HomeMy WebLinkAboutPLANNING MINUTES 2018-07-17 MINUTES OF THE 1,126th PUBLIC HEARINGS AND REGULAR MEETING HELD BY THE CITY PLANNING COMMISSION OF THE CITY OF LIVONIA On Tuesday, July 17, 2018, the City Planning Commission of the City of Livonia held its 1,126th Public Hearings and Regular Meeting in the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan. Mr. Ian Wilshaw, Chairman, called the meeting to order at 7:00 p.m. Members present: Sam Caramagno Glen Long Betsy McCue Kevin Priddy Carol Smiley Peter Ventura Ian Wilshaw Members absent: None Mr. Mark Taormina, Planning Director, and Ms. Margie Watson, Program Supervisor, were also present. Chairman Wilshaw informed the audience that if a petition on tonight's agenda involves a rezoning request, this Commission makes a recommendation to the City Council who, in turn, will hold its own public hearing and make the final determination as to whether a petition is approved or denied. The Planning Commission holds the only public hearing on a request for preliminary plat and/or vacating petition. The Commission's recommendation is forwarded to the City Council for the final determination as to whether a plat is accepted or rejected. If a petition requesting a waiver of use or site plan approval is denied tonight, the petitioner has ten days in which to appeal the decision, in writing, to the City Council. Resolutions adopted by the City Planning Commission become effective seven (7) days after the date of adoption. The Planning Commission and the professional staff have reviewed each of these petitions upon their filing. The staff has furnished the Commission with both approving and denying resolutions, which the Commission may, or may not, use depending on the outcome of the proceedings tonight. ITEM #1 PETITION 2018-06-06-03 C-1 REGULATIONS LIQUOR LICENSES Mr. Caramagno, Secretary, announced the first item on the agenda, Petition 2018- 06-06-03 submitted by the City Planning Commission, pursuant to Section 23.01(b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, to determine whether or not to amend Section 10.03 of Article X, Waiver Uses, C-1 District Regulations, of the Livonia Zoning Ordinance No. 543, as amended, so as to allow for establishments having liquor licenses July 17, 2018 28671 such as Class C, Tavern, Micro brewers and Brewpubs, to operate in conjunction with restaurants and other dining facilities. Mr. Taormina: This proposed language amendment would allow for on-premise consumption of alcohol within C-1 zoning districts. Currently, restaurants and other establishments licensed to serve alcohol are restricted primarily to C-2 zoning districts. The change would expand opportunities for smaller restaurants that are located in C-1 zones to obtain and operate several of the various categories of licenses that are available through the Michigan Liquor Control Commission to allow for on-premise consumption of alcohol. Some of these include Class C, Tavern licenses as well as small distiller and brew pub licenses. The amendment was prompted by the owner of the New-Five Shopping Center which is located at Five Mile and Newburgh Roads. This was on behalf of a prospective tenant who is considering opening a sushi-style restaurant that would include either a Class C or a Tavern license. The use is currently not allowed at the New-Five Shopping Center as this site is zoned C-1, Local Business. Similar to the SDD and SDM licenses, which allow for the sale of beer, wine, spirits and other alcohol products for consumption off-premises, the on- premise licenses would be treated as a waiver use subject to Planning Commission and City Council approval. There are several special conditions that would apply to these licenses, including minimum separation distances from other similar licensed establishments, churches and school buildings, and also limiting alcohol sales to no more than 35 percent of the total gross receipts of all sales. With that, Mr. Chairman, I'll be happy to answer questions. There is no correspondence related to this item at this point. Mr. Wilshaw: Thank you, Mr. Taormina. As this is our own petition, there is no petitioner to come forward on this item. Is there anybody in the audience that wishes to speak for or against this item? Mark Canvasser, 28580 Orchard Lake Road, Farmington Hills, Michigan. I'm the owner of the shopping center at Five Mile and Newburgh. I had the opportunity to meet and speak with several of you at a meeting about a month ago. We've had a couple tenants in the past that have been interested in coming to the shopping center to do smaller restaurant-type uses, a sushi restaurant. They want the ability to serve liquor, either beer