Absent: Laura Toy. rd MAD #305-10 Resolution by Brosnan and Pastor, approving the minutes of the 1,663 FAT Regular Meeting of the Council held August 25, 2010. A roll call vote was taken on the foregoing resolution with the following result: AYES: Schwartz, Pastor, Meakin, and Brosnan. NAYS: None. PRESENT: Laura and McCann. AUDIENCE COMMUNICATION: Joan Gebhardt, Wayne County Commissioner, announced that she will be hosting a Citizens Help Forum titled “Save Your Home” to provide free mortgage foreclosure prevention counseling. The forum is open to the Wayne County public and will be held at The Bailey Center, 36651 Ford Road, Westland, from 6:00 p.m. to 8:00 p.m. on Thursday, September 9, 2010. This forum is provided to help assist the public in an effort to keep them from walking away from their homes or to assist them with paying their bills and taxes on time by developing a plan to modify their mortgage. The website for further information is www.fightmortgageforeclosure.com. Christine Jaddou, U.S. Census Bureau, presented Mayor Kirksey; Dave Varga, Director of Administrative Services; and Mark Taormina, Director of Planning and Economic Development; plaques of appreciation for their participation in a job well done for the City of Livonia. Livonia was the top city in the nation with a household response percentage in the high 80’s. She said they appreciated the time and resources the City of Livonia dedicated in helping to ensure a successful 2010 census. She asked them to please accept the plaques on behalf of Dr. Groves, Director of the U.S. Census Bureau. President McCann said congratulations go to the community and its residents for doing such a great job in responding. Mayor Kirksey thanked all of the citizens that participated by completing the census. He also thanked Mark Taormina and Dave Varga for their work with the 2010 Census. John Grzebik, 11301 Hubbell, said there is some legislation in the House right now up in Lansing, regarding the 20J Funding for schools; he encouraged residents to contact their legislators on the matter. He said, as a citizen, he would like to encourage the public to attend the 911 Memorial to be held at 6:30 p.m. on September 11, 2010, at the American Legion Post 32, 9318 Newburgh Road, Livonia. Joanne Porretta, 28788 Wilton Drive, Farmington Hills, MI 48331, addressed Council regarding an issue with the property located at 19365 Hardy that was owned by her mother before she passed away. Ms. Porretta stated that she is overseeing this property along with her brother. She indicated she was having difficulty resolving the matter with the Building Inspection Department. President McCann asked the Mayor to have the Building Inspection Department Head, Mr. Bishop, look into this matter and provide Council with an informal written report. President McCann asked her to leave her name and address where she can be contacted and for her to call Ms. Tesner, Director of Legislative Affairs, in the Council Office tomorrow. The following items were received and filed: A communication from the Department of Finance, dated August 20, 2010, re: forwarding various financial statements of the City of Livonia for the month ending July 31, 2010. A communication from the Engineering Division, dated August 30, 2010, re: Mr. Frank Kalinski’s concerns with respect to the Merriman Road Safety Improvement Project. A communication from Todd J. Zilincik, City Engineer, dated August 30, 2010, re: response to letter from Frank Kalinski concerning the addition of dedicated right turn lanes on Merriman at Five and Six Mile Roads. A communication from Frank Kalinski, dated August 27, 2010, re: the addition of dedicated right turn lanes on Merriman at Five and Six Mile Roads. (CR 171-05) th SYNOPSIS OF THE MINUTES OF THE 1,664 REGULAR MEETING 3 LIVONIA CITY COUNCIL – September 8, 2010 The following resolutions were offered by Pastor and Brosnan: MAD #306-10 Approving the request from OSI/Flemings, LLC (A Delaware Limited FAT Liability Company) to transfer ownership of a 2009 Class C Licensed Business with Planning