HomeMy WebLinkAboutSYNOPSIS - 2010-12-15 st SYNOPSIS OF THE MINUTES OF THE 1,671 REGULAR MEETING LIVONIA CITY COUNCIL – DECEMBER 15, 2010 Meeting was called to order at 8:00 p.m. Present: John Pastor, Brian Meakin, Laura Toy, Maureen Miller Brosnan, Conrad Schwartz, and James McCann. Absent: Joe Laura. th #426-10 Resolution by Toy and Meakin, approving the minutes of the 1,670 MAD Regular Meeting of the Council held December 1, 2010. FAT A roll call vote was taken on the foregoing resolution with the following result: AYES: Meakin, Toy, Brosnan, Schwartz, and McCann. NAYS: None. PRESENT: Pastor. Pastor thanked everyone who has donated their time and gifts for the Toys for Tots Program. Pastor wished Toy a Happy Birthday; December 22, 2010. Mayor Kirksey encouraged everyone to drive through the City Civic Center Campus to enjoy the holiday light decorations. He recognized the management and members of UAW Local 182 for the special help they provided to some Livonia children in need at their Christmas party this past Sunday, December 12, 2010. The Mayor also mentioned the extremely cold temperatures made the task of clearing the roads much more difficult; however, he did appreciate all the hard work of those who worked to plow the snow and worked on clearing the roads. The Mayor and President McCann were in federal court earlier today to support the McDonald family of Livonia Chrysler Jeep relative to their ability to do business in the future in Livonia. AUDIENCE COMMUNICATION: George Donabedian, 14236 Beatrice, addressed Council regarding his concern with sycamore trees in his neighborhood. He also expressed how pleased he is with the Marycrest Heights project and said it will be an asset to the community. He said the Livonia Senior Center is an awesome place and it has made a positive impact on his life. He also mentioned that Nicky’s Grill at the Whispering Willows Golf Course Club House is a great restaurant; it is located at Eight Mile and Newburgh Road. Christopher Martin, 11037 Hubbard, said he believes in separation of church and state. He said he respects peoples right to their own religious beliefs and doesn’t appreciate being singled out and being asked to participate in the beliefs of someone else’s religious preference at the beginning of tonight’s meeting. st SYNOPSIS OF THE MINUTES OF THE 1,671 REGULAR MEETING 2 LIVONIA CITY COUNCIL – December 15, 2010 The following items were received and filed: A communication from the Department of Finance, dated November 22, 2010, re: forwarding various financial statements of the City of Livonia for the month ending October 31, 2010. A copy of the resolution, received in the Office of the City Clerk, dated December 15, 2010, adopted by the Water and Sewer Board at their meeting held December 6, 2010, re: approving additional appropriations and expenditures for the 2010 Asphalt Paving and Water Main Replacement Program. (CR 111-10) A letter from the City Clerk dated November 19, 2010, re: collection of the Wayne County Regional Educational Service Agency’s (RESA) taxes for the year 2011. A communication from the Public Service Division, dated December 9, 2010, re: additional information requested concerning a proposal for consulting services for Livonia Act 87 landfill monitoring and reporting. The following resolutions were offered by Pastor and Meakin: #427-10 Approving a request submitted by Margaret Brooks and Cathy Vickers, for MAD FAT a Massage Establishment License to operate under the name of MC Therapeutic Police Massage, to be located at 17870 Farmington. OrdEnf #428-10 Approving the request of the Livonia Anniversary Committee for the MAD issuance of a permit for Wade Shows to hold carnival amusement rides at Ford Field FAT and Veterans’ Park June 21-26, 2011; a permit for a fireworks display by American Police Fireworks, Inc. to be held at 10:15 p.m. on June 26, 2011 at Veterans’ Park; and Fire Insp authorization to use and lease the facilities at Ford Field, Eddie Edgar Arena and Veterans’ Park during the period of the SPREE ‘61. #429-10 Approving the request of the Livonia Anniversary Committee to close MAD Stark Road from the Family Y (14255 Stark Road) to Lyndon and Lyndon from FAT Farmington Road to Stark Road to through traffic from 8:00 a.m. Monday, June 20, Police 2011 through 12:00 noon on Monday, June 27, 2011; FURTHER, approving the request Fire that the City seek permission from the Wayne County Road Commission to allow the closure of Farmington Road between the I-96 overpass and Five Mile Road from 6:30 p.m. through 11:30 p.m. on Sunday, June 26, 2011 in connection with the SPREE ‘61 fireworks display. #430-10 Approving the request of the Livonia Anniversary Committee to display MAD banners advertising SPREE ‘61 on Farmington and Five Mile Roads and display 4’ x 8’ FAT P&R signs at City Hall and Ford Field from May 23, 2011 through June 26, 2011; FURTHER, Insp