HomeMy WebLinkAboutSYNOPSIS - 2018-06-04 th SYNOPSIS OF THE MINUTES OF THE 1,850 REGULAR MEETING LIVONIA CITY COUNCIL – JUNE 4, 2018 ______________________________________________________________________ Meeting was called to order at 7:00 p.m. by President Toy. Present: Brandon Kritzman, Scott Bahr, Cathy White, Jim Jolly, Brian Meakin, and Laura Toy. Absent: Kathleen McIntyre. th #203-18 Resolution by White and Jolly, approving the minutes of the 1,849 Regular Meeting of the Council held on May 21, 2018. A roll call vote was taken on the foregoing resolution: AYES: Kritzman, Bahr, White, Jolly and Toy NAYS: None PRESENT: Meakin Council Vice President Jim Jolly wished a Happy Birthday to his daughter, Lexie, who he stated turned 7. Councilmember Meakin announced two Happy Birthday wishes: one to his wife, Colleen, th who celebrated her birthday on May 28; and the second to his son Brendon, who turned 20 on May 31st. Councilmember Meakin also offered congratulations to City employee retirees Gregg Winn after 39 years of service and Debra Seeman after 27 years of service. President Toy announced the “Okay 2 Say Program” implemented by Attorney General Bill Schuette and thanked all residents who helped build the equipment at Rotary Park. She thanked all who participated for their hard work and dedication. Councilmember Brandon Kritzman spoke about the Rotary Park playscape and stated residents were still busy working through last Saturday and thanked all those who put forth tremendous work and helped out. President Toy introduced Debbie McDermott who were present at tonight’s meeting and brought with her Cooper, a therapy dog who has helped many Livonia residents through countless hours of therapy work. Ms. McDermott stated Cooper has worked the last three years at Churchill High School where he has received a great response from all the students. th President Toy announced the following (2) Public Hearings held on Monday, June 25, 2018 at 7:00 p.m. in the Auditorium of City Hall for the following items: Petition 2018-02-01-03 submitted by Cross Winds Court, to rezone the properties located on the south side of Ann Arbor Trail between Norwich Avenue and Wayne Road (34405, 34401, and 34407 Ann Arbor Trail) in the Southwest 1/4 of Section 33, from R-U-F (Rural Urban Farm), to R-1 (One Family Residential); and th SYNOPSIS OF THE MINUTES OF THE 1,850REGULAR MEETING 2 LIVONIA CITY COUNCIL – JUNE 4, 2018 Petition 2018-04-06-01 submitted by the City Planning Commission, pursuant to Council Resolution #145-18, and Section 23.01(a) of Zoning Ordinance No. 543, as amended, proposing to amend Sections 9.03(j) of Article IX and Section 10.03(d) of Article X in order to remove the requirement for the written consent of fifty-five (55) percent of the residential property owners within a four hundred (400) foot radius of the property lines of the proposed day care nursery as part of waiver use approval for day care nurseries in OS and C-1 Zoning Districts. President Toy indicated there was New Data on Item #15. AUDIENCE COMMUNICATION: Susan Yarbrough, 33428 Richland, addressed Council to speak about her concerns regarding cell towers in Livonia causing serious health concerns to residents. Ken Gentile, 35008 Ellen Court, addressed Council to express his concern regarding a neighbor cutting in to the flood plain and nature preserve near his property. He asked Council for their help to get the matter resolved. The following items were received and filed: Communication from the Department of Law, dated May 29, 2018, attaching proposed amendment to Livonia Zoning Ordinance No. 543, re: correcting erroneous statement of minimum lot size from 60’ x 120’ lots to 70’ x 120’ lots for development. (Petition 2018- 01-01-01) The following resolutions were offered by Jolly and White: #204-18 Approving request from Allison Adams for block party on Flamingo Blvd. between Clarita and Pickford on Saturday, June 30, 2018, from 4:00 p.m. to 10:00 p.m., with a rain date of Saturday, August 4, 2018. #205-18 Approving request from Jackie Gordon, to hold a graduation party with music, bounce house, and games and to barricade street from 11029 Arden to 11011 Arden between the hours of 12:00 p.m. and 10:00 p.m. on Saturday, June 23, 2018, the Council does hereby determine to waive Section 8.32.070 (Noise Control) of the Livonia Code of Ordinances during requested time. #206-18 Approving request to waive Section 8.32.070 (Noise Control) of the Livonia Code of Ordinances as requested by Rev. Fr. Tony Massad of St. Rafka Maoronite Catholic Church to host cultural festival with music played by a DJ and live bands at 32765 Lyndon Street, scheduled for Saturday August 4, 2018 from 3:00 p.m. to 12:00 a.m. and Sunday, August 4, 2018 from 1:00 p.m. to 9:00 p.m. #207-18 Confirming the reappointment