HomeMy WebLinkAboutSYNOPSIS - 2016-07-25 th SYNOPSIS OF THE MINUTES OF THE 1,805 REGULAR MEETING LIVONIA CITY COUNCIL – JULY 25, 2016 ______________________________________________________________________ Meeting was called to order at 7:00 p.m. by President McIntyre. Present: Cathy White, Brian Meakin, Brandon Kritzman, Maureen Miller Brosnan, Jim Jolly, and Kathleen McIntyre. Absent: Scott Bahr. MAD #285-16 Resolution by Brosnan and Jolly, unanimously adopted, approving the FAT th minutes of the 1,804 Regular Meeting of the Council held on July 11, 2016. MAD #286-16 Resolution by Meakin and Brosnan, unanimously adopted, amending the FAT rd minutes of the 1,803 Regular Meeting of the Council held on June 20, 2016. Clerk Nash spoke about the upcoming State Primary Election being held on August 2, 2016. She urged people to get out and vote and stated her office will be issuing absentee ballots up until Monday. She noted some of the voting precincts changed and that notices were sent to those affected by those changes and that the information is on the City’s website as well as signs at all of the precincts. th President McIntyre sent birthday greetings to her son Patrick on his 13 birthday. She then wished Judy Priebe happy birthday for the upcoming day on August 2nd and congratulated her on the birth of her tenth grandchild. President McIntyre announced there will be four (4) Public Hearings held on Monday, August 15, 2016 at 7:00 p.m. in the Auditorium of the Livonia City Hall, 33000 Civic Center Drive, Livonia, Michigan: 1. PETITION 2016-04-01-03 submitted by Dave Phipps, to rezone the properties located on the west side of Farmington Road between Lyndon and Five Mile Roads (14851 and 14931 Farmington Road) in the Northeast 1/4 of Section 21, from OS (Office Services) and R-2 (One Family Residential) to R-9-I (Housing for the Elderly, 4-Stories Maximum Height of Buildings). 2. PETITION 2016-06-01-04 submitted by Soave/Oro Construction LLC, to rezone the property located on the north side of Lyndon between Harrison and Barkley (28200 Lyndon) in the Northeast 1/4 of Section 24, from R-U-F (Rural Urban Farm – minimum ½ acre lots) to R-2 (One Family Residential – 9,600 sq. ft., 80 ft. x 120 ft. lots). 3. Appeal of the denial of the Planning Commission regarding Petition 2012- 09-02-22 submitted by Marx Collision, requesting to modify Council Resolution 462-12 in connection with a previously approved waiver use adopted on November 21, 2012, in order to allow the overnight outdoor parking and storage of vehicles in connection with the auto repair business, located on the southwest corner of Eight Mile Road and Milburn Avenue (30731 Eight Mile Road), in the Northwest ¼ of Section 2. th SYNOPSIS OF THE MINUTES OF THE 1,805REGULAR MEETING 2 LIVONIA CITY COUNCIL – JULY 25, 2016 4. Appeal of the denial of the Planning Commission regarding Petition 2016- 04-02-07 submitted by Laurel Park Retail Properties, L.L.C., requesting waiver use approval to construct and operate a freestanding full service restaurant with drive-up window facilities (Panera Bread) within the parking lot of the Laurel Park Place shopping center located on the north side of Six Mile Road between Newburgh Road and I-275/96 Expressway (37700 Six Mile Road), in the Southeast ¼ of Section 7. She then announced that there is one X-Item at the end of tonight’s agenda as well as new data received on Item 28. AUDIENCE COMMUNICATION: Christopher Martin, 11037 Hubbard, gave an update on the outcome of his court case and indicated that his property has been listed for sale with a realtor. Diane and Katie Mann of Ingram Street both spoke about the tremendous support the Livonia Fire and Police Departments provided when their detached garage caught fire on Father’s Day and they thanked both departments for their exemplary response to their tragedy. Slater, Treasurer, Plymouth Road Development Authority, dated May 13, 2016, re: tax rate request for the Plymouth Road Development Authority for the 2016 tax year. Communication from Scott T. Vandemergel, MMAO (4), Director, Division of Assessment and Equalization, Wayne County, dated May 26, 2016, re: requesting that the City collect 5.6483 Charter authorized mills as part of the summer tax collection and the remainder as part of the winter tax collection. Communication from Lisa Abbey, Assistant Superintendent, Livonia Public Schools, dated June 6, 2016, re: tax rate approved by the Board of Education on June 6, 2016. Services for the City of Livonia (Public Body) pursuant to Michigan Law for a period of five (5) years. #295-16 Authorizing the purchase of fifty (50) Cradlepoint computer modems; fifty MAD FAT (50) Cradlepoint five-year Enterprise Cloud Managers; and forty-five (45) Powertech Police antennae, for an amount not to exceed $42,324.44 from budgeted funds utilizing the MITN bid from Oakland County, to be utilized by the Uniform Division. MAD #296-16 Authorizing the Mayor and City Clerk, for and on behalf of the City of Livonia, FAT to execute the proposed Interlocal Agreement between the City of Livonia and Schoolcraft Police College, for the purpose of defining police services on the Schoolcraft College Campus. MAD #297-16 