof shall be charged to cover inspection services.
3.3 Any permit issued under the provisions of this ordinance may be
cancelled by the Bureau of Inspection on written request from the holder of such
permit, but only in the event such written request is made within one year from the
date of issuance of the permit and prior to any inspection or other action under the
permit, including any exercise of privileges granted by the permit In the event
any permit is cancelled on request of a holder thereof, as above provided, there
shall be no refund of the permit fee or any part thereof, but the City Treasurer
shall make a refund of 75% of all inspection fees paid in connection with such
unused permit
Section 4 0 Access to Buildings
4 1 The Plumbing Inspector and his assistants shall have the right of
access to buildings for the purpose of inspection, as provided in the State Plumbing
Code
Section 5 0 Permits
5.1 No person or persons shall excavate or obstruct any public or private
street, alley or other thoroughfare within the City of Livonia, for the purpose
of installing plumbing or sewerage, or connect to any private or public sewer within
the City of Livonia, commence the construction, reconstruction, alteration or repair
of a plumbing or sewerage system within the City of Livonia without first obtaining
a permit so to do from the Bureau of Inspection of the City of Livonia, provided,
however, that no permit will be necessary for the repair of leaks, unstopping of
sewers or waste pipes, replacing of broken fixtures, installing water coolers or
refrigerators where no connection to sewer is required. •
5 2 All such permits shall be subject to the rules and regulations of the
State Plumbing Code and of the Bureau of Inspection of the City of Livonia
5 3 All applications for permits shall be made to the Bureau of Inspection
of the City of Livonia in such manner as required by the State Plumbing Code
5.4 All permits issued under the provisions of this ordinance shall
terminate on the expiration of one year from the date of issuance unless exercised
within such period of time

Section 6 0 Inspection
6 1 Upon the completion of the installation of plumbing, drainage, or
any materials used in plumbing or drainage, in any building, it shall be the duty
of the person, firm or corporation installing the same to notify the Bureau of
Inspection, which shall require the Plumbing Inspector to inspect the installation
as soon as possible, and if it is found to be fully in compliance with this ordinance
and does not constitute a hazard to life and property, he shall issue to such person,
firm or corporation for delivery to the owner a certificate of inspection authorizing
use of plumbing and drainage and the turning on of the water supply
6 2 All plumbing and drainage materials which are to be hidden from view
shall be inspected before concealment and any person, firm or corporation installing
such materials shall notify the Bureau of Inspection, giving sufficient time in which
to make the required inspection before such materials are concealed.
6 3 The Plumbing Inspector may make periodically a thorough re-inspection
of the installation in buildings of all plumbing, drainage and materials used in
plumbing and drainage, including material now installed or hereafter installed,
410 within the City of Livonia and when the installation of any such plumbing, drainage
or materials is found to be in a dangerous or unsafe condition, the person, firm
or corporation owning, using or operating the same shall be notified and shall mace
the necessary repairs or changes required to place such plumbing, drainage or
materials in a safe condition and have such work completed within fifteen days, or
any longer period specified by the Plumbing Inspector in said notice
6 it The Plumbing Inspector is hereby empowered to disconnect or order
the discontinuance of water service to such plumbing, drainage, or materials so
found to be defectively installed until the same has been made safe as directed by
the Plumbing Inspe ctor
Section 7 0 Construction and Materials
7 1 All the materials used in plumbing or drainage and the construction
and installation of all plumbing and drainage shall be in strict conformity with the
provisions of this ordinance, the Statutes of the State of Michigan, the State
4110 Plumbing Code, and the rules and regulations established as provided in this
ordinance
7.2 No certificate of inspection shall be issued unless such materials,
installation and construction are in conformity with the provisions of this ordinance
and with approved methods of construction for safety to persons and property.
7 3 It shall be the duty of the Plumbing Inspector from time to time to
inspect material and equipment offered to the public for use in installation to see
that such items conform to the above requirements
7 4 Prior to the issuance of a certificate of inspection authorizing the
use of plumbing or drainage, such use is hereby prohibited and shall constitute a
violation of this ordinance
Section 8 0 Registration of Plumbers.
8 1 All plumbers licensed under the provisions of act number 266, Public
Acts of Michigan, 1929, as amended, residing in or doing work in the City of Livonia
are hereby required to register with the Bureau of Inspection in the manner provided
by said Act number 266, and to pay to the City Treasurer the following registration
fee. for each idaster Plumber One Dollar, and for each Journeyman Plumber Fifty cents