or wine or liquor, and the zoning for our shopping center doesn't allow that. Our shopping center is 75,000 square feet. In our meeting that we had, they had the zoning map and it showed that there were very similar shopping centers throughout Livonia of that size and that caliber that allowed C-1 type uses. Even at Six Mile and Newburgh in the July 17, 2018 28672 { small center on the northeast corner is a C-1 zoning. So there was discussion with several other people to change the zoning or amend the zoning, and that's really what I'm here to support. I appreciate your consideration in making this change to the zoning. Retail has changed as we all know. It's prime day right now, so if you haven't been on Amazon Prime, you might be one of the few in America that wasn't. And in other communities, these are similar uses. I know Livonia has attracted younger millennials and a sushi restaurant or smaller venues are appealing to people that can walk. You know that we have suffered a long time in that shopping center with the vacant Farmer Jack. We've completely turned that center around. We've got some great tenants, but we've had trouble filling some of those other spaces. So we've got to be aggressive and I'm hoping you'll be aggressive with us to allow this amendment to the Zoning Ordinance. Thank you very much. I can handle any questions you may have. Mr. Wilshaw: Thank you, Mr. Canvasser. Do we have any questions for Mr. Canvasser? Eric Ladwig, UPS Store, 37637 Five Mile, Livonia, Michigan 48154. I'm one of the tenants in Mark's plaza. And I think Mark alluded to the fact that we've had a lot of vacancies in that plaza for many years, and we're starting to come back. I think a sushi restaurant would attract the younger-type customers that I'm looking for. So I definitely want to support this, and I don't think it would be an issue. He's got great lighting. He's been a good tenant. He's been a good corporate citizen of this City and I'd really like to see this pass because this will just kind of be in fairness with some other plazas that are similar size to change the category. So as a tenant, I'm not speaking for the whole plaza, but for a lot of them. We'd love to see the zoning changed. Mr. Wilshaw: Excellent. Are there any questions? Ms. Smiley: Have you spoken to any of the other tenants about it? Mr. Ladwig: I've talk to like three or four of them. They're very supportive. Ms. Smiley: What's your store? Mr. Ladwig: The UPS store. Ms. Smiley: You're not serving liquor there, are you? Mr. Ladwig: No. They would be very upset with me if I did. July 17, 2018 28673 Ms. Smiley: I'm just teasing. Mr. Ladwig: The whole thing is traffic and it's hard because when Farmer Jacks left and the Rite Aid, I was basically the anchor of the plaza. And that was kind of tough for a lot of years. If we have a chance to get a new tenant that's going to come in, I think that would be great. I think a lot of the younger people, especially the millennials that are moving into the area, would love to have something like that. Ms. Smiley: Very good Thank you. Mr. Wilshaw: Any other questions or anybody else in the audience wishing to speak for or against this item? Seeing no one coming forward, I will close the public hearing and ask for a motion. On a motion by McCue, seconded by Smiley, and unanimously adopted, it was #07-49-2018 RESOLVED, that pursuant to a Public Hearing having been held by the City Planning Commission on July 17, 2018, on Petition 2018-06-06-03 submitted by the City Planning Commission, pursuant to Section 23.01(b) of Ordinance #543, the Zoning Ordinance of the City of Livonia, as amended, to determine whether or not to amend Section 10.03 of Article X, Waiver Uses, C-1 District Regulations, of the Livonia Zoning Ordinance No. 543, as amended, so as to allow for establishments having liquor licenses such as Class C, Tavern, Micro brewers and Brewpubs, to operate in conjunction with restaurants and other dining facilities, the Planning Commission does hereby recommend to the City Council that Petition 2018-06-06-03 be approved for the following reasons: 1. The proposed language amendment will allow for on- premise consumption of alcohol in the C-1 zoning district under the waiver use process; 2. The proposed language amendment will allow for establishments having liquor licenses such as Class C, Tavern, Micro brewers and Brewpubs, to operate in conjunction with restaurants and other dining facilities; and 3. The proposed language amendment will help meet a growing demand, broaden and encourage economic activities, and allow commercial enterprises to remain competitive in a way that is compatible and in harmony with the community's