Wednesday, September 27, 1995 at the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan at approximately 2 05 P M , at which time and place the following members of said commission were present Present Joan McCotter, City Clerk Robert D Bennett , Mayor Cathy White, City Attorney Absent None Joan McCotter assumed the duties as Chairperson of the Election Commission Upon a motion by Commissioner White, supported by Commissioner Bennett and unanimously adopted, it was RESOLVED that the minutes of the Election Commission meeting held on Monday, August 28, 1995 be hereby approved Upon a motion by Commissioner White, supported by Commissioner Bennett and unanimously adopted, it was ir RESOLVED that the Election Inspectors listed on the schedule attached hereto, and made a part of these minutes, are duly appointed to the Election Board for the City Regular Election to held on Tuesday, November 7 , 1995 Upon a motion by Commissioner Bennett, supported by Commissioner White and unanimously adopted, it was RESOLVED that the compensation for the day of Tuesday, November 7, 1995 be $80 00 for each Inspector, $85 00 for each Vice-Chairperson, and $90 00 for each Chairperson and further that each appointed member required to attend an instructional meeting be reimbursed at the rate of $5 00 per meeting Chairperson McCotter opened the floor for discussion of the proposed Charter Amendment on the City Treasurer Discussion included that the City Clerk' s office had not received a response on the proposed amendment from the Governor and the State Attorney General to allow the amendment to be placed on the November 7, 1995 City Regular Election ballot Chairperson McCotter expressed concern that the deadline for ballot printing (10-09-95) for the November election was drawing close and that a decision needed to be made on the appropriate action to take if the Governor were to either disapprove the proposed charter amendment or if the Governor did not respond to the proposed charter amendment in a timely matter Upon review of the Home Rule City Act by Commissioner White the following issues were discussed (1) If the Governor approved the charter amendment, the amendment is placed on the ballot, (2) If the Governor disapproved the imcharter amendment - the charter amendment would not go on the ballot, (3) The City Council can override the Governor ' s disapproval with a two-thirds majority vote (5-2) and therefore place the charter amendment on the November 7, 1995 ballot, (4) If no response is received from the Governor' s office, and the printing deadline has passed, the City will incur the additional costs to have the ballots printed and proceed with placing the charter amendment on the ballot as the City followed section 22 of the Home Rule City Act Upon a motion by Commissioner Bennett, supported by Commissioner White and unanimously adopted, it was RESOLVED that the Election Commission wait for a response from the Governor and State Attorney General and to proceed with the ballot layout that includes the Charter Amendment on the City Treasurer It was further resolved that as the October 9 , 1995 ballot printing deadline draws near and if correspondence from the Governor and State Attorney General has not been received or if the Governor disapproves the proposed Charter Amendment , that this issue may need additional review and another Election Commission meeting may need to be scheduled Chairperson McCotter presented the Election Commissioners with the report on CR 627-95 in regard to the City Primary Election After some discussion, it imwasnoted by the Election Commission that there was not an equipment failure or a system failure while tabulating the Absentee Ballots during the City Primary Election on September 12 , 1995 Upon a motion by Commissioner Bennett , supported by Commissioner White and unanimously adopted, it was RESOLVED that the Election Commission accepts the report submitted by Joan McCotter, City Clerk, and that the same report be submitted to the City Council There being no further business to come before the Commission, the Chairperson declared the meeting adjourned at
