MINUTES OF THE ADJOURNED ONE HUNDRED FORTY-SIXTH REGULAR
iir MEETING OF THE CDUNCIL OF THE CITY OF LIVONIA
On July 18, 1955, the above meeting was held at 33001 Five Mile Road,
Livonia, Michigan, and was called to order at approximately 8:07 P. M., by the
President of the Council, John T. Daugherty. Roll was called with the following
result: Present-- John T. Daugherty, David L. Jones, Harry R. Killam, Rudolf R.
Kleinert, John W. Whitehead, Nettie Carey and Wilson W. Edgar. Absent-- None.
The City Clerk, Marie W. Clark, read a letter dated July 15, 1955 from
George D. Haller, City Attorney.
By Councilman Kleinert, seconded by Councilman Edgar, it was
#368-55 RESOLVED, that resolution #334-55, adopted by the Council
June 27, 1955, and vetoed by the Mayor under date of July 7, 1955,
is hereby readopted in its entirety, just as if it were word for
word repeated herein.
iim A roll call vote was taken on the foregoing resolution with the following result:
AYES: Kleinert, Whitehead, Carey, Edgar and Daugherty.
NAYS: Jones and Killam.
The President declared the resolution adopted.
On request of the Stewart Building Company, the petition for sidewalks
in E. G. Settle Realty Company's Bonaparte Gardens Subdivision is postponed until
the meeting of July 25, 1955.
The City Clerk read a letter dated June 7, 1955 from the Zoning Board of
Appeals for additional appropriation.
By Councilman Kleinert, seconded by Councilman Kilian, it was
#369-55 RESOLVED, that the request of the Zoning Board of Appeals
dated June 7, 1Q55 for additional funds in the following amounts:
Stenographic Services $200.00
Postage 50.00
Laiis approved and the sum of $250.00 is hereby appropriated from the
Unallocated Fund to the proper budget accounts for this purpose.

Councilman Edgar introduced the following Ordinance:

AN ORDINANCE VACATING PORTIONS OF
STREET, ALLEY AND PUBLIC GROUND.
THE CITY OF LIVONIA ORDAINS:
Section 1. The report and recommendation of the City Planning Commission
dated April 15, 1955 and Apri'. 21, 1955, on Petitions No. V-8 and V-9, for vacating
portions of certain street, alley and public ground, are hereby accepted and adopted;
and the Council does hereby approve all proceedings on said petitions, it appearing
that a public hearing thereon was duly held on March 29, 1955 and April 19, 1955
respectively, as provided by law, and that proper notices of such hearing were given.
Section 2. Pursuant to Ordinance No. 29, as amended, of the City of
Livonia, entitled: "An Ordinance Providing for Vacating of Streets, Alleys and
Public Grounds ," the following portions of certain street, alley and public ground
are hereby vacated:
(a) That certain easement described in said Petition No. V-8
being more properly described as that portion of a 20 foot drainage
easement across the rear of lots 9, 10 and 11 of Bell Creek Farms Sub-
division No. 1, being a part of the Northwest 1/4 of Section 15, City
of Livonia, Wayne County, Michigan; provided however that a new 20 foot
easement with a centerline 10 feet from the West line of said lots and
lying generall y adjacent to the gest line of said lots be recorded.
(b) That certain alley or easement described in said Petition
No. V-9, being more properly described as that portion of a 20 foot alley
or easement South of lots 15 9 (on Floral), and 264 (on Deering) and in
the rear of lots 27 through 39 inclusive (on Curtis) of Sunningdale Park
Subdivision, being a part of the Northeast 1/4 of Section 12, City of
Livonia, Wayne County, Michigan; provided a 20 foot easement be retained
for public uti'ities.
Section 3. All ordinances or parts of ordinances in conflict herewith are

hereby repealed only to the extent necessary to give this ordinance full force and
effect.
Section 4. Should any portion of this ordinance be held invalid for any
reason, such holding shall not be construed as affecting the validity of the re-
maining portion of this ordinance.
The foregoing ordinance was placed on the table for consideration at the
next regular meeting of the Council, July 25, 1955.
The City Clerk read the report of the Justice Court and Violations Bureau
for the month of June, 1955, which was received and placed on file.
By Councilman Killam, seconded by Councilman Whitehead and unanimously
adopted, it was

until the Council meeting of August 8, 1955, and that the Board of
Water Commissioners submit t heir recommendations at that time.
The following ordinance was introduced by Councilman Killam at the meeting