existing land uses, and is therefore in the best interests of the City and its residents. July 17, 2018 28674 { FURTHER RESOLVED, that notice of the above hearing was given in accordance with the provisions of Section 23.05 of Zoning Ordinance #543, as amended. Mr. Wilshaw, Chairman, declared the motion is carried and the foregoing resolution adopted. It will go on to City Council with an approving resolution. I will just make one brief comment that I was at the meeting that Mr. Canvasser alluded to, and one of the options that was considered was rezoning just one of the units of that center to C- 2 to accommodate this type of use. And if we were to start to get into that, it would get into a situation where we're almost spot zoning slices of a shopping center. This seems to be better option to this situation than that type of solution. ITEM #2 PETITION 2018-06-08-06 LA PLAZA Mr. Caramagno, Secretary, announced the next item on the agenda, Petition 2018- 06-08-06 submitted by Steve Anton requesting approval of all plans required by Section 18.58 of the City of Livonia Zoning Ordinance #543, as amended, in connection with a proposal to remodel the exterior of the commercial strip center (LA Plaza) at 36083-36175 Plymouth Road, located on the south side of Plymouth Road between Yale Avenue and Levan Road in the Northeast 1/4 of Section 32. Mr. Taormina: This is a request to remodel the exterior of LA Plaza, which is a commercial strip center that is located on the south side of Plymouth Road between Yale Avenue and Levan Road. This property is about 4.8 acres. It includes 480 feet of frontage on Plymouth Road. Located on the site is a multi-tenant retail shopping center that is about 36,000 square feet in size. It has an L-shaped configuration with some of the storefronts facing north towards Plymouth Road and other storefronts facing west. Currently, the exterior of the building contains a combination of face brick and vinyl siding. The brick is on the main part of the façade where it extends from the sidewalk to the top of the parapet. There is horizontal vinyl siding on the tower elements which highlights the ends as well as the center portion of the shopping center. The changes would mostly involve covering portions of the brick and vinyl with new materials. On the upper part of the building, the brick would be covered with fiber cement panels which are made by HardiePlank and the HardiePlank would also be used to replace the vinyl siding that is located on portions of the peaked tower elements. Between the storefront windows, the plans show cultured stone that would be used to 1 1 July 17, 2018 28675 cover the existing brick, and then from the sill line down to the sidewalk the existing brick would remain. At the end of the day, according to this plan, three primary materials would be utilized — the brick on the lower part of the building, the cultured stone in the middle part and then the HardiePlank on the upper part of the building. There are no other site changes. There were some additional accents provided on the design including some wall scones. I think the Commission had asked for some details on that, although I don't know if we have anything related to that. With that, Mr. Chair, I'll be happy to read out the correspondence. Mr. Wilshaw: Certainly, please. Mr. Taormina: There are five items of correspondence. The first item is from the Engineering Division, dated June 19, 2018, which reads as follows: "In accordance with your request, the Engineering Division has reviewed the above referenced petition. We have no objections to the proposed project at this time. The existing parcel is assigned a range of addresses from #36083 to #36175 Plymouth Road, with the address of #36217 Plymouth Road being assigned to the overall parcel. The submitted legal description appears to be correct and should be used in conjunction with this petition. The existing building is currently serviced by public water main, sanitary sewer and storm sewer. Should renovations to the building require alterations to the existing services, drawings will need to be submitted to this department to determine if permits will be required. Also, should the owner need to complete work within the Plymouth Road right- of-way, permits from the Michigan Department of Transportation (MOOT) will be required."The letter is signed by David Lear, P.E., Assistant City Engineer. The second letter is from the Livonia Fire & Rescue Division, dated June 29, 2018, which reads as follows: "This office has reviewed the site plan submitted in connection with a request to remodel the exterior of the commercial strip center on property located at the above referenced