Approving the modifications to the Guidelines Regarding the Appearance FAT of City of Livonia Employees in the Civil Service Commission Rules and Regulations. CivSvc MAD #298-16 Approving the addition of an autism rider for the City of Livonia Health FAT Insurance Plan for a minimum of four (4) bargaining units that agree to include this autism CivSvc rider with a signed Memorandum of Agreement. th SYNOPSIS OF THE MINUTES OF THE 1,805REGULAR MEETING 5 LIVONIA CITY COUNCIL – JULY 25, 2016 #299-16 Approving an Intergovernmental Agreement between the County of Wayne MAD FAT and the City of Livonia for the road improvements of Eight Mile Road (Farmington Road Eng to Golf Ridge Circle) and Seven Mile Road (Farmington Road to Newburgh Road); FURTHER, authorizing an expenditure in an amount not to exceed $212,644.00 from funds already budgeted for this purpose; FURTHER, authorizing a Working Capital Advance to the County of Wayne in the amount of $106,322.00 as fifty percent (50%) of the City of Livonia’s participation of the total project cost; and the City Engineer is hereby authorized to approve any minor adjustments in the work as it becomes necessary. #300-16 Authorizing the release of the Sidewalk Bond to Leo Soave Building, Inc., MAD FAT 20592 Chestnut Circle, Livonia, MI 48152, the proprietor of Churchill Manor Site Eng Condominiums. #301-16 Accepting and authorizing the unit price bid of Rotondo Construction MAD Corporation, for completing all work required in connection with the City Hall Front FAT Entrance Project, including the removal of deteriorated segments of sidewalk, the Eng reductions of the large sections of concrete sidewalk, the replacement of the existing main ADA ramp on the east side of City Hall and the addition of a new ADA ramp leading from the library parking lot to the south side of City Hall; at the unit prices bid for a total amount not to exceed $40,000.00; FURTHER, authorizing an expenditure in the amount of $2,500.00 to D & B Landscaping, Inc. for completing all work in connection with the irrigation system portion of the contract; FURTHER, authorizing an expenditure in the amount of $5,000.00 to Christensen’s Plant Center, to be utilized by the Parks Department for plant and landscape materials for the City Hall Entrance Project; FURTHER, authorizing an expenditure in an amount not to exceed $47,500.00 from funds already budgeted for this purpose; and the City Engineer is hereby authorized to approve minor adjustments in the work as it becomes necessary. #302-16 Approving Petition 2016-04-08-04 submitted by Curtis Creek, L.L.C., in MAD FAT connection with a proposal to construct an accessory building for the apartments (Curtis Eng Creek Apts.) located on the northwest corner of Farmington and Curtis Roads (18203- Insp 18351 Farmington Road), subject to conditions. Plan A roll call vote was taken on the foregoing resolutions: AYES: White, Meakin, Kritzman, Brosnan, Jolly and McIntyre. NAYS: None. White gave SECOND READING to the following Ordinance AN ORDINANCE AMENDING SECTION 080 OF TITLE 8, CHAPTER 40 (NOXIOUS WEEDS AND REFUSE) OF THE LIVONIA CODE OF ORDINANCES, AS AMENDED. A roll call vote was taken on the foregoing Ordinance: AYES: White, Meakin, Kritzman, Brosnan, Jolly and McIntyre. NAYS: None. th SYNOPSIS OF THE MINUTES OF THE 1,805REGULAR MEETING 6 LIVONIA CITY COUNCIL – JULY 25, 2016 Kritzman stepped down from the podium at 7:21 p.m. to avoid any perceived conflict of interest. #303-16 Resolution by Meakin and White, authorizing the Mayor and City Clerk, for MAD FAT and on behalf of the City of Livonia, to execute a contract amendment between the City Eng of Livonia and Hubbell, Roth and Clark, Inc., to provide Design Engineering Services for the Five Mile Road Water Main Replacement Project from Merriman Road to Inkster Road, in an amount not to exceed $130,000.00; and the City Engineer is hereby authorized to approve minor adjustments in the work as it becomes necessary. (CR 367- 13) A roll call vote was taken on the foregoing resolutions: AYES: White, Meakin, Brosnan, Jolly and McIntyre. NAYS: None. Kritzman returned to the podium at 7:22 p.m. MAD #304-16 Resolution by Jolly and White, approving Petition 2016-05-SN-04 submitted FAT by 4 Tech Signs, to replace a ground sign with variable electronic message board for the Eng restaurant (Johnny’s Ribs and Pizza) located at 19333 Victor Parkway, subject to Insp conditions. Plan A roll call vote was taken on the foregoing resolution: AYES: White, Kritzman, Jolly and McIntyre. NAYS: Meakin and Brosnan. MAD #305-16 Resolution by Brosnan and Jolly, unanimously adopted, approving Petition FAT 2016-05-02-09 submitted by Omorfia Esthetics, to operate a massage establishment Eng within the Burton Hollow Shopping Center located at 17142 Farmington Road, subject to Insp conditions. Plan #306-16 Resolution by Brosnan and Meakin, unanimously adopted, approving MAD FAT Petition 2016-06-08-07, submitted by Joe’s Produce, requesting approval to remodel the Eng exterior of the commercial shopping center (Maiorana Plaza) located on the north side of Insp Seven Mile Road between Merriman and Farmington Roads (33000-33152 Seven Mile Plan Road), subject to conditions.