of Gregory G. Coppola, 17268 McNamara, to Zoning Board of Appeals for a term of three years, which will expire on July 12, 2021. th SYNOPSIS OF THE MINUTES OF THE 1,850REGULAR MEETING 3 LIVONIA CITY COUNCIL – JUNE 4, 2018 #208-18 Authorizing the purchase of (2) Dominion Voting ICC Kit Optical Scan Tabulators through State of Michigan Bid process to streamline processing of ballots as requested by the Office of the City Clerk. #209-18 Authorizing the purchase of one (1) 2018 Ford F550 Regular Champion Defender 217” WB Bus Under State of Michigan Contract as requested by the Department of Community Resources for replacement of vehicle at Senior Center, from budgeted funds. #210-18 Approving dissolution of the Livonia Cable Television Commission as requested by the Department of Community Resources, as Public Act 480 designates authority to the State of Michigan via the Michigan Public Service Commission to negotiate with and oversee cable providers. #211-18 Approving Intergovernmental Agreement between Wayne County and Livonia utilizing grant funds of $217,092.00 to be used for improvements at Rotary Park and Clements Circle Park as requested by the Department of Parks and Recreation. #212-18 Approving extension of contract with ADS Environmental Services for five years for the Sanitary Sewer Flow Monitoring and Rain Gauge Program at an annual cost of $48,864 as requested by the Public Service Division. #213-18 Approving Intergovernmental Agreement between Wayne County and Livonia for the road improvements of Farmington Road between Plymouth Road and Schoolcraft Road with the proposed City’s participation to be estimated at 20% in the amount of $175,000.00 as requested by Engineering Division. #214-18 Approving waiver use petition submitted by Khuja Consulting LLC to increase seating capacity of previously approved limited service restaurant (formerly Rocky’s Rotisserie) into a full-service restaurant (Alloush Cafe) within the Newburgh Plaza Shopping Center, subject to conditions. (Petition 2018-03-02-06) #215-18 Approving waiver use petition submitted by Bianca Bousamra to operate a dance studio (The Foundation House) at 11936 Farmington Road, located on the east side of Farmington Road between Plymouth Road and the CSX railroad right-of-way, subject to conditions. (Petition 2018-04-02-07) #216-18 Approving waiver use petition submitted by Crossfit North Industry to operate an indoor fitness center at 11944 and 11948 Farmington Road, located on the east side of Farmington Road between Plymouth Road and CSX railroad right-of-way, subject to conditions. (Petition 2018-04-02-08) A roll call vote was taken on the foregoing resolutions: AYES: Kritzman, Bahr, White, Jolly, Meakin and Toy. NAYS: None. th SYNOPSIS OF THE MINUTES OF THE 1,850REGULAR MEETING 4 LIVONIA CITY COUNCIL – JUNE 4, 2018 Councilmember Meakin reported out on subject matter of measures to retain employees within the Police and Fire Divisions of the Department of Public Safety and indicated the matter would remain in the Public Safety, Health and Environment Committee. (CR 111- 18) Bahr gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 17 OF THE ZONING MAP OF THE CITY OF LIVONIA AND AMENDING ARTICLE III OF ORDINANCE NO. 543, AS AMENDED, KNOWN AND CITED AS “THE CITY OF LIVONIA ZONING ORDINANCE” BY ADDING SECTION 3.__ THERETO. (Petition 2018-01-01-01) White gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 040 OF TITLE 13, CHAPTER 08 (WATER SERVICE RATES AND REVENUES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Kritzman gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 050 OF TITLE 13, CHAPTER 08 (WATER SERVICE RATES AND REVENUES) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Kritzman gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 120 OF TITLE 13, CHAPTER 20 (LIVONIA SEWAGE DISPOSAL SYSTEM) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Jolly gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 130 OF TITLE 13, CHAPTER 20 (LIVONIA SEWAGE DISPOSAL SYSTEM) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. Kritzman gave FIRST READING to the following Ordinance: AN ORDINANCE AMENDING SECTION 050 OF TITLE 13, CHAPTER 28 (INDUSTRIAL SURCHARGE) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. #217-18 Resolution by Kritzman and Jolly, unanimously adopted, approving request to barricade parking lot to hold Grand Opening Event at Today’s Orthodontics on June 20, 2018, from 4:00 p.m. to 7:00 p.m. at 18444 Farmington Road. th SYNOPSIS OF THE MINUTES OF THE 1,850REGULAR MEETING 5 LIVONIA CITY COUNCIL – JUNE 4, 2018 #218-18 Resolution by Jolly and Meakin, unanimously adopted, accepting monetary donations from Allstate Insurance in the amount of $1,000.00, received by the Division of Police, to be used for the purposes designated by the donor.