address. We have no objections to this proposal." The letter is signed by Keith Bo, Fire Marshal. The third letter is from the Division of Police, dated June 30, 2018, which reads as follows: "I have reviewed the plans in connection with the petition. I have no objections to the proposal." The letter is signed by Brian Leigh, Sergeant, Traffic Bureau. The fourth letter is from the Inspection Department, dated July 11, 2018, which reads as follows: "Pursuant to your request, the above referenced petition has been reviewed. (1) The parking lot located behind the building needs to be repaired/replaced and restriped. (2) The existing dumpster enclosure and gates needs to be repaired. (3) There are additional dumpsters behind the building that do not have July 17, 2018 28676 enclosures. Planning and/or Council may wish to address this. This Department has no further objections to this petition." The letter is signed by Jerome Hanna, Director of Inspection. That is the extent of the correspondence. The fifth letter is from the Finance Department, dated June 20, 2018, which reads as follows: "I have reviewed the addresses connected with the above noted petition. As there are no outstanding amounts receivable, general or water and sewer, I have no objections to the proposal." The letter is signed by Coline Coleman, Chief Accountant. That is the extent of the correspondence. Mr. Wilshaw: Do we have any questions of our Planning staff? Ms. Smiley: Just a question about the dumpsters that are not enclosed in the back. What is the story on those? Mr. Taormina: They're not enclosed. We typically require enclosure of dumpsters where they are visible to the public. Unfortunately, I did not have an opportunity to get out there and take a look at these particular trash containers to see just how visible they are, but in many cases, even if they're behind the shopping complex and they're not enclosed, we do require those to be properly contained with masonry enclosures on three sides and properly gated in the front. The Inspection Department is asking that Council and the Planning Commission consider that as part of any resolution. Ms. Smiley: There is a wall behind there. Mr. Taormina: There is a wall that separates this from the residential to the south. This aerial isn't quite detailed enough to show precisely where those dumpsters are located, but the resolution we have prepared does indicate compliance to the satisfaction of the Inspection Department. So if they feel that they should be enclosed, then that's something that they can require. Ms. Smiley: Thank you. Mr. Wilshaw: Any other questions for our Planning staff? Seeing none, the petitioner is here. We will need your name and address for the record please. Vincent George, Lakepointe Companies, 4564 Coachmaker Drive, Bloomfield Hills, Michigan 48302. We are the general contractors on record for this renovation. Mr. Anton was not able to attend. July 17, 2018 28677 Mr. Wilshaw: Thank you, Mr. George. Is there anything you'd like to add to the presentation? Mr. George: No. We are coming before you to get approved for the HardiePlank and for the other elements of the façade. Mr. Wilshaw: Is there any questions from the Commissioners? Mr. Caramagno: Sir, I saw some materials were brought up. Do you have materials that you can show us? Mr. George: Absolutely. This is our sample of the cultured stone color. This is product made by Dutch Quality Stone. This is what we're going to be wrapping the columns with. The roof has already been done. We got a permit to do that. It was a maintenance issue. There were some leaks. So the City allowed us to do that. And a sample of the new vinyl siding, but some of it will be covered with the Hardie board. Mr. Wilshaw: Any other questions? Ms. Smiley: Is that the HardieBoard colors? Mr. George: Yes, that is. Mr. Wilshaw: It's a red color and a beige color. Mr. George: That's correct. Mr. Wilshaw: Any other questions for our petitioner? Mr. Priddy: Good evening. On the drawing it looks like you're doing the columns. Are you taking brick off and replacing it? Mr. George: No. Right over it. It's a relatively thin veneer so we're going to go over them. Mr. Priddy: And the base is all remaining brick. Mr. George: It's remaining brick, yes. Mr. Priddy: What about the windows? Are you trimming the windows out? Mr. George: No. Just a nice clean look. Mr. Priddy: You mentioned previously something about lights? July 17, 2018 28678 Mr. George: Yes. We did email a spec on the lighting. They are wall scones. They're constructed of aluminum so they won't rust and stain the cultured stone. I believe you should have them. Mr. Priddy: Did you get anything on that? Mr. Taormina: