HomeMy WebLinkAboutSYNOPSIS - 2018-12-03 (2) nd SYNOPSIS OF THE MINUTES OF THE 1,862 REGULAR MEETING LIVONIA CITY COUNCIL – DECEMBER 3, 2018 ______________________________________________________________________ Meeting was called to order at 7:00 p.m. by President Toy. Present: Scott Bahr, Cathy White, Kathleen McIntyre, Brian Meakin, Jim Jolly, Brandon Kritzman, and Laura Toy. Absent: None. #411-18 Resolution by Jolly and White, unanimously adopted, approving the minutes th of the 1,861 Regular Meeting of the Council held November 19, 2018. Councilmember McIntyre remarked on the recent passing of former President George H.W. Bush and his legacy. nd Councilmember Bahr acknowledged and thanked all who helped for the 2 Annual Holiday Parade and indicated it was an amazing event that makes the Livonia community special. President Toy thanked all City Departments for their hard work in putting together the Holiday Parade. President Toy reminded residents City Council meetings are aired on various cable channels depending on provider. President Toy also wished all who celebrate birthdays in December a Happy Birthday including: Brian Meakin – December ththth 11; Mayor Wright – December 13; and Linda McCann – December 9. Councilmember Meakin indicated President Toy also has a December birthday and wished her a Happy Birthday on December 22nd. st City Treasurer Lynda Scheel indicated Winter tax bills were mailed out December 1 and encouraged residents to visit the City’s website if any questions. Treasurer Scheel indicated taxes can be paid in person, via U.S. mail, or dropped off in the red mail box outside City Hall. Wayne County Commissioner Diane Webb was present to thank residents for their support in the recent election and extended Happy Holiday wishes to all. AUDIENCE COMMUNICATION Several Livonia residents addressed Council to speak in opposition to and in favor of the proposed Planned Parenthood location on Farmington. The following items were received and filed: Communication from the City Engineer, dated November 29, 2018, re: sidewalk waiver requested for single-family home located at 9915 Wayne Road. Revised proposed amendment to Sections 020, 030, 090, 110 and Repealing Section 120 of Title 9, Chapter 30 (Narcotics and Dangerous Substances) of the Code of Ordinances, as submitted by the Department of Law. Communication from Jordan Jonna, A.F. Jonna Development & Management Co., dated October 31, 2018, re: Brownfield Plan and Reimbursement Agreement for Haggerty Square as requested by Asti Environmental, on behalf of Haggerty Square, LLC. nd SYNOPSIS OF THE MINUTES OF THE 1,862 REGULAR MEETING 2 LIVONIA CITY COUNCIL – DECEMBER 3, 2018 The following resolutions were offered by Jolly and Kritzman: #412-18 Approving service agreement for cloud-based recreation management software and support for Department of Parks & Recreation for five years commencing December 1, 2018 and expiring December, 2023. #413-18 Approving request to purchase one (1) John Deere 2025R utility tractor through State of Michigan bid process for Parks Maintenance Section of DPW. #414-18 Approving request to purchase one (1) John Deere 1575 lawn mower through State of Michigan bid process for Parks Maintenance Section of DPW. #415-18 Approving request to purchase three (3) John Deere XUV turf vehicles with utility attachments through State of Michigan bid process for Parks Maintenance Section of DPW. #416-18 Approving request to purchase four (4) John Deere turf vehicles through State of Michigan bid process for Parks Maintenance Section of DPW. #417-18 Approving request to purchase five (5) Toro Zero Turn Mowers (ZTR)-5000 through State of Michigan bid process for Parks Maintenance Section of DPW. #418-18 Approving request to transfer funds to offset cost for emergency patching on Newburgh Road in the amount of $65,000 for the 2018 Concrete Road Program, Contract 18-C. (CR 130-18) #419-18 Approving request to amend engineering contract through QBS process with OHM Advisors for design engineering services for the 2019 Asphalt Road Program. (CR 365-16) #420-18 Approving vacating request of Water Main Easement 1A located within Marycrest Manor Development located at 15475 Middlebelt Road. #421-18 Approving vacating request of Water Main Easement 1B located within Marycrest Manor Development located at 15475 Middlebelt Road. #422-18 Approving vacating request of Water Main Easement 2A located within Marycrest Manor Development located at 15495 Middlebelt Road. #423-18 Approving vacating request of Water Main Easement 2B located within the Marycrest Manor Development located at 15495 Middlebelt Road. #424-18 Approving request to release general improvement bond, public utility bond and site development bond for Washington Park