Section 9.0 Plumbing Board of Review
9 1 A Plumbing Board of Review is hereby constituted consisting of the
Plumbing Inspector of the City of Livonia and two other persons who shall be appoint-
ed by the Mayor for such terms as shall be designated at the time of appointment
At least one of the members of said Board shall be a Master Plumber who shall have
had ten (10) years or more experience in his field.
9 2 When the Plumbing Inspector condemns or disapproves of all or part
of any plumbing or drainage installation, the owner may within five days after
receiving written notice from the Plumbing Inspector, file a petition in writing
for a review of said action of the Plumbing Inspector with the Plumbing Board of
Review.
9 3 On receiving a petition for review, said Plumbing Board of Review
shall at once proceed to determine whether said plumbing or drainage installation
complies with this ordinance and within three days shall make a decision in
accordance with its findings
Section 10.0 Water Supply and Distribution
10.1 In buildings without basements an inverted stop and waste cock shall
be placed in the horizontal pipe as near as possible to the vertical riser.
10.2 All stop and waste cocks underground shall be full size inverted type
protected with a stop cock box, either of iron, cement or vitrified clay pipe
brought level to the surface of basement or cellar floor or, in buildings without
basement or cellar, to the level of the ground.
Section 11 0 Building Drains and Sewers
11 1 If vitrified clay or cement pipe is used for a building sewer, it
shall be not less than six (6) inches internal diameter If cast iron pipe is used,
it shall not be less than four (4) inches internal diameter
11.2 The building drain shall be lain to a depth of not less than five
(5) feet at its highest point if there is no basement; provided that in special
cases it may be laid to such a grade and depth as is approved by the Plumbing Inspec-
tor Depth shall mean the distance from the building grade to the top of the pipe
Section 12.0 Owners Constitutional Privilege
12.1 Nothing herein contained shall prohibit any bona fide owner from
personally installing plumbing in his own residence, provided that said owner shall.
(a) Apply for and secure a permit
(b) Pay required fees
(c) Do the work himself or herself in accordance with this ordinance
(d) Apply for inspections
(e) Receive approval of Plumbing Inspector.
Section 13 0 Use of Funds
13.1 All fees paid into the City Treasury for permits, licenses and
inspections under the provisions of this ordinance shall become a part of the general
fund of the City, and such part thereof as may be necessary shall be used to pay
the expenses of the regulation and inspections herein authorized

14 1 Any person, firm or corporation who shall violate or fail to comply
with any of the provisions of this ordinance, or who shall injure or destroy any
property or notice of the Bureau of Inspection, or who shall interfere with any of
the work of said Bureau, shall be guilty of a misdemeanor, and on conviction, shall
be punished by a fine not to exceed Five Hundred Dollars ($500 00), or by imprison-
ment for not more than ninety (90) days, or by both such fine and imprisonment in
the discretion of the Court
Section 15.0 Repeal.
15 1 Section 12 01, entitled, "Plumbing", of Article XII of the Building
Code of the Township of Livonia, together with all parts of said Code which are
inconsistent or in conflict with this ordinance, are hereby repealed
15.2 All ordinances or parts of ordinances in conflict or inconsistent
with this ordinance are hereby repealed
Section 16 0 Liability
16 1 This ordinance shall not be construed to relieve from or lessen the
responsibility or liability of any party awning, operating, controlling or installing
any plumbing, drainage, and/or materials used in plumbing and/or drainage for
damages to person or property caused by any defect therein nor shall the City of
Livonia, or any of its subdivisions or agents, be held as assuming any such lia-
bility by reason of the inspection authorized herein, or certificate of inspection
issued as herein provided
Section 17.0 Severability.
17 1 In the event any portion of this ordinance is held invalid for any
reason, such holding shall not affect the validity of the remaining portion of this
ordinance.
Section 18 0 Effective Date
18.1 This ordinance is hereby declared to be an emergency ordinance
necessary for the protection of the public health and welfare, and shall take effect
immediately on publication, as provided by the Charter.