Outdoor Service (1 Area) and Official Permit (Food) from Fleming’s/Great Lakes-I, Insp Limited Partnership (A Florida Limited Partnership) (Step 2) for a Business Located at Police Fire 17400 Haggerty, Livonia, Michigan 48152, Wayne County. #307-10 Approving the request from Livonia Koney, LLC to transfer ownership of MAD an escrowed 2010 Tavern Licensed Business, located at 26800 Plymouth, Redford, MI FAT Planning 48239, Redford Township, Wayne County, from Pizza Hut of America, Inc.; to 29530 W. Insp Seven Mile Road, Livonia, Michigan 48152, Wayne County; and request for new Official Police Permit (Food) and new Outdoor Service Area for a business located at 29530 W. Seven Fire Mile Road, Livonia, Michigan 48152, Wayne County #308-10 Accepting the proposal of A.K. Equipment, Inc., 7254 Quincy Street, MAD Zeeland, Michigan 49464, for completing all work required in connection with the FAT construction of a divider and end walls in the existing transfer station for the City’s salt Eng Planning storage needs in the total amount of $57,613.00; FURTHER, authorizing the expenditure of a sum not to exceed $57,613.00 from budgeted funds. #309-10 Authorizing the Mayor and City Clerk, for and on behalf of the City of MAD Livonia, to execute a contract between the City of Livonia and Orchard, Hiltz and FAT Eng McCliment, 34000 Plymouth Road, Livonia, Michigan 48150, to provide design services Planning for the Safety Improvement Project – Merriman Road Intersection at Five Mile and Six Mile Roads in an amount not to exceed $69,900.00; FURTHER, authorizing an expenditure in an amount not to exceed $69,900.00 from funds anticipated in the 2011 budget, and the City Engineer is hereby authorized to approve minor adjustments in the work, as it becomes necessary. #310-10 Approving and granting Petition 2010-06-SN-03 submitted by Costco MAD Wholesale, for additional wall signage for the commercial building (Costco), 20000 FAT Haggerty Road, Livonia, MI 48152, subject to conditions. Scott Architects, to add drive-thru facilities to an FAT existing restaurant (Dunkin’ Donuts), 19010 Middlebelt Road, Livonia, MI 48152, subject Eng to conditions. Insp Planning A roll call vote was taken on the foregoing resolution with the following result: AYES: Schwartz, Meakin, Laura, Brosnan, and McCann. NAYS: None. #312-10 Resolution by Brosnan and Meakin, waiving the requirement that the MAD turning radius on any curve of a drive-up window traffic lane shall be no less than fifteen FAT Eng feet (15’), in connection with the approval of waiver use Petition 2010-06-02-12, Insp submitted by Jeffery A. Scott Architects, to add drive-thru facilities to an existing Fire restaurant (Dunkin’ Donuts), 19010 Middlebelt Road, Livonia, MI 48152. Planning A roll call vote was taken on the foregoing resolution with the following result: AYES: Schwartz, Meakin, Laura, Brosnan, and McCann. NAYS: None. #313-10 Resolution by Brosnan and Laura, waiving the requirement that a by-pass MAD lane be provided for vehicles not using the drive-up window, in connection with the FAT approval of waiver use Petition 2010-06-02-12, submitted by Jeffery A. Scott Architects, Eng to add drive-thru facilities to an existing restaurant (Dunkin’ Donuts), 19010 Middlebelt Insp Road, Livonia, MI 48152. Fire Planning A roll call vote was taken on the foregoing resolution with the following result: AYES: Schwartz, Meakin, Laura, Brosnan, and McCann. NAYS: None. Pastor returned to the podium at 8:23 p.m. NEW BUSINESS MAD #314-10 Resolution by Brosnan and Laura, unanimously adopted, approving a FAT request by Kristyn St. Clair, Chairperson, St. Michael Church, in connection with their Police annual Fall Family Picnic scheduled for Sunday, September 19, 2010, to waive Section OrdEnf 8.32.070 (Noise Control) of the Code of Ordinances to allow a DJ to play at Rotary Park, from 12:00 p.m. to 6:00 p.m. AUDIENCE COMMUNICATION: None. Brosnan congratulated the Old Rosedale Gardens Homeowners Association that recently obtained recognition with a listing on the National Registry of Historic Places.