I did not see anything. Mr. Wilshaw: If it was received, it didn't make it into our packets, but hopefully the City has it somewhere and we can get it into the packet for the Council. Any other questions for our petitioner? Mr. Ventura: Good evening. At the study session, it was noted and comments made about the fact that the parking striping was pretty well worn out. It appeared as though there was some spots, not in the main parking lot, I'm talking about behind that could stand some resealing. And so I'd ask you have you had an opportunity to mention that to the owner and something that can be added to this project. Mr. George: The owners are a company called Cantor Real Estate Opportunity Fund. They are out of Florida. The property manager is the one that takes care of these types of things. I will mention it to him along with the dumpster issue. The parking lot was redone, I believe, two years ago in the front and it's in relatively nice shape. Mr. Ventura: The underlying asphalt . . . . Mr. George: Just the back, yeah. I'll absolutely mention it to the property manager and see if we can. Ms. Smiley: There is an awning on one of the buildings. Mr. George: The jewelry store, yes. Ms. Smiley: Are you going to restore the awning and it will be what color? Mr. George: It's not in our scope of work to redo the awning. We will remove the awning and do the Hardie board or siding, whatever is going to go in that section, and then replace it. We don't have anything in our scope of work to replace or redo the awning. Ms. Smiley: Do you happen to know what color it is? Mr. George: Yeah, I think it's maroon. July 17, 2018 28679 Mr. Wilshaw: My recollection is that it's also a maroon color. 1 Mr. George: It is. On a motion by Smiley, seconded by Ventura, and unanimously adopted, it was #07-50-2018 RESOLVED, that the City Planning Commission does hereby recommend to the City Council that Petition 2018-06-08-06 submitted by Steve Anton requesting approval of all plans required by Section 18.58 of the City of Livonia Zoning Ordinance #543, as amended, in connection with a proposal to remodel the exterior of the commercial strip center(LA Plaza) at 36083-36175 Plymouth Road, located on the south side of Plymouth Road between Yale Avenue and Levan Road in the Northeast 1/4 of Section 32, be approved subject to the following conditions: 1. That the Exterior Elevations Plan identified as Sheet A.1, dated June 14, 2018, prepared by Chester Stempien Associates, is hereby approved and shall be adhered to; 2. That the issues as outlined in the correspondence dated July 11, 2018, from the Director of Inspection, including repairs to the parking lot and screening the trash receptacle(s) shall be resolved to the satisfaction and within a time frame agreeable to the Inspection Department; 3. That only conforming signage is approved with this petition, and any additional signage shall be separately submitted for review and approval by the Zoning Board of Appeals; 4. That no LED light band or exposed neon shall be permitted on this site including, but not limited to, the building or around the windows; 5. That unless approved by the proper local authority, any type of exterior advertising, such as promotional flags, streamers or sponsor vehicles designed to attract the attention of passing motorists, shall be prohibited; 6. That the specific plans referenced in this approving resolution shall be submitted to the Inspection Department at the time the building permits are applied for; and July 17, 2018 28680 7. Pursuant to Section 19.10 of Ordinance #543, the Zoning Ordinance of the City of Livonia, this approval is valid for a period of ONE YEAR ONLY from the date of approval by City Council, and unless a building permit is obtained, this approval shall be null and void at the expiration of said period. Mr. Wilshaw, Chairman, declared the motion is carried and the foregoing resolution adopted. It will go on to City Council with an approving resolution. ITEM #3 PETITION 2018-06-08-07 BRASHEAR TOWER Mr. Caramagno, Secretary, announced the next item on the agenda, Petition 2018- 06-08-07 submitted by Brashear Tower Limited Development Housing Association, L.L.C. requesting approval of all plans required by Section 18.47 of the Zoning Ordinance in connection with a proposal to remodel the exterior of the nine-story independent senior housing facility, known as William W. Brashear Tower, at 17841 N. Laurel Park Drive, located on the west side of N. Laurel Park Drive between Six Mile Road and University Drive in the Southeast 1/4 of Section 7. Mr. Caramagno: Mark, is Item 3 going to be heard tonight? Mr. Taormina: Mr. Chair, we did receive an email from