Site Condominiums (former Washington Elementary School site). #425-18 Approving request to accept storm water facilities maintenance agreement for construction of a storm drainage system for site located at 12651, 12661 and 12691 Middlebelt Road at Menards. nd SYNOPSIS OF THE MINUTES OF THE 1,862 REGULAR MEETING 3 LIVONIA CITY COUNCIL – DECEMBER 3, 2018 #426-18 Approving Haggerty Square Planned General Development Agreement between City and Haggerty Square, LLC, in connection with waiver use petition for approval of retail shopping center and multi-family housing development at 19700 and 19750 Haggerty Road. (Petition 2018-01-02-02) #427-18 Approved proposed 2019 City Council meeting schedule, subject to change with notice. A roll call vote was taken on the foregoing resolutions with the following result: AYES: Bahr, White, McIntyre, Meakin, Jolly, Kritzman, and Toy. NAYES: None. #428-18 Motion by Bahr and Kritzman, unanimously adopted, denying sidewalk waiver requested by Soave Homes, Inc. for single family home located at 9915 Wayne Road. #429-18 Motion by Bahr and Kritzman, unanimously adopted, referring subject matter of a Master Plan for sidewalks within City to the Capital Outlay and Infrastructure Committee for its report and recommendation. #430-18 Motion by Meakin and McIntyre, unanimously adopted, approving Petition 2018-09-03-01 submitted by Jeffery and Tracy Nolte, to vacate existing ten (10) foot wide public sidewalk that runs along the north side of Lot 94 of Arbor Estates Subdivision (9386 Knolson), subject to petitioner’s removal of the subject sidewalk and fence, and the Department of Law is requested to prepare the necessary vacating ordinance for same. Bahr gave First Reading to the following Ordinance: AN ORDINANCE AMENDING SECTIONS 020, 030, 090, 110 AND REPEALING SECTION 120 TO TITLE 9, CHAPTER 30 (NARCOTICS AND DANGEROUS SUBSTANCES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Bahr invoked the Emergency Clause to allow for the Second Reading to the foregoing Ordinance. A roll call vote was taken to allow the Emergency Clause with the following result: AYES: Bahr, White, Meakin, Jolly, Kritzman, and Toy. NAYES: McIntyre. President Toy passed the gavel at 8:14 p.m. to speak on the matter. Bill Schmidt, 29688 McIntyre, addressed Council to indicate he felt Council is rushing too fast on this matter and encouraged them to listen to those who voted in favor of the law. Bahr then gave Second Reading to the following Ordinance: nd SYNOPSIS OF THE MINUTES OF THE 1,862 REGULAR MEETING 4 LIVONIA CITY COUNCIL – DECEMBER 3, 2018 AN ORDINANCE AMENDING SECTIONS 020, 030, 090, 110 AND REPEALING SECTION 120 TO TITLE 9, CHAPTER 30 (NARCOTICS AND DANGEROUS SUBSTANCES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. A roll call vote was taken on the foregoing Ordinance with the following result: AYES: Bahr, White, McIntyre, Meakin, Toy, Kritzman, and Jolly. NAYES: None. #431-18 Motion by Kritzman and Toy, unanimously adopted, referring the subject matter of the recently adopted Michigan Regulation and Taxation of Marihuana Act and its legal implications to the Committee of the Whole for its report and recommendation. President Toy resumed the gavel at 8:21 p.m. #432-18 Motion by Meakin and McIntyre, unanimously adopted, referring the subject matter of Petition 2018-08-01-05, submitted by Leo Soave Building Inc., to rezone properties located on west side of Farmington Road, between Norfolk Avenue and Eight Mile Road (20209, 20219, 20225, 20235, and 20307 Farmington Road) to the Committee of the Whole for its report and recommendation. #433-18 Motion by McIntyre and Jolly, unanimously adopted, approving the Haggerty Square Brownfield Plan for planned general development consisting of a retail shopping center and multi-family housing located on the east side of Haggerty Road between Seven Mile Road and Eight Mile Road (19700 and 19750 Haggerty Road). #434-18 Motion by White and Kritzman, unanimously adopted, approving the Haggerty Square Reimbursement Agreement between the City, the Brownfield Redevelopment Authority, and Haggerty Square, LLC, for reimbursement of eligible costs for property located at 19700 and 19750 Haggerty Road. AUDIENCE COMMUNICATION Several Livonia residents addressed Council to speak in opposition to and in favor of the proposed Planned Parenthood location on Farmington. Laura Zain, Tailwaggers, spoke to announce they will be rolling out a financial assistance campaign to aid residents with pet vaccinations in 2019 and was looking for support from the community and local businesses to help in this endeavor. nd By Jolly and Meakin, unanimously adopted, adjourning this 1,862 Regular Meeting of the Council of the City of Livonia at 8:47 p.m. on December 3, 2018.