AN ORDINANCE AMENDING SECTIONS' 22, 33 AND
36 OF THE ZONING MAP OF THE CI'TY OF LIVONIA,
AND AMENDING ARTICLE 3.00 OF THE ZONING OR-
DINANCE, ORDINANCE NO. 60, OF THE CITY OF
LIVONIA, BY ADDING THERETO SECTIONS 3.63,
3.64 AND 3.65.
THE CITY OF LIVONIA CR.DAINS:
Section 1. The report and recommendations of the City Planning Commission
dated April 21, 1955, on Petitions No. Z-93, Z-98 and Z-99, having been considered by
the Council, the Council hereby adopts said petitions to amend the Zoning Ordinance
and the Zoning Map of the City of Livonia and all proceedings heretofore conducted
on said petitions, are hereby approved.
Section 2. Article 3.00 of the Zoning Ordinance, Ordinance No. 60 of the
City of Livonia, is hereby amended by adding thereto the following sections:
Section 3.63. PetitionNo. Z-93 of Virgle and Zora Whitteaker
is hereby granted; the zoning classification of the premises described in
said petition is hereby changed from R-U-F-B to R-1-A as requested in
said petition; and the Northwest 1/4 of Section 33 of said Zoning Map
is hereby amended to conform to the change made in this section.

Section 3.64. Petition No. Z-98 of Morris Pollack is hereby
granted; the zoning classification of the premises described in said
petition is hereby changed from R-U-t'-B to R-1-B as requested in said
petition; and the Southeast 1/4 of Section 22 of said Zoning Map is
hereby amended to conform to the change made in this section.
Section 3.65. Petition No. Z-99 of Harold C. and Pearl M.
Mueller is hereby granted; the zoning classification of the premises
described in said petition is hereby changed from R-U-F-B to R-1-B as
requested in said petition; and the Southeast 1/4 of Section 36 of said
Zoning Map is hereby amended to conform to the change made in this section.
Section 3. The attached map designated "Arrendment No. 15 of the Zoning
Map of the City of Livonia" showing all of the amendments and changes made in the
foregoing Section 2 of this Ordinance, is hereby approved, established and made a
part hereof.
Section 4. All ordinances or parts of ordinances in conflict herewith
are hereby repealed only to the extent necessary to give this ordinance full force
and effect.
Section 5. Should any portion of this ordinance be held invalid for any
reason, such holding shall not be construed as affecting the validity of any of the
remaining portions of this ordinance.
A roll call vote was conducted on the foregoing ordinance with the following result :

NAYS: Kleinert and Edgar.
The President declared the Ordinance duly adopted and would become effective on

The following Ordinance was introduced by Councilman Kleinert at the
meeting of June 27, 1955:

OF LIVONIA, BY ADDING THERETO SECTIONS
3.66 AND 3.67.
THE CITY OF LIVONIA ORDAINS:

Council, the Council hereby adopts said petitions to amend the Zoning Ordinance and

ing Map is hereby amended to conform to the change made in this section.
Section 3.67. Petition No. Z-97 of Jesse M. Cook, Cook Develop-
ment Company is hereby granted; the zoning classification of the premises
described in said petition is hereby changed from R-U-F-B to R-1-B as re-
quested in said petition; and the Southeast 1/4 of Section 32 of said Zon-
ing Map is hereby amended to conform to the change made in this section.
Section 3. The attached map designated "Amendment No. 16 of the Zoning
Map of the City of Livonia" showing all of the amendments and c hanges made in the
foregoing Section 2 of this Ordinance, is hereby approved, established and made a
part hereof.

The President declared the ordinance duly adopted and would become effective on
date of publication, July 28, 1955.
On motion of Councilman Killam, seconded by Councilman Jones and unanimously
adopted, this adjourned 146th regular meeting of the City Council was duly adjourned
at 8:50 P. M., July 18, 1955.