AN ORDINANCE AMENDING ORDINANCE NO 7 OF THE CITY
OF LIVONIA ENTITLED. " AN ORDINANCE TO ESTABLISH
DISTRICTS IN THE CITY OF LIVONIA; TO REGULATE THE
USE OF LAND AND STRUCTURES THEREIN, TO REGULATE AND
LMT THE HEIGHT, THE AREA, THE BULK AND LOCATION
OF BUILDINGS; TO REGULATE AND RESTRICT THE LOCATION
OF BUILDINGS DESIGNED FOR SPEOIFIC USES, TO REGULATE
AND DETERMINE THE AREA OF YARDS, COURTS AND OTHER OPEN
SPACES, TO REGLIATE THE DENSITY OF POPULATION; TO
PROVIDE FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS
ORDINANCE; TO PROVIDE FOR A BOARD OF APPEALS, AND ITS
PGS AND DUTIES; TO PROVIDE A PENALTY FOR THE VIO-
LATION OF THE TERMS THEREOF; AND TO ADOPT THE ZONING
ORDINANCE OF THE TOWNSHIP OF LIVONIA, AMENDMENTS

THE CITY OF LIVONIA ORDAINS•
Section 1 Sub-section 5 03 of Section 5, Sub-section 6 03 of Section
6, Sub-section 7 03 of Section 7, Sub-section 8 03 of Section 8, Sub-section 9.03
of Section 9, and Sub-section 10 03 of Section 10 of the Zoning Ordinance of the
Township of Livonia, as adopted by Section 2 of Ordinance No 7 of the City of
Livonia entitled• "An Ordinance to Establish Districts in the City of Livonia,
to Regulate the Use of Land and Structures Therein; to Regulate and Limit the Height,
the Area, the Bulk and Location of Buildings; to Regulate and Restrict the Location
of Buildings Designed for Specific Uses, to Regulate and Determine the Area of
Yards, Courts and Other Open Spaces; to Regulate the Density of Population, to
Provide for the Administration and Enforcement of this Ordinance; to Provide for a
Board of Appeals, and Its Powers and Duties, to Provide a Penalty for the Violation
of the Terms Thereof; and to adopt the Zoning Ordinance of the Township of Livonia,
Amendments Thereto and Zoning Map," are hereby repealed.
Section 2 Section 4 of said Zoning Ordinance of the Township of Livonia,
adopted by the City of Livonia as aforesaid, is hereby amended by adding to said
Section 4 the following Sub-sections-
4.20 LOT AREA AND MINIUM WIDTH. For the purpose of this Sub-section,
the following special zones are hereby created:
ZONE I shall consist of Sections 34, 35 and 36, Town One South, Range
Nine East, Livonia Township, now the City of Livonia, said Zone being
bounded by Plymouth Road on the North, Inkster Road on the East, Joy Road
on the South and Farmington Road on the West
ZONE II shall consist of the entire area of the City of Livonia except
the territory contained in ZONE I, as above defined
Every lot in ZONE I as above defined, upon which it is intended that a
building or buildings for dwelling purposes be hereafter erected shall
have a width of at least Fifty-five (55) feet and an area of at least
Sixty-six hundred (6600) square feet; and every lot in ZONE II upon which
it is intended that a building or buildings for dwelling purposes be

hereafter erected shall have a width of at least Sixty (60) feet and an
area of at least Seventy-two hundred (7200) square feet; provided, however,
that each multiple dwelling hereafter erected shall provide a lot area of
not less than 1,250 Square Feet per family; and provided, further, that
these requirements as to minimum widths and minimum areas shall not apply
to a piece or parcel of land platted and identified as a single unit on
a plat officially approved and recorded prior to the effective date of
this Ordinance
1 .21 PLATS. No proposed plat of lands or of a new subdivision shall be
hereafter approved by either the City Council or the City Planning
Commission unless such plat and subdivision are in full compliance with
this Zoning Ordinance, the Statutes of the State of Michigan, the Ordinances
of the City of ldvonia, the Rules and Regulations of the City Planning
Commission and the Resolutions and Requirements of the City Council.
Section 3 All Ordinances or parts of Ordinances in conflict or incon-
sistent herewith are hereby repealed
Section 4 Should any portion of this Ordinance be held invalid for
any reason, such holding shall not be construed as affecting the validity of any
of the remaining portion of this Ordinance
Section 5. This Ordinance is hereby declared to be an emergency Ordinance
necessary for the protection of the public health and welfare, and shall take effect
immediately on publication, as provided by the Charter
On motion of Councilman Raymond E. Grimm, seconded by Councilman Harvey
Jahn and unanimously carried by the affirmative vote of all of the Councilmen named
as present in the roll call of this meeting, it was:
P /79 RESOLVED, that the foregoing ordinance amending Ordinance No. 7,
the zoning ordinance of the City of Livonia, be and hereby is referred to
the City Planning Commission for holding a public hearing thereon as pro-
vided by law and the making of a report and recommendation to the City
Council.
On motion of Councilman Raymond E Grimm, seconded by Councilman Harvey Jahn
and unanimously carried, the meeting was adjourned at 11:50 PIT , September 1l., 1950.