the petitioner on July 11 indicating that they requested that this item be tabled to a date uncertain. We'll notify the Planning Commission when this item comes back for consideration. Mr. Wilshaw: I think that's fine. We'll just go with that. We'll note to anyone watching in our TV audience that Item 3 will be tabled to a future date. Is there a motion for that tabling? On a motion by Long, seconded by McCue, and unanimously adopted, it was #07-51-2018 RESOLVED, that the City Planning Commission does hereby recommend that Petition 2018-06-08-07 submitted by Brashear Tower Limited Development Housing Association, L.L.C. requesting approval of all plans required by Section 18.47 of the Zoning Ordinance in connection with a proposal to remodel the exterior of the nine-story independent senior housing facility, known as William W. Laurel Park Drive between Six Mile Road and University Drive in the Southeast '% of Section 7, be tabled as requested by the Petitioner in an email dated July 11, 2018. ITEM #4 APPROVAL OF MINUTES 1,125TH Public Hearings and Regular Meeting Mr. Caramagno, Secretary, announced the next item on the agenda, Approval of the Minutes of the 1,125th Public Hearings and Regular Meeting held on June 26, 2018. On a motion by Ventura, seconded by Long, and unanimously adopted, it was #07-52-2018 RESOLVED, that the Minutes of 1,125th Public Hearings and Regular Meeting held by the Planning Commission on June 26, 2018, are hereby approved. A roll call vote on the foregoing resolution resulted in the following: AYES: Ventura, Long, McCue, Priddy, Smiley, Caramagno, Wilshaw NAYS: None ABSENT: None ABSTAIN: None Mr. Wilshaw, Chairman, declared the motion is carried and the foregoing resolution adopted. Josh, on his trek to being an Eagle, which is a couple years away, he has to do a communications merit badge. And so that's what he's here tonight for to do that, so he has to write notes about what was discussed and if it was approved or disapproved and then he has to turn that in to his leader. So I'm doing my merit badge for communications and it's a Eagle July 17, 2018 28682 requirement and I eventually have to do it so I can get Eagle. So I'm getting closer and closer so I can get eventually to Eagle. Mr. Wilshaw: Excellent. And what did you obtain from this meeting or what did you learn as you listened to the meeting? Josh Lee: A lot of stuff. Mr. Wilshaw: A lot of formality, right? A lot of formal processes we go through here. We're glad to have you here. We're glad that you came to watch our meeting and we certainly want to wish you well in your process of getting your Eagle Scout. That's a very important thing and a very high honor to earn. Congratulations and we wish you well on that. Josh Lee: Thank you. Thomas Lee: I want to put a plug in for his brother. He's three years older and he chose to redo the Livonia Archery Range. It was overgrown and a lot of the targets were busted up. So we've been working for the last month, and tomorrow we finish it. You have a big giant field there. It's a big field. It was 70 yards of mulch to mulch that field, and we got it donated from the yard next door where they mulch the trees up. And so we're finishing tomorrow. We have to put a target line in and just do a safety line and we're finished. Mr. Wilshaw: That's awesome. That's really good. A lot of people don't realize that in and among all the different resources we have in the City, we do have an archery range down on Glendale that's a nice resource for people who want to practice archery. Thomas Lee: Yep. So we built ten new targets for them, which the requirement was, and then to mulch the field and redo all the safety lines, make sure everything was in a safe manner. So in the morning we'll finish it up. Mr. Wilshaw: That's excellent. I certainly appreciate the efforts of both your son, Josh, his bigger brother. Thomas Lee: His name is Jacob. Mr. Wilshaw: Jacob's work and yourself for encouraging them to do this great public service. Thomas Lee: As well as people love sports, I love scouting. We will do sports, but it's something that they're going to live with forever and it's going to stick with them. And Mr. Priddy and I, our kids were in July 17, 2018 28683 scouts together at St. Michael's for a long time, all the way from first grade on. We've known each other for a long time. Mr. Wilshaw: That's wonderful. Thank you so much for coming. Ms. Smiley: Can I ask what grade are you in Josh? Josh Lee: I'm going into seventh. Ms. Smiley: Very good. Thomas Lee: His brother is going into 10th grade. To be an Eagle Scout, if you don't do it early on, women get in your life and then you forget about being an Eagle Scout.