permitting various banners and signage not to exceed 3’ x 5’ in size on Ford Field and the ball diamonds only from June 20, 2011 to June 27, 2011. st SYNOPSIS OF THE MINUTES OF THE 1,671 REGULAR MEETING 3 LIVONIA CITY COUNCIL – December 15, 2010 #431-10 Approving the request, submitted by Enrico E. Soave, Esq., Kucyk Soave MAD & Fernandes, PLLC, to waive a sidewalk requirement in front of a newly-constructed FAT home located at 29191 Grove; FURTHER, reserving the right to require sidewalks at Eng this location in the event that sidewalks are installed in this area at some future date. #432-10 Approving the request, submitted by Enrico E. Soave, Esq., Kucyk Soave MAD FAT & Fernandes, PLLC, to waive a sidewalk requirement in front of a newly-constructed Eng home located at 15400 Loveland; FURTHER, reserving the right to require sidewalks at this location in the event that sidewalks are installed in this area at some future date. MAD #433-10 Approving the agreement for the Specialized Services Operating FAT Assistance Program between SMART and the City of Livonia for the period October 1, ComRes 2010 through September 30, 2011. #434-10 Accepting the bid of Wolverine Power Systems, 50160 Pontiac Trail, MAD FAT Wixom, Michigan 48393, in an amount not to exceed $40,680.00, for supplying the Eng Public Service Division (Equipment Maintenance Section) with one (1) trailer-mounted generator, the same having been in fact the lowest bid received which meets all specifications. #435-10 Appropriating and authorizing the expenditures of the additional amounts MAD of $115,117.28 to be paid to Hayball Transport, Inc., 12550 Farmington Road, Livonia, FAT Michigan 48150; and $12,200.00 to be paid to Orchard, Hiltz & McCliment, Inc., 34000 Eng Plymouth Road, Livonia, Michigan 48150 for additional inspection services and services provided by the contractor for water main and sanitary sewer repairs in connection with the 2010 Asphalt Paving and Water Main Replacement Program. (CR 111-10) A roll call vote was taken on the foregoing resolutions with the following result: AYES: Pastor, Meakin, Toy, Brosnan, Schwartz, and McCann. NAYS: None. UNFINISHED BUSINESS #436-10 Resolution by Toy and Meakin, unanimously adopted, accepting the MAD proposal, dated November 22, 2010, submitted by Golder Associates, Inc., 51229 FAT Century Court, Wixom, MI 48393, to provide consulting services for Livonia Act 87 Eng landfill monitoring and reporting and for providing services in connection with the remedial action plan implementation activities approved by the Michigan Department of Natural Resources and Environment (MDNR&E) Remediation and Redevelopment Division (RRD) for the former landfill area along Glendale Avenue in the amount of $32,586.50. (CR 321-08 and CR 192-07) st SYNOPSIS OF THE MINUTES OF THE 1,671 REGULAR MEETING 4 LIVONIA CITY COUNCIL – December 15, 2010 #437-10 Resolution by Brosnan and Schwartz, approving Amendment No. 1 to the MAD Water Service Contract between the City of Detroit and the City of Livonia, to be in FAT effect for the next three years. (CR 255-09) Eng A roll call vote was taken on the foregoing resolution with the following result: AYES: Pastor, Meakin, Brosnan, Schwartz, and McCann. NAYS: Toy. #438-10 Resolution by Toy and Pastor, unanimously adopted, supporting and MAD approving the request of 19055 Farmington Road, LLC. to obtain certain property tax FAT commencing in 2011 for their property located at 19055 Farmington Road (Bigg Burger Assessr Restaurant), under the Wayne County TURBO (Transforming Underdeveloped Residential and Business Opportunities) Development Program. #439-10 Resolution by Pastor and Brosnan, unanimously adopted, approving MAD Special Assessment Roll No. 425 in connection with the Street Lighting Project for FAT Rosati Industrial Subdivision; FURTHER, determining to install street lighting consisting Assessr of six (6) LED lights, three (3) to be mounted on existing poles and three (3) to be mounted on stock code 06 poles. (CR 364-10) NEW BUSINESS #440-10 Resolution by Pastor and Meakin, directing that a closed Committee of the MAD Whole meeting be held for the purpose of discussing pending litigation and FAT attorney/client privileged communications with respect to Linda Lott and Robert Lott v City of Livonia, et. al. A roll call vote was taken on the foregoing resolution with the following result: AYES: Pastor, Meakin, Toy, Brosnan, Schwartz, and McCann. NAYS: None. #441-10 Resolution by Pastor and Toy, unanimously adopted, accepting cash MAD donations and various gifts in the amount of $6,015.00 to the Department of Community FAT Resources from various contributors to be used for purposes designated by the donors. ComRes AUDIENCE COMMUNICATION: None. Pastor wished everyone a Merry Christmas and a Happy New Year. th Brosnan wished her daughter Marie a Happy 16 Birthday; her birthday is December 22, 2010.
